Sponsors: Ald. Perez Mr. Richardson gave an overview on the rationale behind the proposed ordinance. The category of industrial-mixed (IM) zoning district, created back in 2002 with the adoption of the zoning code, has worked fairly well. The IM zoning district allows for a variety of activities that includes residential, commercial, and industrial. However, in some cases, heavy and intense manufacturing land uses and residential land uses within the IM zoning district are incompatible with each other. Many issues would arise from the two land uses when in close proximity to each other. Noise, which is typical, from businesses engaged in heavy or intense manufacturing would be a nuisance to residents. Manufacturing businesses would be hindered in their ability to do business due to safety issues and an increased presence of children and pedestrians in area. The proposed ordinance is designed to address these issues by creating some limited and special use standards that would not allow a residential land use in an IM zoning district to be located within 150 feet of a land use meeting the definition of heavy or intense manufacturing. Mr. Richardson added that his office has heard from the community and received letters of concern from industrial businesses. He added that there were some people present in the audience who can provide some testimony. Atty. Mukumal said that a proper record should be made. Letters of concern should be placed into the record. Public testimony should be provided to the Zoning, Neighborhoods and Development Committee. Atty. Mukumal said that the term of intense manufacturing is not defined in the zoning code, and Mr. Richardson stated that the term is defined under manufacturing City of Milwaukee Page 1 ZONING CODE TECHNICAL Meeting Minutes September 24, 2014 COMMITTEE intense. Atty. Mukamal moved that the proposed ordinance meets the standards of legality and enforceability, administrative efficiency, and consistency with the format of the zoning code subject to a proper record being made.
