Sponsors: THE CHAIR Mr. Richardson said that the proposed legislation reflects floodplain-related code changes that the Department of Natural Resources (DNR) wants municipalities to incorporate. The proposed legislation is modelled after the DNR’s version. The file was introduced to also allow the opportunity for quick enactment once issues have been resolved with DNR. There is a possibility that the proposed legislation may undergo further changes after this committee’s deliberations. Mr. Rute said that the moratorium from November 5 through 16, 2014 was lifted due to the adoption of floodplain maps by the City on November 16, 2014. Atty. Mukamal was concerned about the clause “and be more restrictive than the map based on the flood insurance study at the site of the proposed development” in section 1117-5-c of the proposed ordinance. The clause may lead to undesirable results and confusion. DNR should be contacted to explain the rationale regarding this particular clause. His recommendation is to remove the clause. He had no issues with the adoption of the maps as stated in this section. Mr. Roberts was concerned about the clause “equal to or greater than 0.00 foot” in section 1119-c-3 of the proposed ordinance. In his view, this clause is convoluted. His recommendation is to remove the clause to make that section of the proposed ordinance more succinct and easier to enforce. Atty. Mukamal moved that the proposed ordinance meets the standards of legality and enforceability, administrative efficiency, and consistency with the format of the zoning code, subject to the Department of Natural Resources providing justification City of Milwaukee Page 1 ZONING CODE TECHNICAL Meeting Minutes January 5, 2015 COMMITTEE for the clause “and be more restrictive than the map based on the flood insurance study at the site of the proposed development” in section 1117-5-c and the clause “equal to or greater than 0.00 foot” in section 1119-c-3 of the proposed ordinance. The proposed ordinance shall be amended to remove the clause “and be more restrictive than the map based on the flood insurance study at the site of the proposed development” in section 1117-5-c and the clause “equal to or greater than 0.00 foot” in section 1119-c-3 absent justification from the Department of Natural Resources.
