Minutes Town of Mooresville Board of Adjustment April 13, 2026 4:00 PM - Mooresville Town Hall Present: Matthew Harrow, Mike Jones, Jason Overturf, Jason Fobbs, Matthew Frederico Absent: Andrew Wingo Also present: Planning & Community Development Director James Coley, Planner III Ashley Lattin, Planner I Patrick Werner, Administrative Assistant Lisa Smith, Town Attorney Sharon Crawford, Assistant Town Attorney Carey Austin, Staff Attorney Caline Schecter 1. Call to Order Vice Chair Overturf called the meeting to order at 4:12 p.m. 2. Chairperson's Welcome and Opening 3. Pledge of Allegiance 4. Postponement or Withdrawal Requests There were no postponement or withdrawal requests. 5. Adjustments to the Agenda Amended Staff Report 6. Adoption of Agenda ACTION: A motion was made by Mike Jones, seconded by Matthew Harrow, to approve the agenda as presented. Motion Carried: Unanimously 7. Consideration of Approval of Minutes 7.a Consider approval of Feb. 9, 2026, Minutes ACTION: A motion was made by Mike Jones, seconded by Matthew Harrow, to approve the January minutes as presented. Motion Carried: Unanimously. 8. Old Business There was no old business. 9. New Business Consider appeal APL-2026-01 of an administrative decision revoking vested rights, to the extent any such rights existed, for a project located on W. McLelland Avenue, parcel numbers 4657-84-5010 and 4657-83-7679. Appeal APL-2026-01 is being brought forward by the applicant for a review of the revocation of vested rights to IDT Project 783182 and 1684603 for Parcel Numbers 4657- 84-5010 and 4657-83-7679 on W. McLelland Ave. Assistant Town Attorney Carey Austin recused herself from APL-2026-01. ACTION: A motion was made by Matthew Harrow, seconded by Mike Jones, to continue the Case when the Board has legal representation at the next regular meeting May 11, 2026. Motion Carried: 3-2 (Jason Fobbs, Matthew Frederico). 10. Administrative Items None 11. Adjournment ACTION: A motion was made by Mike Jones, seconded by Jason Fobbs, to adjourn the meeting at 4:32 p.m. Motion carried: Unanimously.
