Present: Steve McGlothlin, Michael Cole, Michelle Marckwardt, Gregory Peretz, Laura
Temple, Shaun Hooper.
Absent: Mark Brady, Jeremy Katz, and Rosalind Campbell.
Also Present: Planning & Community Development Director Erika Martin, Senior
Planner David Cole, Planner Rayvon Walker, Community Development Planner Amber
Goudreault, Assistant Town Attorney Carey Austin, Board Clerk Lisa Smith, and Assistant
Town Clerk Ann Burns.
1. Call to Order
Chair Steve McGlothlin called the meeting to order at 6:01 PM.

Chair McGlothlin welcomed the Planning Board and Guests and then opened the
meeting.
4. Public Comment
There was no public comment.
5. Adjustments to the Agenda
There were no adjustments to the agenda.
6. Adoption of the Agenda
ACTION: A motion was made by Michael Cole, seconded by Shaun Hooper to approve
the agenda as presented.
The motion carried unanimously.
7. Consideration of Approval of Minutes

ACTION: A motion was made by Michael Cole, seconded by Michelle
Marckwardt to approve the meeting minutes as presented.
The motion carried unanimously.

9. a Consider Conditional Rezoning Request CZ-2024-15 for approximately 9.5-acre site
located at 171 W. Waterlynn Road. The applicant is requesting Conditional Corridor mixed-
use (C-CM) zoning. Red Apple at Mooresville LLC is seeking Town of Mooresville Conditional
Corridor Mixed Use (C-CM) for a 9.5-acre site located at 171 W. Waterlynn Road (PIN
4646843592). The property is currently zoned Residential Low-Intensity (RLI) within the
Town of Mooresville Extra Territorial Jurisdiction (ETJ).
Rayvon Walker presented the staff report for CZ-2024-15.
The applicant is proposing an Early Learning Center.
A virtual neighborhood meeting was held on November 25, 2024, in which neighbors and
the public did not attend.
The 4 conditions associated with this request are noted on the proposed ordinance attached
hereto.
Mr. Walker stated that the staff recommends approval of the request.
The applicant Todd Lucas with Lucas Development spoke on their project.
There were no citizens signed up to speak at this public hearing.
Carey Austin verified with the applicant that they are aware of the 4 conditions stated and
that the conditions are agreed upon.
ACTION: A motion was made by Shaun Hooper seconded by Michelle
Marckwardt to recommend approval for CZ-2024-15.
The motion carried unanimously.
9.b Consider Text Amendment TA-2024-10: Amendment to the Unified Development
Ordinance (UDO) to provide greater flexibility to the "Cottage Development" use, definition,
and subdivision standards. A text amendment application by Nest Communities to provide
further flexibility for the Cottage Development use type, pertaining to lot size, dwelling size,
parking, and open space design and orientation.
David Cole presented the staff report for TA-2024-10.
The text amendment request was proposed by Mr. Adam Hayes who is a representative of the
Cottages at BackCreek Development.
Mr. Cole stated staff recommends the approval of the text amendment however staff does
have concerns regarding the maximum home size. The proposed 1,800 sqft minimum is on
the upper end for most cottage developments.
The applicant Adam Hayes showed his presentation for Cottages at BackCreek and his
proposal for the Text Amendments.
Erika Martin informed the board that they could create a new use for the type of development
being proposed and that the use could only happen under conditional zoning.
Mr. Richard Beck spoke at the public hearing.
ACTION: A motion was made by Laura Temple, seconded by Shaun Hooper to
table TA-2024-10 to allow to allow staff to work with the applicant on a more
tailored proposal.
The motion carried unanimously.
10. Administrative Items
Ms. Martin informed the Planning Board about recent Town Board actions.
January Planning Board meeting will have 5 agenda items.
She informed the board that this meeting would be David Cole’s last meeting.
11. Adjournment
ACTION: A motion was made by Laura Temple, seconded by Shaun Hooper to adjourn the
meeting at 7:45 pm.
