Minutes Town of Mooresville Board of Adjustment December 8, 2025 4:00 PM - Mooresville Town Hall Present: Andrew Wingo, Matthew Harrow, Mike Jones, Jason Overturf, Jason Fobbs, Matthew Frederico. Also present: Planning Director James Coley, Planner II Ashley Lattin, Planner I Patrick Warner, Administrative Assistant Lisa Smith, Assistant Town Attorney Carey Austin. 1. Call to Order Mr. Wingo called the meeting to order at 4:01 p.m. 2. Chairperson's Welcome and Opening 3. Pledge of Allegiance 4. Adjustments to the Agenda 4.a Elect new officers 4.b Add Administrative item: Board Training on January 12, 2026 ACTION: A motion was made by Jason Overturf, seconded by Mike Jones to approve the adjusted agenda. Motion Carried unanimously 5. Postponement or Withdrawal Requests Consider Watershed Density Averaging Certificate (WDAC-2025-02) was postponed on June 9th meeting until the August 2025 meeting which was cancelled. Status of WDAC- 2025-02 presently unknown. If request not withdrawn case will be continued at next meeting. 6. Consideration of Approval of Minutes 6.a Consider approval of June 9, 2025, minutes ACTION: A motion was made by Matthew Harrow, seconded by Mike Jones to approve the minutes as presented. Motion Carried unanimously. 7. Swearing In Mike Jones (reappointed) Matthew Frederico (alternate) Jason Fobbs (ETJ) RECESS 5 MINS. Meeting resumed at 4:17 p.m. In order to ensure that proper votes were obtained after all members sworn in, the Chair called for a renewed motion on those matters voted on up to this point as shown below. 8. Adjustments to the Agenda 8.a Elect new officers 8.b Add Administrative item: Legal Training at January meeting ACTION: A motion was made by Jason Overturf, seconded by Mike Jones to approve the agenda. Motion Carried unanimously 9. Consideration of Approval of Minutes 9.a Consider approval of June 9, 2025, minutes ACTION: A motion was made by Mike Jones, seconded by Matthew Harrow, to approve the minutes as presented. Motion Carried unanimously 10. Election of Officers ACTION: A motion was made by Andrew Wingo, seconded by Jason Fobbs to nominate Jason Overturf as Chair Motion denied: 2-3. ACTION: A motion was made by Mike Jones, seconded by Matthew Harrow to nominate Andrew Wingo as Chair Motion carried: 4-1. ACTION: A motion was made by Andrew Wingo, seconded by Jason Fobbs to nominate Jason Overturf as Vice Chair Motion carried unanimously 11. New Business 11.a Consider amendments to the Board of Adjustment Rules of Procedure Assistant Town Attorney Carey Austin will draft changes to be voted on at the next meeting. 12. Administrative Items 12.a Consider 2026 Board of Adjustment Meeting Calendar ACTION: A motion was made by Andrew Wingo, seconded by Jason Overturf to approve the 2026 Calendar as presented. Motion carried unanimously 12.b. Legal Training at January meeting 13. Adjournment ACTION: A motion was made by Jason Fobbs, seconded Andrew Wingo to adjourn the meeting at 5:48 p.m. Motion carried unanimously.
