Present: Steve McGlothlin, Michael Cole, Michelle Marckwardt, Gregory Peretz, Laura Temple,
Shaun Hooper, Mark Brady, Jeremy Katz and Rosalind Campbell.
Also Present: Planning & Community Development Director Erika Martin, Planner III Parviz
Moosavi, Assistant Town Attorney Carey Austin, Administrative Assistant Lisa Smith, and Permit
Specialist Supervisor Danielle Upright.
1. Call to Order
Chair Steve McGlothlin called the meeting to order at 6:00 p.m.

ACTION: A motion was made by Shaun Hooper, seconded by Michelle Marckwardt, to approve
the agenda as presented.
The motion carried unanimously.

9.a Consider Rezoning Request RZ-2024-11 for 84.853-acre sites located on Wiggins Road. The
request is to rezone from the Town of Mooresville Hybrid Light Industrial (HLI) and Neighborhood
Mixed Use with Conditions (RMX-C) to Residential Low-Intensity (RLI).
The Town of Mooresville is seeking Residential Low-Intensity (RLI) zoning for 84.853-acre sites
located on Wiggins Road (PINs 4678465650, 4678479350, 4678474510, 4678584212) owned by John
Meadows, Paige Meadows, Donald Meadows, and Barbara Meadows. The site is currently zoned
Town of Mooresville Hybrid Light Industrial (HLI) and Neighborhood Mixed Use with Conditions
(RMX-C).
Erika Martin presented the rezoning request for RZ-2024-11.
Property owner John Meadows spoke on behalf of the project.
No one from the public was signed up to speak.
ACTION: A motion was made by Michael Cole, seconded by Shaun Hooper to approve RZ-2024-11.
The motion carried unanimously.
9.b Consider Rezoning Request RZ-2025-01 for a 1.52-acre site located 1554 Landis Highway. The
request is to rezone from Community Commercial (CC) within the Town of Mooresville Extra
Territorial Jurisdiction (ETJ) to Town of Mooresville Residential Limited Services (RLS) Michael
Caldwell, Third Creek Building Company is seeking Town of Mooresville Residential Limited
Service (RLS) zoning for a 1.52-acre site located at 1554 Landis Highway (PIN 4667969342). The
site is currently zoned Community Commercial (CC) within the Town of Mooresville Extra
Territorial Jurisdiction (ETJ).
Erika Martin presented the rezoning request for RZ-2025-01.
The applicant was not in attendance to speak.
No one from the public was signed up to speak.
ACTION: A motion was made by Jeremy Katz, seconded by Michelle Marckwardt to approve RZ-
2025-01.
The motion carried unanimously.
9.c Consider Conditional Rezoning Request CZ-2025-01 for a 62.3-acre site located at 165
Clodfelter Road, 154 Clodfelter Road, and 816 Shearers Road. The request is to rezone from
Residential Limited Service (RLS) to Conditional Traditional Neighborhood (C-TN)
The property owners are seeking Conditional Traditional Neighborhood (C-TN) for a
65.3-acre site located at 165 Clodfelter Road, 154 Clodfelter Road, and 816 Shearers
Road (PINs 4656942810, 4656858555, 4656964401, 4656952172, 4666044772,
4656949554). The property is currently zoned Residential Limited Service (RLS).
Planner Parviz Moosavi presented the rezoning request CZ-2025-01.
The applicant Colin Brown, with Alexander Ricks Law Firm, spoke about the project.
Carey Austin verified with the applicant that they were aware of and in agreement with the 19
conditions listed below:
1. Site development shall conform to the approved Concept Plan.
2. The project density shall not exceed 2.87 units per acre (187 maximum lots).
3. The project shall provide a 20’ greenway easement, dedicated to the Town of Mooresville to connect
with future greenway trails on adjoining property for the benefit of the public, including a 10’ paved
path for the length of the easement built by the developer that will include construction of a pedestrian
bridge over the stream to connect the development to Ridge Avenue right-of-way. The exact location
of the easement, the trail, and the pedestrian bridge shall be determined upon mutual agreement by the
Applicant and Town staff during the civil construction drawing approval process. Prior to the Town’s
acceptance of such easement, including the trail and pedestrian bridge, the developer shall be
responsible for maintenance of the same. 6
4. The project will provide a minimum of 16.30 acres of open space. The developer or HOA shall
maintain the open space in compliance with the Unified Development Ordinance.
5. The project will include street stubs to the property to the south and east as shown on the Concept
Plan.
6. The project is restricted to single-family residential and its associated accessory uses.
7. The project shall not include a road or pedestrian connection to Clodfelter Road.
8. Developer shall complete all mitigation measures recommended by the TIA in accordance with the
Mitigation Measures Agreement between the developer and the Town.
9. Developer shall provide an 8’ vinyl fence within the 8’ perimeter buffer along the eastern property
line as shown on the Concept Plan. This buffer area shall be platted as common open space and
maintained by the community homeowner’s association. This area shall include but not be limited to
opaque screen plantings with evergreen trees (6-8’ in height at installation) planted every 8-10’.
10. During the course of construction of the project, no construction traffic shall be permitted to access
the property via Clodfelter Road, and all such traffic shall access the property by way of Shearers
Road.
11. Developer shall install a traffic signal at the intersection of Timber Road and Shearers Road in
accordance with a signal plan approved by N.C. Department of Transportation, and such signal shall be
constructed prior to the receipt of the last building permit for phase I of the project.
12. The building materials used on the single-family detached dwellings constructed in the project shall
include one or more of the following: brick, stone, stucco, horizontal siding, wide trim wrapped
windows, shake siding at gables, board and batten siding at gables, roof overhangs on sides and rear
elevations, and decorative items such as corbels or other pediments in gables.
13. Building materials utilized in front elevations for each single-family detached dwelling shall
include a minimum of two (2) color variations.
14. No side-by-side single-family detached dwellings or dwellings located directly across the street
from each other shall share the same front elevation.
15. Enhanced side elevation treatments, such as a mixture of materials, windows, and enhanced trim,
shall be provided for certain corner lots along public roads as indicated on the “Enhanced Elevation
Lots” exhibit, and designed as generally depicted on the example elevation labeled as “Enhanced Side
Elevation.”
16. Every single-family detached dwelling shall have a minimum of a two-car garage.
17. Garage doors for single-family detached dwellings shall include windows.
18. The elevations included with this submittal are representative and illustrative in nature to show
potential design based upon the architectural and design conditions herein. Such elevations may be
modified and adjusted with final “for construction” drawings so long as they meet the conditions
herein.
19. At least three (3) residential units shall be attainable for household earning at or below 120% area
median income (AMI), and subject to the Additional Requirements listed in UDO Section 5.12.4. An
attainable housing agreement shall be jointly agreed upon by the property owner/developer and the
Planning Director prior to Site Plan approval.
