Minutes Town of Mooresville Planning Board November 19, 2024 6:00 PM – Charles Mack Citizen Center Present: Steve McGlothlin-Chair, Rosalind Campbell, Laura Temple, Gregory Peretz, Michelle Marckwardt, Shaun Hooper, Jeremy Katz, Michael Cole, Mark Brady. Also Present: Planning & Community Development Director Erika Martin, Senior Planner David Cole, Planner I-Rayvon Walker, Staff Attorney Caline Schecter, and Clerk Danielle Upright. 1. Call to Order Chair Steve McGlothlin called the meeting to order at 6:00 p.m. 2. Pledge of Allegiance 3. Chairperson's Welcome and Opening Chair McGlothlin welcomed the Planning Board and guests and opened the meeting. 4. Public Comment None 5. Adjustments to the Agenda None 6. Adoption of the Agenda ACTION: A motion was made by Mark Brady, seconded by Rosalind Campbell to approve the agenda as presented. The motion carried unanimously. 7. Consideration of Approval of Minutes ACTION: A motion was made by Michael Cole, seconded by Jeremy Katz to approve the minutes for October 22, 2024, as presented. The motion carried unanimously. 8. Old Business None 9. New Business 9.a Consider Conditional Rezoning Request CZ-2024-12 for a 17.01-acre site located at 298 Shadowbrooke Lane and 994 Brawley School Road. The applicant is requesting the Town of Mooresville Conditional Traditional Neighborhood (C-TN). ERR Investments LLC and S+S Family LTDP are seeking Town of Mooresville Conditional Traditional Neighborhood (C-TN) for a 17.01-acre site located at 298 Shadowbrooke Lane and 994 Brawley School Road (PINs 4636584889, 4636588493). The property is currently zoned Iredell County Residential Agricultural (RA). David Cole presented the staff report for CZ-2024-12. The applicant is proposing 68 townhomes on the site located at 298 Shadowbrooke Lane and 994 Brawley School Road. A neighborhood meeting was held in person on October 29, 2024, at 5:30 pm. There were 9 community members in attendance. Mr. Cole stated that the staff recommends approval of this rezoning. The applicant, Matt Gallagher, spoke as a representative with Blue Heel Development. Signed up to speak for public comment was Jean Engelke, 117 Wood Duck, who spoke against the rezoning project. A motion was made by Michael Cole, seconded by Shaun Hooper to approve CZ- 2024-12. The motion carried unanimously. 9.b Consider Conditional Rezoning Request CZ-2024-14 for a 27.72-acre site located at 1614 Azalea Road, 1608 Landis Highway, and 116 Knight Ln. The applicant is seeking a Conditional Traditional Neighborhood (C-TN). Jacks Heavy Property, LLC is seeking Conditional Traditional Neighborhood (C- TN) for a 27.72-acre site located at 1614 Azalea Road, 1618 Azalea Road, 1608 Landis Highway, and 1610 Landis Highway (PINs 4677163439, 4677068490, 4677078031). The property is currently zoned Community Commercial (CC). Rayvon Walker presented the staff report for CZ-2024-14. Staff recommends approval. The applicant is proposing 166 townhomes on a site located at 1614 Azalea Road, 1608 Landis Hwy, and 1610 Landis Hwy. An annexation/utility extension is being sought concurrently with the request. A neighborhood meeting was held on October 30, 2024, at 6:00 pm. with 9 neighbors in attendance. The applicant’s legal representative, Larry Shaheen, spoke on this project. The following individuals signed up to speak for public comment: • Brian Smith, 1627 Landis Hwy, spoke against the project. • Sean Schmidt, 134 E Neel Ranch Road, spoke against the project. A motion was made by Mark Brady, seconded by Michelle Marckwardt to approve the rezoning request CZ-2024-14. Motion carried with an 8-1 vote. 9.c Consider Conditional Rezoning Request CZ-2024-16 for a 62.90- acre site located at Kistler Farm Road and Rocky River Road. The applicant is requesting a Conditional Residential General (C-RG). The property owners are seeking Conditional Residential General (C-RG) for a 62.90-acre site located at Kistler Farm Road and Rocky River Road (PINs 4665664947, 4665776863, 4665763665, 4665764462, 4665766406, 4665767587, 4665769605, 4665768877, 4665766785, 4665774072, 4665671140). The property is currently zoned Residential Limited Service (RLS). Erika Martin presented the staff report. Staff recommends approval. The applicant Cambridge is proposing 175 single-family units. A neighborhood meeting was held on October 29, 2024, at 6:00 pm with 15+ community members in attendance. The applicant, Jay Priester with Cambridge Properties, spoke on the proposed development. The following individuals signed up to speak for public comment: • Michael Hobbs, 164 Shagbark Lane • Heather Linen, 106 Firethorn Court. Mrs. Linen spoke on behalf of 4 or more citizens concerning this project. A motion was made by Shaun Hooper, seconded by Michelle Marckwardt to allow Agenda Item 9.c to remain open while Agenda Item 9.d was presented and heard to allow a better understanding of the proposed text amendment. The motion carried unanimously. 9.d Consider Text Amendment TA-2024-09: Amendment to the Unified Development Ordinance (UDO) regarding access and connectivity standards. Amend the Unified Development Ordinance regarding access and connectivity standards. Erika Martin presented the staff report for TA-2024-09, she noted that this was a developer-initiated text amendment. A motion was made by Laura Temple, seconded by Shaun Hooper to approve the TA-2024-09. The motion carried with an 8-1 vote. Resumption of Item 9.c. An additional condition was added to the conditions of the rezoning: If all applicable easements and permits are obtainable, the Developer shall install a sidewalk along Kistler Farm Road from the northern boundary of the property to connect to the existing sidewalk. A motion was made by Michael Cole, seconded by Laura Temple to approve CZ- 2024-16. The motion carried unanimously. 10. Administrative Items 10.a Consider the 2025 Planning Board Meeting Calendar A motion was made by Michelle Marckwardt, seconded by Shaun Hooper to adopt the 2025 Calendar as presented. The motion carried unanimously. 11. Adjournment A motion was made by Mark Brady, seconded by Shaun Hooper to adjourn the meeting at 8:20 pm. The motion carried unanimously.
