Original Concept: Intend to split the lot into 2 buildable lots. To be considered by City Council on June 20, 2023. c. Reconsideration request by applicant of City Council's decision to deny a Comprehensive Plan Map Amendment from Commercial to Industrial designation, Zoning Map Amendment from BC (Community Business) to IL (Light Industrial) zoning district, & potential Development Agreement at 1508 & 1510 W Karcher Rd. (parcel #s R2446800000 & R2446900000, located in the SE 1/4 of Section 8, T3N, R2W, BM) for Tyler Delay representing Doris Young (CMA-00055-2022 & ZMA-00170-2022). Original Concept: Obtain the correct zoning for the existing land use of outdoor storage of equipment for Young's Equipment addressed at 1502 W Karcher Rd and in order to construct a chain link security fence around the property. To be considered by City Council on June 20, 2023. d. Confirm the assessment of LID 167. To be considered by City Council on June 20, 2023. e. Allocate the 2023 Community Development Block Grant funding for Administration/Planning and Non-Public Service activities as presented. To be considered by City Council on June 20, 2023. 1-5. Authorize to Proceed with Bidding Process a. Authorize Facilities Development to proceed with the informal bidding process for the Hugh Nichols Public Safety Building Flooring Replacement Project. (Approved in FY23 Budget) 1-6. Authorization for Execution of Contracts and Agreements a. Action Item: Approve Landlord's Release and Consent for Cache Valley Bank for Lot 2410 leased by Procon Investments LLC at the Nampa Municipal Airport b. Authorization for Contract for Updated Impact Fee Study by TishlerBise/Galena in the amount of $47,320. The contract will funded by the individual impact fee CIP funds and will require a FY23 budget amendment. c. Authorize Mayor to sign easement agreement with 2nd St Properties LLC for the installation of the new Dewey Palace Hotel Mural at the revised location (Approved by Legal) (Approved in FY23 Budget). d. Authorize Mayor to sign updated contract with Matt Sunderman of Liquid Sol for the installation of the new Dewey Palace Hotel Mural at revised location. Original Concept: Mixed Use Development with 1 commercial building and 192 residential dwelling units in 9 apartment buildings. APPEAL submitted by Loraine Knigge, 16065 Latah Dr. Nampa, ID 83651 (APL-00018-2023). Appeal approved by City Council on May 15, 2023. (Approved by Legal) b. Action Item: Authorize funding to the Nampa Family Justice Center from the City of Nampa's Opioid Settlement Funds for one year in the amount of $27,250.00 to provide education and support to victims of abuse battling drug addiction. 8-3. Action Item: Appointments of Anthony Oxsen to a two-year term (6/12/2023 - 6/11/2025), William Vroman to a three-year term (6/12/2023 - 6/11/2026), and Jacob Allen to a four- year term (6/12/2023 - 6/11/2027) on the Board of Appraisers 8-4. Action Item: Authorize Family Justice Center to apply for a one-year Safe Teen Assessment Center Case Management and Assessment grant through Southwest District Health in the amount of $294,011.86 to support two case manager positions, assessment team, and direct services for clients. (Partial amount pending approval in FY24 Budget) 8-5. Discussion Item: Installation of Backlot Fiber – TDS Metrocom, LLC 8-6. Action Item: Award bid and authorize Mayor to sign contract for the Culvert Replacement Tenmile Creek at Franklin Boulevard project with Knife River Corporation in the amount of $526,917. (Approved in FY23 budget) 8-7. Action Item: 1st reading of ordinance amending Title 5, Chapters 1, 2, 5, 10, 18, 19, and 20 of the Nampa City Code pertaining to the Business License Expiration Date and Fees. (Approved by Legal) 8-8. Award bid and authorize the Mayor to sign a construction contract with Boise Floor Covering & Design Inc. for the Senior Center Flooring Replacement (23-015) for a total of $69,649.00 to complete all necessary work. Action Item: Authorize Mayor and Public Works Director to sign task order for the attached scope of work with Parametrix for the Northside Boulevard, Karcher Road to Birch Lane for $125,314.00 T&M NTE (Approved in FY23 Budget) 8-10. Action Item: Authorize Public Works Director to sign the Local Professional Services Agreement with ITD and Precision Engineering, LLC for Grimes City Pathway Extension, Nampa project (KN23025) in the amount of $98,768 Lump Sum (Approved in FY23 Budget). (9) Public Hearings 9-1. Action Item: Annexation and Zoning to RS 8.5 (Single-Family Residential) zoning district and potential development agreement- a .99 acre parcel #R2928000000 at 2303 Pascoe Ln (located in the NW 1/4 of Section 4, T2N, R2W, BM) for Rick Bergemann (ANN-00274-2023). Original Concept: To split one lot into two lots for construction of a single-family residence. 9-2. Action Item: Nampa City Code Text Amendment for Title 10, Chapter 22, Parking to add requirements for guest parking in a townhouse development, for the City of Nampa (ZTA- 00031-2023). 9-3. Action Item: Nampa City Code Text Amendment for Title 10, Chapter 31, Specific Area Plans & Chapter 34, Design Review in regards to exceptions for chain link fencing around school properties for safety purposes, for the City of Nampa (ZTA-00032-2023). 9-4. Action Item: Public hearing for the review and approval of proposed ordinance amendments to Nampa City Code including Title 2-Chapter 17 and Title 3-Chapter 7 and resolutions to adopt a revised Streets Impact Fee Capital Improvement Plan and to approve an annual inflationary increase for current development impact fees. (Approved by Legal) • Action Item: 1st reading of Ordinance and approval of summary of publication to move the DIFAC committee membership requirements and appointments from Title 3;Chapter 7 - Development Impact Fees to a new chapter Title 2 - Chapter 17 – Development Impact Fee Advisory Committee; and to increase the DIFAC member term from 2 years to 4 years. • Action Item: 1st reading of Ordinance Amending Title 3 - Chapter 7 by removing the requirements for committee membership and appointments; change of the annual fee increase effective date from January 1st to July 1st; change of the basis of annual inflation adjustment to a 12-month time period ending on March 31st of the same year as the increase. • Action Item: Authorize Mayor to sign resolution to adopt the revised streets Capital Improvement Plan (CIP) date May 26, 2023. Revisions to the CIP include changes to street projects for phasing of work and changes in the calculation for the impact fee fund contribution to projects with multiple funding. The total 10-year Streets CIP dollar amount and associated Streets impact fees do not change. • Action Item: Authorize Mayor to sign resolution approving a 2023 annual inflationary increase to current development impact fees: including a 3.43 % increase to Police, Parks and Fire fees; and a 17.36 % increase to Streets, Wastewater, Water, and Pressurized Irrigation fees with an effective date of July 1, 2023. Action Item: 1st reading of ordinance of Rezone from BC (Community Business) to RS 8.5 (Single-Family Residential) on a .6 acre parcel at 0 Southside Blvd (R3230301000, in the NE 1/4 of Section 35, T3N, R2W, BM), for Joseph Profitt (ZMA-00174-2023). (11) Executive Session Action Item: Motion to Adjourn into Executive Session Pursuant to Idaho Code 74-206 (1): (f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. The mere presence of legal counsel at an executive session does not satisfy this requirement; (j) To consider labor contract matters authorized under section 74-206A (1)(a) and (b), Idaho Code.
