The City Council dispenses with the three (3) reading rule of Idaho Code 50-902 for all ordinances 1-3. Plat Approvals a. Subdivision Final Plat approval for Chisum Estates Industrial Complex Subdivision in the IL (Light Industrial) and BC (Community Business) zoning district at 3611 E Amity Ave (a 31.7 acre parcel #R2216000000 and a 10.4 acre portion of #R3238901000, located in the NW 1/4 of Section 36, T3N, R2W, BM) for Triple Crown Investments, LLC (SPF-00241-2023). Original concept: 23 industrial lots and 1 commercial lot. 1-4. Authorize Public Hearings a. Annexation and Zoning to RS4 (Single-Family Residential) zoning district for 13.84 acres, Zoning to RS6 (Single-Family Residential) zoning district for 2.64 acres, potential development agreement, and Subdivision Preliminary Plat, for Clearcreek Subdivision at 0 S. Middleton Rd (a 16.48 acre area - parcel #R3203001000 and fronting right-of-way); located in the NW 1/4 of Section 29, T3N, R2W, BM), for Becky McKay/Challenger Development Inc. representing Endurance Holdings LLC (ANN-00282-2023 & SPP-00125- 2023). Original Concept: 60 single-family detached lots, and 12 common lots. To be considered by City Council on September 18, 2023. b. Zoning Map Amendment from DV (Downtown Village) to DH (Downtown Historic) zoning district for eight parcels (R13607, R13608, R13609, R13610, R13613, R13607010, R13607011, R13613010) addressed as 1015 3rd St S, 315 11th Ave S, 309 11th Ave S, 313 11th Ave S, 323 11th Ave S, 0 3rd St S, & 0 11th Ave S., totaling 0.96 acres, and right-of-way fronting these properties along 3rd St. S, 11th Ave S., and 4th St S specifically described in the legal description on file and totaling 0.61 acres for Mussell Construction Inc. representing Old Towne Nampa, LLC (ZMA-00181-2023). Original Concept: rezone property in order to conduct land uses without minimum parking requirements. To be considered by City Council on September 18, 2023. c. Termination of an existing development agreement attached to ordinance #3626, on a portion of the property located at 0 Roosevelt Ave, Parcel #3206001000, zoned RS 8.5 (Single Family Residential), to accommodate a new lot for a seminary building, for the City of Nampa (DAMO-00063-2023). To be considered by City Council on September 18, 2023. d. Proposed Amendment to the FY23 Budget to be considered by Council on September 18, 2023. 1-5. Authorization for Execution of Contracts and Agreements a. Action Item: Authorize Mayor to sign contract for the Zone B Sewer Rehab FY23 Change Order No. 1 with Iron Horse, LLC in the amount of $69,300. Action Item: Authorize Mayor to sign a Resolution for the Reappointment of Councilmember Randy Haverfield to the Nampa Development Corporation for a five-year term beginning October 1, 2023 and ending September 30, 2028. b. Action Item: Authorize Mayor to sign a Resolution for the Reappointment of Claudia Dina to the Nampa Development Corporation for a five-year term beginning October 1, 2023 and ending September 30, 2028. c. Action Item: Reappointment of Rick Bugatsch to the Nampa Housing Authority for a five-year term beginning October 1, 2023 and ending September 30, 2028. City Council Regular Meeting September 05, 2023 (7) New Business 7-1. Action Item: Reject all bids for the Indian Creek Pathway Repair Project (Approved by Legal) 7-2. Action Item: Authorize Mayor to sign Memorandum of Understanding between City of Nampa and Valley Regional Transit (VRT) for Transportation Funding in the amount of $471,856 for FY24. VRT’s request for City contributions of $705,506 (FY25) and $862,949 (FY26) will be considered as part of the budget process in their respective years. (Approved by Legal) (Approved in FY24 Budget) 7-3. Action Item: Authorize Fleet Services Division to proceed with generating signed purchase orders for the various vendors and manufacturers for approved FY24 vehicles and equipment, for the total estimated amount of $2,573,743.00. The city will not take delivery of any purchases prior to October 1, 2023. (Approved in FY24 Budget) 7-4. Action Item: Adopt the City of Nampa Roadside Memorial Policy for inclusion in the Engineering Development Process and Policy Manual. (Approved by Legal) 7-5. Action Item: 1st reading of Street Naming Ordinance for S Quiet Creek Ln. 7-6. Action Item: Authorize Mayor to sign the State/Local Agreement (Construction) for Franklin Boulevard & Karcher Road Intersection Project No. A022(102); KEY NO. 22102 with Idaho Transportation Department (ITD) in the amount of $306,136 and Authorize the City Clerk to certify the agreement by signing the resolution provided and required by the ITD. (Standard Agreement Approved by Legal) (Approved in FY23 Budget) (8) Public Hearings 8-1. Action Item: Annexation and Zoning to RS6 (Single-Family Residential) zoning district and potential development agreement at 0, 0, 2306, 2414, & 2418 E Locust Ln (parcel #'s R2911600000, R2912000000, R2912101000, R2911700000, R2911900000 totaling 25.06 acres); Subdivision Preliminary Plat for Stoddard Crossing Subdivision; located in the SE ¼ of Section 2, T2N, R2W, BM), for Patrick Connor - Providence Properties, representing Sawtooth Land Acquisition LLC & WFS LLC, (ANN-00269-2023 & SPP-00119-2023). Original Concept: 92 single-family detached dwelling units and 15 common lots. (continued from June 20, 2023, July 17, 2023, and August 21, 2023 meetings) – Council may choose to re-open the public hearing to receive additional information. 8-2. Action Item: Public Hearing to consider increases in Wastewater Utility Rates and User Fees, and Wastewater Hookup Fees. • Action Item: Authorize Mayor to sign Resolution implementing FY24 increases in the service fees charged by the City of Nampa for Wastewater Utility Rates and User Fees, effective October 1, 2023 • Action Item: Authorize Mayor to sign Resolution implementing FY24 increases in the service fees charged by the City of Nampa for Wastewater Hookup Fees, effective October 1, 2023 Page 4 of 6 *Or as soon after 6:00 pm as each matter may be heard. Action Item: Annexation and zoning to RML (Limited Multiple Family Residential) and subdivision preliminary plat approval for the Wilson Landing Subdivision located at 0 Wilson Lane (a 3.74 acre parcel, #R3243401000, NW 1/4, Section 36, T3N, R2W, BM) for Becky Yzaquirre at Ardurra representing Wilson Landing LLC (ANN-00281-2023 & SPP-00124- 2023). Original Concept: Thirty (30) single-family attached lots (townhouses) and two (2) common lots. 8-4. Action Item: Nampa City Code Text Amendment to change Title 2, Chapter 18 - Nampa Bicycle and Pedestrian Advisory Committee to remove the position of secretary and designated as a staff liaison; Title 10 Planning and Zoning, Chapter 1 to clarify Hotel/Motel/Bed and Breakfast/Boarding House, remove caretaker unit definition, add to parking lot expansion to describe required parking spaces, add a new section to 10-1-6.E for Bonding, Financial Security or Guarantee for improvements on commercial projects, change zoning language regarding when a property can have two or more accessory buildings, add pool gate safety language, remove auto repair from home occupations, clarify height of storage structures near RS, RD & RP zones; Chapter 2 to add language to the Neighborhood Meeting guidance, remove reference to Annexation A, B & C and refer to Title 50 in Idaho, clarify parameters for pre-annexation criteria, simplify language regarding Findings of Fact and Conclusions of Law, State Code; Chapter 3 to add reference to specific plan areas, remove agricultural footnotes, remove repetitive residential footnotes and renumber and add where multi-family is allowed based on the future land use map in the Comprehensive Plan, clarify Commercial and Service footnotes, remove PUD subdistricts 10-3-3, clarify non- conforming use approval 10-3-9.G.2; Chapter 4 to add minimum lot area and reference drought tolerant landscaping guidance; Chapter 5 to rewrite the description and purpose, remove permitted uses and conditionally permitted use sections, edit detached structure section, edit bulk requirements section, edit and remove portions of the parking section, edit exterior uses, edit and remove a portion of the landscaping requirements and renumber the section; Chapter 6 to rewrite the description and purpose and add density language for cluster developments; Chapter 7 to clarify urban services, add how to measure principal building height and add density language for cluster developments; Chapter 8 to edit the description and purpose and edit a code section reference; Chapter 10 to rewrite the description and purpose, add chart for bulk requirements and change the charts for lot sizes and future land use map references (and all footnotes); Chapter 11 to rewrite the description and purpose, add chart for bulk requirements and change the charts for lot sizes and future land use map references (and all footnotes); Chapter 12 to add chart for bulk requirements and change the charts for lot sizes and future land use map references (and all footnotes); Chapter 13 to rewrite the description and purpose, add chart for bulk requirements and change the charts for lot sizes and future land use map references (and all footnotes); Chapter 15 to edit the description and purpose and add residential fencing language to the DB, DV and DH zone sections; Chapter 16 to edit the description and purpose; Chapter 19 to edit the description and purpose and remove the term 'visible from any public street' from the exterior storage section; Chapter 20 to remove the term 'visible from any public street' from the exterior storage section; Chapter 22 to remove dates for parking recreation vehicles, add language for safety of parking recreational vehicles, revise the chart for setbacks, and add tree canopy shade parking lot coverage requirements; Chapter 23 to add and remove various definitions, add and remove exempt sign types, add off-premise sign regulations, add motor vehicle sign restrictions, edit sign program requirements, add allowances for signs near I-84; Chapter 24 to add the term 'or his/her designee' to the appeal section and the rebuild letter section; Chapter 25 to rewrite the approval criteria; Chapter 26 to add PUD requirements to create an industrial park for industrial level design review; Chapter 27 to clarify extensions for preliminary and final plats, correct lot size compatibility numbers, add large play and picnic areas by acreage of project, when an Page 5 of 6 *Or as soon after 6:00 pm as each matter may be heard. City Council Regular Meeting September 05, 2023 exception can be requested, remove landscape plan language and only reference Chapter 33; Chapter 31 to add a section regarding not allowing a stretch of the future land use designation in specific plan areas; Chapter 33 to add definitions and change each section based on new language from the city forester and the drought task force and require irrigation plans with landscape plan submittals; Chapter 34 to show specific requirements for the DH (Downtown Historic) zoning district, add that a fence requires staff level review, add that revised elements shall be re-reviewed, review landscaping language to match water- wise language in Chapter 33; for the City of Nampa (ZTA-00033-2023). (9) Unfinished Business None (10) Executive Session Action Item: Motion to Adjourn into Executive Session Pursuant to Idaho Code 74-206 (1): (a) To consider hiring a public officer, employee, staff member or individual agent, wherein the respective qualities of individuals are to be evaluated in order to fill a particular vacancy or need. This paragraph does not apply to filling a vacancy in an elective office or deliberations about staffing needs in general. (f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. (j) To consider labor contract matters authorized under section 74-206A (1)(a) and (b), Idaho Code.
