The City Council dispenses with the three (3) reading rule of Idaho Code 50-902 for all ordinances 1-3. Authorize Public Hearings a. Confirm the assessment of LID 168. To be considered by the City Council on November 6, 2023. City Council Regular Meeting October 16, 2023 b. Authorize advertisement of November 6, 2023, public hearing to present recommended FY24 increases to wastewater hookup fees of 12.55%, effective December 1, 2023. Rescheduled to correct typo on rate figure from prior hearing. (Approved by City Attorney Joe Borton) c. Annexation and Zoning to the RS6 (Single-Family Residential) zoning district on a .63-acre parcel at 812 W Greenhurst Rd (#R2298300000, in the SW ¼ of Section 33, T3N, R2W, BM), for Randy Meyer (ANN-00287-2023). Original Concept: Connection to city water services. To be considered by City Council on November 6, 2023. d. Zoning Map Amendment from RA (Suburban Residential) zoning district to IL (Light Industrial) zoning district for 3814 Airport Rd & 315 N 39th St (two parcels totaling 1.48 acres: #R31786 & R3178601100, located in the NW ¼ of Section 24, T3N, R2W, BM) for Gerald & Karen Moore (ZMA-00179- 2023). Original Concept: Rezone property recently split into 2 parcels in order to sell the northern property 315 N 39th St for industrial use. To be considered by City Council on November 6, 2023. e. Annexation and Zoning to BC (Community Business) zoning district and potential development agreement at 0 Karcher Rd (a 3.92-acre parcel #R3098701000) and Subdivision Preliminary Plat for Woods Crossing Subdivision; located in the SW ¼ of Section 9, T3N, R2W, BM), for Biltmore Company representing Nampa Paving - Randy Wood (ANN-00285-2023 & SPP-00129-2023). Original Concept: 8 commercial lots to include - construction of a 10,000-sf strip retail building, 2 office buildings, and commercial lots for a future coffee shop, fast food restaurant, and two office buildings. To be considered by City Council on November 6, 2023. 1-4. Authorize to Proceed with Bidding Process a. Action Item: Authorize Engineering Division to proceed with formal bidding process for the Annual Waterline Replacement FY23 Port Street project. (Standard bid forms & contracts approved by Legal) (Approved in FY23 Budget, rolled over to FY24 Budget) b. Action Item: Authorize Engineering Division to proceed with formal bid process for the Crushed Aggregate for Chip Seal project. (Standard bid forms and contracts approved by Legal) (Approved in FY24 Budget) c. Action Item: Authorize Engineering Division to proceed with Request for Quote process for the Road Salt Procurement project. (Standard Request for Quote process approved by Legal) (Approved in FY24 Budget) 1-5 Authorization for Execution of Contracts and Agreements a. Action Item: Authorize Mayor to sign License Agreement with PIX Anew Inc. for 210 12th Ave S for the Wall Street Project in downtown Nampa. Action Item: Authorize Mayor to sign Encroachment Agreement (Exhibit A) with Olga Gladysh of 1228 S Locust Street to fence in the alley right-of-way behind the property. Action Item: Authorize Mayor to sign the Release and Satisfaction of Non- Development Agreement for Lekeitio Village Subdivision No. 3 (Standard agreement approved by Legal) 1-6. Public Works Staff Communications (7) New Business 7-1. Action Item: Authorize Mayor to sign Warhawk Air Museum deferral lease and enter negotiations on new lease agreement. (Approved by City Attorney Joe Borton) 7-2. Action Item: Authorize the Mayor to sign the amended contract between the City of Nampa and Nampa Police Protective Association which includes adjustments to wages, benefits and other terms under the 2-year contract. (Approved by City Attorney Todd Lakey) 7-3. Action Item: Police requests to amend Nampa City Code by adding a new section under Title 6-1-1 – Disorderly Conduct, titled "Intoxicated in Public". (Approved by City Attorney Joe Borton) 7-4. Action Item: Authorize Mayor to sign the quitclaim deed for Ustick Road public right-of-way at the Purdam lift station parcel. (Approved by City Attorney Todd Lakey) 7-5. Action Item: Authorize Mayor, Public Works Director, and Planning Director to sign Task Order and Contract with Kittelson & Associates Inc. for the Southwest Nampa Specific Area Plan in the amount of $75,670 T&M NTE. (Standard agreement approved by Legal) (Approved in FY24 Budget) 7-6. Action Item: Direct staff to review the feasibility of installing bicycle lanes on S Powerline Rd from E Roosevelt, to the North, and E Dakota to the South, based on concerns brought forward in the memos issued by the Bicycle and Pedestrian Advisory Committee. 7-7. Action Item: Authorize Mayor and City Council to (1) Approve the Street Facility expansion at the estimated cost of $1,500,000 (Approved in FY24 Budget); and (2) Recommend an option for the purchase of land and building(s) for the Fleet Services Building, estimated between $5.254 million and $8 million (Option 1 approved in FY24 Budget) 7-8. Action Item: Authorize Mayor to sign letter requesting COMPASS planning assistance for Canyon County Registration Fee. (8) Public Hearings 8-1. Action Item: Variance of NCC 10-23-20 limiting sign area to 200 sq. ft. maximum and sign height to 25' in order to construct a sign 91' in height and have an area of 589.17 sq. ft. in a BC (Community Business) zoning district at 612 Northside Blvd and 208 E Barbara St, (parcel #'s R3127300000 & R3125000000 located in the NW 1/4 of Section 15, T3N, R2W, BM) for Michael Everett at Texas Republic Signs representing Jackson Energy Company (VAR-00147-2023). 8-2. Action Item: Variance of NCC 10-23-20 limiting sign area to 200 sq. ft. maximum and sign height to 25' in order to construct a sign 46'-11" in height and have an area of 398.5 sq. ft. in a BC (Community Business) zoning district at 1407 & 1409 N Franklin Blvd, (parcel #R31236010000 & R3123601100, located in the SE 1/4 of Section 15, T3N, R2W, BM) for Michael Everett at Texas Republic Signs representing Jackson Energy Company (VAR-00146- 2023). Action Item: Annexation and zoning to RS7 (Single-Family Residential) and subdivision preliminary plat approval for the Bentley Meadows Subdivision located at 0 S Grays Lane (a 5.69 acre parcel, #R3179101500, NE 1/4, Section 25, T3N, R2W, BM) for Ted Burke at EDM Partners representing Rob Nash, owner (ANN-00277-2023 & SPP-00121-2023). Original Concept: 23 single-family lots and 2 common lots. (9) Unfinished Business 9-1. Action Item: 1st reading of ordinance of Zoning Map Amendment from DV (Downtown Village) to DH (Downtown Historic) zoning district for eight parcels (R13607, R13608, R13609, R13610, R13613, R13607010, R13607011, R13613010) addressed as 1015 3rd St S, 315 11th Ave S, 309 11th Ave S, 313 11th Ave S, 323 11th Ave S, 0 3rd St S, & 0 11th Ave S., totaling 0.96 acres, and right-of-way fronting these properties along 3rd St. S, 11th Ave S., and 4th St S specifically described in the legal description on file and totaling 0.61 acres for Mussell Construction Inc. representing Old Towne Nampa, LLC (ZMA-00181-2023). (Approved by Legal) (10) Executive Session Action Item: Motion to Adjourn into Executive Session Pursuant to Idaho Code 74-206 (1): (f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated.
