CONSIDERATION OF MOTION TO USE OMNIBUS METHOD FOR THE CONSENT AGENDA: A motion was made by Councilwoman Brodhead, seconded by Councilman Hinterlong, to use the Omnibus method to approve the Consent Agenda. Approve the award of Cooperative Procurement 19-233, Transformer Remanufacturing and Tap Changer Board Replacement, to WESCO for an amount not to exceed $141,596 Council approved. 5. City of Naperville Page 6 Printed on 9/18/2019 City Council Meeting Minutes September 3, 2019 At 10:40 p.m. a motion was made by Councilwoman Sullivan, seconded by Councilwoman Gustin, to extend the meeting to midnight. The motion carried via Voice Vote. Council discussed public input, law enforcement feedback, research, the existence of the black market, actions taken by neighboring communities, the appropriateness of a referendum, the legalization of marijuana in Illinois, causes of cancer, tax rates, the use of revenue to fund social service programs, the upcoming trailer bill, the need to bring the issue to a conclusion, that logical comments have been made on both sides, that this is a new and controversial issue with major implications, Tobacco 21, Illinois did not have a referendum on the subject, and that the priority is the protection and safety of the community. Marshall explained that, in his professional opinion, Naperville should opt out and gather more information. Council discussed the number of emails and petitions received, varying interpretations of the law, that medical marijuana will still be available, opting out now does not preclude the City from opting in later, when the tax/revenue will begin, which ballot to place a referendum question on, and the need to educate voters before going to the polls. Enactment No.: ORD 19-120 A motion was made by Councilwoman Gustin, seconded by Councilman Coyne, for Option 1: Pass the ordinance amending Title 3 of the Naperville Municipal Code by the addition of Chapter 17 prohibiting adult use cannabis business establishments other than medical cannabis cultivation centers and medical cannabis dispensing organizations. A motion in substitution was made by Councilman Coyne, seconded by Councilman Hinterlong, for Option 1: to pass the ordinance amending Title 3 of the Naperville Municipal Code by the addition of Chapter 17 prohibiting adult use cannabis business establishments other than medical cannabis cultivation centers and medical cannabis dispensing organizations and to direct staff to bring back a report within 60 days that advises Council concerning including an advisory (non-binding) referendum question on a future election ballot. The motion carried by the following vote: Aye: 6- Coyne, Gustin, Hinterlong, Kelly, Krummen, and White Nay: 3- Chirico, Brodhead, and Sullivan At 11:39 p.m. a motion was made by Councilwoman Gustin, seconded by Councilwoman Brodhead, to extend the meeting to 12:15 a.m. The motion carried via Voice Vote. Pass the ordinance amending Sections 3-3-5, 3-3-14 and 3-3-15 of the Naperville Municipal Code by prohibiting anyone under the age of 21 from possessing tobacco or alternative nicotine products. Enactment No.: ORD 19-121 A motion was made by Councilwoman Brodhead, seconded by Councilman White, to pass the ordinance amending Sections 3-3-5, 3-3-14 and 3-3-15 of the Naperville Municipal Code by prohibiting anyone under the age of 21 from possessing tobacco or alternative nicotine products.. Enactment No.: ORD 19-122 A motion was made by Councilman Krummen, seconded by Councilman Coyne, to pass the ordinance amending Sections 3-3-3 and 3-3-14 of the Naperville Municipal Code by placing age restrictions on the sale and possession of kratom. The motion carried by the following vote: Aye: 9- Chirico, Brodhead, Coyne, Gustin, Hinterlong, Kelly, Krummen, Sullivan, and White 3. Receive the report for Lincoln at CityGate Centre located at the northeast corner of CityGate Lane and Westings Avenue, Naperville, PZC 19-1-020 (Item 1 of 4) Paul DeKruiff, Petitioner CityGate Centre Ventures LLC, explained the proposal to construct a 285-unit multi-family building with 38,000 sq ft roof-level event center on the five-acre property located at the northeast corner of Westings Avenue and CityGate Lane. The Petitioner requests the following: a major change to the PUD and a revised PUD plat with deviations to increase the building height and to reduce the number of parking spaces and lot area; a preliminary plat of subdivision including a deviation from the 30’ platted setback along Westings Avenue; a conditional use to permit multi-family dwelling units; and, a variance to reduce the required amount of masonry on the building. City of Naperville Page 8 Printed on 9/18/2019 City Council Meeting Minutes September 3, 2019 Vince Rosanova, Attorney for Petitioner, stated that the Petitioner is proposing to pay the land cash contribution to the school district, explained the development bedroom count, and the calculation used to arrive at the number of students generated. Joe Segobiano, Lincoln Properties, discussed the affordable housing initiative and the offer of a $200,000 contribution to the City to promote attainable or affordable housing as appropriate. DiSanto discussed the proposed language change to the ordinance. Laff explained the process should the school district object to the development and that a formal objection has to be filed and resolved before final plat is approved. At 12:10 a.m. a motion was made by Councilman Krummen, seconded by Councilwoman Brodhead, to extend the meeting to 12:30 a.m The motion carried via Voice Vote. Council discussed including affordable housing in every development and the appropriateness of the donation. DiSanto explained the donation is not a requirement and may be put in a City grant account. Council discussed the need to formalize the process for the future. A motion was made by Councilwoman Brodhead, seconded by Councilman Coyne, to receive the report for Lincoln at CityGate Centre located at the northeast corner of CityGate Lane and Westings Avenue, Naperville, PZC 19-1-020.
