Conduct the public hearing for the stormwater variance request for the North Aurora Road Underpass project at the Canadian National Railway (Item 1 of 2) The public hearing was opened at 7:25 p.m. WRITTEN COMMENT ONLY K Murphy - Oppose agenda item 22-1463 (Public Hearing - Stormwater Variance Request for the North Aurora Road Underpass) • The spending of $$24.4 million dollars of taxpayer funds to reconstruct a roadway underpass that will continue to flood, as noted in Exhibit A, is irresponsible. • The design of the stormwater drainage system for the underpass is based on 1989 rainfall data, not the most recent 2019 data, and is inadequate for the present and future conditions. The 2019 data shows an increase of approximately 15% in the rainfall design values. Pipes, underground stormwater storage vaults, and pumps should be resized to meet current regulatory conditions. • Adequate time was given by DuPage County Stormwater Management to notify engineers that the 2019 rainfall design data would be required for project permits applied to on and after January 1, 2020, for DuPage County Stormwater Management permits. If a project could not meet these requirements, the County required a waiver application be obtained by December 31, 2019. • The City should publicly provide the frequency and depths of flooding that is expected on this road based on the 2019 rainfall data. • The City should have a public safety plan to close the road and detour traffic when this underpass floods. • The Bipartisan Infrastructure Law funding programs require climate resilient infrastructure. • This project is not in line with the City’s sustainability goals. Flooded infrastructure is not sustainable. • This roadway underpass will not be reconstructed for 50 or more years, making it essential to eliminate roadway flooding now. A motion was made by Councilman White, seconded by Councilman Hinterlong, to close the public hearing for the stormwater variance request for the North Aurora Road Underpass project at the Canadian National Railway at 7:26 p.m. The motion carried by a voice vote. 7. Pass the ordinance approving a stormwater variance to Section 15-72 D.3 of the City of Naperville Page 7 Printed on 12/30/2022 City Council Meeting Minutes December 6, 2022 DuPage Countywide Stormwater and Floodplain ordinance for the North Aurora Road underpass project at the Canadian National Railway (Item 2 of 2) Council discussed the updated guidelines, rain events in the past 15 years, federal funding, and how to better coordinate projects with changing standards. Novack explained that the underpass project is challenging and staff has worked through utilities and right-of-way issues over the past three years and that the updated standard would require a complete redesign and resizing of the project including the vaults, pumps, and land acquisition areas. He stated that DuPage County granted the City a construction grace period but it elapsed due to the prolonged work, that granting the variance will not alter the character of any of the upstream or downstream properties, floodplain or wetland areas, and that complying with the updated standard will significantly add to the design and construction costs as well as jeopardize the outside funding already secured for the project. AWARD OF BIDS AND OTHER ITEMS OF EXPENDITURE: N. PETITIONS AND COMMUNICATIONS: O. REPORTS AND RECOMMENDATIONS: 1. Receive the report and concur with staff recommendations for Washington Street Streetscape Option 3 and Main Street Streetscape Option B Novack explained that Washington Street is a narrow corridor and that the recommendation is for a narrower sidewalk with a brick balance, placing street lights and flowers in planters, and using trees where the width and depth is appropriate. Council discussed planter locations, use of native plantings, whether blind spots will be created, accessibility, and the impact of road salt on the bricks. Novack explained several options that could be used to address the planter concerns and that the brick is sealed and non-permeable. He also stated that the sidewalk width is 6' with an exception near Naperville Bank and Trust, that two strollers can pass easily, and that wheelchairs will be able to pass in the City of Naperville Page 8 Printed on 12/30/2022 City Council Meeting Minutes December 6, 2022 amenity zones. A motion was made by Councilman White, seconded by Councilman Hinterlong, to receive the report and concur with staff recommendations for Washington Street Streetscape Option 3 and Main Street Streetscape Option B. Receive the report and concur with PUAB recommendation to fund the 2023 Renewable Energy Program at the 2022 revenue level and dedicate any underspend to installing solar projects on City of Naperville facilities P.
