PUBLIC FORUM: SPEAKERS Climate Coach program Joseph Hus (Naperville - NEST) NEST has started a free climate coaching program and the United States continues to set records in adding renewable electricity generation and battery storage to the grid. Standing with Naperville’s Immigrant Families Emily Cummings (Naperville) expressed her concerns with the increased activities of ICE and Boarder Patrol in the Naperville area . Welcoming City Ordinance Lauren Reyes-Yu (Naperville) discussed Naperville creating a Welcoming City Ordinance. Diana Torres Hawken (Naperville) ALMAS discussed Naperville creating a Welcoming City Ordinance. Welcoming City Ordinance Signe C Gleeson (Naperville) discussed Naperville creating a Welcoming City Ordinance. IMEA power contract information Steven Cushman (Naperville) is in support of renewing the IMEA contract. SECA Philip Buchanan (Naperville) discussed the possibility of using Naperville City of Naperville Page 3 Printed on 11/19/2025 City Council Meeting Minutes - Final November 4, 2025 Community Emergency Response Team (CERT) volunteers to offset the increasing SECA City services fees. Welcoming City Ordinance Elisabeth Pynn Himmelman (Naperville) discussed Naperville creating a Welcoming City Ordinance. Retiree Life Insurance Vince Clark (Naperville) discussed the increase in retiree life insurance costs for 2026. Mayor Wehrli requested approval to allow Qasim Rashid to speak since he missed his opportunity when his name was called. The Council approved the request via voice vote. Immigration and ICE Qasim Rashid (Naperville) discussed Naperville creating a Welcoming City Ordinance. Council discussed the upcoming increase in retiree life insurance costs, scout tours, loud vehicle exhausts, adopting a Welcoming City Ordinance, CERT’s assistance at local events to help reduce City service needs, climate coaching, and requested updates on the IMEA contract and the 248th project. Oles stated a new letter will be sent via mail and email to all retirees explaining in detail the increase in the retirees insurance costs for 2026. Arres stated that citations have been issued for loud exhausts and tinted windows. He explained that the Police Department can only enforce existing laws; however, individuals can still have illegal exhausts and window tints installed by parts dealers. He added that stronger laws are needed to address these issues and noted that the Trust Act prohibits local law enforcement from collaborating with federal immigration authorities except in cases involving criminal behavior. Groth stated that the RFP for Member Directed Resources (MDR) has closed and staff are reviewing the responses. He added that negotiations with IMEA on the nine points directed by Council are still in progress, and an update is expected in the near future. Louden stated staff is working with an engineering consultant on the design as well as completing the land acquisition needed for the 248th Street project, construction is scheduled to begin in 2027 with a 2028 completion date. Wehrli made the following statement at the conclusion of Public Forum: "Thank you to everyone for participating in tonight’s Public Forum portion of our meeting. All comments received are memorialized into the record. You have been heard by the Council and the community and will be in our minutes forever. All comments are invaluable to the Council discussions". WRITTEN COMMENT ONLY Diane Walter Diamond (Naperville) AI facility buildings. Please consider the environmental and neighborhood impact of building such a facility. Investigate why other communities along I-88 have banned such facilities. Do not sell out Naperville. H. CONSIDERATION OF MOTION TO USE OMNIBUS METHOD FOR THE CONSENT AGENDA: A motion was made by Councilman White, seconded by Councilman Kelly, to use the Omnibus method to approve the Consent Agenda. Pass the ordinance amending Section 3-1-9 of the Naperville Municipal Code - Food and Beverage Tax Council discussed how the Food and Beverage tax revenues are being spent and additional funding for NCTV17 in the 2026 budget. ORD 25-129 A motion was made by Councilman White, seconded by Councilman Kelly, to pass the ordinance amending Section 3-1-9 of the Naperville Municipal Code - Food and Beverage Tax. Adopt the resolution authorizing the execution of an Intergovernmental Police Service Assistance Agreement to join the Northern Regional Major Crimes Task Force: Burglary Task Force RES 25-37 Council adopted. 15. Adopt the resolution approving the agreement between the City of Naperville and the State of Illinois related to roadway and signal improvements at Ogden Avenue and Rickert Drive RES 25-38 Council adopted. 16. Adopt the resolution approving an Intergovernmental Agreement between the City of Naperville and the Illinois State Toll Highway Authority regarding the inclusion of city work in the rehabilitation of the Washington Street Bridge over I-88 RES 25-39 Council adopted. 17. Adopt the resolution authorizing a workers’ compensation settlement contract between Victoria Richardson and the City of Naperville RES 25-40 Council adopted. =18. J. PUBLIC HEARINGS: K. OLD BUSINESS: L. ORDINANCES AND RESOLUTIONS: City of Naperville Page 7 Printed on 11/19/2025 City Council Meeting Minutes - Final November 4, 2025 1. Conduct the first reading of the ordinance amending Section 11-4 of the Naperville Municipal Code regulating the operation, classification, and safety of E-Bikes and E-Scooters SPEAKERS P. Justin White (Naperville - NEST) discussed the differences between the City ordinance under consideration and the law passed by the Illinois legislature. Randall Case (Naperville) is in favor of the E-bike and E-scooter ordinance. Council discussed enforcement of the ordinance, differences between the City’s ordinance and Illinois State law, and the importance of educating parents, children, and businesses that purchase or sell E-bikes and E-scooters. They also discussed the use of bicycles on sidewalks and emphasized that all residents share responsibility for helping to uphold the ordinance. Arres stated under the Illinois State law the owner needs to be 18 years old to ride an E-scooter only on roadways where the speed limit is 35 mph or less, an E-scooter is defined as a scooter that has an electric motor, the City will continue educating parents, children and businesses who purchase and sell these type of motorized vehicles by working with both school districts and area businesses, everyone needs to be involved, children cannot ride an E-bike anywhere except a designated bike path or the street, not on the sidewalk, the enforcement will be complaint based or observed by a Police Officer similar to any vehicle issues, the Police can also be deployed to neighborhoods where there may be repeated issues or concerns and non motorized bikes can be used on the sidewalks but they must yield to pedestrians. Council conducted the first reading. 2. Option A: Concur with the petitioner and direct staff to prepare ordinances and an OAA agreement approving the requested entitlements for Dutch Bros at 1230 S. Naper Blvd. - DEV-0068-2025; or Option B: Deny the requested entitlements for Dutch Bros at 1230 S. Naper Blvd. - DEV-0068-2025. SPEAKER Jamila Husein (Naperville) is opposed to the requested entitlements for Dutch Bros. DiSanto stated prior to the meeting the petitioner requested to table this item indefinitely so they can continue to review the information they have received and work on updates to their proposal. Council discussed residents concerns about the Dutch Bros proposal and inquired about the future of this proposal if they approve to table the item. DiSanto stated that the petitioner is aware additional work is needed on this proposal. He noted that tabling the item allows Council to reconsider it at a future meeting and provides the option to refer it back to the Planning and City of Naperville Page 8 Printed on 11/19/2025 City Council Meeting Minutes - Final November 4, 2025 Zoning Commission if necessary. Gresh (Naperville) Puthucode Subramanian (Naperville) Denise Joyce (Naperville) Brenda (Naperville) Patrick Griffin (Naperville) Michael H Gresh (Naperville) Jenna Kronsted (Naperville) Brittany Higgins (Naperville) WRITTEN COMMENTS Susan Ekkebus (Naperville) I am AGAINST the locating of the Dutch Bros Coffee location in the Jewel parking lot at 75th street and Naper Blvd. I am a frequent shopper at the Jewel location and find that traffic is already impossible without trying to locate a popular coffee shop in that small area of the parking lot. In the spring/summer when Jewel has their flower area there, it would add to even more traffic congestion and take away even more parking for the store. Katie Stevenson (Naperville) Traffic around the corner of Naper Blvd and 75th is terrible already. It is so difficult to get out of either the Mariano’s or Jewel parking lots already. There are so many near accidents at that corner. The addition of a coffee shop will inevitably make this worse. If there is any chance that the addition of this coffee shop would bring more funds to the city that could be used to develop a better traffic plan for that Corner, then I would be on board, otherwise I am against this addition Jeff Moore (Naperville) I've lived on E Bailey Road near Naper Blvd. for 20 years. Have you ever been to the corner of 75th and Naper during rush hour? You cannot put a Dutch bros in Jewel parking lot. In the morning the traffic is backed up southbound all the way to Sara Ln, in the evening you can't even get out of the Jewel parking lot, or Mariano’s. And every month there's a major accident at 75th and Naper. The traffic is horrible, horrible. Please, go see for yourself. on 75th during rush hour, the traffic is backed up on one side all the way back to Wehrli. On the other, almost to Washington. I have wanted for years for Naperville to figure out a fix to this area, and now you want to add a new traffic driver. No, no. Dana Ward (Naperville) The stretch of Naper Blvd. between Hobson and 75th street is already a nightmare during peak hours. Adding a drive through coffee shop will only add to the already overflowing traffic and seems unnecessary when that block already has 2 Starbucks (including the one in Mariano’s), Dunkin (already a congestion causer) and McDonald’s. Do we need a 5th spot selling coffee on that tiny bit of road? City of Naperville Page 9 Printed on 11/19/2025 City Council Meeting Minutes - Final November 4, 2025 Chen Liu (Woodridge) I am strongly against this proposal as the traffic over there is already very bad. It especially takes long time to get out of the Jewel parking lot to Naper Blvd. Ellen Schmidt (Naperville) I’m against allowing Dutch Bros Coffee Shop from being allowed to open at 75th/Naper. The traffic in that plaza is already heavy and the impact on traffic at the light at 75/Naper would be unbearable for those of us who live in the area. Please let them open in an area that is less congested. Lynnae Godsell (Naperville) The shopping area at the corner of 75th Street and Naperville Boulevard is already one of the most congested intersections in the area, particularly during morning and afternoon rush hours. I urge the city to carefully consider the existing traffic patterns, congestion levels, and history of traffic incidents in this area before approving additional development. A business such as Dutch Bros Coffee, which attracts frequent in-and-out traffic, could significantly worsen congestion and increase safety risks for drivers and pedestrians. Please take these concerns into account to ensure any new development maintains safe and manageable traffic flow in this already busy corridor. Debra (Naperville) Concerning the proposed building of Dutch Bros at Naper and 75th street. This is a bad idea. That intersection is busy and congested all the time. I know this because I work at one of the businesses in the Jewel side. There is no amount of traffic management that will make this situation work. I will stop visiting all the businesses at that intersection if this business is built because it won’t be worth the hassle. Kevin W Austin (Naperville) New coffee shop would be better located elsewhere. Traffic is already a nightmare at times at 75th & Naper. This intersection is also the most dangerous in Naperville for automobile accidents Mary Jage ( Naperville) I live 4 blocks from this location. On a regular basis in the morning and evening rush hours traffic is backed up blocking the intersections as well as traffic flowing into and out of Jewel and Mariano's parking lots. It is already a very busy area and we have Starbucks, Dunkin donuts, McDonald’s, Burger king, Starbucks inside Mariano’s, not to mention coffee in the restaurants in both malls. We don't need additional traffic that will be racing through the parking lot at Jewel endangering lives of people leisurely doing grocery shopping. This is no place to have a drive-thru beverage or food location. In the spring Jewel has their annual tent with garden supplies which displaces many parking spots making it very difficult to park already from April through June. This would just exacerbate it. I'm not against Dutch Brothers. I'm just against this location for Dutch Brothers. Please consider the local residents. We do not want it!! Zoran Kosic (Winnetka) I was first introduced to Dutch Bros while living in Arizona, where it quickly became a favorite among locals and snowbirds alike. Its welcoming atmosphere, exceptional customer service, and high-quality coffee made it a daily stop for many. When I returned to the Chicago area, I was surprised to find that Dutch Bros hadn’t yet expanded here-despite strong City of Naperville Page 10 Printed on 11/19/2025 City Council Meeting Minutes - Final November 4, 2025 interest from many who, like me, had experienced it elsewhere. Dutch Bros is more than just a coffee shop. It’s a community-driven brand known for its energetic and friendly staff who genuinely brighten customers’ days. Bringing Dutch Bros to Naperville would not only meet the demand voiced by many former snowbirds and residents familiar with the brand but also contribute positively to the local economy through job creation and increased consumer activity. I understand there are concerns about traffic, especially with another competitor like 7Brew in the area. However, I believe Dutch Bros can coexist successfully by implementing thoughtful traffic management strategies and working collaboratively with city planners. Their proven track record in other busy markets shows they are capable of integrating smoothly into communities while maintaining a positive impact. I strongly support Dutch Bros’ presence in Naperville and encourage consideration of the broader benefits they bring to both residents and the local business landscape. A motion was made by Councilman White, seconded by Councilman Kelly, to table directing staff to prepare ordinances and an OAA agreement approving the requested entitlements for Dutch Bros at 1230 S. PETITIONS AND COMMUNICATIONS: O. REPORTS AND RECOMMENDATIONS: P. NEW BUSINESS: Overnight parking White requested an update on overnight parking during the holiday season. Louden stated staff is continuing to discuss overnight parking concerns and an internal memo is being shared with several City departments and the Transportation Advisory Board (TAB) for review and comment with a recommendation being brought to Council in the future. Arres stated there is a moratorium on the overnight parking ordinance for the holidays and this issue will be communicated to the public through social media. Illegal modifications being made to vehicles Holzhauer is requesting staff to provide options for an ordinance to address the illegal modifications being made to vehicles by any business or other entity. By consensus Council directed staff to provide options for an ordinance to address illegal modifications being made to vehicles and report their finding to the Council at a later date.
