A. CALL TO ORDER:
Chairman Miller called the meeting to order at 6:31 PM.
B. ROLL CALL:
Present 7- Jim Bergeron, Diana Hawken, Nag Jaiswal, Patrick Kelly, Bradford Miller, Brian
Palm, and Nate Wilson
Absent 3- Sha'Ron Booker, Alex Jacobs, and Linda Kuhn

D. OLD BUSINESS:
1. Approve the Human Rights & Fair Housing Commission meeting minutes of June 6, 2022

Commissioner Bergeron made a motion to approve the Human Rights & Fair
Housing Commission meeting minutes of June 6, 2022, seconded by Palm. The
motion was approved and carried by the following vote:
Aye: 6- Bergeron, Hawken, Jaiswal, Kelly, Miller, Palm, and Wilson
Absent: 3- Booker, Jacobs, and Kuhn
E. NEW BUSINESS:
1. Introduce and welcome Miranda Barfuss, CDBG Administrator
Miranda Barfuss introduced herself as the new CDBG Administrator for the City
of Naperville.
2. Introduce and welcome 2022 - 2023 Student Representatives
Raeya Shah, Drake Cote and Rahil Patel introduced themselves to the
Commission.
3. Approve the Human Rights & Fair Housing Commission meeting schedule for calendar
year 2023

Commissioner Hawken made a motion to approve the Human Rights & Fair
Housing Commission meeting schedule for calendar year 2023, seconded by
Palm. The motion was approved and carried by the following vote:
Aye: 6- Bergeron, Hawken, Jaiswal, Kelly, Miller, Palm, and Wilson
Absent: 3- Booker, Jacobs, and Kuhn
4. Receive and review Complaint #32022 and direct staff accordingly
Williams reviewed Complaint #32022. The complainant owns and lives in a
condominium building in Naperville. She brought a claim against the
condominium association board for a reasonable accommodation due to her
disability. She is legally blind and uses a walker. She has requested the
complex install and/or improve the ramp on the backside of the building where
she is often picked up. She sent a letter to the board on August 2, 2022 and has
not received a response. On October 16, 2022, she fell while using her walker
on the existing ramp. Her walker rolled away and she fell. She contacted our
TED department and was informed there were no code violations that would
cause TED to intervene. Williams consulted the Property Manager, who
informed her that the board has asked their outside counsel to provide them
with an opinion letter regarding whether they have an obligation to install and/or
improve the ramp in question. Williams recommended that the Commission
give the board a reasonable amount of time to respond to the complainant,
following the response of their legal counsel.
Commissioners asked if the complainant is asking for the association to
install/improve the ramp, or if she is asking to do it herself. Bergeron noted that
the association cannot deny her the ramp, but the association paying for the
accommodation is not required by federal law. Williams circulated a picture of
the existing ramp on the building. It appears to be ADA accessible.
Commissioners asked for further clarification on the reasonable
accommodation requested. Miller recommended tabling the item until the next
meeting to allow the condominium association the opportunity to respond to the
complainant.
Commissioner Bergeron made a motion to direct staff to seek further clarification
on the accommodation being requested and to table the complaint until the next
meeting, seconded by Palm. The motion was approved and carried by the
following vote:

Commission
Commissioners discussed the role that student representatives can play in the
Commission. Cote reported that they do not have a voting role, but they are able
to participate in all discussions and deliberations. The student representatives
shared the reasons they were interested in serving in the Human Rights & Fair
Housing Commission and Commissioners introduced themselves to the
students and shared their backgrounds.
G. ADJOURNMENT:
Commissioner Palm made a motion to adjourn the regular Human Rights & Fair
Housing Commission meeting of November 7, 2022 at 6:55 PM, seconded by
Hawken. The motion was approved and carried by the following vote:
Aye: 6- Bergeron, Hawken, Jaiswal, Kelly, Miller, Palm, and Wilson
Absent: 3- Booker, Jacobs, and Kuhn
