A regular meeting of the Board of Aldermen was held Tuesday, April 12, 2011 at 7:30 p.m. in the Aldermanic Chamber. President Brian S. McCarthy presided; Deputy City Clerk Patricia Piecuch recorded. Prayer was offered by Deputy City Clerk Patricia Piecuch; Alderman Craffey led in the Pledge to the Flag. The roll call was taken with 14 members of the Board of Aldermen present; Alderman Cox was not in attendance. President McCarthy Alderman Cox is ill this evening. Her Honor Mayor Donnalee Lozeau and Corporation Counsel James M. McNamee were also in attendance. President McCarthy Does the Mayor wish to address the Board? REMARKS BY THE MAYOR Thank you Mr. President, I do. Tonight I would just take a moment to talk about two extraordinary men that we’ve lost in the community over the last few weeks. Sadly we’ve lost quite a few in the last few months it seems and more today. I am going to keep my remarks to two gentlemen that I wanted to comment on. First is Mr. Peter Davis. I think every member of this Board knew Peter. I happened to meet Peter as a 23 year old freshman legislator, in his first year as the CEO of St Joe’s Hospital. Peter had a way about him of really making people feel like they brought something to the table. He and I took a liking to each other and I, over the years, learned more from Peter than I could probably count if I took the time to think about all of those things. As I think many of you saw, his family at St. Joe’s Hospital really I think honored him very well in this community, within the hospital itself, within the newspaper, at his services and supporting his family; his two sons and his wife, their wives and children, and I just somehow couldn’t find exactly the right words to say tonight to talk about the kind of impact that he’s had on my life and on this community as a whole. It is without a doubt that this community has benefited for more than 25 years of his caretaking of one of our hospitals, and he will be sorely missed. Also impacting our community and my family is Mr. Lou Desmarais. Lou worked in this city for a very long time as well. He worked with my husband at Nashua Corp, I won’t say how long ago but quite some time let’s just say, and they were office mates. Later in life you know you come across people that you haven’t seen in a while and my middle son was a member at the karate school that Lou and his family ran and still runs on Lake Street the Independent Karate School. It had a profound impact on my son. As a matter of fact it was Mr. Desmarais that first saw in my son that he had the ability to be a remarkable teacher and it’s because of his guidance and attention to my son that I think he’s a different person today or found who he was sooner because of him. His service is tomorrow and I know that the difference that he made is this community was also remarkable. As a matter of fact some of you I mention that I had that round table in my office with students from the high schools and in finding somebody from this community that was here when President Kennedy visited; it was Lou Desmarais and his wife Julie. And Lou had just gotten out of the hospital the evening before and would not hear of me rescheduling and made it in and had a really engaging conversation with the youth around that table and of course that’s where he really shined. So you know as I say sometimes but not often there are people in our lives that come and go and make an impact but then there are people who will forever have made an impact on you, and I think both of those gentlemen are in that category. I strongly feel by helping us, you will be helping yourselves by showing voters you will stand up for them. Until the last meeting, I had tried 5 times for an appointment to see Mayor Lozeau but she refused to see me. Finally we talked because she did not like what I had said. She has heard me read and afterward I have given her copies of all statutes, etc. to do with our problem. Instead of saying something once, I have said it numerous times in case something was missed before. Laws: RSA 676:11 Building Permits Required has, ‘building inspector’s examination and approval’, Ord. 190-268 Building Permits has ‘if approved by the Administrative Officer’ and under the Criminal Code is RSA 626:3 Effect of Ignorance or Mistake ‘a person is relieved.…(if) he acts under a mistaken belief…… offence officially made by a public servant’. All of those laws make it easy to understand when the City’s public servants approved the building permits our neighbors used them as the authority to take our land; the building inspectors were at fault, not the Gilbertsons. Another law that falls under the Criminal Code is RSA 627:9 Curtilage that is back by federal and state constitutions, protects a property owner from the loss of all of any part of his/her driveway, etc. used for domestic purposes. Mayor Lozeau and Attorney McNamee who are public servants are bound to look out for the citizens of Nashua; have failed our family! Thank you.” Stacie Laughton, 11 Cottage Avenue, #2 I was born and raised in this city and I left about 8 years ago. One thing I noticed 8 years ago was the city was, no offense, was starting to look a little trashy. But now that I have come back it is starting to look a lot better. However, there are a few areas in the city such as the trail that runs alongside City Hall over here and there is a park I believe it is right off of Ash Street that have a tremendous amount of trash. I know it is against city ordinances to throw trash or let your animals do their business on city property. I would be willing to help the City in volunteering to clean up these areas. However, I will need some help. The City is looking a lot better, but I believe that there could be some more done to beautify these areas that have a tremendous amount of trash. I can provide contact information after the meeting if necessary, but I would be willing to volunteer for the City and help in these areas. Thank you. REMARKS BY THE MEMBERS OF THE BOARD OF ALDERMEN Alderman Cookson Thank you. I just wanted to say I’m excited this evening to see that we have nominations for the Nashua Arts Commission. I appreciate the Mayor bringing those forward, I appreciate Alderman McCarthy identifying me as an Aldermanic Liaison, and I look forward to doing some fine work with this commission. Thank you. Alderman Flynn Thank you Mr. President. I would like to take this opportunity to extend my condolences to the family of Paul Roussel who passed away last week. I first met Mr. Roussel when I was knocking on doors running for office. Bd. of Aldermen – 04/12/11 Page 8 He was on the porch and he wouldn’t talk to me until I convinced him I was an honest politician. I hadn’t run for office before and after a couple of questions I just kind of told him yes I was. I didn’t really know where he was going with that question. He never pursued that anymore, but over the years 5 or 6 times I have been to visit with him and he was an Alderman when I was in high school. I’m sure I never voted for him, I was too young to vote, but what I liked about him was he always had a lot of pleasant stories. He had great memories of when he was an Alderman. Every time I met with him there was always a lot of giggling, a lot of joking, a lot of laughing, kind of the way I would hope that things would be for, probably we all hope that, but at least for myself hope that would be at the end of my term is that not only did I serve the public but I had a good time while I was an Alderman, that I did my best like I say to serve all of my constituents, but along the way you have got to come away from that with good strong memories. Boy he had a lot of stories to tell. I enjoyed those moments with him. I extend my condolences to that family. Thank you Mr. President. Alderman Chasse Condolences go out to the Hill family also. I met Mr. Hill a few years back when his Daughter opened up Flowers on the Hill in Hudson. I did some construction work over there. This gentleman at that time was retired, but he was out there helping his Daughter delivering flowers. He had the perfect disposition for anybody to deliver flowers. This gentleman, first name I have no idea, as far as I am concerned it is Mr. Hill because I respect my elders. This guy was one real nice guy. I know his Son, I know his Grandsons who have been very much involved in sports, and it has been a lifelong family in the City of Nashua. Condolences go out to that nice family. Thank you. Alderman Wilshire I would also like to send condolences out to the family of Lou Desmarais who I knew from my Nashua Corp. days many years ago. He was a terrific guy, always willing to help the kids and always willing to sponsor kids that needed help at Christmas time. Just a terrific guy. I would also like to thank everyone who came out on Sunday. The Nashua Soup Kitchen held their 18th Annual Run for Food & Shelter. They had about 900 people participate, about 50 volunteers, and I would really like to thank the folks at Rivier College for opening their doors and allowing the Soup Kitchen to stage their race from there. They used to use the YMCA and were not able to do that this year. The folks at Rivier College were terrific and let us use their space. It was really a great day. A lot of people turned out, a lot of walkers, and we had a few places that the City needed to sweep and they were out there. Boy they did a great job. It was just a great day, great event. I would also like to thank Stacie Laughton for his willingness to come forward and volunteer to help clean up the rail trail and parks. Thank you. Alderman Sheehan Thank you. The French Hill Revitalization group is meeting at 6:30 p.m. on the next Wednesday, not tomorrow night. If anyone is interested in participating and trying to figure out what can be done to make improvements in their part of it that would be great. It is at the Dental Connection on the second floor from 6:30 to 7:30 p.m., and it is being hosted by Habitat for Humanity. Swim lessons are now up on the web and camps for the summer. A lot of people having been waiting to find out when those are online and ready to sign up, and now would be the time. Bd. of Aldermen – 04/12/11 Page 9 Alderman Melizzi-Golja I have two announcements. The first one is April 20th Arbor Day 9:30 a.m. at Tom Kelley Square. Pam and Tom Osgood from Ward 8 have donated a tree that is going to be planted as the City Arbor Day Tree in honor of Mr. Kelley, and that is going to be again at 9:30 a.m. on Wednesday April 20th. The Police Athletic League (PAL) is having their second annual spelling bee May 6th, which is a Friday from 5:30 to 8:30 p.m. at Estabrook Grill. Tickets are $20 per person. The library team is going to be back to defend their title. We hope you can join us. Thank you. Alderman Pressly Thank you Mr. President. I would like to give a moment of praise to our police department and our fire department, in particular Officer Robert Goodwin and Fire Marshall Richard Wood for the way they handled the tragic fire on Chestnut Street on Saturday morning April 3rd. As one of life’s ironies, 12 hours before the fire started Alderman Craffey and I were at the property with the homeowner who was applying for some public money to fix up this wonderful old building. It was just a tragedy that it caught on fire. I was there about two hours after it was put out and had a chance to talk with these people that had been so courageous. The police were there and evacuated the building. There was no loss of life. It is a wonderful building, over 100 years old, and even Officer Goodwin commented that the units were particularly nice. Unfortunately we lost 8 legal units of really affordable housing. It is my hope that the property can be restored. It is right across from the Soup Kitchen and it is really a handsome property. Praises to our police and fire. They did a magnificent job and responded in a timely way. People were saved because of them. Thank you. Alderman Deane Thank you. I can answer a question for Alderman Chasse. Mr. Hill’s first name was Archie. I knew Archie for a number of years. His younger Daughters were friends of my Wife’s Sister. Archie was an interesting guy. He had a lot of history. I spoke with him many many times. He would be telling me things about Nashua Corp. and the covered bridges and how they used to come across and how the Pop Warner Football field used to go all the way down to the edge of the Amherst Street School and this was never there and this was never here. He did keep a watchful eye on that Artillery Lane property. I would see his little beige car and I saw one of his Daughters driving it last night. I hadn’t seen it in a while and I knew he was ill, but…he would make his presence and his opinion known to Park Department personnel as well as the Park Superintendent who had many interesting conversations with Archie and Archie’s vision of that parcel. He was a nice guy. He was very interesting. I really enjoyed talking with him a lot because he had an awful lot of history. He was a really good guy. On another note, we often talk about different children events and programs, but ice hockey we never seen to speak about and since it is warming up; there is Nashua Panthers, one hockey team, which is made up of 7 and 8 year olds from Nashua and the surrounding towns won their league championship on Sunday coming from behind to defeat Methuen 3/2. Panthers began the final weekend of the regular season in last place and ripped off 5 straight wins to claim the title. The Valley League is the biggest hockey league in the nation made up of thousands of players ages 6-18 from the Merrimack Valley and southern New Hampshire. The Panther players play most of their games at Conway Arena, and have both a select and a town level team. Unlike so many elite programs, the Panthers have a team for any child who wants to play ice hockey. If your children are interested in playing that is the program to get involved in. It is not all dedicated to the elite. I would like to congratulate those children for their victory. Bd. of Aldermen – 04/12/11 Page 10 On another note, Mayor all of the lights on the Main Street Bridge are working. I went by there this morning around 2:00 a.m. and they were all on. I put my timer on to see how long it is going to take for one of the bulbs, for something bad to happen. Thank you. Alderman Craffey Thank you. I too want to extend congratulations to our firefighters and police officers on that tragic fire and their ability to get it out in time. I want to say thank you to Stacie Laughton for volunteering. The Ward 4 informational meeting we have every month. It will be at the Ledge Street School at 7:00 p.m. on Monday the 18th. The Nashua Baseball and Parks Association is putting on a charity event at Holman Stadium May 1st of amateur baseball in the City. Raffle prizes and things will be at Holman itself. Come out and see umpires in pink shirts. Thank you. Alderman Vitale Tomorrow evening from 6:00 – 7:00 p.m. I would like to invite the residents of Ward 1 to Starbucks at exit 6 for a constituent coffee if they would like to bring any questions they have with them. Thank you. Alderman Clemons Thank you. Tonight I have prepared remarks, which I will now proceed with. It is not too often as an Alderman that I receive phone calls, e-mails, letters or even get stopped on the street or in a restaurant regarding things that are going on in Concord. Usually the comments and questions that I receive have to do with things that this Board of Aldermen directly deals with such as our local budgets, schools, or neighborhood issues, but recently I have been getting feedback from constituents regarding issues coming out of Concord. The folks who have contacted me are deeply concerned about the direction our State is taking with regards to the recently passed House budget and other proposals that the New Hampshire House has embraced. The folks who I have spoken with are worried that New Hampshire is pulling the rug out from under the poor and the working class. Here is a list of partial proposals coming from the New Hampshire House of Representatives that our Republican delegation has for the most part supported: 1) Attempting to take away the rights of college age students to vote in New Hampshire. 2) Eliminating the marriage rights of thousands of New Hampshire citizens. 3) Eliminating funding for New Hampshire PBS 4) Cutting aid to our colleges and universities 5) Refusing to increase the R&D tax credit 6) Changing the retirement system for those folks who have already been paying into it. 7) Taking away retirement benefits from those who already have them. 8) Taking away the right of collective bargaining for New Hampshire’s public employees. 9) Eliminating millions in hospital funding to help the poorest New Hampshire citizens be able to afford hospital bills. 10) Cutting aid to the unemployed, the disabled, the poor, and the homeless. 11) Downshifting to municipalities millions of dollars. Make no mistake about it, these issues may be State issues, but they are Nashua issues as well. As the second largest city in the state we have a lot at stake. I honestly believe that when it came to all of our Bd. of Aldermen – 04/12/11 Page 11 Nashua representatives be them Democrat or Republican that they would have done what was best for Nashua as they have always done in the past. I had high hopes that this new Republican majority that we elected would deliver on their promises of jobs and fiscal responsibility. But instead the Republicans have proposed an outright attack on the middle class. As such, I believe, as do many of our citizens that these proposals do not reflect nor represent what the great majority of the people of Nashua voted for in the last election. The voters of Nashua surely asked for balanced budgets and cut in spending, but they didn’t ask for an assault on public employees, they didn’t ask for the Legislature to rip away the lifelines of the poor and the less fortunate, they didn’t ask for a decimation of our higher education systems, and they certainly didn’t ask for some of their civil liberties to be taken away. Tonight I speak because I want the people of Nashua to hear what I think about these things. I speak out tonight because I want to speak up for the many who have shared their views with me. I speak out tonight for those who feel that they have no voice, for those who feel that the State is about to abandon them. I speak out tonight because if I hold any influence at all I hope I can reach out to Nashua Senators Gary Lambert and Senator Jim Luther and ask them on behalf of these concerned citizens who reached out to me and to the many others who did not, but who also share my views to ask them to do a better job representing the people of Nashua. I ask that you stop these proposals. Don’t make Nashuans suffer needlessly with these ill advised cuts. don’t scapegoat our public employees, and don’t put out our working class and our poor. I’m counting on it and so are the citizens of Nashua. Thank you. Committee announcements: Alderman Tabacsko Thank you. Next Tuesday the 19th is the Planning & Economic Development Committee meeting here in the Chamber at 7:00 p.m. There is a public hearing on O-11-64 and there are several items on the table. I just wanted to also mention that I will be away next week and Alderman LaRose will be chairing. I just wanted to mention that. Also because I am away next week and next week is the Joint Special School Building Committee meeting and the School Construction Projects Committee meeting on Thursday night, normally it is the 4th week of the month and because of school vacation that is now going to take place that week on the 21st, so just a reminder to everyone who is a member of the Joint Special School Building Committee you are needed for a quorum at 7:00 p.m. at Nashua High School North and the School Construction Projects Committee meeting is at 6:00 p.m. Alderman Cookson We have a Committee on Infrastructure meeting tomorrow evening in the Chambers beginning at 7:00 p.m. Alderman Clemons The Personnel/Administrative Affairs Committee will meet Thursday at 7:00 p.m. in these Chambers.
