A regular meeting of the Board of Aldermen was held Tuesday, January 8, 2013, at 7:30 p.m. in the
Aldermanic Chamber.
President Brian S. McCarthy presided; City Clerk Paul R. Bergeron recorded.
Prayer was offered by City Clerk Paul R. Bergeron; Alderman Pressly led in the Pledge to the Flag.
The roll call was taken with 14 members of the Board of Aldermen present; Alderman Moriarty was recorded
absent.
Her Honor Mayor Donnalee Lozeau and Deputy Corporation Counsel Stephen M. Bennett were also in
attendance.
REMARKS BY THE MAYOR
This evening I would let the Board know that tomorrow, at the Capital Budget Overview Committee at the
State House, there will be votes relative to rail. I thought you all might be interested. There will be two
votes in particular that this group would be interested in; one is the Capitol Corridor, that vote is there
before the Capital Budget Overview Committee because there is a request for using toll credits for the
FTA portion of the project. The legislature in the last session voted that anytime toll credits are to be
used instead of DOT being able to use their discretion, it does have to go to the Capital Budget Overview
Committee. So, that is what is sending that on that course of action. I thought some of you might not be
aware that it would have that step along the way so I wanted to make you aware of it. In addition, you
may recall many months ago, we accepted a $6.5 million CMAQ grant municipal agreement for the city
for Park & Rides and rail locations, and as you know, we have been talking about Crown Street and
purchasing Crown Street. It is on the table both in the Infrastructure Committee and the Finance
Committee. One of the reasons that we haven’t pursued moving it forward was because that’s a project
that also requires that match of toll credits which has been recommended by the Department of
Transportation. That is up for a vote as well tomorrow. We are hopeful that we have the votes for both
items. I have somewhat more confidence on the Crown Street property than I do on the Capitol Corridor
but we will see tomorrow after that happens. That’s at 10:00 tomorrow morning. You might be interested
in knowing that Director Galligani is going to go up on behalf of the city to speak to both of those items.
Other than that, I wish everybody a wonderful Happy New Year and I know that many of us are getting
over colds and all the other things that come with gifts around this season.

Actually, Alderman Donchess, it’s my intention at the next Board of Public Works meeting on the 24th to
agree to a time. We’ll send something out with folks and get that first meeting schedule. At that first
meeting, the committee will elect its chairman and then set its schedule.

I just have a quick question on this because I recall receiving a memo from the Mayor prior to the
holidays indicating it was a three-year contract. We were going to try to get it before the full Board for an
emergency vote. We were going to suspend the rules. I don’t know what the conflict was at that time, if
it was the fact that it was a three-year contract or I’m not sure why it didn’t come before us. But
apparently now it’s a one-year contract that’s gone before Finance. It’s received the approval of Finance
and now it’s waiting for the approval by this body. Is that correct?
President McCarthy
I believe so.
Mayor Lozeau
Actually it’s a one-year contract with two one-year options, which is why it’s here tonight. It didn’t come
before the full Board at the last meeting. I was out; as you know, I was ill, but also there were concerns
raised about having a three-year contract. So some of us went back and negotiated with FairPoint to
maintain that same price and break it into three one-year agreements. That’s what we’ve done and
that’s what’s before you this evening.
Alderman Cookson
That’s actually the direction I was going because what we have now is, the language within the memo
from Mr. Gabriel, the Purchasing Manager says the upgrade to the current service will carry a 12-month
term with an automatic renewal for two one-year terms for a grand total of three years. So it’s still a
three year contract, but it is one year that expires and then it is automatically renewed for another year
and then expires and renews for a third year.

My understanding is it renews at our option. The difference is that we do not have to renew it for second
and third years if we don’t want to.
Alderman Cookson
So it’s an automatic renewal.

It doesn’t say that within this document. It says it is an automatic renewal.

Thank you, Mr. President, Although you and I had spoke to this prior, it is an automatic renewal without
our notifying them that we do not wish to renew. It’s just a matter of how you do it, but it is an automatic
renewal unless we notify them that we choose not to renew.

Dear Alderman McCarthy. At the last Alderman meeting, I quoted from the Code Book, Article 5, Section
5-34, Powers and Duties of Division Directors and from the city website on the duties of the city attorney,
and asked you to speak to Mayor Lozeau so I could speak to Kathy Hersh as soon as possible. But I
have not heard from anyone. On March 4, 2011, you wrote to the Board of Aldermen and Mayor Lozeau
on the top item lists for Vision 20/20 Sessions. One of these items were zoning code enforcement.
That’s interesting. Why do you feel some codes should be enforced and not others? Or, maybe it’s
Mayor Lozeau. Last month I handed her a 16-page package on our problem to read and she refused to
take it. A good example that can go wrong is when someone is lax in their job is our problem that was
caused by building inspectors in approving building permits that had a boundary line that did not agree
with the deed. Neither Mayor Lozeau or the City Attorney should be involved with our problem.

I’ve got two subjects to address tonight. Mr. Bergeron’s office area and the back entrance that the city
hall is being renovated. As many of you are aware, and I know you, Mr. President, were fully involved in
the two Nashua high school buildings. We are perpetuating again bad workmanship, encouraging bad
workmanship. The current wiring system that is going into the clerk’s office out into the hallway and then
down to the corridors is against NFPA code, NEC code, 70. It concerns the routing, support, interference
by EMF to communication cable. There are no wire racks as per code for any of our city communication
cable in and around that area. The HVAC system controls are mounted in a non-conforming area
underneath a possible pipe leaking section. It’s not shrouded. And the false ceiling is being lowered.
That according to the code may present a problem under the life safety rules of NFPA 70. I have brought
it to the attention of the new building manager, but I have not been able to get in touch with the electrical
inspector. The city is the centerpiece for anything that goes on in our city. We have a building
department who should be really on top on this. Correct me if I’m wrong, Alderman McCarthy, but some
of the points I raised during the building of the two high schools did actually result in quite a considerable
savings to the city because we didn’t have to pay for change orders for work that was done against code.
I believe this Chamber has the right to make sure that whatever goes on in city hall is done correctly
because this is the centerpiece of where you all work. I do know that when Mr. Farenkopf was running

part of the IT Department for the schools, we have horrendous problems of communication. Some of the
cables would not come to what they call attenuation. They went through and a lot of the photographs,
and there were 718 of them that I took, they found electrical 220 volt cables alongside the communication
cable. We’ve got the same thing happening downstairs again. Code also says if you lift a ceiling tile, any
suspended ceiling, no cables may be within 18 inches of that suspended ceiling. I expect if we went in
the mayor’s office or anywhere else round here, I know in the DMV definitely, there is cable looped all
over the place. There’s power cables looped all over the place, all against federal, state and our own city
code. That’s one aspect I think has to be addressed asap.
The other one is it was very nice presentation, Mayor, the other night with Mr. Vancor. The only problem
is a number the aldermen here raised the question: What does it look like approaching or by the side of
either the Fairmount or the Baldwin Bridge? It was my understanding that all future work within the city
was to be done in CAD that was 3-D. If the work that we’re paying over one and a half million dollars for
is being done in 2-D, there’s no way that any of you will get an idea of what the rendering of those
approaches, either side of those bridges, will look like. I’m still very upset that we’re still back in 2-D and
not 3-D, and it’s a very cheap program. You can go to Space Cling, you can go to Solid Works, you can
go to Cateer, you can go to Daso, you can go to AutoDesk. For $9,000 you can get everything under the
sun from them per platform. We’ve paid out this money and we still got 2-D drawings.
The other thing which I find extremely distressing is back in 2011, there was a communication between
Engineer Dookran and at that time, it was Mr. Kenison, and myself. I introduced them to the HCB Bridge
Company of John Hillman. John very kindly contacted and sent through a whole load of data to Mr.
Dookran who handed it onto Mr. Kenison who then when he left apparently was handed on to John
Vancor who then said it needs to go to the new engineering company. Well Tom Dinsmoor had all that in
2011. The complete package of how to make a composite bridge. As we stand here now, he is in
Atlantic City with the Governor of New Jersey. They are talking about rebuilding the hole of the
boardwalk plus a whole bunch of other stuff in this HCB system. He has a contract with Ocean City.
They’ve got a letter of intent from a number of other places. I find out that here in New Hampshire, we
have three bridges. One of them is actually a DOT bridge up in the north country. They have just
recently finished in November of last year a huge bridge system in Missouri, 107-foot span. We don’t
need 107-foot to get across the river. You were asking about cost of maintenance, ongoing
maintenance. They have had exhaustive tests done by the Institute of Technology in Washington and
they have literally put through much of what they have done, crash tests, and they have shown they can
achieve about 100-year life out of their construction. So why weren’t you presented with this? Why are
we going to go with steel? It’s got to maintained. Why do we have to go with concrete? It’s got to be
maintained. The composite stuff will go up quicker. It will cost us less and overall the life expectancy
could be between 50 to 75 years minimum, possibly 100. Are we shortchanging ourselves? Mr. Hillman
actually called me. He has made an offer, and I believe you have the e-mails from me because the
Mayor asked me to forward and distribute all the data and information. He’s actually offer to come here
to New Hampshire to Nashua on his way up to the University of Maine. Now he will be leaving
Washington, having visited with the Federal Highway Deputy of Bridges. With it he will have the
possibility, if the city considers it, of being able to get federal highway funding of up to $1 million.
Apparently this is per bridge. If we got three bridges, we theoretically have the capability of getting $1
million per bridge of federal money by HCB. If we were to consider going with this system which would
save us an awful lot of extra money. I know the mayor said: “I don’t want to go over budget.” This lowers
our budget to the point where one or two of the niceties she was asking for in this presentation the other
day maybe considered. But when the US Army also utilizes this building system now, we’ve got to
consider it. The fact that the New Hampshire DOT has already built a bridge here in New Hampshire,
Nashua’s really got to give it serious consideration for our Broad Street Parkway.
I actually today or yesterday, I think it was, spoke with Alderman Pressly. You will not be able to see that
bridge from the Millyard area going across from the center of Main Street Bridge or up right on the corner
where the little park is. The only time you’ll be able to see it is if you walk up the street towards the
Clocktower Condominiums because during the summertime, it will be all covered up with the greenery

from the trees. In the wintertime, you really can’t see anything. You might hear something but that’s
about it. So putting all the niceties on the main big bridge, I think would become moot if you physically
cannot see it. That’s why it would have been nice to have been able to have had a 3-D rendering so you
could have seen all the views from all angles. If anybody here has seen 3-D renderings, they are pretty
impressive, but I think a lot of it would have been answered if we’d had all those drawings in 3-D.
The other thing, Mr. president, none of the Spofford drawings, designs are on any of the Broad Street
Parkway website. Even though we were told that would be put on. The mayor did find out that the
presentation drawings were on the agenda, which I thank you Mayor, but again, it was my understanding
it was supposed to have been there, but thank you for letting us have a copy the other night. But coming
back, I would ask this chamber tonight to consider a possible motion. I leave it up to whoever wants of
making a formal invite to Mr. John Hillman with the HC Bridge Company from Illinois to come by Nashua
on his way up to the University of Maine. He’s not going to do a selling job. The selling job has already
been done to the state, and the federal government, they are already on board. That’s why his company
has been allowed and given this federal highway funding capability of up to $1 million a bridge. If we’ve
got the capability of $3 million for those three bridges, I believe you have a fiduciary responsibility to
consider it. Thank you.

I guess I’ll begin where Mr. Daley ended and question or ask is there the opportunity to invite Mr.
Hellman and is that being considered by administration or I suppose the board in general?
Mayor Lozeau
I’m looking into the information that Mr. Daley sent. The bridges actually had been looked at when Mr.
Kenison was here. This is the first I’ve heard that somebody is willing to come by. I’ll have to look into
that and decide whether that makes sense and if it’s something that we can do or not do. It depends on
timing and people’s schedules and frankly also the purchasing guidelines and some of those things too to
find out whether we can do something like that.
Alderman Cookson
So it sounds like some things are going to need to take place in order to determine whether it’s
appropriate.
Mayor Lozeau
Whether an invitation would be extended, yes.
Alderman Cookson
Thank you. I hope everybody had a wonderful holiday season. I just had one final question. I know that,
I want to say it was during December; it may have been during November, that Alderman Craffey had
crafted a memo. We were expecting a response from the Pennichuck CEO with regard to WICA. I
haven’t seen it come through out packets, and I’m curious. Is that letter forthcoming?
Mayor Lozeau
Yes, the Pennichuck Board took it up. The information has been gathered. My understanding is it
should be out before the end of the week. It will be sent to the Chairman of the Special Pennichuck
Water Committee because the Board sent it to the that committee.

The Pennichuck CEO, Mr. Patenaude sent the memo, his response?
Mayor Lozeau
The response from the Pennichuck Board was done by Mr. Patenaude and the Chairman. When it’s
completed, it will be sent to Alderman McCarthy as the President of the Pennichuck Special Water
Committee because this board sent that to that committee.
Alderman Cookson
The Pennichuck Special Water Committee sent the memo?
Mayor Lozeau
No. This board took action at the meeting when that memo was discussed and sent that memo to the
Pennichuck Special Water Committee. When I was asked who the response should be sent to, I asked
that it be sent to the committee.
Alderman Cookson
Okay, wonderful. So that’s happened recently. I thought I read a couple of weeks ago that Mr.
Patenaude was working on that memo.
Mayor Lozeau
What I just said to you is I believe it will come out at the end of the week. I know that it’s been worked
on. The board took it up. We discussed it. Talked about what we were going to do. Mr. Patenaude was
assigned the responsibility to respond, and I believe that letter should be forthcoming at any time.
Alderman Cookson
Very good. Thank you so much.
Alderman Craffey
I just want to follow up on my colleague’s question. I’m hoping that a copy of the letter would also come
to me since I was the originator of the request. My understanding from that meeting that we had, Mr.
President, was a copy would come to me also. That was my understanding from the meeting that we
had on that day. Because I was the generator of the request, a copy would come back to me. I’m still
hoping that a copy would come to me too in addition to you.
President McCarthy
As soon as we receive it, it will go to the entire board.
Alderman Craffey
Alright. Thank you, Mr. President. I just want to say I attended the VFW New Year’s Eve party and I want
to thank the Women’s Auxiliary Committee. They did a fine, wonderful job. My wife and I had a great,
great time welcoming in the New Year with all the vets there. I sat next to a gentleman who talked my

ear off. A very nice gentleman; served with a Special Battalion that was seen 11 different countries and
four different armies. It was an engaging evening with him, and I really and thoroughly enjoyed it. Thank
you very much.

With the (inaudible) happened to date, I think I’ll forego my comments. Thank you.
Alderman Chasse
It is a New Year, and I did watch the Board of Aldermen meeting along with the Public Works. It was a
joint meeting. I even sent a text. There was a lot that was missing during the meeting because of
individuals not getting close enough to the mics. I know when I see a certain individual out there, he’s
going to say “Ya, Mr. Vancor talked for about two or three minutes before somebody in the meeting
mentioned something about getting close to the mics.” I think we should all make a honest effort to get
closer to the mics when we speak, even at the committee meetings because a lot of times things are
missed. It was a very interesting meeting from what I got. What I missed, I can always go back to the
regular minutes or something, but anyways that’s the first thing.
The second thing is I went to a new restaurant in the City of Nashua, and I said I’d put a plug in for them
and that’s the Arena. The Arena is on High Street. I went over there and had a look at their menu. They
have a very generous menu. The food was excellent. I had the steak tips, and they were a great portion
and very good. The wife had a club sandwich and she had to take most of it home because it was huge.
I just figured I’d throw a plug. If you like sports, you can watch ten different ballgames going on at the
same time. Like I say, I wish them the best of luck and hopefully they’ll make it in the City of Nashua.

Thank you. First of all, I’d like to wish each of you and Happy New Year. And, I’d just like to thank the
Board for the flowers you sent for my father’s funeral. My mother was happy they were a bouquet and
not those, to quote her, “awful funeral flowers” so you made her happy too. To those of you, I’d also like
to thank you for your individual e-mails and cards and words. Thank you.

There is an issue with the current level of dedicated internet access bandwidth that we purchase from our
current service provider - FairPoint Communications "FairPoint". The City has outgrown its current
bandwidth level which has caused problems such as difficulty navigating the city website, sending and
receiving large emails and the slowing down of other web related business activities. To rectify the
situation, the City's Information Technology Department has investigated increasing the bandwidth level
for the city.
At this time, the City IT Department has recommended increasing the bandwidth level which FairPoint has
proposed advantageous pricing as part of the contract. IT has also done research that supports
FairPoints offering as being "best value" to the city which is beyond the normal sole source justification.
This upgrade to our current service will carry a 12 month term with automatic renewal for 2 one year
terms for a grand total of 3 years and a cumulative cost of $57,348 (1,593 per month) over the length of
the new agreement. With six months remaining in the current fiscal year, the amount to be expended out
of the FY13 operating budget will be $9,558.
Pursuant to NRO Sec 5-84 (A)(4) Special purchasing procedures for sole-source procurements, pricing
was solicited from FairPoint Communications, Portland, ME.
The award is contingent pursuant to NRO § 5-74 (B) which states that a contract that extends from the
current fiscal year into succeeding fiscal year(s) in which no funds have been appropriated nor otherwise
designated for this purpose shall be approved by the full Board of Aldermen before the contract shall
become binding on the City.
For your review, please find the proposed Service Agreement along with the supporting Service Schedule
both of which have been reviewed by the Legal Department.
The City IT Division, Financial Services Division and this Office recommend awarding the contract in the
amount of $57,348 to FairPoint Communications, Portland, ME.

155-B:13 Hazardous Excavations. - If in any city or town, an excavation for building
purposes is left open for more than 6 months without proceeding with the erection of a building
thereon, whether or not completed, or if any excavation or basement is not filled to grade or
otherwise protected after a building is destroyed, demolished or removed, the governing body
may order such excavation to be filled or protected or in the alternative that erection of a
building begin forthwith if the excavation is for building purposes. The order shall be served
upon the owner or his agent in the manner provided by RSA 155-B:4. If the owner of the land
fails to comply with the order within 15 days after the order is served upon him, the governing
body shall cause the excavation to be filled to grade or protected and the cost shall be charged
against the real estate as provided in RSA 155-B:9.

RE: I Ferry Road, Nashua, New Hampshire
The original structure located at I Ferry Road, Nashua, New Hampshire was damaged by fire on
November 13,2007. Subsequently, the owner of the property, Navin Patel, requested and received a permit
to demolish the remains of the building. The demolition was accomplished on or about August 1,2008.
After the building was demolished, Mr. Patel enclosed the property with a fence. However, that
fence was poorly made and did not prevent people from entering the property or accessing the uncovered
basement. After repeated attempts to have Mr. Patel repair the fence, he was issued a notice of violation on
May 21,2012. That notice of violation required him to either fill the basement to grade or protect the
uncovered basement with a permanent four foot (4') high fence. Mr. Patel did comply with that order by
erecting a new fence.
The fence installed by Mr. Patel in June, 2012, was subsequently found to be improperly installed
when it collapsed in several places again allowing access by the general public. This department has made
repeated attempts since September, 2012 to have Mr. Patel reinstall or repair the fence. To date, Mr. Patel
has ignored the phone calls and letters from this department and the legal department.
The exposed basement is approximately ten to twelve feet deep and any person who fell into the
basement would likely suffer severe injuries or death. The uncovered and unprotected basement presents
an immediate threat to the health and safety of the general public.
Based upon this departments observations and its attempts at obtaining compliance from Mr.
Patel, it is recommended that this board order that the foundation be filled to grade to abate this hazard.

This letter is to document our phone conversation of this afternoon regarding the open foundation
located at 1 Ferry Road.
If you are constructing a fence to provide the required barrier it must meet all the code requirements
of a pool fence. 1 have attached a copy of those requirements to guide you in this process. It is
imperative that the fence be completed by June 8th as I am required by law to either fill the
foundation to grade or erect a fence with the cost associated charged against the property as a lein.

to the general public. You have been advised on a number of occasions that it is your

The fence currently around the property is inadequate and has collapsed in several placcs.
You have failed to respond to recent letters and calls to you regarding this
dangerous situation on your property. This office will obtain an order from the board of
aldermen pursuant to RSA 155-B:13 requiring you to have the foundation filled in.
Should you fail to promptly respond to die order, the city will fill in the foundation and
place a lien against your property as permitted by law.
Please consider this letter to be your last warning before the order is obtained
from the board of aldermen. If you do not contact Mr. Metcalf in the city's code
enforcement office on or before December 28,2012, the city will obtain the order and
remove this hazardous condition. All costs associated with the city's actions will be
