Cc: Alderman-at-Large Jim Donchess, Chair Infrastructure Committee Subject: No parking sign at 85/87 Palm Street. Dear President Deane, When, John Vancor was preparing for work to be done on the BSP. His assistant had the responsibility of recording where our No Parking sign was installed because it is the law to return it to the same place after the sidewalk work is completed. I do remember John Vancor talking about a lost parking space which I presumed was the one lost to the residents because of installing the speed hump on the west side. Nothing was ever said to me about the No Parking sign. We would like Ord. #0-00-24 reinstated in Sect. 320-69 of Ord. #0-12-025 to read as follows: Name of Street Side Location Palm Street West From a point 200 feet north of Kinsley Street north for a distance of 20 feet And, we would Like you to be the endorser. Sincerely, AMENDED O-14-033 ORDINANCE PROHIBITING THROUGH TRAFFIC ON THE UNNAMED STREET BETWEEN PEARSON AVENUE AND PARK STREET CITY OF NASHUA In the Year Two Thousand and Fourteen The City of Nashua ordains that Part II “General Legislation”, Chapter 320 “Vehicles and Traffic”, of the Nashua Revised Ordinances, as amended, is hereby further amended as follows: 1. In Article III “Stop and yield intersections”, Section 320-4 “Stop intersections”, add the following new underlined language in the appropriate alphabetical order: “§ 320-4. Stop intersections. … D. The following intersections are hereby designated as stop or through streets, and authority is hereby granted for the erection of a stop sign at the corner so designated in accordance with the tenor of this chapter: Stop Sign on Sign Location At Intersection of … Unnamed street connecting Southeast corner Pearson Avenue Pearson Avenue and Park Street” 2. In Article VIII “Certain Classes of Traffic on Certain Streets” add the following new section: “§ 320-30.1 No through traffic. Through traffic is prohibited on the following streets, with the exception of any vehicle owned and operated by the City and emergency vehicles: Name of Street Location Unnamed street connecting Pearson Entire length Avenue and Park Street” All ordinances or parts of ordinances inconsistent herewith are hereby repealed. This ordinance shall become effective at the time of removal or installation of the necessary sign(s). AMENDED 0-14-037 ORDINANCE INCREASING THE PERIOD OF VIABILITY FOR SPECIAL EXCEPTIONS AND VARIANCES CITY OF NASHUA In the Year Two Thousand and Fourteen The City of Nashua ordains that Part II "General Legislation", Chapter 190 "Land Use", Article XV "Zoning Procedure" of the Nashua Revised Ordinances, as amended, be hereby further amended by deleting the struck-through language and adding the new underlined language as follows: 1. In Section 190-134 "Special exceptions", subsection H: "190-134. Special exceptions. H. Scope of approval. A special exception shall authorize the applicant to apply for approval of a site plan or subdivision plan, if required, and a building permit and certificate of use and occupancy. A special exception shall be null ond void 12 months from the date of approval unless the applicant files a complete application for a building permit, site plan or subdivision plan within that time period. Special exceptions shall be valid if exercised within two (2) years from the date of final approval, or as further extended by local ordinance, or by the Zoning Board of Adjustment for good cause, provided that no such special exception shall expire within six (6) months after the resolution of a planning application filed in reliance upon the special exception. Any time to appeal a determination as to completeness of an application does not count toward the twelve month two (2) year period." 2. In Section 190-137 "Variances from zoning", subsection H: "190-137. Variances in zoning. ORDINANCE 0-14-037 H. Scope of approval. The granting of an appeal by the Board shall not exempt the applicant from any provision of this chapter not specifically ruled upon by the Board or specifically set forth as accepted in this particular case by a provision of this chapter. An authorized variance shall be null and void 12 months from-the date of approval unless the applicant files a complete application- for-a-building permit, site-plan, or subdivision plan concerning that parcel within that -time period. Variances shall be valid if exercised within two (2) years from the date of final approval, or as further extended bv local ordinance» or bv the Zoning Board of Adjustment for good cause, provided that no such variance shall expire within six (6) months after the resolution of a planning application filed in reliance upon the variance. Any time required to appeal a determination as to completeness of that application does not count toward the twelve-month two (2) year period." All ordinances or parts of ordinances inconsistent herewith are hereby repealed. This ordinance shall become effective at the time of passage.
