A regular meeting of the Board of Aldermen was held Tuesday, March 24, 2015, at 7:30 p.m. in the Aldermanic Chamber. President David W. Deane presided; Deputy City Clerk Patricia Piecuch recorded. Prayer was offered by Deputy City Clerk Patricia Piecuch; Alderman Chasse led in the Pledge to the Flag. The roll call was taken with 14 members of the Board of Aldermen present. Mayor Donnalee Lozeau and Corporation Counsel Stephen M. Bennett were also in attendance. REMARKS BY THE MAYOR I want to take a moment to thank all of the volunteers that are here tonight, many of whom will be sworn in tonight for the start of your service or the continuation of your service. Please know that your city very much appreciates it. I also look forward to congratulating our young investors in a few moments. I think this is the best piece of legislation that I have seen come out of this Chamber in a long time. There have been so many times that I have these pan handlers down by Ruby Tuesday’s at the jug handle. They are at Whole Foods waiving signs and you can’t see traffic. I have called the police many times saying that you have to move them because someone is going to get killed and it’s about time we start curbing all of this throughout the city. The last time I was down by Ruby’s I asked this young lady, don’t I see you up in Tyngsboro? She said I am only up there a couple of times. I said I think you are up there more, don’t you think it would be better if you got a job and she said I work part-time and I go to school. I said maybe you can fit another job into this or pay taxes on this money. It’s really a shame because I think there are some people out there that are homeless that do this but I think there are a lot of people that do it as their job. It’s easier to pan handle than to get a job. Thank you, Alderman Soucy for writing such a great piece of legislation. I hope it passes just to keep this city safe. Mr. Bob Keating, 5 Colburn Woods I am speaking on the same piece of legislation. I want to raise my concern about it. First off, I am pressing the need for it given the laws that are present within the city and the discretion of a police officer if there is a safety issue in terms of traffic. Why is it only the person making the request is subject to a criminal charge and clearly the operator of the motor vehicle is the one who is stopping and the incident is occurring from the person driving the motor vehicle? I think we are particularly targeting those who are making the request. There are people in other communities who make requests and hold up signs from firefighters who hold out boots and do toll roads to request money. I don’t see this in Nashua at present but there are people in Boston selling newspapers at corners and that was thought of as a way of making income and is still done this day. There are groups that hold up signs for car washes and in little neighborhoods for kids making money selling lemonade. This issue is about behavior that is not acceptable to many people who have been criticized for many years for pan handling. We went away from that and I’m afraid that this is a step back. This community has much to be proud of in terms of its address of people who are poor. We were the first community in this state to develop a plan to end homelessness. We were the first community in the nation of our size to do that. We have made tremendous progress. Last year we housed all of the people that we could identify that were chronically homeless and located. I think that is something that our community has much more to support, that Board of Aldermen – 3/24/15 Page 3 effort as being known as the Nashua that has done that than to be the second community in the state to pass a piece of legislation that is particularly targeted to those who are generally the most challenged. To add a little piece of statistics, I just looked at research that was done in coalition with providers in Nevada and they came up with those that are pan handling; 81% of them have no homes. About 11% are living with family and 7% have their own homes. In terms of those who are homeless who are pan handling, 81% had not pan handled before and about 19% of them had. There are things that are already in place that if there is a safety issue then a safety officer can address that. I don’t think that this adds to the well-being of our community overall. Thank you. Alderman Donchess I think she had a good idea too so I am going to vote no as well. Alderman Siegel This is where we have a difference of opinion. I think we already have people in the city that do this job and we had this discussion and it was fairly clear that it just didn’t seem to be anything that was practical. Alderman Siegel The amendment was very simple. I believe it was done at the first reading, it was just a minor date change and nothing substantive that was done in committee. The only discussions we had in committee about this is that I had made a motion that I later withdrew to change the polling times to make it easier on the polling people. The reason we chose this date was because the other alternative in April, the first Tuesday of April vacation, would have compressed the schedule for filing lower than the ten days that was typical. We would have had to actually kick the legislation back to change the funding source because part of this relies on the unspent funds from Alderman Sheehan’s stipend so if someone had been elected sooner we would have to kick that back. I also pointed out that people that were concerned about there being a gap in the budget process; of fifteen Aldermen last year, four did not attend any Budget Committee meetings and one attended one. There’s also the opportunity to watch them on TV and participate in public discussion for those people that are considering the office and want to make their views known. I think this is our best option and I would strongly argue that this is our only option at this point. President Deane Alderman Siegel, can you list the funding sources that were found in R-15-120. Alderman Siegel Yes, I can. One was Alderman Sheehan’s stipend up to the point that we believed somebody would be sworn in and the other funding source was the unused salary for the purchasing manager position. This came before the Finance Committee and we had a stock Cisco router that we had to pay over $2,000 extra for because of the procedures that were in place for purchasing. This allows us, for nationally advertised items over the web; to treat it as though they were open bidding because there is no more effective open bidding than the open market so we can save ourselves some money. Brown PROPOSING AN AMENDMENT TO THE CITY CHARTER TO ALLOW WARD ELECTION OFFICIALS TO FILE A DECLARATION OF CANDIDACY AND PAY AN ADMINISTRATIVE ASSESSMENT INSTEAD OF SUBMITTING A PETITION OF NOMINATION Given its first reading; MOTION BY ALDERMAN DONCHESS THAT R-15-126 IS NECESSARY, THAT IT BE ASSIGNED TO THE PERSONNEL/ADMINISTRATIVE AFFAIRS COMMITTEE AND A PUBLIC HEARING BE SCHEDULED FOR MONDAY, APRIL 13, 2015, AT 7:00 PM IN THE ALDERMANIC CHAMBER ON THE QUESTION Alderman Chasse What’s the necessity? Alderman Donchess The purchase of this is to make it easier for ward officials to sign up to run for a ward office. Right now for a state legislature you do not have to get petitions, you can simply file a $2.00 administrative fee and become a candidate for state rep. It is more difficult to become a ward official. The option of the $2.00 administrative fee, which is open for state reps, is not available to people who wish to run for selectman or moderator of a ward for the election officials. In talking with ward people as well as the city clerk, the fact that people have to go out and get the extra signatures is a deterrent for people who want to run for ward office and we have difficulty attracting enough people to serve in the wards. This would equalize the procedure. Alderman Chasse I don’t totally agree with you because I think people only have to go and get fifteen signatures and if you really talk to those Ward people, now you are going to say that they are going to have to put a stipend out there for them to become a ward, a moderator or whatever they do at the ward. Basically many years ago if one person wanted to be the moderator everyone that was working with that person would sign a piece of paper and it didn’t cost them anything. I don’t want to lose anyone because they are going to have to pay a $2.00 stipend at the polls. Board of Aldermen – 3/24/15 Page 10 Alderman Donchess That does not take away that option. You can still, if you wish, do the signatures and so can a state rep candidate. It simply says if you don’t want to go get the signatures, like a state rep candidate, you have the option to file a $2.00 fee. Alderman Chasse I’ll see you in committee. Alderman Soucy I think both arguments have merit. I am going to support it as I’d like to see it go to committee so we can discuss it. McGuinness Alderman Ken Siegel Alderman-at-Large Lori Wilshire PROHIBITING THE PASSING OF OBJECTS TO OR FROM THE OCCUPANT OF A MOTOR VEHICLE ON A ROADWAY Given its first reading; assigned to the PERSONNEL/ADMINISTRATIVE AFFAIRS COMMITTEE by President Deane ON THE QUESTION Alderman McCarthy I would like to ask that when that’s taken up by the Personnel Committee if it would be possible for corporation counsel to be present given the letter that we received last night. PERIOD FOR GENERAL PUBLIC COMMENT Mr. Jim Cutter, 86 Palm Street Dear President Deane, The installing, removing and replacement of signs is always the responsibility of the DPW. Certain members of the DPW were shirking their duties with updating the traffic ordinances to Board of Aldermen – 3/24/15 Page 11 reflect final Broad Street Parkway Plans of O-12-025. Updating the traffic ordinances could have been done by them going to the City Clerk’s office to look through the Code of Ordinances Binder for the active ordinances. When I complained to Steve Dookran, City Engineer and Lisa Fauteux, DPW Director about our missing No Parking sign they sent Wayne Husband to meet with me at home and after their review it was returned on 9/4/14 because it would not harm the Broad Street Parkway plans. But it was removed 5 days later because O-00-24 had been revoked. It should not have been revoked because O-00-24 is for the prevention of vehicles blocking our driveway and the free movement of our vehicles. Alderwoman Brown will not sponsor legislation to have O-00-24 reinstated. We will be grateful to anyone who wishes to help us. Sincerely, Jim Mrs. Paula Johnson, 15 Westborn Drive I think we have to go on-line and start Justice for Mr. Cutter and see if other people from other communities will help Mr. Cutter. What is the big deal of putting a sign up so no one parks behind his driveway? He’s a taxpaying citizen not a pan handler. I’ve been gone for a while because I was pretty ill this past fall and winter but it’s still the same problem. Not even his Alderman, Alderwoman Brown won’t help Mr. Cutter. She’ll put a handicapped parking sign but she won’t help him. She helps the people downtown but what about Mr. Cutter. It is a disgrace that nobody wants to help Mr. Cutter. I know you were probably happy when I was not here but guess what, I’m back. I’m not running but I’m back; my health is preventing me from running, otherwise I would have been on the ballot to take the seat from that woman who was so rude and nasty but she’s in North Carolina now. I won’t be able to be at the Infrastructure Committee meeting because I’m taking a class. I want to talk about 11-13 Mulberry Street. I did get a chance to read those minutes and I’m shocked. Alderwoman Brown is so concerned about buying that building for $300,000 but again, she won’t help Mr. Cutter. It appalls me that this is going to become another Broad Street Parkway; not knowing the true cost because there’s going to be overruns and it’s going to become another downtown sidewalk project that we will never know the true cost because we have nothing in writing. Where are our estimates to renovate the old building and to tear down this building? We are told that the building that houses our Public Health Department right now is only worth between $50,000 and $100,000 but we don’t have anything in writing from a professional. I went on-line to do a little research because if you don’t have your facts and figures straight, you look like a fool. The value of our building; the land alone of the Public Health Department is $38,800 and this is the assessed value which is always less than market value. The building value is $883,300 with the total value of $922,100. Alderwoman Brown, who won’t help Mr. Cutter, is more than willing to take that building and turn it into SRO’s, single resident occupancies with 10 to 11 studio apartments. My question is who is going to manage this? We are not in the landlord rental business. That’s not what government priority is. There’s fire, police, schools and public works. I don’t want to be in the rental business and have to chase people for money. If we were to sell the building, what is the value? I’m sure it’s more than $50,000 and $100,000 considering someone is going to want to come in and renovate this building to put studio apartments as Alderwoman Brown talks about. Alderman Moriarty was quick to say I’m for the buying of this building for $300,000 that costs $2 million but I came up and I said no, it’s not $2 million it’s really $3.5 million if anybody read the paperwork. The other question is, which Alderman McCarthy talked about, is what we find when we go into buildings. When we tore down the old Nashua South we incurred lead, asbestos, mercury and other toxic materials. We don’t know what’s in that building that we want to buy for $300,000 because we don’t have any paperwork in front of us; we are going in sight unseen. We are saying that building is worth $300,000 but because the Health Department is going to kick in $50,000, it’s only $250,000 but that $50,000 came from somebody so it’s really $300,000 no matter how you look at it. What is the cost to buy the building, see if there are any toxins in the building and to remediate the building when you tear it down and haul the toxins away and then renovate the building? We talked about that when I was on the Board from 2002 – 2005 and nothing was ever done. Unless you have a purchase and sales that talks about everything contingent upon any toxins and what the true value of this building is, I would proceed with caution. We don’t need any more spending of money. We don’t even have any priorities on what our priorities are going to be on this Board. My biggest project would be that we need money to fix the roadways but instead we gave the money to the downtown and that money should have gone into a fund to fix the streets. Alderwoman Brown I would like to express condolences to the Markum family and my thoughts and prayers are with them. Alderwoman Melizzi-Golja I would also like to express condolences to the Markum family and a thank you to all of the volunteers who were here this evening and congratulations to the members of the Youth Ambassador Program who completed their eight weeks of training. Alderman Siegel I would like to let everyone know that there is going to be a Ward 9 Informational meeting on Monday, April 6th at 7:00 p.m. at the New Searle’s Elementary School and everyone is invited to attend, even outside of Ward 9 if you are interested. I would also like to thank my colleagues for helping with the Nashua PTO Benefit Fund. Alderman Schoneman not only attended but donated a nice auction item which led to a pretty hilarious auction. Thank you to Alderman Chasse and wife and Alderman Caron, Alderman Donchess, Alderman Wilshire and Alderman Deane. Also, thank you to Sgt. Bolton of the Nashua Police Department and Doug Rapsis of NFR. Thank you to the New Searle’s PTO for stepping up and helping out the night of the event. Alderman Moriarty I am hosting an event, the Nashua Citizen’s Forum which is open to all citizens at the New Searle’s Elementary School café on Monday, March 30th. It will be an Aldermanic review. Alderman Soucy I want to thank everybody who has taken an interest in O-15-046. I have never received so many phone calls in my 1 ½ years and never saw so much activity on Facebook and in the paper. Whether you are for it or against it thank you for taking an interest and I would encourage everyone to come down when it goes to the PAA and to the full Board to get involved in the discussion. Alderman Caron I would like to send out condolences to our former Deputy City Clerk Pat Lucia who lost her mother-in- law this week. She was 98 years old. Alderman McCarthy At our last meeting Alderman Chasse had asked me to look into the issues with the roof at the Dr. Crisp School. Apparently there were some leaks that have been corrected. You’ll be happy to know that the roof on that building is scheduled to be replaced this summer. The pre-bid conference on that is tomorrow. I am told that there are currently no active leaks in the roof. On a personal note, my son participated for the second year in the 24-hours of Stratton Ski Race and he finished 4th in the fundraising with a little over $5,000 and his team finished 4th in overall fundraising. In the race itself he finished 3rd Board of Aldermen – 3/24/15 Page 13 having done 174 runs for 144,000 vertical feet in the course of 24-hours. I think he was only off of his skis once for about 15 minutes at 3:00 a.m. President Deane Congratulations to him, that’s quite a feat! Committee announcements: Alderman Moriarty There is a Finance Committee meeting on April 1st and a Pennichuck Water Special Committee on the 7th and of course, Monday, March 30th there is a citywide, come one, come all at the New Searle’s Elementary School. Alderman Donchess Tomorrow night there is an Infrastructure Committee meeting at 7:00 p.m. in the Aldermanic Chamber. When, I complained to Steve Dookran, City Engineer and Lisa Fauteux, DPW Director about our missing No Parking sign they sent Wayne Husband to meet with me at home and after their review it was returned 9/4/14 because it would not harm the BSP plans. But, removed 5 days later because our Ord. #0-00-24 had been revoked. It should not have been revoked because Ord. #0-00-24 is for the prevention of vehicles blocking our driveway and the free movement of our vehicles.
