A meeting of the Finance Committee was held on Wednesday, April 21, 2010 at 7 p.m. in the
Aldermanic Chamber.

I just have a question. It’s such a long contract is that typical for this type of work?

It’s such a long contract?
Alderman Pressly
Yes. It’s I mean it goes it seems it’s quite unique and I think it’s a little bit different from the
others. Is that because it’s the type of project it is?

That is the reason. But they do believe the website will be up operational by July 1st, and there
are some components of that will go online later.
Alderman Pressly
Okay.
Mayor Lozeau
For instance there’s a ticketing system so they will be able to buy tickets online. But that’s not
likely to go live right away. And so, you know as they develop. . . (inaudible)
Alderman Pressly
I have a second question. Another alderman asked me to inquire, who awarded, who chose
this vendor.
Mayor Lozeau
The vendor was chosen by committee.
Alderman Pressly
By what committee?
Mayor Lozeau
Usually it’s made of the purchasing manager, the transit director; in this instance I know there
was somebody on board, Mr. Gabriel, IT, so they looked at the vendors. I know that the
question is probably specifically why didn’t we go with the local vender because we have
somebody right here in Nashua.
Alderman Pressly
That was not my question but someone else’s.
Mayor Lozeau
Okay, I know and I understand that and it’s a priority of mine. And the reason that that
happened was because the local vendor was unable to get a disadvantage business enterprise
DBE. Let me make sure its enterprise. It is. They were unable to get that and in order be
awarded this contract with federal dollars they had to be considered a DBE. And that local
vendor understood that, tried to get it and couldn’t make it happen. That’s why.

Just a quick note. I know that this is from the American Recovery and Reinvestment Act. my a
question is more general to that. I would like to see the amount that the City has received from
that Act thus far. And how much we have appropriated. or about to receive. Just because I
think that it would be good to have people know how much we receive from that.
Mayor Lozeau
Actually we have a list we look at. I can tell you that the federal stimulus dollars for
transportation projects like this are different than other ones. When you look at things job
creation and things like there’s doesn’t have a requirement like that. So, it might be worth while
for on the list when we give it to you to kind of differentiate some of that as you know we didn’t
take any for operations. The school took some dollars I don’t know that we have a list broken
out, I guess we can look at that we do have the that broken out? Mr. Gilbar? It’s not up to date
he said. and then the other projects we took it for were the sewer projects. And I always of
course made sure that people knew what we were . . . I would be happy to put a comprehensive
list together so you just have it.

Well of course.
Alderman Deane
I guess this is a good thing. I just can’t support the funding source. I the American Recovery
and Reinvestment Act I this is supposed to create jobs. I don’t know if it did or not, it just seems
like everybody is out with their hand out taking money and spending it on foolishness like this
that nobody will . . . we’ll all be dead by the time its paid off but. I just really struggle with some
of this federal money. And I know that if we didn’t take it somebody else would so.
Mayor Lozeau
Alderman Deane, I can’t argue with your case as a matter of fact I was telling legislators today
that the US Conference of Mayors has sent around something for to me endorse with them for
legislation for 75 billion dollar piece of legislation that’s pending before congress right now that
mayors are signing up for that would end up getting Nashua $10 million dollars. And that
money is operations money. , keeping employees employed for two years. And I’ve refused to
sign it because I don’t think that I don’t think we should be taking money like that. And as you
know we’ve not used any money for operations. We’ve used it for some of the projects it
seemed to make sense but I’ve tried to make sure that we didn’t take it in a way that we are
dependant on it. The federal transit authority dollars are not necessarily related to job creation

they are related to things like modes of transportation connecting systems. Like you will see
this website will have a trip planner on it so someone can go in and say I want to go from the
Nashua Mall to the Pheasant Lane Mall. And I don’t want to go just by bus. So it will be able to
plan a trip out for them and say well you can take your bike from this point to this point, and then
the bus from here to here, and then you know you could end your ride this way and you could
put your bike on the bus. You know that sort of thing. Those are things that some of these
stimulus dollars are looking for is to better connect some of the existing infrastructure and that’s
why I bought into the argent about how to use this. Plus I wanted to make sure that it looked
like the City website. I didn’t want to be hosting some other website, so tried to be very careful
about the dollars we chose for this. And for any of the projects frankly.
Alderman Deane
Well, I would hope there is a counter on this website so we can see how many times some of
these components are utilized. You know that’s visible to the public not just to the
administrative side of the website and just I just and as for I commend you for not signing into
something I mean I guess that’s a political issue if these people can’t understand how to operate
within the confines of the economy to sustain the operations and keep the vitality of their
communities alive without begging the federal government for more money, their asking for
revenue to meet to sustain their operations and in two years they are not going to have that
money any more and then what do they do? You know there comes a point in time when
people have to bite the bullet and look at and start dealing with reality and a lot of these
communities thank God we are not one of them when I saw an article in Manchester on how
they were patting themselves on the back about putting $500,000.00 into their undesignated
fund balance account to bring it 6.5 million and look back and I think what we did in this
community and where we stand today with the economic times we have, you know we did a lot
of hard thinking and made a lot of hard decisions and that’s why we are in the shape we are in
today. You know, we didn’t spend beyond our means. And a lot of these communities and the
State we live in is one of them.
Mayor Lozeau
Well I think that, and I’ve said it since I got here with my first budget that there were policy
decisions made by this board long before I came along put us in some good financial positions.
What I am concerned about and remained concerned about is the ability to spend money on our
infrastructure and I think if the federal government really wanted to help communities and
stimulate anything the investment in infrastructure building, fleet, roads, you know those one
time expenses to get caught up where communities haven’t been caught up because they
made other choices or didn’t have revenue available would have been a better way to invest
those dollars they if in my perfect world Nashua could be self sustaining without the help of the
State. But with education costs the way they are, I just don’t see that being possible. But if it
was . . .
Alderman Deane
But the folks you talk to you were you know asking the federal government for money to pay for
health care, pensions, and salaries.
Mayor Lozeau
Manchester is bonding school books. So different choices different circumstances. Anyway, so
I think we’ve made good decisions. I think this is a reasonable amount of money to take to put
into this. The money was designated for communities specifically for this kind of use and like I
said it’s not an operating cost so.

Alderman Clemons
Just briefly on the on the just so I can get on the record I agree with the decisions that you’ve
made Mayor and I certainly agree with the fact that we shouldn’t be using stimulus dollars to
fund operational costs for the most part. I think there may be some exceptions to that there is
exception to every rule but in general I agree with you.

There seem to be quite a discrepancy in the bids that were received. What was. . .

If you look on the page six, page seven. If you look at the metrics. I know the page you are on;
you’re on the page that lists everybody with the dollar amounts?

Well I go from that then it goes page three and then it goes back to page one again.

See this page here Alderman Deane that looks like metrics chart? It’s on the back of the sheet
that has all the it says bid results?

The one you just referenced?

Yes.
Alderman Deane
The good, good, and very good.
Mayor Lozeau
Right. According to the Jordan Institute who’s the one that wrote up the comments on the right
hand column, the company that you know when you look at like Dubois and King, which is
one of the higher ones. And those after it. They really had a sense that they really didn’t know
the project well enough, that it was not something that they were necessarily comfortable with
that they might have to get other subs involved. Whereas Colby had come in they felt they
were confident that they knew the building they had worked before with them on a similar type
of building, same kind of age that sort of thing. And they were more confident with them. As a
matter of fact , the one of the things that helped with them with this choice is that they can help
with relocation of the units on the roof. Because they actually have a structural engineer on
staff. so that’s another reason that their cost was less. Because they have some things
available to them that other companies would have to pay for.
Alderman Deane
When is this ...
Mayor Lozeau
Well the HVAC work should be completed by October. This design work should be m
completed by ser. which should give us a chance to have the rest of the work done.
Alderman Deane
So if that’s the case then if we have the design work and we know where the curbs are going to
go then we should be able to have the roof done and curbs covered anyways until they get here
is that the plan?
Mayor Lozeau
Well part of what they are talking about right now, I’m waiting to see their final decision on some
of that. Part of what they are talking about is what pieces of the project can happen
concurrently. So like the windows can happen at the same time as the HVAC work. One is not
going to hold up the other. The roof work, I think some of it is going to be determined on what
kind of units go on the roof. Some have talked about doing the roof first and then putting the
units on it when it is complete. Others have talked about being up there on the roof; put the

units in place before the new roof is set. And they talked about it makes a difference on what
kind of units they have. And I don’t know what that final decision will be made during the design
phase.
Alderman Deane
Well the units normally just sit on a curb. Which is a rise unit curb. They just sit on a curb I’m

Well, the units we have up there now sit on the old sky lights.
Alderman Deane
And that’s the curb.
Mayor Lozeau
Yeah I know. I’d like not to consider the curb. I wish they wouldn’t have used it.
Alderman Deane
Well, it’s still a curb I mean that’s what it’s utilized for but, and the roof’s leaking.
Mayor Lozeau
We have problems with the roof. I mean its not horrific, but . . . the right time to do it.
Alderman Deane
It would just seem to me that, it would seem to me that once this design was done and they got
they’ll know what size units are going to be up there with the tonnage and everything that they
could get rocking and rolling on the roof, because really the unit placement probably isn’t going
move much if at all and if anything the curbs would be downsized cause the units might be
smaller or whatever but they will have locations for ducting and everything at that point. And we
could get the roof done cover the curbs until such time as you know they come and crane them
up and you know take off the old and crane up the new.
Mayor Lozeau
That’s absolutely part of the discussion. But I think . . .
Alderman Deane
But we are looking at October, then its November then its snowing again.
Mayor Lozeau
No. The design work is going to be done long before October. The roof work can be done over
the ser.
Alderman Deane
Oh, I thought I heard you say October was when . . .

For the completion of the HVAC work. For the actually units everything done. Buttoned up and
running by October.
Alderman Deane
So when are you going to know how they are going to attack the roof and this.
Mayor Lozeau
We think we are probably going to know the June? Mr. Gilbar did you want to add something?
Michael Gilbar
We are trying to coordinate the windows with the roof with the HVAC so that there is not a lot of
...
Alderman Deane
I don’t care about the windows. I mean I don’t care about the windows. I mean I care about
them but I don’t care about when they do them that has no effect on putting a membrane up
there and building curbs and dropping units on there you know.
Michael Gilbar
No. My point is that what we are trying to do is to coordinate everything so that, we are trying to
do the windows first but if you do that there’s no air conditioning in some of the areas of the
building and so we are really trying to coordinate everything so we had it we had as little time . .

With no condition space?

So we are trying to work out a phase in that will allow us to do that and get everything done.
Mayor Lozeau
That’s why I’m pretty confident the roof will be done you know, before you know, no later than
the fall. We are not going to go through another winter with that roof, that’s not the plan.

And what are they specking that roof at?

I don’t think we have even . . .

I just didn’t bring it in tonight with this.

And when the roof is done, the HVAC is done which includes the boilers, which is part of this
right? Cause they seem to get away from the heat pps. And the windows are in and the front
steps are done.
Mayor Lozeau
Steam traps, we are doing the steam traps too.
Alderman Deane
Well the steam traps are part of this isn’t it? What I read it was. But so when the heating,
ventilation and air conditioning is done, and the roof is done and the windows are in and the
front steps are fixed their done here?
Mayor Lozeau
No. We have door work that needs to be like the front door but I’m hoping to make that part of
the front step . . .
Alderman Deane
But the Jordan Institute should be done here right.
Mayor Lozeau
The Jordan Institute should be done here.

So after so we so after this we cut them loose we don’t have any more obligations with them for
anything else?

In this building but they’re still working with us on our energy efficiency plans for all of the
buildings they’re doing that assessment with our energy dollars. It’s different from this project.
That work should be wrapping up relatively soon.
Alderman Deane
And then they are done.
Mayor Lozeau
Well when they’re done we’ll have long term energy plan for every building in this City.
Alderman Deane
Yeah. But when do we get to. When is the financial liability with these people over? How
much more money are we going to be spending?
Mayor Lozeau
We should be spending what we agreed to.
Alderman Deane
What was that total?
Mayor Lozeau
Off the top of my head? I don’t think I can answer that tonight. Their dollar amount is part of the
City Hall project amount. And their dollar amount for doing the energy assessment $243,000.00
something like that . . . two fifty. I mean I don’t want to give you wrong information I keep a lot
of numbers in my head but I don’t want to, two forty three is pretty close to two fifty but I’d still be
wrong by seven thousand.
Alderman Deane
And the bond that was floated . . . this was cash right. This is the 1.5 million, okay so
$919,000.00 left after this $40,000.00.

I remember some if this 1.5 went to the library.
Alderman Deane
I thought it was 1.2.
Mayor Lozeau
. . . With their roof and their that’s what’s left at the cause the library took.
Alderman Deane
The library got $250,000. For the roof and associated brick work or whatever else and then
they . . . 20 something was it $27,000.00 did they ever do the carpet, they never did the carpet.
Mayor Lozeau
They did do some of the carpet I think. Or they are trying to do some of the carpet which was
left in the amount that they got their roof at a lot less money because the roofer was already in
the City doing another roof so it saved a significant . . .
Alderman Deane
And they didn’t have to stage and all that other stuff cause they were here.
Mayor Lozeau
So they were capturing that remaining amount and planning on replacing the carpet.

Would it be possible to get a breakdown of what we spent to date on these you know, between
the library and here?
Mayor Lozeau
Sure.

I think they’re I want to say there’s $17,000.00 left that they’re raising. I’m pretty confident that
they’re going to have it. I think it’s amazing that they’ve raised what they raised.

Thank you. what do we do with the old units?
Mayor Lozeau
We. . . the old units are coming in to the IT Department, and then we will determine based on
needs and priorities that Mr. Barker is trying to set for other divisions where they might go if they
are able to be used. The last set went to the Fire Department. and they were not really able to
be used by them. So we have not made a decision but we have now agreed that all of the
equipment like this will be first Mr. Gabriel will be notified when the equipment is available and
then a decision will be made on who is going to responsibility. In this case, it’s been determined
that IT will take responsibility for redistribution.

And the other question I have and just I’m interested in how do they , how do they do their
connections to get to the state database. Is that all out of antenna in the car? Or how does that
work?

I don’t know if this is proprietary information Alderman Deane might by the cruisers and make
them not so that they can’t look anything up.

Hopefully the cruiser wouldn’t be sitting there long enough for somebody to do anything to it with
nobody around it.

we are currently using the radio system infrastructure that’s already in place and so that
connects back to the station which in turn is connected to the state.
Alderman Deane
Oh it’s through the radio system.

That’s right.

I remember that now that you say that.

So is that is there any other internet connection on there other than that? That’s the way it’s
used?
Peter Cinfo
Yep.
Alderman Deane
. Why did the Fire Department find the units unusable? It just didn’t fit their needs? Or the lap
tops were beyond they didn’t have the capabilities . . .
Mayor Lozeau
They had some but they didn’t really fit their need they thought that they were going to have
other capabilities that they didn’t have when they received them. It doesn’t mean that we might
not be able to use them for something else but we really don’t know. And this will be the first
time Mr. Barker will be able to take a look at them and see.

What’s the operating system on those?

Well, you think somebody could use them for something. I hope so. I’m sure you will let us
know if we have success.
Mayor Lozeau
I will. you know we are trying to do this with as you know we have all the computers now in a
five year cycle and when the budget comes in you’ll see that we’ve moved dollars for
computers out of individual departments and divisions and put it into IT. In effort to keep that
five year cycle and then have the equipment again go through IT and be redistributed
appropriately. We have places where you know we have ten and fifteen year old computers
that we can take the five year computers and at least temporarily replace the 10 and 11 year old
computers and people would still be ahead. so it’s really put a lot of time and effort into looking
at how to redistribute some of the equipment that we can’t replace as quickly.

after purchase of $261,995. It should read $389,795. And you’ll see why as we go through the

I just want to say that I think list is very appropriate particularly the Simon Street I mean Ledge
Ledge to Simon Street. I drive that every day and it is absolute mess so. I’m happy to see that
that on the list. But one of the I just had a question as far as Sunshine Paving. Is as is it says
is new to the City and one of the things that I didn’t see and correct me if I’m wrong but Is there
a contingency in this amount at all or are we pretty certain that they are not going to spend
above Six eighty eight.
Mayor Lozeau
Well, we are pretty certain that they are not and typically if they do, they will take something out
of the list, but actually because of the price they came in at we think we’ll actually be able to do
more streets there some more dollars in the account we might be able to do some of the fiscal
10 contingency streets in addition to the list that you see. and let me give you a little bit of
information about Sunshine Paving.
Last year I was really concerned , the Board of Public Works meetings about oh, feeling like
there was nobody bidding on the projects. I think we talked a little bit about it in finance too that
it seemed like it was Brox or Continental and then last year Continental didn’t bid and so Brox
came in with a bid and some of the small companies kind of looked at it and uh never mind.
You know they’re kind of big boys and so they didn’t bid. This year, Mr. Gabriel worked with
the engineering department and identified more paving companies and actually sent out
solicitations to a lot of them. And Sunshine Paving is right out of Hudson. I thought they might
be new company but they’re actually not a new company and so they did some due diligence
on them, checked their references in other communities and they’ve done significant projects
like this in Lincoln Mass., Lowell Mass., Gloucester, Chelmsford, all their references were really
great. and they do more than just street paving, so we are pretty excited to have this new
company coming into our market so. Good thing. Further question?

Thank you, that’s the Motion. And just to remind everybody because these things come in and
out so quickly sometimes, different parts of them and this comes up a lot because people say
well we never finished paving Amherst Street. Or we didn’t finish paving Main Street or didn’t
finish paving you know, Amherst Street Main Street, Beech Street are all streets that during the
due diligence of camering and getting ready to do the work discover that there were problems
and so like Amherst Street is the one in front of Holman Stadium where you are driving along
and its nice pavement then it stops and then its nice pavement again. Because we purposely
didn’t pave there because we found these problems. The other three streets, the other two
streets, well no three. Tolles, Wilder, and Holman were because we had sewer failures and
that’s why they are on the list. Just so for those of you that like to keep track of that just
thought I would point that out.

It’s nice to see that we had six people bid on this project. It seemed like park construction even
though they are very good and reputable company it’s nice to see someone else and come in
and substantially underbid and we hope we get the same cooperation and quality at park office
the city through their work as well.

attempt to go out there and solicit more interest in projects so that we have a better pool of

It’s a transformer type of vehicle but it’s you know we are looking we are spending a
$125,000.00 on this right? Between the components and the

It replaces two vehicles. I mean this is a I was going to explain it when we took the motion but.
This is one of those think out of the box things that I’ve asked the staff to do as we’ve been
doing the fleet assessments on. What else can we do? We have a lot of trucks that are
seasonal trucks that go out of service depending on the season. They sit there and get no use.
m and that’s not necessarily good for the trucks either. So what else could we do? There are a
few communities in New Hampshire that are using these. Keene has been using them for more
than five years now and has had great luck with them. Bringing this truck in gives us an
opportunity to really test it out. and then we can have streets look at the same product and
others. It’s designed so that the you’ve seen the large tow trucks that will pull up to specialty
kind of vehicle on a the tow truck will drop its bed and then they will pull with a hook you know. .

I think you are probably right. Except where Nick did look into whether the other municipalities
that were using them had a lot of trouble based on that and they weren’t, and the life of the
equipment and the other pieces that they put on. They last longer. So they can replace the cab
and chasse again and still have the packer body the sander and other things that can go
through a second truck before you have to start replacing those pieces. So I mean I you know I
happen think it’s a pretty creative solution to a pretty significant problem that we have. I think
from my perspective the biggest challenge with this truck is going to be the new emissions
standards which all the bigger trucks are coming out with its I like to call it the 21st century
version of the catalytic converter. Where it has the double chamber, it catches the exhaust,
runs it back through the engine again and cleans it. sort of with like fertilizer actually. Just with
the cost of fertilizer is going up.

I hope they don’t have the same value as the average catalytic converter does today.

Well, the don’t have the plating in them if that’s what you’re

place of what three vehicles?

Well he has it as a flat bed, or a trash truck, vehicles used for plowing and sanding on city
streets and schools, picking up trash in city parks, hauling material, transporting pallets of
fertilizer, lime and other well, you can do that in a pick up truck. The new vehicle will multiply
back options. Back options should allow the department to eliminate the two vehicles listed
above instead just one. But, the one thing is that the park department isn’t going to have two
trash trucks. I mean they historically they’ve always you know taken one of the last leg trucks
from the land fill which I guess the land fill is filled with right now. But , so and the trash pick up
is seasonal anyways. Well they just started last week I think they started picking trash up at the
parks I know our ball field got our barrels picked up. Thank you very much. , and then that
goes on until October maybe? When football is done and but I mean the route breaks down
because the facilities start. . .

Accept that this an opportunity for us when have trash truck down, that we could use this in
some of the smaller streets, and some of the smaller routes to help. And we’ve had significant
challenges with those trucks which you’ll find out at our fleet assessment meeting Monday night.
and we just haven’t had options. So you know this is just another opportunity. So. I mean I
think its great we are starting to think about how else could we do this. So.

So if you think about it; well see you’re never going to you’re never going to reduce any vehicle
counts anywhere else but here though really.

Well I think you could we are thinking that you can in streets, and you can in parks. Solid
Waste, maybe? But that’s going to be more dependant on you know.

They pick trash, that’s what they do.

Well, they pick trash; they pick up soft yard waste, they you know if we expand recycling there’s
going to be some components to that. so these are all things in the mix. I think you are going
to be very impressed with the work that the staff has done doing the assessment of our fleets.
And what we need and what when we look ten years out, and I’m very pleased with the end
product of their work.

meeting as you probably do remember. But this is like one of the what now what the Public
Works Department is starting to get out of the hydraulic business. Which is not necessarily a

Street Department for five to seven months and not been moved, waiting for them to be fit up so
I think having the things go out and having the components and hydraulic systems put on I don’t
think is necessarily a bad thing. There was a point in time where all the hydraulic components
were built down there from scratch. The oil boxes, everything.

It’s awaiting our action and then full Board of Aldermen action, whatever our recommendation
is back to the full board. they’re looking toward to getting started. we’re all; I think the
agreement with 505 is almost complete. The I’m trying to think of what’s, there is discussion
that is probably going to go before the Board of Public Works relative to landfill trash and things
like that of that nature, but they’re ready to get started. They’re actually a little bit behind
schedule because there were things that we required in the contract that took some
negotiations.

The Labine project contract was a P.O. with the terms on it so it was a Purchase Order with
the terms on it. A contract that is required by the funding source will be done. That works from
the purchase order. The purchase order has been filed with the City Clerk’s Office.
And then the credit card information I have it here, and I will give it to you on the way out.

So in lieu of a contract, we did a purchase order and then the contract, and the contract comes
afterwards?
Mayor Lozeau
No actually Alderman Deane a purchase order is a contract, and the purchase order was drawn
on a verbal contract based on the timing and for the purposes of making sure that there isn’t a
problem, that verbal contract that was part of the purchase order is being, has been drafted to
make sure that it is clear and it is on paper so everybody understands what it is we got for that
$50,000.

And when will that be available?

It’s, I think it is completed so, the purchase order has been filed with the Clerk because that is
the contract that went with the memorandum. If you would like to see the contract that is written
