REPORT OF THE FINANCE COMMITTEE JUNE 20, 2012 A meeting of the Finance Committee was held on Wednesday, June 20, 2012 at 6:20 p.m. in the Aldermanic Chamber. Mayor Donnalee Lozeau presided. SOURCE OF FUNDING IS: BROAD STREET PARKWAY PROJECT, ACCOUNT NUMBER AS PROVIDED ON AGENDA ON THE QUESTION Mayor Lozeau This is an opportunity for us to do some of the right-of-way work so we don’t get behind on the project. These are the companies. There’s a list of companies on the state bid. All of them were solicited, and these are the ones that have responded and that have been recommended. Alderman Pressly Any changes? Any changes in the plan and the appraisal? Mayor Lozeau No. Alderman Pressly No. How much land does the city own on the west side of the parkway in the Millyard? Finance – 06/20/12 Page 2 Mayor Lozeau I don’t think I could tell you specifically. The interactive map is on the website now. Alderman Pressly As you know I live on the east side and I talk with people that have the buildings there. I bumped into a gentleman the other day and he said that the parkway will really from the east side there will be no possibility for parking. I’m wondering if that’s been a consideration at all. The west side and the city-owned land does have a lot for future parking. Mayor Lozeau Right now they already have a parking problem in the Millyard. Alderman Pressly Right. Mayor Lozeau So this is not going to make that problem worse. Alderman Pressly It cuts it in half so the east side cannot easily get to the west side where there’s more land. Mayor Lozeau But the property owners in question don’t necessarily own property on the east side today for parking. Alderman Pressly Right. Mayor Lozeau So we’ve been meeting with them and the engineers to see what we can do about drafting driveway access points and see if we can solve some of the parking concerns that have been out there. I’d like to try to solve them. I think we all would but there’s also, more than one of them are interested in buying the city land that we do have for parking for their parcel. So we have to be somewhat careful. Alderman Pressly Is the city considering making that parking space. If you revitalize and you bring in all sort of new people and jobs and all, we are going to need parking. Is the city sort of saving that land for… Mayor Lozeau The city doesn’t have plans for that land right now but discussions have been had about parking. Whether it will be that spot or another location, we’d like to involve some of the business owners with some of their land. Look at maybe doing a single deck of parking somewhere. We’ve had some conversations with Clock Tower with their underground parking. There’s some issues with 18-wheel trucks that are driving over that service some of the other buildings. Those are all the things on the table that we’re discussing. Finance – 06/20/12 Page 3 Alderman Pressly Okay, just as long as somebody is considering that. Mayor Lozeau We are. I don’t know what the solution is going to be, but we’re trying to put it all out there. Alderman Caron Do they have a time span to get this project done? Mayor Lozeau Our goal is that the parkway should be completed for December, 2014. I hope we make it. We’ll try hard. MOTION CARRIED From: Robert Gabriel, Purchasing Manager Re: Purchase of Flu Vaccines for 2012-2013 Season Requested by Public Health Department Value: $15,151) MOTION BY ALDERMAN CHASSE TO ACCEPT, PLACE ON FILE AND AUTHORIZE THE PURCHASE FROM GLAXO SMITH-KLINE IN THE AMOUNT OF $15,151. FUNDS ARE AVAILABLE IN COMMUNITY HEALTH ACCOUNT: VACCINES & MEDICINES, ACCOUNT NUMBER AS PROVIDED ON AGENDA ON THE QUESTION Mayor Lozeau This is our annual. Alderman Craffey Do we know the number of doses we got last year? Mayor Lozeau We usually get about 1,500 doses; I’m pretty certain. It’s the same generally, and we get credit for the doses that we don’t use. They’ll accept them back. Alderman Craffey Do we know how many doses we gave out last year? Mayor Lozeau I want to say that it was 1,200 but I can’t promise. It was pretty significant. The people that can pay for their dose, pay and then we also bill Medicaid as well. Alderman Craffey This is offered at the clinic or do we go to the senior citizens and offer it there? Finance – 06/20/12 Page 4 Mayor Lozeau We have from time-to-time moved to different locations depending on the organization. Sometimes we have gone to the Senior Center. I know with staff sometimes, they will move around when we do the staff vaccines. The schools, we’ve talked about going to schools and partnering with them. So we do do that when people are interested in working with us. MOTION CARRIED From: Robert Gabriel, Purchasing Manager Re: Purchase of Replacement Robotic Survey Equipment (Value: $20,550) MOTION BY ALDERMAN CHASSE TO ACCEPT, PLACE ON FILE AND AWARD THE CONTRACT TO NEW ENGLAND LASER & TRANSIT IN THE AMOUNT OF $20,550. SOURCE OF FUNDING IS: SURVEY EQUIPMENT ($2,500), SEWER MAINTENANCE ($7,050), SOLID WASTE EQUIPMENT ($1,000) PAVING ($5,000) AND STORM WATER ABATEMENT ($5,000), ACCOUNT NUMBERS AS PROVIDED ON AGENDA ON THE QUESTION Mayor Lozeau We took this up at the Board of Public Works this past week. Their survey equipment had to be replaced. There was an opportunity here for them to get another robotic set. They were able to get the demo unit for the same price as getting the regular equipment that wasn’t robotic. This is an advantage to us because this is something a staff member can do on their own out there. Just thought I’d let folks know that. MOTION CARRIED From: Robert Gabriel, Purchasing Manager Re: Main Street Lights Change Order #1 (Value: $45,500) MOTION BY ALDERMAN CHASSE TO ACCEPT, PLACE ON FILE AND AUTHORIZE CHANGE ORDER NO. 1 TO THE CONTRACT WITH UNION METAL CORPORATION FOR A NET CHANGE IN THE AMOUNT OF $45,500. FUNDS ARE AVAILABLE IN THE STREETS ACCOUNT: MISCELLANEOUS EQUIPMENT, ACCOUNT NUMBER AS PROVIDED ON AGENDA ON THE QUESTION Mayor Lozeau The reason that there’s a change order is because the first one that we took up in finance was specifically for the six lights that are on the bridge that are the ones designed to match what had historically been there. These are just the next ones for the remainder of the sidewalk on those two sides. You can see the list on the next page. Then three for the West Pearl Street, West Hollis Street side. Alderman Pressly It says just for the poles. Does that mean it’s the whole light fixture or just the poles? Finance – 06/20/12 Page 5 Mayor Lozeau No, it will include the light fixture. Alderman Pressly This change order for additional light poles is the amount of $45,000. Mayor Lozeau I think that’s just what they Alderman Pressly Call the whole thing? Mayor Lozeau I think so. Alderman Pressly With this expense that will take care of all of the lights that are going to be replaced on all of the front.. Mayor Lozeau No. This is only for the areas listed on the memo. Main Street Bridge, Water Street, Main Street Bridge, and Pearson, Pearson and Park, Main Street Bridge and Canal and West Pearl and West Hollis. Alderman Pressly I think I have to ask. It’s really alarming to see what’s happening on the Main Street Bridge. What is going on with the part that they are doing now? With all those huge cords. I don’t know what they are but it looks. Mayor Lozeau Conduits. Alderman Pressly That looks rather intimating. What’s happening with that? Mayor Lozeau It is. They’ve done a great job. The reason that we started with the bridge, I’ll just refresh everybody’s memory, was because the side of the sidewalk that they are on now, the east side, had been collapsing, sinking. Not the bridge, but the sidewalk. We knew that it was because we had problems with the conduit. We did some excavation and looked and checked and that in fact was the problem. It also was the problem on why the Main Street lights kept going on and off as Alderman Deane would frequently report to us that the lights were out. So we knew there was a problem there. We also had a leak in the storm water drainage there that was also washing out underneath. We knew that we were going to find a lot of problems in there because the way that they had encase that conduit. It was not the best way that it could have been done. Right now they’ve gone through. They’ve cleaned it up. They’ve identified all the lines. The owners of those lines are coming in. We’re recasing them. We’re going to put them in the proper Finance – 06/20/12 Page 6 cradle that they need to be in, and we’re going to use what’s call a flowable fill that will level things out and float them at the appropriate level. Then we’ll close up the sidewalk the way we should and be able to finish the job. Alderman Pressly How far do they go down the street? Mayor Lozeau They go pretty far. Alderman Pressly So you’ll have that same situation all the Mayor Lozeau As you know all the utilities on Main Street up to city hall are underground. Alderman Pressly Right. Are they all on that side of the street so every time you take up the sidewalk we’re going to have those conduits? Mayor Lozeau I don’t believe that the entire length of the conduit is in the sidewalk. Some might be in the road in the street area, but I’m not exactly certain. But we knew that those were there and we know that they’re in front of the Telegraph building, and we know they’re in front of the Framery and that’s where we’re doing some work now. Alderman Pressly Just a further comment, I must again say that I’m not going to support this beaus I don’t support buying these lights. I think it’s absolutely critical not only for the Board of Aldermen but for the public to have a public discussion of this. I know it’s been presented to a lot of groups, but not to the Board of Aldermen and we’re the one that represent the people. I think this is a big enough project that affects so much of the city. I know we’ve asked and asked to have it done and apparently it’s going to be scheduled, but it hasn’t taken place yet. It’s very hard to fund things and to give you the public money to spend without having let the public take a look at this. The Board of Aldermen, you’re ward alderman is the chairman of the committee, and we’ve had one meeting, proper meeting in the whole year. I don’t know why. I mean I just think we should not fund anything more on the Main Street on the sidewalks until you present it, it is formally presented to this governing body which gives the body then a chance to see it and participate with it. What the Board of Aldermen does that all of these other committees do not do, we do advertise. We post it. We have opportunity for people to come and speak. It’s done all in a public forum. I think the citizens who are paying for this have a right to see the whole plan before I’m willing to spend anymore money on it. So, I just wanted you to know that. Mayor Lozeau I am very well aware of that, Alderman Pressly. I understand your position. I will say that the Board of Public Works, who has the authority over this, is also an elected body. I do think they represent the people as well. They have seen this. It has been done in a public setting. They have had public comment allowed Finance – 06/20/12 Page 7 for this. The opportunity to show it the Board of Aldermen just between the Budget meetings and the other meetings, there has not been a free night to be able to present it. The aldermen that have been interested have seen it. The merchants have seen it. I’ve presented it at the Downtown meeting. The chairman of PEDC has seen it. People that are interested in seeing. Alderman Pressly Chairman of PEDC? Mayor Lozeau Right. Alderman Pressly He is the one who has not shown it to us yet. Mayor Lozeau No, it’s not his responsibility to show it to you. He was at the downtown meeting as you were when I showed it to everyone. So I’m saying that he has seen it. You have seen it. The ward alderman has seen it. The Ward 2 alderman has seen it. People that have asked to see it, have seen it. I met with the merchants as you know. I understand that. But this sidewalk work has been appropriately approved and not approving the lights means that that work is going to happen and there won’t be lights on those sidewalks. I don’t think that’s our best choice. Alderman Pressly I would like to respond. I know the Board of Public Works is now doing far more work than they have in the past. They meet at 2:00 p.m. I’ve attended their meetings. They rarely have anyone from the public there. And I don’t believe they post or advertise what they are going to talk about. To suggest that the public has an opportunity because you present it to the Board of Public Works is nothing at all like what we do here. It’s at 2:00 p.m., not too many people go there. So I really think it diminishes the responsibility and importance of this governing board to be spending money before it has been formally introduced and viewed and this board has had a chance. I go to all these other meetings because that’s the only way I learn. I don’t learn it through my committee. The meeting I was at, I didn’t have an opportunity to ask questions. That was strictly for that volunteer board. Mayor Lozeau I gave you an opportunity to ask questions. I welcomed you to the table to join us. Alderman Pressly Thank you, Madam Chair. The point is we’re the governing board that authorizes the expenditure of money. That’s the key. The fact you’ve gone to crime watches and told people that you’ve gone to. Different people in town, not every merchant on Main Street has seen this, just those that happen to be at the right place at the right time. The formal way to deal with this is through the Board of Aldermen. I just can no longer pay or authorize money until it has been formally presented and the public. I know where to go to get the information, but the public doesn’t. And this is the Board of Aldermen where the public is involved to see these things. So thank you. Finance – 06/20/12 Page 8 Mayor Lozeau You’re welcome, and just for clarification, the Board of Public Works does post their agenda. Just so you know. Alderman Deane In our previous meeting on the 10th of April, we approved the original lights. We used EDI Riverwalk 09 money. There was $15,250 left over in that fund. Is there any reason why we didn’t use the balance of that to offset some of this cost? Mayor Lozeau We’re using some alternative funding sources. For instance that same EDI funds are for the Riverwalk. They are also used for the Riverwalk. I’m not certain if that money has already been accounted for in something else. But we’re using some of the federal energy dollars for the crosswalk lighting for the Main Street Bridge. Alderman Deane Between now and the 10th of April, do you think that $15,250 might have been spoken for? Mayor Lozeau I think it might be. Alderman Deane Because when you look in the street department operating budget under miscellaneous equipment, which this is funded under, there was $10,000 budgeted and this is an expenditure of $45,500. Mayor Lozeau Because funds have been transferred into that account. Alderman Deane So this is the road salt money? Mayor Lozeau It could be. The money necessary for some of this sidewalk work as I’ve told the committee on multiple occasions has been moved into the appropriate accounts to be able to do that so that there’s different accounts that it has been moved into. MOTION CARRIED Finance – 06/20/12 Page 9 From: Robert Gabriel, Purchasing Manager Re: Purchase of Front Load Dumpsters Requested by Solid Waste (Value: $85,826) MOTION BY ALDERMAN CHASSE TO ACCEPT, PLACE ON FILE AND AWARD THE CONTRACT TO CONSHOHOCKEN STEEL IN THE AMOUNT OF $85,826. SOURCE OF FUNDING IS THE RECLAMATION TRUST FUND ($22,160) AND MISCELLANEOUS EQUIPMENT ($63,666), ACCOUNT NUMBERS AS PROVIDED ON AGENDA ON THE QUESTION Mayor Lozeau These are the dumpsters that go with the frontend load truck that we purchased. It should be arriving sometime in October. Alderman Deane Is this for the school department? Mayor Lozeau It includes the school department, yes. Alderman Deane Where are there frontend. Are there locations listed in here where these are all going? Mayor Lozeau I have the locations if you would like them to be distributed. I’m sure Mr. Gabriel will. Alderman Deane Oh, you have that with you? Mayor Lozeau I do. I know you had asked about it. This is for 78 dumpsters. When we bought the frontend load truck, it’s going to allow us to stop having as many roll off units as we had. There will still be three compactors, Alderman Deane. One at each high school and one at Elm Street Middle School. Alderman Deane Are we going to put a lock on these dumpsters? I’m serious. I’ve been down at Main Dunstable soccer fields and I saw a guy coming up with Massachusetts license plates. A pickup truck throwing stuff into that dumpster. So I told the guy to take it out or I was going to call the police department. He gave me a bunch of crap and he left and two minutes later he turned around and came back and got the dumpster and took it all back out. But I’m just wondering how we’re going to contain this to stop people from illegally dumping in these containers because these containers make sense but the other problem with containers is if you a perfect example of a collection container is when you look at up on West Hollis Street, the old Soucy Market. When those clothing containers were filled what were people doing? T hey were just backing up and dumping stuff. It’s nice that people want to donate but I’m just wondering how we’re going to stop people from cleaning out their basements and going down to the Main Dunstable soccer field or Mine Falls Park or the Concord Street playground. Finance – 06/20/12 Page 10 Mayor Lozeau I think opportunity to lock these is much easier than the opportunity to lock what’s there today. All those roll offs. Those are just wide open and available. Alderman Deane I don’t believe there’s a roll off at Mine Falls or Main Dunstable. Mayor Lozeau Stellos has one. But the ones where they are being replaced, there currently roll offs that are in those locations. Some might have like at city hall we have, it’s not a roll off but it’s not a front load dumpster. It’s throw the chains over it on the Alderman Deane No, I understand that. I’m fully supportive of the convenience of dumping them. Absolutely. I use the one at Holman Stadium when it’s open and I take all our trash from our baseball field and I bring it down there because if I don’t then the skunks get in it and it’s blown all over the parking lot and it’s stuck in the tennis court fence. This is all being funded out of the reclamation trust fund? Mayor Lozeau No, not all of it. There’s $22,000 coming out of the reclamation trust and $63,000 coming out of miscellaneous equipment and solid waste. Alderman Deane $63,000 in miscellaneous equipment? Mayor Lozeau Yes. Alderman Deane Was that budgeted for previously? Was that the idea? Mayor Lozeau We had planned for it. Alderman Deane But when the budget presented? Mayor Lozeau I’m trying to remember if we put it in the 2012 when we knew we were going to get the truck. Probably not because we came up with the truck after. Finance – 06/20/12 Page 11 Alderman Deane Miscellaneous equipment. Well they changed all the, what was the old two-digit? Mayor Lozeau I don’t know, I didn’t bring my book with me. I just know that the funds are available that we put it in. Alderman Pressly I’m just curious about the miscellaneous equipment. That’s so vague and it’s been taking money from it in these two accounts. Mayor Lozeau That’s where we ordinarily would take it. Alderman Pressly What else comes under miscellaneous equipment? Just stuff that doesn’t require a special funding all by itself? Mayor Lozeau You don’t want to make a line item for every single thing that you could possibly have on your equipment list. For the bigger items, you identify them and then for other items you put it in miscellaneous. From time to time money gets moved from other accounts when you didn’t need it into miscellaneous equipment if you have a purchase. Because we have the opportunity to buy this frontload dumpster, we knew that we needed to buy the dumpsters to be able to replace the ones that we have. Alderman Pressly Just further comment then so the street lights are considered miscellaneous equipment also? That’s the other account that’s taken from. Mayor Lozeau It’s a different department. It’s not solid waste, but yes. Alderman Pressly So, just sort of a vague. Mayor Lozeau We don’t have a streetlight fund. We don’t often replace street lights. Main Street is pretty much the only place where we have street lights we’re responsible for and they have a pretty long shelf life. Alderman Deane There’s two line items under miscellaneous equipment. One is for fire extinguishers and the other one is for toter replacement and toter parts. Finance – 06/20/12 Page 12 Mayor Lozeau I know that we’ve moved money into the miscellaneous equipment to cover this purchase, Alderman Deane. We were either going to have to purchase new roll offs because some of them are too damaged or dumpsters so I can’t tell you where it is. Alderman Deane There was only $5,000 budgeted. Mayor Lozeau Are you in the ’12 budget? Alderman Deane I’m looking at the aldermanic approved for the FY12, yup. There was $5,000 approved and zero expended as of 31-March. This year you’re asking for $145,000. We can talk about that at budget. So somewhere within this operating budget, $80,000 was found for this. Mayor Lozeau Right. Between the reclamation trust and the miscellaneous equipment. Alderman Deane Well, $63,000. Mayor Lozeau I understand how much it is. It’s almost $64,000. Alderman Deane Welcome to the end of the year. Mayor Lozeau This is not a spend down, Alderman Deane. It’s appropriate to look at using budget monies for things like this that we need. Alderman Deane You’ll have to do better to convince me. Mayor Lozeau Well and we told people that it was coming. We purchased the truck specifically for this purpose. Alderman Deane Well I guess we’ll have to ask more detailed questions. Do you have any idea when they will be heard? Mayor Lozeau No, I don’t think they have been put on the docket yet. Alderman Pressly Do you have a list of attorneys that are specialized in this that you’ll be looking to hire? Mayor Lozeau We’ve chosen the attorney. That’s what this is tonight. Alderman Pressly Oh, okay. Sorry. Mayor Lozeau This is an attorney that we’ve worked with before. Alderman Pressly Out of Exeter. I see it now. What luck have you had with them? Mayor Lozeau Very good luck. We’ve actually been able to win our case each time. For instance the DeMoulas Shopping Center’s come every year and they’ve successful managed that. Alderman Pressly Oh, okay. The 65 radios being accepted from the state? Mayor Lozeau They are compatible and these are vehicle radios instead of the handheld. What you dealt with on Monday were the handheld. Mayor Lozeau Certainly. It’s a three-year contract with two one-year options. It’s the same lease amount that they are paying today which is $250 a month. It includes a provision that should the property be sold while they are there, that the new owner will have to honor their lease and it gives them the first right of refusal if there is somebody interested in purchasing it. That’s a little bit unusual. The taxes are laid out here. In order for their taxes to be waived, they have to go to the Board of Assessors and prove that they are charitable organization. You may recall we had that lengthy discussion with the former owner. Those taxes have all been paid. This is the new owner of the school that we’re entering this lease with. We had a meeting. Myself, Alderman Caron, Alderman McCarthy and Alderman Cookson with the previous owner to discuss potential solution and this was the one that we came up with. Alderman Wilshire The prior contract was a five-year contract or was it a three with a two-year extension? Mayor Lozeau The prior one had been expired for many years. She’s had it for over 20 years. It expired in 2008, and basically they were a tenant at will since 2007 or 2008. Alderman Wilshire But there was an agreement in that contract that said if the property sold, the city only needed 30 days notice. That’s not the same in this contract. Mayor Lozeau That’s not the same in this contract. Alderman Wilshire Okay, thank you. Any possibility of getting the lifeguards trained in time? Mayor Lozeau We opened the rotary pool today at 5:00 p.m., and we’re hopeful to open the other two tomorrow. Alderman Pressly How did you get that resolved? Did you have a crash training for them? Mayor Lozeau They were already trained. They just had to be recertified. The person responsible for doing that had scheduled it for Saturday, not expecting that we might be looking at opening early and they were willing to reschedule it and we think it’s going to be able to take place in the morning tomorrow. We’re hopeful to have the pools open in the afternoon. Alderman Pressly That’s great. Alderman Chasse Does that include the splash pads? Mayor Lozeau That includes the splash pads. Alderman Deane There’s a lifeguard at the splash pad? Mayor Lozeau No, there’s not.
