REASON FOR REQUEST / BACKGROUND This ordinance allows for additional video gaming licenses for liquor license holders with 33 maximum licenses allowed; this is an increase for the previously allowed amount of 16. ORG# Total Amount for Approval ACCT# Budget Amount Variance ORDINANCE 2017 - ORDINANCE AMENDING CHAPTER 10 AMUSEMENTS AND ENTERTAINMENTS, ARTICLE IV REGULATIONS FOR LICENSEES OPERATING VIDEO GAMING TERMINALS, SEC. 10-83 NUMBER OF VIDEO GAMING LICENSED ESTABLISHMENTS TO THE CODE OF ORDINANCES, VILLAGE OF NILES NOW, THEREFORE, BE IT ORDAINED, by the President and the Board of Trustees of the Village of Niles, Cook County, Illinois, as follows: SECTION 1: Chapter 10 Amusements and Entertainments, Article, Regulations for Licensees Operating Video Gaming, Sec. 10-83 Number of video gaming licensed establishments to the Niles Code of Ordinances shall be amended as follows: CHAPTER 10 AMUSEMENTS AND ENTERTAINMENTS * * * ARTICLE IV REGULATIONS FOR LICENSEES OPERATING VIDEO GAMING TERMINALS * * * Sec. 10-83 Number of video gaming licensed establishments. Maximum number of 1633 licensed establishments is allowed subject to subsection (e) herein. The distribution of these licenses is outlined below: (a) Not more than 1225 existing liquor license establishments may obtain video gaming licenses only if named license holder was in existence for a minimum of 18 months and in good stead with the Local Liquor Commissioner. (b) Not more than two four (24) new video gaming café business owners may obtain video gaming licenses only if the owners locate in a retail strip center or shopping center, that at the time of the execution of their lease of space, is experiencing a vacancy rate of greater than thirty percent (30%) (i.e. gross leasable space available for rent, unoccupied or not producing rent for the owner) and who have applied for and received a liquor license. (c) Not more than one two (12) existing business owner who may or may not now hold a liquor license, may obtain video gaming licenses only if said business owners have owned or leased property in the Village of Niles for five (5) or more years and whose business has declined over the past three (3) years and who have applied for and received a liquor license. Ordinance 2017- (d) Not more than one two (12) fraternal or veterans' organization may obtain video gaming licenses only if named license holders have operated within the Village of Niles for at least five (5) years and who have applied for and received a liquor license. (e) In the event that one (1) or more liquor license holders obtains a video gaming license and elects to install less than the maximum of five (5) machines, then, in that event, the Public Safety Committee shall have the authority, upon advice and consent of the Alcohol Tobacco and Gaming Commissioner, to allow additional liquor license holders in the Village to apply for and obtain a video gaming license. Notwithstanding this provision, in no event shall the Public Safety Committee allow more than a maximum five (5) additional video gaming licenses to be issued and in no event shall the total number of video gaming machines exceed the total number of machines authorized in subsections (a) through (d) herein. SECTION 2: That this Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. SECTION 3: That all ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of any such conflict. SECTION 4: That any section or provision of this ordinance that is construed to be invalid or void shall not affect the remaining sections or provisions which shall remain in full force and effect thereafter. ORG# Total Amount for Approval ACCT# Budget Amount Variance ORDINANCE 2017 - ORDINANCE AMENDING CHAPTER 6 ALCOHOLIC BEVERAGES, SEC. 6-1 DEFINITIONS, SEC. 6-34 CLASSIFICATION AND FEES, SEC. 6-38 NUMBER AND APPENDIX D FEE SCHEDULE TO THE NILES CODE OF ORDINANCES WHEREAS, the Village of Niles (“Village”) is a home rule unit of government as provided by the provisions of Article VII, Section 6 of the Illinois Constitution of 1970; and WHEREAS, as a home rule unit of government, the Village is expressly empowered to perform any function pertaining to its government and affairs including, but not limited to the power to regulate for the protection of the public health, safety, morals, and welfare; and WHEREAS, the Village’s Liquor Commission recommends that the Village establish a billiard parlor and pool hall liquor license classification; and WHEREAS, the President and Board of Trustees agrees with the recommendation of the Liquor Commission and finds that it is in the best interests of the Village to establish a billiard parlor and pool hall liquor license classification as set forth in this Ordinance. NOW, THEREFORE, BE IT ORDAINED, by the President and the Board of Trustees of the Village of Niles, Cook County, Illinois, as follows: SECTION 1: Chapter 6 Alcoholic Beverages, Sec. 6-1 Definitions, Sec. 6-34 Classification and Fees, Sec. 6-38 Number and Appendix D Fee Schedule to the Niles Code of Ordinances shall be amended as follows: CHAPTER 6 ALCOHOLIC BEVERAGES ARTICLE I IN GENERAL Sec. 6-1. Definitions. * * * Billiard Parlor/Pool Hall means any business establishment devoted to the playing of the game of billiards or pool. * * * Ordinance 2017- ARTICLE II LICENSE * * * Sec. 6-34. Classification and fees. Licenses required by this article shall and are hereby divided into six seven classes: * * * (7) Class P. Billiard Parlor and Pool Hall Liquor License: A Billiard Parlor and Pool Hall Class Liquor License shall authorize a licensee for the retail sale of alcoholic liquor, for consumption on the specified premises. Refer to Appendix D for fees. Regulations specific to a Class P license are: a. Class P liquor license allows the sale of alcoholic liquor. The Liquor Commissioner at his/her discretion can change the selling time for the sale of alcoholic liquor between the hours of 2:00 a.m. and 4:00 a.m. b. Class P licensees must have at least one BASSET certified manager on premises whenever alcoholic liquor is available for consumption. c. Every employee of a Class P licensee who participates in the sale of alcoholic beverages must be BASSET certified. d. The service or pouring of alcoholic liquor shall be done by a BASSETT trained licensed bartender and not the customer. e. Refer to Appendix D Fee Schedule of the Niles Code of Ordinances for the annual fee for a Class P license. * * * Sec. 6-38. Number. No more than the maximum number of licenses set forth below shall be issued for any class of licenses. ORG# Total Amount for Approval ACCT# Budget Amount Variance RESOLUTION 2017 - RESOLUTION INITIATING THE SUBMISSION OF AN ADVISORY QUESTION OF PUBLIC POLICY FOR THE NOVEMBER 6, 2018 GENERAL ELECTION BALLOT REGARDING THE ENHANCEMENT OF LOCAL SCHOOL DISTRICTS RATINGS WHEREAS, the Village Board of the Village of Niles hereby finds and determines that it is in the best interest of the community to determine the level of public support for the Village’s social, health and economic programs; and WHEREAS, it is the intention of the Village Board that the referendum provided for in this Resolution shall be advisory for approval or disapproval of the electors without further action by the Village Board; and WHEREAS, Article 28 of the Illinois Election Code provides for a referendum on advisory questions of public policy; NOW THEREFORE, BE IT RESOLVED, by the President and Board of Trustees of the Village of Niles, as follows: SECTION 1: The foregoing recitals are incorporated herein as though fully set forth.
