APPROVED MINUTES OF THE MEETING OF THE PLAN COMMISSION AND ZONING BOARD OF APPEALS VILLAGE OF NILES COOK COUNTY, ILLINOIS March 5, 2012 The Niles Plan Commission and Zoning Board of Appeals was called to order at 7:00 P.M. Chairman Kanelos asked everyone to stand for the Pledge of Allegiance. Present along with Chairman Thomas Kanelos were Vice-Chairman Karen Dimond, Commissioners Thomas Surace, Angelo Troiani, Barbara Nakanishi and Robert Schulter. Also present was Charles Ostman, Director of Community Development. Village Attorney Joseph Annunzio, Commissioner Morgan Dubiel and Assistant Director of Community Development Richard Wlodarski were absent. OLD BUSINESS 12-ZP-04 Douglas Pasma, Architect 1601 Sherman Ave. Evanston, Illinois 60201 Requesting an Amendment to Special Use ordinance 2004-41 for expansion of existing use and a variation to Appendix B Section VII (B)(14) to increase the maximum impermeable surface to 75% from the required 60% at 7333 N. Caldwell Ave., Niles, IL 60714. NEW BUSINESS None Chairman Kanelos stated the Board received a request for 12-ZP-04 [Harvest Bible] to be continued to the May 2012 meeting. Charles Ostman, Director of Community Development, said the petitioner is here this evening if the Board has any questions. Chairman Kanelos asked the petitioner to come to the podium and be sworn in. Paco Orozco from Pasma Architects stepped forward. [The microphone at the podium was not working. Most of what Mr. Orozco said was very faint or inaudible.] He said their client is still working on a contract among the neighbors to share parking. They will be requesting the same variance. Chairman Kanelos asked what would be required from a legal perspective if that were to take place. Mr. Ostman said it doesn’t need any change. The zoning code in one section says you are to provide off-street parking at a certain ratio on the property. In another section of the code, also under parking requirements, it states you may reach an agreement with an adjoining property owner within 300 feet to meet that parking requirement. That is what the petitioner is working toward right now – reaching that perpetual agreement to be recorded that they will have off-site parking within 300 feet. There is not going to be any change in the request. Vice-Chairman Dimond asked if this was an easement and is it for certain times of the day or days of the week. Mr. Orozco said yes. The property nearby is another church and there is also commercial property. The land is already paved so there will be no additional paving. Vice-Chairman Dimond said therefore the 75% impermeable surface will be just on the property owned by Harvest Bible. Mr. Orozco replied yes. Chairman Kanelos asked if the zoning notice sign was currently up on the property. Mr. Ostman said he didn’t believe the legal sign was still posted on the property but the Village will re-establish that sign tomorrow [March 6, 2012] to make sure various property owners around there are aware this case is continued. There is no date on the sign. It states to contact the Village of Niles. Chairman Kanelos asked since this is being continued again, we should probably request that letters be sent out to the neighbors. There aren’t that many property owners affected. Vice-Chairman Dimond said she is concerned about storm water management. Should that be addressed today or when the case is heard? Chairman Kanelos said that could probably wait until the actual zoning hearing. Vice-Chairman Dimond asked if there will be drains installed under the additional parking area and is that water going into the sewer system. Mr. Orozco said yes. Chairman Kanelos said therefore you are working on off-site parking recorded in perpetuity and storage of run-off. Mr. Ostman said the petitioner will be meeting all the requirements. We can go into more detail in the main meeting. Vice-Chairman Dimond asked Mr. Orozco if the client has considered the more permeable type of parking surface now available which allows more water to go through into the ground. Mr. Orozco said the client is going through many considerations. Nothing has been decided yet. Chairman Kanelos asked if there were any other questions from the Board. There were none. There were no questions from the public either. At this time he entertained a motion. Commissioner Nakanishi moved to grant the continuance [case 12-ZP-04] until the Zoning Board meeting May 7, 2012. Seconded by Commissioner Surace, on roll call the vote was: AYES: 6 Dimond, Surace, Troiani, Nakanishi, Schulter, Kanelos NAYS: 0 ABSENT: 1 Dubiel There being six (6) affirmative votes the motion carried. He then entertained a motion to adjourn. Commissioner Nakanishi moved to adjourn the meeting. Seconded by Vice-Chairman Dimond, on roll call the vote was: AYES: 6 Dimond, Surace, Troiani, Nakanishi, Schulter, Kanelos NAYS: 0 ABSENT: 1 Dubiel There being six (6) affirmative votes the motion carried.
