The Niles Planning and Zoning Board was called to order at 7:02 P.M. All
rose for the Pledge of Allegiance. Chairman Kanelos asked everyone to remain
standing for a moment of silence in remembrance of the deadly attack in Las
Vegas on 10/1/ 2017.

APPROVAL OF MINUTES
Chairman Kanelos asked if there were any additions, clarifications or corrections
to the minutes of September 11, 2017. There were none.
Commissioner Dubiel moved to approve the minutes of September 11, 2017.

OLD BUSINESS
16-ZP-38 Requesting approval of a special use permit to allow ‘outdoor
storage ’ per Village Ordinance Appendix B, Section 8.2(A) and
8.3(P) at 6801 Howard St.
17-ZP-21 Continued discussion of proposed text amendments to the
following sections of the Village of Niles Zoning Code Appendix B
as recommended by the Director of Community Development
and the Village Attorney (items 1 through 14 were discussed at the
September meeting):
15) Table 4-1 specifying side-yard set-back requirements for lots with a
detached garage in the R-1, R-2 and R-2-35 zoning districts;
16) Section 10.3(B) clarifying impervious surface coverage requirements for
parking pads;
17) Section 10.2(B) creating rules that require parking facilities within the
Village of Niles to be used only for businesses or uses within the Village of
Niles;

Chairman Kanelos rearranged tonight’s agenda. He will take 16-ZP-38 first as is
shown on the schedule. But 17-ZP-21 will be moved to the end of the agenda.
This is in regard to proposed text amendments to sections of the Zoning Code.
He then called for the first item on tonight's agenda.

16-ZP-38 Requesting approval of a special use permit to allow ‘outdoor
storage ’ per Village Ordinance Appendix B, Section 8.2(A) and
8.3(P) at 6801 Howard St.
Mr. Sylvester said this item was considered a little over a year ago. It is a request
for a special use permit by a masonry business. The owner is here tonight. The
business is currently located at 6801 Howard St., just east of the river and south
of Howard. This is for outdoor storage. His business requires the need to
stockpile materials for masonry work. In Niles, outdoor storage in the M district
requires a special use permit. This item was tabled a year when the Village
Engineer stated the building and the storage area is actually in the flood plain.
When large quantities of material are stored in a flood plain, it diminishes
capacity of the flood plain to hold water in a flood event. FEMA regulates in that
situation you cannot diminish the capacity of a flood plain unless you provide
compensatory storage. The applicant spent ten months with FEMA and an
engineer to come up with a plan for how he would meet FEMA’s requirements for
compensatory storage. That plan was submitted to the Village Engineer who
reviewed and approved it. It now meets all of FEMA’s requirements as well as
the Village’s requirements. Now that it has been accomplished it is before this
Board again for the special use permit. The Staff does not have concerns about
this proposal. Materials will be stored on the south side of the building. They
have been there for some time and are not visible because of the building and
other properties in the area.
Chairman Kanelos ask if the storage is already taking place in the area.
Mr. Sylvester said he will have the applicant explain that. The Village allowed
him to store materials while going through the FEMA process, which he did in
good faith.
Commissioner Dubiel asked if the FEMA issues had to be discussed tonight.
Chairman Kanelos said no.
Commissioner Dubiel said it looks like the 10 ft. set-back gets violated at the site.
What is the history behind that?
Mr. Sylvester said he is aware of a couple other businesses in the community that
have outdoor storage. In the past it has been an issue where they cram too
much on the site.
Chairman Kanelos asked if there were more questions for Staff. There were
none. He called the petitioner to come forward.
Edward Marcizewski, 1600 Riverside Ct., Glenview, IL 60025 came forward and
was sworn in. He wanted to let the Board know that next door to him the Village

has three times the amount of garbage piled up. He came to Niles because his
previous location was too small. He stores old Chicago brick, sand, etc. Winter
time he hardly has anything stored because he does not work in the winter.
Commissioner Dubiel asked how high the fence is along the side. And also he
doesn’t feel the 10 ft. set-back is a big deal. Can it be waived?
Mr. Marcizewski said that is the Village’s fence.
Mr. Sylvester said the adjacent property belongs to Niles Park District, not the
Village of Niles.
Mr. Marcizewski said he won’t store things too high because if he did they would
start to fall over.
Chairman Kanelos asked if there were more questions. There were none.
He entertained a motion.
Commissioner Dubiel moved to approve item 16-ZP-38 requesting
approval of a special use permit to allow ‘outdoor storage’ per Village Ordinance
Appendix B, Section 8.2(A) and 8.3(P) at 6801 Howard St. The petitioner has
met the FEMA requirement for compensatory storage in a flood plain. The Board
will waive the 10 ft. set-back in this particular case.

Chairman Kanelos called for the next item.
17-ZP-23 Requesting approval of a special use permit to allow a ‘massage
services establishment ’ per Village Ordinance Appendix B,
Section 8.2(A) at 8068 Milwaukee Avenue.
Mr. Sylvester said this is at the multi-tenant 2 story building on the west
side of Milwaukee, north of Oakton. Currently this is a vacant space a few doors
south of the new Dunkin’ Donuts. The applicant is here tonight with her

translator. This property is zoned C-3 and requires a special use permit. The
Community Development Department does have a suggested condition of
approval. See page 2, item b in the packet. The applicant must complete a
background check to be approved by the Chief of Police before a business
license can be issued. All required notifications have been provided. There are
no other concerns.
Chairman Kanelos asked if the background check is merely for the applicant or
for potential employees.
Mr. Sylvester suggested it for the business owner. But you can expand that, if
you feel it is appropriate, to all future employees.
Mr. Ostman said there is a state license that needs to be obtained. He is not
sure if they do a background check.
Chairman Kanelos called for the petitioner to come to the podium.
Ming Shu Li, 8068 N. Milwaukee Ave., Niles, IL, the petitioner, and her
translator, YoYo Kim, were sworn in.
Ms. Li read a statement saying she is a licensed professional massage service
provider. She has been in the massage business for more than 8 years. She
has helped patients at the pain and hip rehabilitation clinic where she works. Her
clients appreciate her care. So she wants to have her own business to help more
people.
Commissioner Dubiel asked her if she is licensed.
Ms. Li said yes.
Chairman Kanelos asked if she has ever owned another business in Niles.
Ms. Li said no.
Commissioner Schulter asked about the diagram of the location. What is the
couple body massage room?
Mr. Kim answered for couples to have massages together.
Chairman Kanelos asked if there were more questions from the Board or the
public. There were none. He entertained a motion.
Commissioner Dubiel moved to approve a special use permit to allow a
‘massage services establishment’ per Village Ordinance Appendix B, Section
8.2(A) at 8068 Milwaukee Avenue for case 17-ZP-23 . It meets the

requirements for a special use permit per the findings of fact given in the packet
before this Board tonight.

17-ZP-24 Requesting approval of a special use permit to allow two (2) 3 ’ x
2’ signs at 7428 Waukegan Road per Village Ordinance Chapter
78, Article 1x, Section 78-208.
Mr. Sylvester said Big Blue Swim School opened about two years ago in the
former Aldi Store on Waukegan. Business is good but they would like more
signage on the site. They would like a sign not only on Waukegan, which is the
address with an entrance. It is a through lot with an entrance on Milwaukee as
well. Therefore they would also like a sign on Milwaukee. The sign code limits
the amount of signage a business can have. The building code does allow them
to request a special use permit to allow a second sign.
A site plan is shown on the overhead. Also included in the packet are
responses about the requirements that need to be met. Elevations of the signage
are shown on the overhead.
Commissioner Schulter asked if the sign on Waukegan is going on the actual
property.
Mr. Sylvester said yes.
Commissioner Schulter then asked who owns the property along Milwaukee
if the sign goes there also.
Mr. Sylvester went back to the property diagram on the overhead. It is all
one property – it is a through lot. So there would be a sign on their property on
Milwaukee and on their property on Waukegan.
Chairman Kanelos said he definitely sees a need for a sign on Milwaukee.
Why do they need another sign on Waukegan?

Mr. Sylvester will let the petitioner address that.
Commissioner Schulter asked if the condominium building next door was
notified of this.
Mr. Sylvester said yes. The sign inspector, Dennis O’Donovan, sent notices to
all based on the PINs for the properties. That was mailed out within the legally
required timeline. This does not require a site sign.
Mr. Ostman said they are allowed to have one of two ground signs, either on
the Waukegan side or the Milwaukee side. On the Waukegan side there is a pole
still standing from when Aldi was there.
Chairman Kanelos said the request if for two 3’ x 2’ signs but actually one of
the signs is larger than 3’ x 2’.
Mr. Sylvester said that was pointed out right before this meeting. It is an
error in the report. However the elevations are correct.
Commissioner Dubiel asked if these types of requests do or do not come
before this Board.
Mr. Sylvester said they do but not often.
Mr. Ostman said when they first developed the sign code [2011] it came in
front of the Planning and Zoning Board. Any amendment since then did not. But
we took the suggestion of the Chairman to the Building and Zoning Committee
that has the authority of reviewing amendments. They recommended that any
future amendments come back to this Board for consideration.
Commissioner Dubiel said so now they do have authority to do sign code
appeals, right?
Mr. Ostman said you always had the authority to decide appeals; you also
can review any amendments that will be presented to the sign code; the same for
the zoning code. Aldi did have signs on both sides. The code was the same
back then. He’s not sure how they got that sign on Milwaukee.
Commissioner Dubiel asked when someone comes it to apply for a sign, how
is it decided that is an appealable situation…… nothing has been denied yet.
Mr. Sylvester said this is not an appeal. This is a request for a special use
permit.
Mr. Ostman said this was recommended a long time ago by a consultant that
this comes up as a special use, not a variation. It would have been very hard to
meet the variations requirements for a sign.

Mr. Sylvester said after this case, there is another item tonight that is a
request for a sign variation.
Commissioner DeBartolo said the one on Waukegan looks small. People
walking on the sidewalk – it seems unsafe there.
Mr. Sylvester said it is on private property.
Commissioner Schulter felt it to be unsafe as well.
Chairman Kanelos suggested making it a little taller so people aren’t running
into the sign.
Commissioner Dubiel would like for the signs to be visible so people wouldn’t
drive by, all of a sudden see the sign, and then try to turn into the entrance right
away.
Commissioner Nakanishi asked how high the post is.
Chairman Kanelos said it is a little over 2 ft.
Commissioner Nakanishi said so it’s approximately 4 ft. with the sign. Kids
should be looking where they’re going.
Chairman Kanelos said they have to protect people in the Village. He thinks
it should be a little taller.
There were no more questions for Staff.
Chairman Kanelos called the petitioner to the front.
Mike Lonergan, representative from Big Blue Swim School, 4618 N. Racine
Ave., Chicago, IL 60640 came to the podium and was sworn in. He passed
around a picture. Right now the post is just sitting there at 6 ft. tall on Waukegan
Rd. They would like to cut it down to 2 ft. But if the Board wants it higher, they
can go with that as well. They own the property on the Milwaukee side as well.
Commissioner Dubiel asked how high could the sign post be if the special use
is passed tonight.
Mr. Ostman said maximum height is 20 ft.
Commissioner Schulter asked if there would be a line of sight problem if it
were only 4 feet.
Commissioner Dubiel said he is not opposed to anything anyone said. He

thinks it is up to the applicant. He feels it’s more invasive, the taller it is.
Mr. Lonergan said the sign sits back about 8 ft. from Waukegan Rd. People
pulling out are well ahead of the sign.
Chairman Kanelos entertained a motion.
Commissioner DeBartolo moved to approve 17-ZP-24 requesting a
special use permit to allow two (2) 3’ x 2’ signs at 7428 Waukegan Road per
Village Ordinance Chapter 78, Article 1x, Section 78-208 with a minimum of a 6
ft. pole on the Waukegan side. Also, there is a correction in the description. It
should read one 3’ x 2’ sign and one 5’ x 7’ sign – not two 3’ x 2’ signs.
Seconded by Commissioner Schulter, on roll call the vote was:

17-ZP-25 Requesting approval of a variation to allow three (3) 2 ’ x 8’
temporary feather signs at 7609 Milwaukee Avenue per Village
Ordinance Chapter 78, Article 1x, Section 78-209.
Mr. Sylvester said the business is Concealed Carry Safety for Person Defense
Inc. They were here a couple years ago to obtain a special use permit to provide
instruction and training for concealed carry. The business owners would like
some additional signage on the site to attract more business. They are
requesting 3 permanent feather signs, 2 ft. by 8 ft. This is not something that is
allowed in the building code for sign regulations. The ordinance doesn’t have a
provision that these are allowed with a special use. In this case, they need a
variation. The Community Development Department does have concerns about
this request, as this type of sign would be allowed year round on a permanent
basis. The sign inspector did provide a mailed notice to property owners in the
vicinity.
Commissioner Schulter asked if surrounding villages allow these types of
signs to be permanent.

Mr. Ostman said they did not do any survey on these banner signs. Right
now the sign code allows banner signs up to four months. It was recently
discussed at the Building and Zoning Committee meeting to amend and allow
banner signs like these up to six months. Then they would have to take them
down for six months. The sign code says a maximum of 32 sq. ft. total. For
example, if this business had three signs, they cannot exceed 32 sq. ft. total.
Commissioner Schulter said what if a business next to this business wanted to
put banner signs up next to theirs.
Mr. Ostman said it is allowed.
There was discussion about the types of permanent signs allowed. If it doesn’t
meet the code, then it is a special use request. However, temporary signs revert
back to a variation. At issue is the type of sign [feather] and material and the fact
the petitioners want it permanent.
Commissioner DeBartolo brought photos of feather signs throughout the Village
and she stated they have been up longer than 4 months.
Attorney Grcic read from code: a banner sign is a temporary sign composed of
light-weight material either enclosed or not enclosed in a rigid frame; secured or
mounted so as to allow movement of the sign caused by movement of the
atmosphere.
Mr. Ostman discussed how some temporary signs are accepted, such as lottery
signs.
Chairman Kanelos stated now they continue reviewing this signage as a
variance. He went on to read the code and said the petitioner would have to
meet certain criteria. He suggests having these signs in place every day when
the business opens, and take them down when the business closes.
Commissioner Dubiel read the criteria out loud. Mr. Ostman does not decide.
This Board decides.
Chairman Kanelos called the petitioners to be sworn in.
Marc and Connie Jensen, owners of the business at 7609 N. Milwaukee Ave.,
Niles.
Mrs. Jensen passed out more information as some things had changed.
Mr. Jensen said they appreciate all the help and support they have had from this
Board and the Board of Trustees. They are set back quite far from Milwaukee
Ave. and are looking for ways to be recognized from the street. Signage above
their door is not visible from Milwaukee.

Mrs. Jensen said they have tried to get permission from the landlord, Parkway
Bank, to add signage. They will not allow it. She brought in pictures of a
permitted flag she had out on Milwaukee. It is a 13 ft. flag.
That flag has been damaged by the wind. The other permitted sign was stolen.
She explained where she wanted to put the flag on the grassy parkway along
Milwaukee Ave. She has no plat of survey. Neither does the bank [owner of the
property]. It used to be the Niles Village Hall years ago.
The Village does not have a plat of survey either. The Jensens do not want to
pay $800 for a survey on property that does not belong to them.
Mr. Ostman said it is not Village property along Milwaukee Ave. It is IDOT
because Milwaukee Avenue is a state route so they own the right of way. Same
on Harlem Avenue.
There was a very long discussion about property lines, state or otherwise; right of
way and site lines. Included in this discussion is more information about the
signage the petitioners seek to put up. This went on for almost an hour. They
then discussed about placement of the signs on the actual corners of the property
and/or just inside the parking lot.
Chairman Kanelos entertained a motion to table this item. It can be on the
agenda next month and the petitioners can gather more answers about the
property lines and where their signs can be placed.
More discussion is taking place about placement of signage and their request for
temporary signs to become permanent.
Commissioner Dubiel moved to table 17-ZP-25 until the November meeting.

17-ZP-21 Continued discussion of proposed text amendments to the
following sections of the Village of Niles Zoning Code Appendix B
as recommended by the Director of Community Development
and the Village Attorney (items 1 through 14 were discussed &
approved at the September 2017 meeting):
15) Table 4-1 specifying side-yard set-back requirements for lots with a
detached garage in the R-1, R-2 and R-2-35 zoning districts;

NO OBJECTION - these are the set-backs for garages with driveways and
no alley accessibility.
16) Section 10.3(B) clarifying impervious surface coverage requirements for
parking pads;
NO OBJECTION
17) Section 10.2(B) creating rules that require parking facilities within the
Village of Niles to be used only for businesses or uses within the Village of
Niles;
NO OBJECTION – there was discussion about ‘why’. It is not in the best
interest of the Village for businesses to be leasing out parking -example
being a large lot. Mr. Sylvester gave an example of a business on Touhy in
Chicago wanting to lease parking behind it which is in Niles.
18) Section 10.9 creating standards for when parking traffic studies will be
required by the Village;
NO OBJECTION – however Attorney Grcic has an amendment to this
item. Language added should be: a traffic study approved by the Village
of Niles.
19) Section 7.1(A) clarifying uses allowed within the ‘P-1’ zoning district;
NO OBJECTION – Attorney Grcic recommends changing the wording from
‘private institutions’ to ‘quasi-public institutions’. She explained how it
should be defined such as: a private school with a purpose serving the
public.
20) Section 12.6(B) creating requirements for letters of credit, cash deposits,
or bonds for public and common area improvements in planned unit
developments;
NO OBJECTION
21) Section 11.11 specifying street tree requirements for new construction
projects;
NO OBJECTION – specifies the builder needs to do whatever the Village
requires outside of the zoning ordinance. The requirement is a tree needs
to be provided every 40 ft. of frontage in the parkway.
22) Section 10.3(C)(4)(c) correcting a mistaken reference to Section 9.3(H);
NO OBJECTION – Chairman Kanelos asked what happens if someone
has a three car garage – they can’t put in a driveway to accommodate a
three car garage. Mr. Sylvester answered starting at the garage, the
driveway may exceed 20 ft.
23) Section 10.1(B) specifying that parking must be provided for increases in

3. Non-retail land uses on corners in commercial zoning districts

Commissioner Nakanishi moved to table the DISCUSSIONS until the November
