The Niles Planning and Zoning Board was called to order at 7:04 P.M. All rose
for the Pledge of Allegiance. Chairman Kanelos announced that Ginger Troiani is
now home receiving physical therapy and doing well. Sending thoughts and
prayers his way.

APPROVAL OF MINUTES
Chairman Kanelos asked if there were any additions, clarifications or corrections
to the minutes of October 2, 2017. There were none.
Commissioner Dubiel moved to approve the minutes of October 2, 2017.

17-ZP-26 Requesting approval of variations from Village Zoning Ordinance
Section 9.3 to allow a tree house that does not meet set-back
and other accessory structure requirements at 7617 Oketo
Avenue.
Bruce Sylvester presented this item. This came to the attention of Community
Development when Code Enforcement officers were going through the
community. They realized the tree house had been built without permits in the
side yard at 7617 Oketo. They explained to the property owner tree houses are
only allowed in the rear yard and set back a minimum distance from side property
lines. This tree house does not meet either of those requirements. Rather than
tearing it down and trying to relocate, the owner requested if variations could be
granted after the fact to allow the tree house to stay where it is. Included in the
packet are the regulations regarding tree houses. They are an accessory
structure. It has to be at least 3 ft. from the side lot line; they are treated as
sheds. For sheds, maximum height allowed is 10 ft. These are the two items
that are not met.
Chairman Kanelos asked where do we measure in an instance of a shed or
accessory structure from the side yard.
Mr. Sylvester said from the side property line to the wall of the structure.
Chairman Kanelos said if it’s a building structure and it cantilevers over, we
measure to the foundation, right?
Mr. Sylvester said there are somethings permitted to encroach, such as bay
windows, window wells. But if there is a primary wall, that is what we measure to.
Mr. Ostman said the way they measure now, if it cantilever’s over, they measure
to the wall, not the foundation.
Chairman Kanelos asked if the code specifically lists play structures as a shed.

Mr. Sylvester said there are specific rules for play structures. It is listed in your
Staff report. Play structures are treated as sheds.
Commissioner Nakanishi questioned the height. If the branch of the tree is 8 ft.
and you build a tree house on top of that, you won’t have much of a tree house if
it can be only 10 ft. maximum.
Chairman Kanelos said that basically we are saying we don’t want tree houses in
Niles.
Mr. Sylvester said that could be tweaked. That’s why they keep notes throughout
the year. This way they know what has to be revisited or changed in some way.
Commissioner Dubiel asked if there were a specific definition of a play structure.
Is it normal that Code Enforcement was patrolling? No one called this in with a
complaint, right?
Mr. Ostman said everyone in the department keeps their eyes open for any
violations. It was visible from the street. No one called in a complaint.
Commissioner Nakanishi questioned the tall ladder leaning against the tree
house shown in a picture in the packet. Is it there all the time? And were there
any complaints from the neighbors?
Mr. Sylvester said it was not there when he drove by today.
Chairman Kanelos said the pictures show the ladder there while under
construction. The ladder is gone now.
Mr. Sylvester said there have been no complaints. One neighbor [who could not
attend tonight’s meeting] emailed that he had no objections with it.
Commissioner Schulter asked if Staff knows the height of the roof line. Is this
located within a utility easement?
Mr. Sylvester said he does not know the height. They did not make the property
owner obtain a survey.
Commissioner Dubiel said there are various issues as to height and location.
Chairman Kanelos asked for the petitioner to come forward. He was not present.
Commissioner Schulter asked if the resident applied for a permit, would the
Village have issued one.
Mr. Ostman said it is not too often they come across this. It would have had to be
evaluated.

Chairman Kanelos called a member of the audience to give testimony.
Mark Aimers, 7616 Oketo, Niles, IL came forward and was sworn in. He lives
across the street from the subject property. He said it is a nice looking tree
house. The grandfather built it around a portion of a tree that broke off during a
storm.
Commissioner Dubiel asked if he was surprised at the level of attention this tree
house is getting from the Village.
Mr. Aimers said when it was being built, he told the owner he really should have a
permit.
Chairman Kanelos entertained a motion.
Commissioner Nakanishi moved to approve item 17-ZP-26 requesting
approval of variations from Village Zoning Ordinance Section 9.3 to allow an
existing tree house that does not meet set-back and other accessory structure
requirements at 7617 Oketo Avenue. The requirements for such a variation have
been met.
Seconded by Commissioner Dubiel, on roll call the vote was:

Commissioner Dubiel said perhaps in December they could discuss this
particular section of the code.
Chairman Kanelos called for the next item.
17-ZP-27 Requesting revocation of a special use permit for a ‘massage
services establishment ’ at 259 Golf Mill Center.
Mr. Ostman presented this case. This is a request to revoke the special use
permit in its entirety for the massage establishment at 259 Golf Mill Center.
On December 27, 2011 the Village granted this special use. The special use for
this particular business has already been revoked. He would like to revoke the
entire special use. Therefore if anyone wanted to reopen this business as
another massage establishment, they would have to come before this Board and
start over with the procedure in applying for a special use.

Commissioner Dubiel asked what it means that the special use has already been
revoked. What initiated this revocation?
Mr. Ostman said it has been revoked but the language in the ordinance stating
another same use business can reopen within one year without coming in front of
the Board. He said the business was cited as a nuisance to the Village and the
business volunteered its closure and would not reapply for a business license for
a 4 year term.
Village Attorney Grcic said there was an agreement between the Village and the
license holder. It was a settlement agreement after citations were issued by the
police department. The agreement was entered as part of the administrative
hearing process. There were two independent instances of violations. One was
approximately a year ago. That resulted in a hearing. Then there was a second
instance that resulted in citations and an administrative hearing. There wasn’t a
full hearing because the respondent wanted an out of court settlement. Also, the
violations are against our code as a nuisance and there were allegations of
violation of a state statute.
Chairman Kanelos said then our protection for the Village is to revoke the
special use and any new business that wants to go in could apply for their own
special use.
Attorney Grcic said the revocation of the special use is not part of the settlement
agreement. This process was not included in the settlement agreement. It is
only for the business license revocation.
Commissioner Dubiel said regarding the findings of fact, was there a danger to
the health, welfare and safety of the public?
Attorney Grcic said yes.
Chairman Kanelos called the petitioner to the podium.
Nancy Tran, business owner, 259 Golf Mill Center, Niles, IL came forward and
was sworn in. She then read a letter she wrote because she could not find a
legal representative to come with her to this meeting. On August 16, 2017,
James Hahn [her attorney] represented her at the hearing about the violations.
He went into a private meeting with the judge. When they came out of the
meeting, she was told there were 2 options: she could go to trial but if she loses,
there would be heavy fines on each of the citations and she would never be
allowed to apply for a massage license within the Village of Niles or anywhere
else in the country. The second option is she could give up the business license
now and then could reapply for a business license after 4 years not just here but
anywhere in the country. She chose the second option to keep her professional
license but lose the business license. The judge said she could sell the business
as long as she has a sales contract and not sell to any family members. She’s

looking within the Chinatown community for a buyer. On Monday, August 21,
2017 she arrived at Niles Village Hall at 8:00 a.m. and spoke with Assistant
Community Director Rich Wlodarski. She told him she gave up the business
license. She asked when the next zoning meeting was so she may have the new
owner re-apply for the special use. Store has been closed since June. Mr.
Wlodarski told her if the store has not been closed for more than 6 months there
is no requirement. The owner can just apply for the business license. Mr.
Sylvester called her back and she asked the same questions and got the same
answers. On August 23, 2017 her prospective buyer started the application with
the mall management. On Sept. 26, 2017 the buyer received a landlord consent
contract. She brought the buyer to the Village Hall with a check for $250 to apply
for a business license. She went on to explain her rental problems and issues.
She has to keep paying her rent. If she subleases, she has to sign a personal
guarantee for the signee. She has thousands of dollars of outstanding gift
certificates and people want to know when they can be redeemed. She read
from her letter for a very long time. The prospective buyer is in the audience with
his attorney. He wants to apply for a business license and change the sign to the
new name of the company.
Commissoner Dubiel said there were 2 instances that were against the law,
correct? And you signed an agreement with the Village of Niles and your
attorney [James Hahn] present to lose your license, correct?
Ms. Tran said the first one was done without her knowledge. He was an
independent contractor since fired. Second time she believes the customer was
a scammer. She had a massage, paid and said nothing according to surveillance
footage. She left. Two days later she called 911 and said she was sexually
assaulted. Yes, she gave up the license to do business.
Commissioner Dubiel said when this special use was granted there were two
findings of fact applied. 1. The establishment named in the special use will not be
detrimental to or endanger the public health, safety or general welfare of the
public. 2. The establishment named in the special use shall in all other respects
conform to all Village of Niles ordinances. This is why you are here before this
Board. We know about the two incidents that occurred.
Attorney Grcic said it started as two separate criminal violations that led to
ordinance violations that then led to a hearing to revoke the business license.
Ms. Tran said the second violation is being continued in court and she believes
she will win because she says it is a scam.
Commissioner Dubiel said it doesn’t change the fact that you signed an
agreement to give up the business license. These are pretty serious violations.
There was a lot of discussion back and forth about her hardship.

Commissioner Dubiel asked Staff what would preclude a new buyer of this
business to come forward and apply for the same special use.
Mr. Ostman said the new applicant can come in and apply for a new special use
[if it is another massage business]. Or she can sublease to another permitted
business that does not need a special use. There are other ways to manage this
lease.
Chairman Kanelos said you’re having a potenetial owner here with his lawyer is
not an issue for this Board tonight. We have to decide if this special use is
revoked so that anyone else coming in has to go through this process and prove
they will operate the business in such a way it is not in violation of those four
criteria, especially the health, safety and welfare of the public.
What was the outcome of the first criminal case?
Ms. Tran said the independent counselor had to go to counseling and there was
unlawful surveillance. The second one was a different therapist.
Commissioner Schulter asked when the first violation occurred.
Ms. Tran said July or August 2016.
Commissioner Nakanishi asked why the Board is first hearing about this now.
Chairman Kanelos said he has no idea. This is zoning, not court. The second
incident this past summer ended up with the revocation of the business license.
Attorney Geoffrey Gist came to the podium to speak on behalf of the proposed
new buyer of the business. He wanted to present a brochure regarding the new
buyer.
Chairman Kanelos said no. We will be happy to hear information if this special
use is revoked and the new buyer comes forward to apply for a new special use.
Attorney Gist said there was a question as to whether Ms. Tran was relinquishing
her right to the special use permit.
Michelle Migasi, client of Ms. Tran, 1131 S. Knight, Park Ridge, IL came forward
and was sworn in. She came in support of Ms. Tran. She has been a client there
for a number of years. She has never had a problem there. She feels bad for
Ms.Tran. It’s too bad that Golf Mill is so quiet but she had a nice business with
some amazing masseuses.
Chairman Kanelos made a motion.
Commissioner Dubiel said in the case of 17-ZP-27 move to revoke a special
use permit for a ‘massage services establishment’ at 259 Golf Mill Center.

As findings of fact there is the testimony of Ms. Tran as to the nuisances and
violations of ordinance as well as the threat to the public health, safety and
general welfare of our community per original ordinance 2011-49.
Seconded by Commissioner Karabatsos.
Chairman Kanelos asked Commissioners Dubiel and Karabatsos if they
would accept the settlement agreement as part of the findings of fact.
Commissioner Dubiel said absolutely.
Commissioner Karabatsos said yes.
On roll call the vote was:

17-ZP-28 Requesting approval of a special use permit to allow a ‘day care
center ’ per Village Ordinance Appendix B, Section 8.2(A) at 6625
Milwaukee Avenue.
Mr. Sylvester presented this case to re-establish a day care center at 6625 N.
Milwaukee Ave. This would be an adult day care center serving the residents
of the nursing home next door and Village of Niles senior citizens. This is on
the same property as the Regency Nursing Home. It is behind an industrial
building and is zoned C-3, which requires a special use permit for a day care
center, whether it be for children or adults. The applicant is here.
There were no questions for Staff.
Chairman Kanelos called for the petitioner to approach the podium and be
sworn in.
Ae Hee Yum, 2501 Independence Blvd., Glenview, IL 60026 is the petitioner.

She is a director of nursing at Chicago Home Health Company. Her goal is to
help seniors to stay active and live a healthy life. Three reasons she requests
approval of a special use are:
1. A senior day care facility will protect the health, safety and
welfare of seniors of Niles.
2. She believes there is an unmet need for an adult day care
facility in Niles. It will help keep seniors lively and healthy in a
safe environment. It also helps families and care givers of
seniors to be productive during the workday knowing their
relatives are cared for. A day care facility in Niles will promote
healthy living for seniors.
3. Regency used to occupy this site but decided to shut down their
day care service a few years ago. According to new Illinois
requirements, nursing home owners are not allowed to have
senior day care centers since it is a conflict of interest. She is
looking to bring back this important resource to Niles.
She has a brochure about hours of operation, their mission, etc.
Commissioner Dubiel said there is a concern about the parking.
Ms. Yum said they have a van that will pick up the seniors and then take
them back home at the end of the day. There is plenty of parking at Regency
Nursing Home next door. This building belongs to the nursing home so there is
shared parking.
Mr. Sylvester said given that they bus in most of the clients, parking should
not be an issue.
Commissioner Parala asked if they will serve lunch or dinner and is there a
nurse on staff.
Ms. Yum said no dinner, just light breakfast and lunch. The rest of the day is
recreation. They are done before dark. She will be the nurse on staff.
Commissioner Nakanishi asked the longest time a person would be on the
bus for transport.
Ms. Yum said depending on location, approximately 10 to 15 minutes each
way. Some people are driven back and forth by family.
There were no further questions.

17-Sign-29 Requesting approval of a special use permit per Village
Ordinance Chapter 78, Article IX, Section 78-208 to allow a sign
at 8300 Greenwood (Our Lady of Ransom Church).
Mr. Ostman presented this case. This is to allow a multi-colored electronic
sign message board at Our Lady of Ransom Church at 8300 Greenwood Ave.
This is the exact same request Notre Dame High School had recently. This
would replace the current electronic sign. This new electronic message center
will exceed 25% of the total area of the ground sign of which it is a part. The sign
will be illuminated 24 hours a day, 7 days a week.
Commissioner Dubiel asked what is the issue that the sign would be 25%
larger than the ground sign of which it is a part.
Mr. Ostman said it is the appearance of these electronic signs up and down
Milwaukee Ave. Quite a few of them have been approved. If, for example, the
entire ground sign was 100% electronic, the visual effect along Milwaukee
Avenue would be not presented well in the business district. This is the changing
trend – the multi-colored signage.
Commissioner Dubiel asked about the illumination 24/7. So is it OK if this
sign at Our Lady of Ransom stays on 24/7?
Mr. Ostman said the major concern with these electronic signs is in the
commercial districts. It is dependent on the situation if the sign is to be on

24/7. But the language should stay in the code that it has to be requested as a
special use.
Chairman Kanelos asked if Jerry’s and Fresh Farms, to name two, signage
stays on 24/7 or do they stick to 11:00 p.m. for turning off.
Mr. Ostman said he doesn’t know.
There were no further questions.
Rev. Christopher Gustafson, the petitioner, approached the podium. He is
the pastor at Our Lady of Ransom, 8300 N. Greenwood Ave., Niles. He is also
an attorney and did not need to be sworn in.
Shown on the overhead is a picture of the current sign and also the proposed
sign. The current sign is electronic but it’s too small. The word ‘confirmation’
doesn’t even fit. The new one would be the same footprint but a smaller sign with
more space for a single message as people pass by, rather than alternating
messages. There is ability to dim it or cut it off at a certain time if there are any
issues in the neighborhood.
There are no other questions from the Commissioners or the public.
Chairman Kanelos made a motion.
Commissioner Nakanishi moved to approve item 17-Sign-29 for a
special use permit for a proposed electronic message board sign at 8300
Greenwood (Our Lady of Ransom Church). The request meets all
requirements for a special use.

17-Sign-30 Proposed amendments to the sign code sections 78-92 and
78-121.
Mr. Ostman said this is a discussion regarding the sign code. The Building and
Zoning Committee is making two recommendations to amend the sign code -
Chapter 78 [as we just heard in case 17-Sign-29]. First text amendment is the
ability to change from monochrome to multi-color. The other text amendment is
to allow temporary banners to be displayed for a period of 6 months for all
businesses.
Commissioner Dubiel said he understands that amendments to sign regulations
are not a zoning matter. If that’s true, why are we considering it tonight.
Mr. Ostman said in the language of the zoning code you do have the authority to
approve any amendments to the sign code. But it was recommended since this
Board listens to all the special uses and variations for signs. Therefore, you can
have comments on the amendments to the sign code.
Chairman Kanelos added when the Building and Zoning Committee met, they
asked this be brought to this Board to comment on and pass up the chain.
Mr. Ostman said there is nothing in the ordinance that gives this Board authority
to initiate changes.
Chairman Kanelos said however, there is nothing that would prevent this Board
from making a suggestion to the Building and Zoning Committee, who can then
review it and give it back to this Board for comment and then up the chain.
Commissioner Dubiel stated again if it is not a zoning matter then it doesn’t
belong here. If it is a zoning matter, then we get to suggest and comment on it.
Chairman Kanelos said by right, it is not a Zoning Board of Appeals matter. But
by request, this Board’s input is welcome to go back to the Building and Zoning
Committee. If they pass it, then it comes to this Board for discussion then up to
the Trustees. Technically, this Board does not have the right to review the sign
code, but they welcome suggestions.
Commissioner Dubiel said we could have a general discussion in December
where we would go over …….. and how do we enforce if the nits in the sign go
brighter, then dimmer during the course of the day.
Chairman Kanelos said they can ask an expert where, if there are 5,000 nits
there may be a slight change if you go from white lettering to yellow lettering, or
whatever. But that there not be a significant brightening or darkening…….

Commissioner Dubiel said would it be better to write this as not to exceed 5,000
nits. Clearly white light is going to be brighter than green light.
Mr. Ostman said his recommendation is if we are going to come back and
discuss additional code information next month, he can do some research.
Commissioner Dubiel moved to table 17-Sign-30 proposed amendments to
the sign code sections 78-92 and 78-121 until December.
