CALL TO ORDER/ROLL CALL The Niles Planning and Zoning Board was called to order at 7:02 P.M. All rose for the Pledge of Allegiance. PRESENT: 7 Chairman Thomas Kanelos, Commissioners Ted Karabatsos, Susan DeBartolo, Robert Schulter, Barbara Nakanishi, Terrence McConville and Morgan Dubiel Also present was Director of Community Development Charles Ostman, Senior Planner Ron Traub and Village Attorney Danielle Grcic. [Ms. Grcic arrived at 7:20]. . APPROVAL OF MINUTES Chairman Kanelos asked if there were any additions, clarifications or corrections to the minutes of June 3, 2019. There were none. Commissioner Dubiel moved to approve the minutes of June 3, 2019. Seconded by Commissioner DeBartolo, on roll call the vote was: AYES 6 Dubiel, Karabatsos, DeBartolo, Schulter, McConville, Kanelos NAYS: 0 ABSTAIN: 1 Nakanishi There being six (6) affirmative votes the motion carried. OLD BUSINESS 18-ZP-28, Grosse Pointe Manor, 6601 W. Touhy Ave. Charles Ostman, Director of Community Development, presented the information about this case. The owner, Sherry Mauer, and architect, Alan Freiberg, of Grosse Pointe Manor, have submitted a new set of plans regarding the requested parking variance. The parking will be reconfigured to meet the Village of Niles requirements consistent with the addition to the building and increasing the number of beds by 21. Chairman Kanelos made a motion to continue this case to the next meeting, September 9, 2019. Commissioner Dubiel moved to continue case 18-ZP-28 to September 9, 2019. Seconded by Commissioner Schulter, on roll call the vote was: AYES 7 Dubiel, Karabatsos, DeBartolo, Schulter, Nakanishi, McConville, Kanelos NAYS: 0 There being seven (7) affirmative votes the motion carried. NEW BUSINESS 19-ZP-08, Chase Bank, 9300 N. Milwaukee Ave. A request for approval of a special use permit to allow a financial institution in the C-2 zoning district per Niles Zoning Ordinance Section 8.2 at 9300 N. Milwaukee Ave., doing business as Chase Bank. Ron Traub, Senior Planner, presented this case. He explained that Chase Bank already has a presence in the Village of Niles and is looking to build a new, state of the art bank at 9300 N. Milwaukee. They will be closing the branch that is at Golf Rd. and Milwaukee Ave. in the Wal-Mart center. Plans for the new bank are shown on the overhead screen detailing location, layout and the like. There was discussion about whether or not this new bank is necessary for the public convenience. Chase is also requesting a special use permit to allow a drive-thru facility [19-ZP-09] and a preliminary plat of subdivision for the property [19-ZP-10]. Chairman Kanelos asked the petitioners to come forward. Terry Roswick, Chase Bank, 10 S. Dearborn St., Chicago, IL and Tim Meseck, Architects Partnership, Ltd., 200 S. Michigan Ave., Suite 1020, Chicago, IL came to the podium and were sworn in. They each spoke and told of the need for a bank that is up to the 21st century standards of technology. The floor plan of the bank was explained with an ATM lobby in the entryway, then a living room type area, followed by offices Page 3 of 8 Planning and Zoning Board Final Approved Meeting Minutes August 12, 2019 ________________________________________________________________________ and/or cubicles for more private conversations with patrons and ending with tellers at the far end of the building. Chairman Kanelos said he felt that was a long walk to get to a teller. Mr. Roswick stated not as many people use tellers anymore since so much banking is done online or at ATM machines. Banks are getting more into wealth management and areas whey they may have to sit down with a customer and deal with whatever it is they are requesting, not so much deposits and withdrawals. Commissioner Dubiel verified Chase will be closing the branch in the Wal- Mart Center. He asked what would become of that building. Mr. Roswick is not sure if Chase actually owns the building. Whether they do or not, it would probably have to be demolished to make way for another kind of business. Even if another bank went in there, it would have to be brought up to date with technology. The employees from that branch will be moved to this new location. There is also a satellite branch across the street from this proposed new location. It is in a smaller center and that will be closed as well, bringing those employees to the new building. Chairman Kanelos asked again about this being necessary for the public convenience. There are now 10 different banks in Niles, some part of a big group; others are smaller and independent. He was assured by the representatives this bank will be an asset to the community. At this time he entertained a motion. He also said that all three items pertaining to Chase Bank will be voted on separately. Commissioner Dubiel moved to approve 19-ZP-08, requesting a special use permit to allow a financial institution in the C-2 zoning district per Niles Zoning Ordinance Section 8.2 at 9300 N. Milwaukee Ave., doing business as Chase Bank. Seconded by Commissioner Nakanishi, on roll call the vote was: AYES 6 Dubiel, Karabatsos, DeBartolo, Schulter, Nakanishi, McConville NAYS: 1 Kanelos There being six (6) affirmative votes the motion carried. Chairman Kanelos stated this Board is a recommending Board to the Board of Trustees who can either confirm or negate this recommendation. It will be necessary for the petitioner to contact Mr. Ostman and ask to be placed on the Board of Trustees agenda. This is to add a second floor to an existing one-story home at 7850 Nora Ave. There will be a 1 ft. 2 in. encroachment on the property line Chairman Kanelos called the petitioner to the podium to be sworn in. Loukas Spiradakos, 7850 Nora Ave., Niles, had nothing to add to the information already given. Commissioner Dubiel moved to approve item 19-ZP-11, a request for a variation from Niles Zoning Ordinance Section 4.3 for side yard requirements for a proposed second-floor addition to an existing one-story home at 7850 Nora Ave. Seconded by Commissioner DeBartolo, on roll call the vote was: AYES 7 Dubiel, Karabatsos, DeBartolo, Schulter, Nakanishi, McConville, Kanelos NAYS: 0 There being seven (7) affirmative votes the motion carried. 19-ZP-12, Athletico, 7119 Dempster Street. A request for approval of a special use permit to allow a medical/dental clinic in the C-2 zoning district per Niles Zoning Ordinance Section 8.2 at 7119 Dempster St., doing business as Athletico. 19-ZP-13, Athletico, 7119 Dempster Street. A request for approval of a variation from the Niles Zoning Ordinance Section 5.1(A)3 requiring ground floor uses on corner lots are limited to those listed under the “Retail” category within 250” along the lot line, for the property at 7119 Dempster St., doing business as Athletico. Ron Traub presented both cases. Athletico has outgrown its current location in Morton Grove. This is also on Dempster Street approximately 5 blocks east of the proposed location. The following two people were sworn in to offer testimony for this case. Richard Gordon, architect, 1200 Shermer Road, Northbrook, IL Jennifer Wingelink, Athletico Project Manager, 625 Enterprise Dr., Oak Brook, IL Additionally, two lawyers who came to the podium did not need to be sworn in: Gary Annes, 2785 Greenwood, Highland Park, IL Michael Annes, 725 College Place, Highland Park, IL Ms. Wingelink reiterated Athletico had outgrown the facility where they are currently located. She stated there is a demand for physical therapy services in the area. Chairman Kanelos stated to Mr. Ostman that perhaps the designation of physical therapy companies as medical/dental clinics needs to be revisited but for now that is the description. He entertained a motion for both requests to be voted on together. Commissioner Dubiel moved to approve 19-ZP-12, requesting approval of a special use permit to allow a medical/dental clinic in the C-2 zoning district per Niles Zoning Ordinance Section 8.2 at 7119 Dempster St., doing business as Athletico and 19-ZP-13, a request for approval of a variation from the Niles Zoning Ordinance Section 5.1(A)3 requiring ground floor uses on corner lots are limited to those listed under the “Retail” category within 250” along the lot line, for the property at 7119 Dempster St., doing business as Athletico.
