A quorum was present. 35 36 Review of Minutes 37 Commissioner Katz moved, seconded by Commissioner Menn, to approve the July 10, 2014 Architectural 38 Control Commission (ACC) meeting minutes as submitted. On a voice vote, the motion was 39 unanimously carried. 40 41 Public Comments Regarding Items Not on the Agenda 42 Robert Boiko, of the Northbrook Electrical Commission and member of the National Board of Boiler and 43 Pressure Vessel Inspectors, addressed the Commission. He provided information on exploding CVPC 44 plastic pipes and discussed the study being done by Sandy Labs. He discussed what happens when CVPC 45 pipes are heated. Director Poupard added that the new plumbing code issued by the State of Illinois in 46 2014 is what the Village is following. There was brief discussion of the plumbing code amendment. The 47 Commission thanked Mr. Boiko for speaking. 1 1 Review of Building Permit Extension Request – 1722 Chapel Court 2 Assistant Director Nick Desario provided background information to the Commission including that the 3 permit for this property expired on August 8, 2014 and the foundation is not yet completed. He 4 directed the Commission’s attention to the permit extension request packet that included photographs 5 which portray the existing conditions as well as a letter from the general contractor conveying the 6 circumstances associated with the subject development, a request for the permit extension and a 7 construction schedule detailing the sequence of construction to justify the additional period of 8 requested time. Mr. Desario also mentioned that a neighbor had written a letter describing her 9 frustration with the construction. There was a review of the site plan for 1722 Chapel. Director Poupard 10 said that as a part of the history of this permit, revisions were submitted soon after the permit was 11 issued. Construction was delayed until several months after the permit was issued. 12 13 Greg Faynshtein, general contractor, and Lenny Goldfarb, Property Owner 1722 Chapel Court, 14 addressed the Commission and relayed problems encountered including a shoring issue, soil tests that 15 were not completed by engineer, requirement of hand pruning along the driveway and a number of 16 additional issues and problems that have been encountered. Additionally, Mr. Faynshtein discussed 17 problems with the swimming pool and stated dates of the delays back to last November. 18 19 Chairman Schwall inquired about the accuracy of the dates and delays. Assistant Director Desario said 20 that the phased pouring of the foundation has caused delays and the foundation will take at least three 21 more weeks to finish. 22 23 Chairman Schwall said that after a year and not having the foundation complete is simply unacceptable 24 and is a burden on the neighbors. He said it is unacceptable that it has taken a year for the foundation 25 and there has to be consideration given to the neighbors. An extension is needed to finish this project, 26 but there has to be accountability along the way of that extension. 27 28 The Commission agreed that the schedule presented by the builder is not realistic. The Commission 29 asked the homeowner and developer to come back next month with a more realistic schedule and at 30 that meeting the Commission will set out guidelines that will need to be met in 2 or 3 month segments. 31 It is likely that the Commission will request the homeowner and developer return every two months to 32 give a progress report on construction. There was also discussion of what type of fees can be attached 33 to this type of an extension. 34 35 At this time, the Commission moved to Agenda Item #8, New Business for discussion. 36 37 New Business 38 39 Discussion included review of the project at 560 Pfingsten Road. The permit for that project expired last 40 March. The neighbors are very unhappy at the condition of the site. The homeowner is not able to 41 financially complete the project. There are many property maintenance violations and the Commission 42 reviewed photos of the site showing the violations. The house is uninhabitable. 43 44 Chairman Schwall said that a guideline is needed on how to handle this type of situation and anticipates 45 there will be similar situations in the future. Director Poupard said he would follow-up with the Village 46 Attorney regarding what fee or fine can be imposed for situations like this at 560 Pfingsten Road. There 47 was discussion and the Commission directed that the house and yard need to be cleaned up. 48 2 1 Development and Planning Services Department Activity Update and ACC Work Priorities 2 Last month, Director Poupard presented an overview of department activity and the proposed goals and 3 objectives planned for the Department of Development and Planning Services for the fiscal year of May 4 1, 2014 to April 30, 2015. Since that time, the plumbing code has taken a priority. Director Poupard 5 discussed the plumbing code overhaul by the State of Illinois. He said his goal was to present the draft 6 plumbing code amendments to the State of Illinois by the end of the month to get approval before the 7 code is adopted. Discussion included that local amendments are voided by the state code. The 8 plumbing code is the number one priority right now. Contractors can follow the state code and not the 9 local code. There will be more discussion at the next meeting on this topic. 10 11 New Single Family Home Elevations 12 Staff member Tom Poupard announced that there were 5 homes on the agenda for discussion and 13 review. Commission members reviewed the individual homes as presented in the packet. New single 14 family home elevations for consideration include: 15 a. 808 Cedar Lane (R-4 District) – William Brown, Architect 16 b. 2533 Walters Ave. (R-5 District) – W.K. Olson, Architect 17 c. 2300 Ash Lane (R-4 District) – G.O. Architectural Design, Architect 18 d. 1224 Glenoak Lane (R-4 District) – JMB Architects 19 e. 1042 Hillside Road (R-4 District) – John Y Kim, Architect 20 21 Commissioner Katz motioned, seconded by Commissioner Menn, to approve the elevations of the five 22 homes as presented. On a voice vote, the motion was approved unanimously. 23 24 Old Business 25 There was no old business. 26 27 Adjourn 28 There being no further business, Commissioner Menn moved, seconded by Commissioner Katz, to 29 adjourn the meeting.
