34 Chairman Alan Schwall called the meeting to order in the Development and Planning Services Conference Room
35 of Village Hall, 1225 Cedar Lane, at 5:33 p.m.

38 Chairman Schwall called the roll. A quorum was present.

40 Review of Minutes
41 Commissioner Menn moved, seconded by Commissioner Town, to approve the August 14, 2014 Architectural
42 Control Commission (ACC) meeting minutes as submitted. On a voice vote, the motion was unanimously
43 carried.

1 Continued Review of Building Permit Extension Request – 1722 Chapel Court
2 Assistant Director Nick Desario provided an update on the property at 1722 Chapel Court including that since
3 the ACC met on August 14 there has been an embankment failure on the south side of the excavation. The
4 original concrete contractor, Batista Concrete, is no longer on the site and a new concrete contractor, Krueger
5 Concrete, has been hired. A stop-work order has been issued. A slide show presentation of photos of the site
6 included the embankment failure. The photos show that the foundation was complete but there was no drain
7 tile installed.

9 Property owner Lenny Goldfarb and Greg Faynshtein of Phoenix Construction Group also spoke to say that a
10 new concrete contractor has been hired. Art Krueger gave a description of what he planned to do on the site
11 including completion of shoring on Monday, September 15, 2014. There was discussion of the rest of the
12 property that has not yet failed. There was also discussion of what material should be used to do backfill so the
13 trees do not die. It was recommended that the Village arborist/forester be asked about what material to use for
14 backfill. There was discussion by Krueger Concrete of their proposed schedule and grading materials for
15 structural fill. Krueger predicted it would take five weeks for concrete work to be complete.

17 Tom Poupard said that the Village Attorney has advised and recommended drawing up a simple agreement
18 between the Village and the Homeowner setting forth important milestones and if these are not met than the
19 Village would revoke the building permit. This would mean that if the permit was revoked then the Homeowner
20 would have to reapply and pay the fees again. This could continue to happen every month if schedule is not
21 met. The original building permit fee was $12,345.

23 Chairman Schwall said this entire situation is ridiculous and has caused problems for the neighbors and it is
24 critical to get this construction moving. It was recommended by the ACC that a schedule will be put together by
25 the Contractor and the Village and put on the ACC agenda for the next few months to monitor for progress.
26 Chairman Schwall said the ACC will enforce a very strict schedule. It was also requested that the schedule be
27 provided to the ACC members in advance of the next meeting – with the packet – so there is time to review.
28 Chairman Schwall wants the agreement ready for signing by all parties at the next ACC meeting.

30 Mrs. Risenger, neighbor to 1722 Chapel Court, and her daughter both spoke of their concerns for the existing
31 trees, the danger presented by the site and the length of time this construction has taken. Mrs. Risenger is
32 looking for a guarantee for the trees and it was determined that will be addressed in the agreement.

34 The Commission members agreed to continue discussion of this matter at the next meeting and to see what
35 progress has been made. They also asked to see a copy of the draft agreement from the Village Attorney when
36 it was ready.

38 99 Pointe Drive (Plan Commission Docket No. 14-09) – Review of Proposed Northbrook Inn Memory Care
39 Facility (Building Design & Materials, Signage and Landscape)
40 David Schoon, Village Assistant Director/Development and Planning Services, gave a presentation of the
41 proposed building, signage and landscaping as part of an application submitted by RJ Development, LLC on
42 behalf of Koelsch Senior Communities for a proposed assisted living memory care facility on the property
43 located at 99 Pointe Drive. The plan includes a 36,000 square foot, 69-bed, single-story assisted living facility.
44 The site design, building design and landscaping were discussed. Austin Groves of RJ Development answered
45 questions regarding the setback relief request. There was discussion about the closeness of the building to the
46 sidewalk. There was discussion of the stucco wall and police concerns of possible graffiti at this location. Many
47 issues were discussed including the monument sign and possibility of putting signage into the wall or perhaps ivy
48 to “soften” this corner wall. There was also discussion of making the corner sign angled or rounded. Austin also

1 displayed sample materials that will be used in the construction including the brick, the limestone and roofing
2 shingles.

4 Member Menn motioned, seconded by Member Katz, to approve the renderings and drawings with the
5 recommendation to work on the NW corner exterior fence wall to be softened with a combination of
6 landscaping and piers and one-foot for landscape between the wall and the sidewalk or adding a 45 degree
7 corner with pillars. On a voice vote, there were all ayes and the motion was approved.

9 Draft Amendments to Plumbing Code and General Building Code Update Schedule
10 Tom Poupard, Village Director Development and Planning Services, gave an update on the plumbing code –
11 specifically the village code interacting with the state code. He reported that the State of Illinois is now more
12 aggressively involved with the municipal codes. The IDPH doesn’t like the municipalities to use the international
13 code. The IDPH prefers municipalities to tell them what amendments they would like to have to the state code
14 instead of using the international code. There was discussion on how the code has been simplified. Director
15 Poupard said that it is a goal to present other amendments at the next meeting.

17 New Single Family Home Elevations
18 Director Poupard announced that there were 2 homes on the agenda for discussion and review. Commission
19 members reviewed the individual homes as presented in the packet. New single family home elevations for
20 consideration include:

22 a. 3460 Cornflower Trail (R-3 District) – Clifford Town, Architect
23 b. 440 Melvin Drive (R-3 District) – Clifford Town, Architect

25 Commissioner Katz motioned, seconded by Commissioner Menn, to approve the elevations of the two homes as
26 presented. On a voice vote, the motion was approved unanimously. Member Town abstained from voting.

28 New Business
29 Director Poupard said that in the very near future, permits would be issued in the Village for a Mariano’s Store,
30 Zengeler’s and a new residential building.

36 There being no further business, Commissioner Menn moved, seconded by Commissioner Katz, to adjourn the
37 meeting. On a voice vote, the motion unanimously carried and the meeting adjourned at 7:02 pm.
