1 Approved 2 MINUTES OF A MEETING OF THE ZONING BOARD OF APPEALS 3 VILLAGE OF NORTHBROOK 4 COOK COUNTY, ILLINOIS 5 October 27, 2014 6 7 Call to Order 8 Chairman Decker called the meeting to order at 8:02 p.m. in the Board Room of Village Hall. Chairman 9 Decker and Members Geslicki, Sussholz, Schofield and Wolfmark were present. Members Craig and 10 Lown were absent. A quorum was present. 11 Village Staff present included Tom Poupard, Director Development and Planning Services, Village of 12 Northbrook; and Denise Kauffman, Recorder. 13 Review of Minutes 14 Member Schofield, seconded by Member Wolfmark, moved to approve the minutes of the September 15 22, 2014 meeting, as presented. On a voice vote, the motion carried unanimously. 16 General Public Comments 17 There were no comments. 18 Chairman Decker announced that the docket would first be heard in the public hearing portion of the 19 meeting. ZBA deliberation and decision regarding the docket would occur immediately following the 20 hearing, during the regular meeting. It was announced that if members of the audience are not able to 21 stay for the regular meeting, they can contact the Zoning Administrator for results. Petitioners will be 22 sworn in and should address the Board. Neighbors within 250 ft. were notified of each new petition. As 23 required by state statute, the hearing notice for all new dockets was properly published in the 24 Northbrook Star on October 9, 2014. 25 Public Hearing and Consideration of the Following Petitions: 26 DOCKET NO. 14-Z-16 (1802 Oak Avenue – New Single Family Home) – Petition by Matthew D. and 27 Jessica C. Love, as property owners, for a Zoning Code variation to reduce the required corner side yard 28 setback requirements for a building in the R-5, Single Family Residential District from 25 feet to 19.14 29 feet. The Property is commonly known as 1802 Oak Avenue (PREI No 04-10-312-021-0000) and is the 30 site of an existing single-family home. The variation has been requested to allow the construction of a 31 new two-story single-family home on the Property. 32 Petitioners Matthew and Jessica Love were sworn in. Matthew Love addressed the ZBA to 33 discuss the proposed variation and said that not having a variation would cause hardship to the 34 neighbor to the west and he said that the existing setbacks in the neighborhood would be met by the 35 variance. Jessica Love said this variance would keep in character of the neighborhood as it exists and 36 the variance would allow for landscaping. Mr. and Mrs. Love pointed out that several neighbors were 37 present in the audience to express their support. There are also letters from additional neighbors that 38 have been provided to show their support. There were no comments from the audience. 39 Motion by Member Sussholz, seconded by Member Geslicki to close the public hearing. On a 40 voice vote, there were all ayes and the motion passed. 1 In the regular meeting, Commission members discussed that the existing home has a setback of 2 19.1 feet. There was no further discussion. 3 Member Schofield moved, seconded by Member Geslicki, to accept the proposed variation 4 request by Matthew D. and Jessica C. Love for a Zoning Code variation to reduce the required corner 5 side yard setback requirements for a building in the R-5, Single Family Residential District from 25 feet to 6 19.14 feet commonly known as 1802 Oak Avenue (PREI No 04-10-312-021-0000), subject to the 7 following conditions: If approved, the house is constructed in substantial compliance with the plans and 8 materials dated 9-24-14 reviewed by the Zoning Board of Appeals 10-27-14 and as confirmed with the 9 applicant, the open stairways will not project more than 3 feet from the exterior walls of the house and 10 not exceed 4 feet in height, as measured from grade to the top level of decking. 11 On a roll call vote, Members Geslicki, Sussholz, Wolfmark, Schofield and Decker voted aye. 12 Motion passes. 13 DOCKET NO. 14-Z-17 (420 Academy Drive – Parking Lot Addition) -- Petition by Korman Lederer and 14 Associates, LLC of Northbrook on behalf of 420 Academy Drive, LLC, as property owners, for a Zoning 15 Code variation to reduce the required front yard requirements of the I-1, Restricted Industrial, zoning 16 district from for a parking lot from 30 feet to 11.99 feet. The property is commonly known as 420 17 Academy Drive (04-05-301-007-0000), and is the site of an existing industrial building and parking lot. 18 The variation is requested to allow the construction of an expanded parking lot along the Doolittle Drive 19 frontage of the property. 20 Petitioner Patrick Lederer was sworn in. He gave background information to the ZBA including 21 that the tenant for the building is Underground Devices, a plastic manufacturer. He said his father built 22 the building 40 years ago and now they need to add more parking. They are petitioning to add 14 spots 23 and this will bring the parking in compliance with the Village Code. At peak hours, there are 35 24 employees at the building during two different shifts. Currently the building doesn’t conform to Village 25 Code by 12 spaces and this proposal is to add 14 spaces. Discussion included that there are 34 spaces 26 now and with the addition of the 14 spaces there will be 48 parking spaces. There was also discussion 27 about the landscaping and Lederer said they will add landscaping to comply with the Village code. The 28 landscape code was discussed and included that two trees added must be located no more than 5’ 29 outside the perimeter of the paved area. Discussion also included re-striping parking spaces to provide 30 two handicap accessible spaces. Discussion that this parking variance will be off street parking and 31 others on Doolittle Drive have variance for street parking. There was discussion of lighting for the 32 parking lot and if it is sufficient. Tom Poupard said the Village has a lighting requirement and it would 33 need to be met. 34 No members of the audience wished to speak. 35 Motion by Schofield, seconded by Geslicki, to close the public hearing. On a voice vote, all ayes 36 and motion was approved. In the regular meeting there was no further discussion. 37 Motion by Sussholz, seconded by Geslicki, to accept the proposed variation request by Korman 38 Lederer and Associates, LLC of Northbrook on behalf of 420 Academy Drive, LLC, as property owners, for 39 a Zoning Code variation to reduce the required front yard requirements of the I-1, Restricted Industrial, 40 zoning district for a parking lot from 30 feet to 11.99 feet. The property is commonly known as 420 41 Academy Drive (04-05-301-007-0000). The purpose of the variation is to allow the construction of an 42 expanded parking lot along the Doolittle Drive frontage of the property, subject to the following 43 conditions: that the addition be constructed in substantial compliance with the plans dated 9/11/14 and 44 reviewed by the Zoning Board of Appeals 10/27/14; and provide the additional landscaping as required 45 by Code. 1 On a roll call vote, Members Geslicki, Sussholz, Wolfmark, Schofield and Decker all voted aye. Any appeal of this final administrative decision of the Village of Northbrook’s Zoning Board of Appeals must be in compliance with the Administrative Review Law, 735 ILCS 5/3-101 et seq and filed within 35 days from the date of the ZBA’s decision. The Village of Northbrook is subject to the requirements of the Americans with Disabilities Act of 1990.
