CITY OF NORWALK AQUIFER PROTECTION AGENCY - MEETING MINUTES November 20, 2024 PRESENT: Nick Kantor, Chair; Diana Lenkowsky; Tammy Langalis; Ana Tabachneck; Galen Wells; Louis Schulman; Richard Roina; Jacquen Jordan-Byron; Hector Pachas STAFF: Alexis Cherichetti I. CALL TO ORDER The meeting was called to order at 5:55 p.m. It should be noted that this meeting was held on Zoom.com with participants calling in, separately. II. ROLL CALL Ms. Cherichetti called the roll. III. SEATING OF MEMBERS IV. REGISTRATION APPLICATIONS A. Receipt of New Applications for Re-Registration – Review and decision a) #RA-24-98 – 347 Main Avenue – Global Montello Group Corp. d/b/a Global Service Station #7180 – APA Registration application for active underground storage/transmission of petroleum and retail oil or petroleum dispensing (action by April 16, 2025 meeting) b) #RA24-99 – 28, 42, 44 Slocum Street – Hutchinson Tree Care Specialists, Inc. – APA Registration application for active pesticide services (action by April 16, 2025 meeting) c) #RA24-100 – 131 New Canaan Avenue – Interlagos Auto Repair – APA Registration for active repair/maintenance of vehicles (action by April 16, 2025 meeting) d) #RA24-101- 87 New Canaan Avenue – New Canaan Service Inc. d/b/a New Canaan Ave. Mobil Station – APA Registration application for active underground storage/transmission of peroleum, retail oil or petroleum dispensing and repair/maintenance of vehicles (action by April 16, 2025 meeting) e) #RA24-102 – 120 New Canaan Avenue - Town Plaza Associates LLC – APA Registration application for inactive dry cleaning service (action by April 16, 2025 meeting) Ms. Cherichetti reviewed the Registration application process. She indicated items b) and d) on the agenda were complete and ready for formal acceptance by the Agency. She noted the other three items were currently incomplete but were missing minor items. She stated they would be complete well before the 180-day review period was upon them. *** MS. TABACHNECK MADE A MOTION TO ACCEPT REGISTRATION APPLICATIONS #RA24-99 AND #RA24-101 AS COMPLETE. Pending Applications for Re-Registration a) #RA24-97 - 2 Muller Avenue – SLI Norwalk LLC d/b/a Shawn’s Lawns – APA Registration application for active retail oil or petroleum dispensing and repair/maintenance of vehicles (action by January 22, 2025 meeting) Ms. Cherichetti stated this Registration application was received in July 2024; the deadline to make a determination would be the January 22, 2025 deadline. She explained she had been in communication with the applicant. Though the facility owner had been working to complete all the steps needed to submit a complete registration, they would not be able to be complete by the January meeting. She recommended rejecting the current registration application and providing the facility will a new deadline of May 7, 2025 to submit a complete application. *** MS. LANGALIS MADE A MOTION TO REJECT REGISTRATION APPLICATION #RA24-97 AS INCOMPLETE AND SET A NEW DEADLINE OF MAY 7, 2025 TO SUBMIT A COMPLETE APPLICATION. *** MS. TABACHNECK SECONDED THE MOTION. *** MOTION PASSED UNANIMOUSLY WITH ONE ABSTENTION (PACHAS). V. DISCUSSION a) Discussion regarding APA Citation & Fine Ordinance Ms. Cherichetti stated she had met with the staff for the Ordinance Committee to discuss a proposing an Aquifer Citation & Fine Ordinance to the Committee. Attorney Candela, Law Department staff, is working on drafting possible language of such ordinance. VI. 2025 MEETING CALENDAR Ms. Cherichetti presented the proposed meeting schedule for the upcoming year. Due to the 5-year cycle of registration applications, she recommended the Agency meet more frequently than the quarterly schedule adopted for the current year. VII. APPROVAL OF MINUTES a) August 21, 2024 meeting minutes *** MR. SCHULMAN MADE A MOTION TO ACCEPT THE MEETING MINUTES OF AUGUST 21, 2024. *** MS. TABACHNECK SECONDED. *** MOTION PASSED UNANIMOUSLY. Members of the public who wish to provide public comment on a specific application are encouraged to submit those via email in advance of the meeting.
