Call To Order Chair Abu-Taleb called the meeting to order at 2:12 P.M. He authorized a statement be read providing that this meeting is being held remotely due to COVID-19 restrictions and guidelines and that it is not prudent to have people present in person due to public health concerns related to that pandemic. 2. Roll Call of Electoral Board (Abu-Taleb, Taglia, Scaman) Present: 3 - Chair Anan Abu-Taleb, Member Vicki Scaman, and Member James Taglia Absent: 0 Also Present: Board Secretary Christina Waters and Village Attorney Paul Stephanides 3. Agenda Approval Village Attorney Paul Stephanides asked both parties if there was an objection to hearing case 2020-2, Peppard v. Enyia before hearing case 2020-1, Peppard v. Clark. There was no objection from either party. It was moved by Member Taglia, seconded by Member Scaman to approve the agenda as amended. A roll call vote was taken and the motion was approved. The vote was as follows: Ayes: Chair Abu-Taleb, Member Scaman, Member Taglia Nayes: none 4. Motion to Approve Minutes from the January 6, 2021 meeting of the Municipal Officers Electoral Board of the Village of Oak Park. A. MOT 21-7 Motion to Approve Minutes from the January 6, 2021 meeting of the Municipal Officers Electoral Board of the Village of Oak Park. A roll call vote was taken and the motion was approved. The vote was as follows: Ayes: Chair Abu-Taleb, Member Scaman, Member Taglia Nayes: none 5. Call of the Docket C. ID 21-34 Reconvene hearing in Case No. 2020-2, Peppard v. Enyia Village Attorney Stephanides called the reconvening of Case No. 2020-2, Peppard v. Enyia. Mr. Mullen provided an argument in response to an additional exhibit filed by Mr. Peppard. Mr. Peppard countered Mr. Mullen's argument. After discussion, Member Scaman, Member Taglia and Chair Abu-Taleb agreed that Mr. Peppard, the objector, did not meet the burden of proof to remove Mr. Enyia, the candidate, from the ballot and determined that Case No. 2020-2, Peppard v. Enyia should be dismissed. It was moved by Member Taglia and seconded by Member Scaman to dismiss and overrule the verified objection in Case No. 2020-2, Peppard v. Enyia. A roll call vote was taken and the motion was approved. The vote was as follows: Ayes: Chair Abu-Taleb, Member Scaman, Member Taglia Nayes: none All parties agreed to recess until Tuesday, January 14, 2021 at 2:00 P.M. CST for the issuance of findings, decision and order in Case No. 2020-2. B. ID 21-33 Reconvene hearing in Case No. 2020-1, Peppard v. Clark Village Attorney Stephanides called the reconvening of Case No. 2020-1, Peppard v. Clark Mr. Peppard and Mr. Mullen provided opening statements before members of the Electoral Board. Mr. Peppard and Mr. Mullen presented evidence to the Electoral Board. After evidence, testimony and cross-examination was concluded all parties involved agreed to any additional evidence and filing of closing briefs to be provided to the Electoral Board by January 14, 2021 at 5:00 p.m. and Village of Oak Park Page 2 Printed on 1/19/2021 Municipal Officers Electoral Board Meeting Minutes January 12, 2021 of the Village of Oak Park reconvene Case No. 2020-1, Peppard v. Clark on January 19, 2021 at 10:30 A.M. Member Taglia moved to recess Case No, 2020-1, Peppard v Clark, with the intent of reconvening on January 19, 2021 at 10:30 A.M. Member Scaman seconded the motion. A roll call vote was taken. The motion was approved. The roll call vote was as follows: Ayes: Chair Abu-Taleb, Member Scaman, and Member Taglia Nayes: none 6. Public Comment Attorney Stephanides reminded members of the Board that public comment is not testimony or evidence to be considered when making decisions for the hearing. Reverend John Edgerton: Reverend Edgerton provided a comment in support of Village Trustee candidate Chibuike Enyia to remain on the ballot. 7. Adjournment or Recess of Electoral Board Case No. 2020-1, Peppard v. Clark was recessed until January 19, 2021 at 10:30 A.M. 123 Madison Street Village of Oak Park Oak Park, Illinois 60302 www.oak-park.us Meeting Agenda Municipal Officers Electoral Board of the Village of Oak Park Tuesday, January 12, 2021 2:00 PM Remote Meeting PLEASE TAKE NOTICE that Chair Anan Abu-Taleb, Village Trustee James Taglia and Village Clerk Vicki Scaman constituting the Municipal Officers Electoral Board of the Village of Oak Park (“Electoral Board”) for the hearing and passing upon of objections to nomination papers for candidates in the Village of Oak Park to be voted upon by the electors of the Village of Oak Park at the April 6, 2021 Consolidated Election, will hold a meeting remotely with live audio available and optional video on January 12, 2021 at 2:00 p.m. The meeting will be streamed live and archived online for on-demand viewing at www.oak-park.us/boardtv as well as cablecast on VOP-TV, which is available to Comcast subscribers on channel 6 and ATT U-Verse subscribers on channel 99. The remote meeting is authorized pursuant to Section 7(e) of the Open Meetings Act. The Village President has determined that an in-person meeting is not practical or prudent due to the COVID-19 outbreak during Governor JB Pritzker’s current disaster proclamation. It is also not feasible to have a person present at the meeting due to public safety concerns related to the COVID-19 outbreak. 1. Call To Order 2.
