Call to Order Village President Pro Tem Tucker called the meeting to order at 7:00 P.M. II. Roll Call Present: 4- Village Trustee Barber, Village Trustee Lueck, Village Trustee Salzman, and Village Trustee Tucker Absent: 3- Village Trustee Brewer, Village Trustee Ott, and Village President Abu-Taleb III. Consideration of Motion to Adjourn to Executive Session to Discuss Litigation. It was moved by Village Trustee Salzman, seconded by Village Trustee Barber, to enter into Executive Session pursuant to 5 ILCS 120/2(c)(11) - discussion of litigation. The motion was approved. The roll call on the vote was as follows: AYES: 4- Village Trustee Barber, Village Trustee Lueck, Village Trustee Salzman, and Village Trustee Tucker NAYS: 0 ABSENT: 3- Village Trustee Brewer, Village Trustee Ott, and Village President Abu-Taleb V. Agenda Approval It was moved by Village Trustee Lueck, seconded by Village Trustee Barber, to approve the agenda. A voice vote was taken and the motion was approved. VIII. Minutes A. MOT 15-058 Motion to Approve Minutes for March 9, 2015 Special Meeting of the Village Board, March 16, 2015 Regular Meeting of the Village Board and March 23, 2015 Special Meeting of the Village Board. A voice vote was taken and the motion was approved. IX. Non-Agenda Public Comment There was no non-agenda public comment. X. Proclamation B. MOT 15-059 Motion to Approve Proclamation for National Public Safety Telecommunications Week of April 12th through April 18th. Village President Pro Tem Tucker read the Proclamation aloud. A voice vote was taken and the Proclamation was approved. XI. Village Manager Reports Village Manager Pavlicek announced that an Earth Day celebration will be hosted by Public Works this Saturday. XII. Village Board Committees Village Trustee Barber noted that the I-Gov Committee will be hosting a forum for members from all Oak Park governing bodies on May 9. He recommended that all members of the Village Board attend. XV. Second Reading C. ORD 15-086 Second Reading and Adoption of an Ordinance Amending Chapter 7 (“Buildings”), Article 8 (“Fees”) of the Oak Park Village Code to Establish an Annual Building and Construction Permit Fees and Zoning Application Fees Ordinance Requirement. Village Attorney Paul Stephanides clarified that this ordinance will adopt an annual fee requirement. The next ordinance on the agenda establishes the fees. Director of Development Customer Services Tammie Grossman explained the method used to determine some of the fees in order for those permits to be in proportion to the cost of doing business. Other fees will become flat fees. She noted that in the past, fees were determined by using a percentage of the construction cost. The proposed new method will be more accurate in distributing the costs evenly among the permit applicants, is an easier way to calculate the fess and should result in most fees dropping slightly overall. It was moved by Village Trustee Salzman, seconded by Village Trustee Brewer, that this Ordinance be adopted. The motion was approved. ORD 15-087 Second Reading and Adoption of an Ordinance Establishing the Annual Building and Construction Permit Fees and Zoning Application Fees of the Village of Oak Park. It was moved by Village Trustee Brewer, seconded by Village Trustee Salzman, that this Ordinance be adopted. The motion was approved. The roll call on the vote was as follows: AYES: 5- Village Trustee Barber, Village Trustee Brewer, Village Trustee Lueck, Village Trustee Salzman, and Village Trustee Tucker NAYS: 0 ABSENT: 2- Village Trustee Ott, and Village President Abu-Taleb XVI. Regular Agenda E. RES 15-256 A Resolution Authorizing the Execution of a Contract with Triggi Construction, Inc., for Project 15-5, 2015 Alley Improvements, in an amount not to exceed $916,221.00. Village Manager Pavlicek stated that this is for the second phase of alley improvements and part of the 2015 Capital Improvement Program, which includes a substantially larger construction program for alley improvements per Board direction. Village Engineer Bill McKenna answered questions from the Board. Village Trustee Salzman suggested that the map indicating where the improvements are being done be available for viewing on the Village website. Village Manager Pavlicek noted that this could be done. It was moved by Village Trustee Lueck, seconded by Village Trustee Barber, that this Resolution be adopted. The motion was approved. RES 15-258 A Resolution Authorizing the Execution of a Contract with Chicagoland Paving Contractors, Inc. for Project 15-2, Resurfacing of Various Streets, in an amount not to exceed $2,339,900.00. Village Manager Pavlicek noted that this is for resurfacing of various streets and reflects an increase in the investment in infrastructure of the streets. As with the alley project, included in the packet is a map showing the location of the streets that will be improved as part of the project. It was moved by Village Trustee Brewer, seconded by Village Trustee Lueck, that this Resolution be adopted. The motion was approved. ORD 15-090 An Ordinance Amending Chapter 3 (“Alcoholic Liquor Dealers”), Article 8 (“List of Licenses for Each License Class”), Section 3-8-1 (“Number of Licenses Permitted to be Issued Per License Class”) and Section 3-8-2 (“Licenses by Name and Address Per License”) of the Oak Park Village Code to Remove Certain Businesses. .End It was moved by Village Trustee Barber, seconded by Village Trustee Tucker, that this Ordinance be adopted. RES 15-251 A Resolution Awarding a Small Rental Property Rehabilitation Loan and Authorizing the Execution of a Loan Commitment and Agreement (SPR-028). This Resolution was adopted. RES 15-253 A Resolution Authorizing the Execution of an Agreement with the Oak Park Education Foundation for the Hosting of a One Week Summer Camp at the Public Works Center. This Resolution was adopted. P. RES 15-254 A Resolution Approving an Agreement between the Village of Oak Park and Wireless Bridge Partners, LLC and Authorizing Its Execution. This Resolution was adopted. Q. RES 15-255 A Resolution Authorizing Renewal of an Agreement with McAdam Landscaping, Inc., for FY 2015 Parkway Tree Watering in an Amount not to Exceed $35,000.00. This Resolution was adopted. R. RES 15-259 A Resolution Authorizing Execution of an Amendment to the Power Supply Agreement with Constellation NewEnergy, Inc., for the Oak Park Community Choice Aggregation Program Period of June 2015 through August 2015. This Resolution was adopted. S. ORD 15-093 An Ordinance Providing For Abatment of $1,524,400 of the 2014 Tax Levy (2010A General Obligation Corporate Purpose Bonds) This Ordinance was adopted. T. ORD 15-095 An Ordinance Providing For Abatement of $680,500 of the 2014 Tax Levy (2011A General Obligation Corporate Purpose Bonds) This Ordinance was adopted. U. MOT 15-056 Motion to Approve the Bills in the Amount of $1,892,802.43 From February 27, 2015 Through March 26 , 2015 This Motion was approved. V. MOT 15-057 Motion to Approve the Monthly Treasurer’s Report for All Funds This Motion was approved. XIX. Call to Board and Clerk Village Clerk Powell stated that the election is over; newly elected Board members would be sworn in over the coming months. Village of Oak Park Page 6 Printed on 5/19/2015 President and Board of Trustees Meeting Minutes April 20, 2015 Village Trustee Lueck commented that there was discussion at the last I-Gov meeting in terms of collecting data and keeping a tally on the impacts of state budget cuts. She noted that in addition to cuts affecting the Village, significant cuts were made to both school districts and the Park District. President Pro Tem Tucker thanked the owners of Connolly's Public House and Serenitea, Inc. for coming to the meeting tonight. Village Trustee Salzman suggested that the Board may want to discuss forming a legislative committee to fight against some of the proposed cuts from the state, as they will have a harmful impact on the municipal budget as well as the needs of Oak Park residents. Village Trustee Barber agreed. He also noted that he has received feedback regarding improvements in the process of doing business in Oak Park. He thanked Village Manager Pavlicek and Development Customer Services Director Tammie Grossman for their leadership. XX. Adjourn It was moved by Village Trustee Lueck, seconded by Village Trustee Brewer, to adjourn. A voice vote was taken and the motion was approved. ORD 15-086 Second Reading and Adoption of an Ordinance Amending Chapter 7 (“Buildings”), Article 8 (“Fees”) of the Oak Park Village Code to Establish an Annual Building and Construction Permit Fees and Zoning Application Fees Ordinance Requirement. Overview: The First Reading of the Ordinance was held on March 16, 2015. The Building Construction Permit Fee and Zoning Application Fee Schedule have not been fully updated since July 2009 and a comprehensive review has been completed resulting in the recommended amendment to the Village Code to establish a new schedule that reflects the current cost of providing services. Additionally, the recommended amendment provides that on an annual basis, the fee schedule should be reviewed and adjusted to ensure that the fees charged accurately reflect any fluctuation in the cost of providing services. D. ORD 15-087 Second Reading and Adoption of an Ordinance Establishing the Annual Building and Construction Permit Fees and Zoning Application Fees of the Village of Oak Park. Overview: The First Reading of the Ordinance was held on March 16, 2015. The Building Construction Permit Fee and Zoning Application Fee Schedule has been re-formatted to be easier to read and apply. Fees have been adjusted to reflect the cost of providing plan review and construction inspection services. XVI. Regular Agenda E. RES 15-256 A Resolution Authorizing the Execution of a Contract with Triggi Construction, Inc., for Project 15-5, 2015 Alley Improvements, in an amount not to exceed $916,221.00. Overview: Competitive bids were opened on March 26, 2015, for the Alley Improvements Project. Seven contractors picked up bid documents and five bids were received. The low responsible bid was submitted by Triggi Construction, Inc. in an amount of $916,221.00. F. RES 15-258 A Resolution Authorizing the Execution of a Contract with Chicagoland Paving Contractors, Inc. for Project 15-2, Resurfacing of Various Streets, in an amount not to exceed $2,339,900.00. Overview: Competitive bids were opened on April 2, 2015 for the Resurfacing of Various Streets Project. Fourteen contractors picked up bid documents and six bids were received. The low responsible bid was submitted by Chicagoland Paving Contractors, Inc., in an amount of $2,339,900.00. XVII. Brunch & Boutique, LLC, DBA OMG! Brunch & Boutique at 100 S. Oak Park Avenue, Original Pizza, LLC Series Oak Park, DBA Leona's Pizzeria at 848 Madison Street, La Majada Restaurant at 226 Harrison Street and Dominick's Finer Foods, LLC, DBA Dominick's #1124 at 259 Lake Street as liquor licensees from the Village Code due to the closing of these businesses. H. ORD 15-091 An Ordinance Amending Chapter 3 (“Alcoholic Liquor Dealers”), Article 8 (“List of Licenses for Each License Class”), Section 3-8-1 (“Number of Licenses Permitted to be Issued Per License Class”) and Section 3-8-2 (“Licenses by Name and Address Per License”) of the Oak Park Village Code for the Issuance of a Restaurant Class B-4 Liquor License to Connolly’s Public House, Inc. .End Overview: The proposed Ordinance authorizes the issuance of a Restaurant Class B-4 liquor license to Connolly’s Public House, Inc. (“Connolly’s”) by the Local Liquor Control Commissioner for the property located at 1107-1109 South Boulevard. I. ORD 15-092 An Ordinance Amending Chapter 3 (“Alcoholic Liquor Dealers”), Article 4 (“Term and Classification”), Section 3-4-2 (“Classification and Number of Liquor Licenses and Fees”) and Article 8 (“List of Licenses for Each License Class”), Section 3-8-1 (“Number of Licenses Permitted to be Issued Per License Class”) and Section 3-8-2 (“Licenses by Name and Address Per License”) of the Oak Park Village Code for the Issuance of a Class D-10 Liquor License to Serenitea, Inc. .End Overview: The proposed Ordinance authorizes the issuance of a Class D-10 liquor license to Serenitea, Inc. (“Serenitea”) by the Local Liquor Control Commissioner for the property located at 1046 Pleasant Street. XVIII. RES 15-219 A Resolution Approving a Visa Commerical Card Agreement with PNC Bank and Authorizing its Execution. Overview: The Village often utilizes a credit card to purchase goods and services. Th Resolution authorizes the Village to enter into an Agreement with PNC Bank to utilize a PNC Bank issued Visa card for purchases with an average rebate of 1.35%. K. RES 15-257 A Resolution Authorizing a Lease Agreement Between the Village of Oak Park and Pilgrim Church of Oak Park and Authorizing its Execution and Direct Staff to Prepare the Necessary Budget Amendment Overview: The Village leases the parking lot at Pilgrim Congressional Church of Oak Park for the Farmers Market. The previous lease agreement was for a 10 year period and expired on December 31, 2014. This new lease is for a 5 year period with the option to renew for another 5 years. L. RES 15-250 A Resolution Awarding a Single Family Housing Rehabilitation Loan and Lead Hazard Reduction Grant (SFR-062). Overview: The purpose of the Single Family Rehabilitation Loan Program is to address and to correct deteriorated and blighted homes throughout the village. The eligible homeowner is requesting a deffered loan of $24,999 and a lead hazard reduction grant of $33,360 from the village. M. RES 15-251 A Resolution Awarding a Small Rental Property Rehabilitation Loan and Authorizing the Execution of a Loan Commitment and Agreement (SPR-028). Overview: The purpose of the Small Rental Properties Rehabilitation Loan Program is to address and to correct deteriorated and blighted homes throughout the village, to provide affordable rental housing, and to improve the energy efficiency of small rental properties. The eligible owner of this four unit property is requesting a forgivable rehab loan of $20,000 from the Village. RES 15-252 A Resolution Approving Illinois Historic Preservation Agency Grant Agreement Number CL-2015-0242 and Authorizing its Execution. Overview: The Historic Preservation Commission included a line item in its 2015 Work Plan to conduct outreach to property owners in the Hulbert Subdivision to determine support for the creation of both a local and National Register historic district. The line item included a budget of $15,000 to secure professional consulting services to prepare a National Register nomination to create a Hulbert Houses Historic District. In anticipation of possible support, staff applied in November 2014 for a Certified Local Government grant to fund 70% ($14,000) of a $20,000 project, with the Village funding 30% ($6,000). The Illinois Historic Preservation Agency recently approved the grant request in the amount of $14,000. Staff is now seeking authorization to execute the Grant Agreement. O. RES 15-253 A Resolution Authorizing the Execution of an Agreement with the Oak Park Education Foundation for the Hosting of a One Week Summer Camp at the Public Works Center. Overview: The Oak Park Education Foundation of Elementary School District 97 is requesting to hold a summer camp based out of the Public Works Center. This agreement will allow this intergovernmental cooperation to take place. P. RES 15-254 A Resolution Approving an Agreement between the Village of Oak Park and Wireless Bridge Partners, LLC and Authorizing Its Execution. Overview: Staff is recommending the Village enter into an agreement with Wireless Bridge Partners (WBP) for professional services related to the marketing and development of contract for the location of small cell antennas on Village owned street lights in order to improve private cellular phone and data reception within Oak Park. Overview: The Amended Agreement extends Constellation NewEnergy, Inc., power supply and related services to the Oak Park Community Choice Aggregation program through the August 2015 meter reads and authorizes new negotiated rates covering the extended period. ORD 15-093 An Ordinance Providing For Abatment of $1,524,400 of the 2014 Tax Levy (2010A General Obligation Corporate Purpose Bonds) Overview: On an annual basis, Village staff recommends the abatement or cancellation of various tax levies that were originally pledged to pay the debt service of a specific bond issue. By default, whenever general obligation (GO) debt is issued, it is presumed to be levied for unless the Village specifically directs the Cook County Clerk’s Office to not levy or abate the amount needed for debt service. The Village abates the tax levy needed to pay for certain issues depending on the purpose of the issue. For example, if GO debt is issued on behalf of the Water and Sewer Fund, it is expected that the Fund will pay for its portion of the debt expense. T.
