The motion was approved. MOT 16-032 Motion to Approve Minutes for February 16, 2016 Regular Meeting, March 7, 2016 Regular Meeting and March 14, 2016 Special Meeting of the Village Board. At the request of Trustee Barber, the word "corridor" in the last line of the last paragraph of Item W in the February 16, 2016 minutes was changed to "core district". It was moved by Village Trustee Barber, seconded by Village Trustee Brewer, that the February 16, 2016 minutes by approved as amended. A voice vote was taken and the motion was approved. It was moved by Village Trustee Tucker, seconded by Village Trustee Barber, that the March 7, 2016 and March 14, 2016 minutes be approved. A voice vote was taken and the motion was approved. IX. Non-Agenda Public Comment Chris Donovan. Mr. Donovan spoke about the proposed Madison Street road diet and expressed concern regarding the Madison Street Coalition's lack of meetings and possible expiration of members' terms. X. Proclamation B. ID 16-084 Motion to Approve Proclamation for The Nineteenth Century Charitable Association Celebrates 125 Years of Service to the Community Village President Abu-Taleb read the Proclamation aloud. C. ID 16-085 Motion to Approve Proclamation for World Autism Awareness Day - April 2, 2016 “Light It Up Blue” Village President Abu-Taleb read the Proclamation aloud. D. ID 16-086 Motion to Approve Proclamation for Earth Month April 2016 Village President Abu-Taleb read the Proclamation aloud. It was moved by Village Trustee Ott, seconded by Village Trustee Tucker, that these Proclamations be adopted. A voice vote was taken and the motion was approved. XI. Village Manager Reports E. ID 16-101 Review of the Village Board Meeting Calendars for April, May, June and July 2016. Village Manager Pavlicek referred to the Meeting Calendars for the next several months and noted that there will be no Board meetings on March 28 or April 4. XII. Village Board Committees Village Trustee Barber commented that the I-Gov Committee met last Saturday. One topic under consideration for this meeting is a comparison of Oak Park services to similar communities. XIII. Citizen Commission Vacancies F. RES 16-135 A Resolution Approving the Purchase of Two 2016 Ford F550 XL Trucks from Currie Motors of Frankfort, Illinois through the Suburban Purchasing Cooperative (SPC) Joint Purchasing Program in an Amount Not to Exceed $159,539 and Waiving the Village’s Bid Process This Resolution was adopted. RES 16-136 A Resolution Approving an Independent Contractor Agreement with Oak Brook Mechanical Services, Inc. to Replace the Village Hall Boiler System in an Amount Not to Exceed $297,612 and Authorizing its Execution This Resolution was adopted. S. RES 16-158 A Resolution Authorizing a Change Order to the Contractual Services Agreement between CityView, a Division of N. T. RES 16-160 A Resolution Approving a Settlement Agreement in Cook County Circuit Court Case No. 2015 CH 02157 and Authorizing its Execution This Resolution was adopted. U. MOT 16-026 Motion to Refer to the Zoning Board of Appeals a Special Use Permit Application with an Allowance from the Lot Coverage Requirement of the B-1/B-2 General Business District to Operate a Financial Institution Drive-Up Facility at 6729 North Avenue This Motion was approved. V. RES 16-147 A Resolution Confirming the Appointment of Village Treasurer. This Resolution was adopted. W. RES 16-148 A Resolution Appointing the Village of Oak Park’s Illinois Municipal Retirement Fund Authorized Agent This Resolution was adopted. X. Z. MOT 16-028 Motion Authorizing the Installation of the 2016 Sculpture Walk in Partnership with the Park District of Oak Park in Mills Park from June 6, 2016 - September 9, 2016. This Motion was approved. Y. MOT 16-027 Motion to Concur with the Transportation Commission’s Recommendation to Upgrade the Two-Way Stop Signs to All-Way Stop Signs at the intersection of Berkshire Street and Columbian Avenue and to Concur with the Transportation Commission’s Recommendation to Deny Making the 1000 block of Columbian Avenue One-Way Southbound Only During School Hours and Direct Staff to Prepare the Necessary Ordinance This Motion was approved. AA. MOT 16-031 Motion to Approve the Monthly Treasurer’s Reports for All Funds This Motion was approved. AB. MOT 16-030 Motion to Approve the Bills in the Amount of $6,528,873.98 from January 29, 2016 Through March 17, 2016 This Motion was approved. AC. ORD 16-037 An Ordinance Approving a Second Amendment to the Lease Agreement between the Village of Oak Park and Robinson’s No. 1 Rib, Inc. and Authorizing its Execution. This Ordinance was adopted. XVII. Regular Agenda AG. ORD 16-032 Concur with the Zoning Board of Appeals’ Recommendation and Adopt an Ordinance Granting a Variance from the Transit-Related Retail Overlay District’s Use Restrictions to Operate a General Office Use (Clinic) at 1144 Lake Street Village Manager Pavlicek stated that this is the former Border's building but the business will not incorporate the entire space, just the portion along Harlem Avenue. Village Planner Craig Failor referred to the map of the space that the business is looking to occupy. It is the north end of the first floor with frontage onto Harlem. They are asking for the variance because this is a transit related overlay district, which prohibits general office uses, including clinics, on the ground floor within the first 50 feet of the street frontage. The Zoning Board of Appeals supports the request. ZBA chair Mike Quinn added that this is the third applicant that they have had to address. In addition, the owner presented testimony as to being unable to lease either the back or front half without some sort of relief from the Village. Village of Oak Park Page 6 Printed on 4/19/2016 President and Board of Trustees Meeting Minutes March 21, 2016 Property manager/owner Nicholas Karris discussed the proposed tenant, Harken Health and spoke favorably about their business plan and the proposed office aesthetics. He answered questions from the Board. It was moved by Village Trustee Barber, seconded by Village Trustee Brewer, that this Ordinance be adopted. The motion was approved. The roll call on the vote was as follows: AYES: 5- Village Trustee Barber, Village Trustee Brewer, Village Trustee Ott, Village Trustee Tucker, and Village President Abu-Taleb NAYS: 0 ABSENT: 2- Village Trustee Lueck, and Village Trustee Salzman AD. ORD 16-035 An Ordinance Providing for the Issuance of $20,300,000 General Obligation Corporate Purpose Refunding Bonds, Series 2016A, of the Village of Oak Park, Cook County, Illinois, and Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the Principal of and Interest on Said Bonds. Village Manager Pavlicek stated that the bond issued tonight will refinance debt that was issued in 2006. Kevin McKenna of Speer Financial stated that the refinance reduces the cost of the bond by $7.5 million over the next 20 years. The maturity date of 2032 will not change. It was moved by Village Trustee Brewer, seconded by Village Trustee Tucker, that this Ordinance be adopted. The motion was approved. ORD 16-036 An Ordinance Providing for the Issuance of $4,075,000 Taxable General Obligation Corporate Purpose Bonds, Series 2016B and $2,845,000 Taxable General Obligation Corporate Purpose Bonds, Series 2016C, of the Village of Oak Park, Cook County, Illinois, and Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the Principal of and Interest on Said Bonds. Village Manager Pavlicek stated that these bond issues will be used to finance the Village's portion of the Oak Park Station development. Both are taxable, as the Village is going to market prior to construction of any capital assets. One will be used for the parking garage, which will remain a taxable issue. The other will be used for the public street and parkway and will be refinanced as a tax-exempt bond once construction is completed. Mr. McKenna discussed the bidding and clarified the taxation issues. It was moved by Village Trustee Tucker, seconded by Village Trustee Brewer, that this Ordinance be adopted. The motion was approved. MOT 16-035 Motion to Concur with the Board of Health’s Recommendation to Raise the Minimum Age from 18 to 21 for the Purchase and Sale of Tobacco/Nicotine and Liquid Nicotine and Direct Staff to Prepare the Necessary Ordinance Village Manager Pavlicek stated that this item has been vetted through the Board of Health and brought before the Business Associations Council. Mark Peysakhovich, representing the American Heart Association. Mr. Peysakhovich spoke in favor of the ordinance and noted that this will prevent many young people from starting to smoke. Charlie Lemke-Bell. Mr. Bell, a student at OPRF High School, also spoke in favor of the ordinance and commented that the business community will benefit, as young people will use the money they would have spent on cigarettes for other things. Board of Health Chair Florence Miller discussed the research that this recommendation is based on. She clarified that it includes e-cigarettes but not nicotine cessation products. There was a discussion regarding penalties. Village Trustee Barber noted that the penalties should be meaningful enough to deter retailers and underage consumers. Village President Abu-Taleb did not want to penalize young people to the extent of affecting their record and causing harm to their future. There was a discussion regarding the adjudication process. Village President Abu-Taleb asked what the penalties are in Evanston, where a similar ordinance was recently passed. Interim Director of Public Health Mike Charley replied that the penalty for the retailer is not less than $200 nor more than $500 for each offense, and they may be subject to having their business license revoked or suspended. They do not address possession. Village Attorney Paul Stephanides provided the range of fees for the retailers and underage consumers in Oak Park. There was further discussion regarding fees. Village Trustee Barber suggested that staff come back with a recommendation. There was consensus. It was moved by Village Trustee Tucker, seconded by Village Trustee Ott, that this Motion be approved. The motion was approved. Call to Board and Clerk Village Clerk Powell thanked all who supported early voting. Oak Park was the most successful location in terms of low waiting times and she is looking ahead to the fall Village of Oak Park Page 8 Printed on 4/19/2016 President and Board of Trustees Meeting Minutes March 21, 2016 election. Village Trustee Brewer discussed a podcast regarding why For Sale signs are "banned" in Oak Park and encouraged others to listen to it. Village Trustee Ott stated that she parked in the Lake and Forest garage last weekend and that it was nearly empty. She suggested better signage to let the public know that it is open. Village Trustee Barber announced that the Building Code Advisory Commission is holding a residential symposium focusing on kitchen, bath and basement remodels on May 11 from 7:00-8:00 at the library. Anyone in the community who wants to learn about the permit process or who has a project they are thinking about doing can learn what the rules are and what they can and cannot do. Village Trustee Brewer added that he has been made aware that Parking Lots 10 and 3 on Marion Street are extremely crowded with little turnover. There have been requests from businesses along Marion that the Board look at imposing a time limit for parking in those lots. XIX. ORD 16-033 Second Reading and Adoption of an Ordinance Amending Chapter 13 (“Human Rights”) of the Oak Park Village Code Overview: This ordinance would add several protected classes, change the structure of hearings, and authorize the Village Manager to enforce the Village’s fair housing ordinance. The Village Board held a First Reading at the Regular Meeting on March 7, 2016. XVI. Consent Agenda I. ORD 16-031 An Ordinance Authorizing the Sale of Surplus Vehicles Owned by the Village of Oak Park Overview: The Department of Public Works will be replacing ten Police vehicles in 2016. The vehicles will be sold at an auction and if not sold at the auction, then they will be disposed of as scrap. RES 16-087 A Resolution Approving Agreements with Canon Solutions America, Inc., for a Five-Year Lease of an Oce Colorwave 500 Printing System in an Amount Not to Exceed $51,445.00 and Authorizing Their Execution Overview: The Engineering Division is currently leasing a large format printing system for copying, scanning, and printing and is about to enter the fifth year of the current five-year lease. The current printing system is beginning to have problems due to its age and usage and the Engineering Division requested proposals to replace the existing system and cancel the current lease. Four firms received proposal documents and 2 proposals were received. The proposal from Canon Solutions America, Inc. best fit the needs of the Village at the lowest competitive price. K. RES 16-119 A Resolution Approving a Settlement Agreement in Workers’ Compensation Case No. 14 WC 04738 and Authorizing its Execution Overview: It is requested that the Village Board approve a settlement agreement in Workers’ Compensation Case No. 14 WC 04738 and authorize its execution. The SPC awarded the bid to Currie Motors of Frankfort, Illinois. M. RES 16-136 A Resolution Approving an Independent Contractor Agreement with Oak Brook Mechanical Services, Inc. to Replace the Village Hall Boiler System in an Amount Not to Exceed $297,612 and Authorizing its Execution Overview: The existing Village Hall boiler system is the original system installed when the building was completed in the mid-1970s and has outlived its useful service life and is in need of replacement. RES 16-138 A Resolution Approving a Contract for Services Between the Village of Oak Park and the Downtown Oak Park Corporation (DTOP) and Authorizing its Execution Overview: Downtown Oak Park Corporation (DTOP) was organized for the purpose of promoting the development and expansion of business within Special Service Area Number One (SSA) and has authority to enter into contracts with the Village for the provisions of services necessary to DTOP’s mission and the purpose of the SSA. An average of 150 excavations are completed annually. P. RES 16-139 A Resolution Authorizing the Renewal of the Service Agreement with McAdam Landscaping, Incorporated for Fiscal Year 2016 Parkway Tree Watering in an Amount Not To Exceed $35,000 Overview: In 2016 the Department of Public Works anticipates planting approximately 450 - 500 new parkway trees. This item allows McAdam Landscaping, Inc. to provide tree watering services to the Village utilizing the second of two contract renewals. Q. RES 16-141 A Resolution Approving a Contract with J. Nardulli Concrete, Inc. for Project 16-4, 2016 Alley Improvements, in an Amount Not to Exceed $2,152,611 and Authorizing its Execution Overview: Competitive bids were opened on March 3, 2016, for the 2016 Alley Improvement Project 16-4. Fifteen contractors picked up bid documents and six bids were received. The low responsible bid was submitted by J. Nardulli Concrete, Inc. in an amount of $2,152,610.50. R. RES 16-142 A Resolution Approving a Contract with Schroeder and Schroeder, Inc., for Project 16-3, 2016 Sidewalk and Curb & Gutter Replacement, in an Amount Not to Exceed $150,000 and Authorizing its Execution Overview: Competitive bids were opened on March 3, 2016 for the Sidewalk and Curb and Gutter Replacement project. Ten contractors picked up proposal documents and eight bids were received. The low compliant bid was submitted by Schroeder and Schroeder, Inc. in an amount of $129,353. It is recommended to award the contract at the full budgeted amount of $150,000 so additional sidewalk locations can be replaced. As part of the configuration process, it was determined that the Village’s Health inspection services need to be further configured into the system than previously believed. MOT 16-026 Motion to Refer to the Zoning Board of Appeals a Special Use Permit Application with an Allowance from the Lot Coverage Requirement of the B-1/B-2 General Business District to Operate a Financial Institution Drive-Up Facility at 6729 North Avenue Overview: The Village Zoning Ordinance, pursuant to Sections 3.1 (Summary Use Matrix), requires a special use permit to operate a financial institution drive-up facility in the B-1/B-2 General Business District. V. RES 16-147 A Resolution Confirming the Appointment of Village Treasurer. Overview: Section 2-6-4 of the Municipal Code provides for the Village Manager to appoint a Treasurer, subject to confirmation of the Village Board. W. MOT 16-027 Motion to Concur with the Transportation Commission’s Recommendation to Upgrade the Two-Way Stop Signs to All-Way Stop Signs at the intersection of Berkshire Street and Columbian Avenue and to Concur with the Transportation Commission’s Recommendation to Deny Making the 1000 block of Columbian Avenue One-Way Southbound Only During School Hours and Direct Staff to Prepare the Necessary Ordinance Overview: The Village of Oak Park received a petition to install all-way STOP signs at the intersection of Berkshire Street and Columbian Avenue as well as a petition to make the 1000 block of Columbian Avenue one-way southbound only during school hours. The Village conducted crash analysis and traffic studies for the intersection as well as the 900 and 1000 blocks of Columbian Avenue. The Transportation Commission voted unanimously to 1) recommend upgrading to all-way STOP signs at the intersection of Berkshire Street and Columbian Avenue and 2) deny making the 1000 block of Columbian Avenue one-way southbound only during school hours at its February 8, 2016 meeting. Z. MOT 16-028 Motion Authorizing the Installation of the 2016 Sculpture Walk in Partnership with the Park District of Oak Park in Mills Park from June 6, 2016 - September 9, 2016. Overview: While early discussions regarding the siting of the 2016 Sculpture Walk concentrated on the Arts District, The Public Art Advisory Commission in collaboration with the Arts District Association determined that the corridor would not be suitable for this year’s event as a significant public infrastructure improvement project is scheduled for the Spring and Summer of 2016. The Public Art Advisory Commission is therefore recommending that the 2016 Sculpture Walk be located in Mills Park in partnership with the Park District of Oak Park. AA. Overview: The proposed Second Amendment will extend the current lease term the Village’s tenant, Robinsons No. 1 Rib, Inc., to occupy the property located at 934-946 Madison Street from March 31, 2016 to May 31, 2016. ORD 16-035 An Ordinance Providing for the Issuance of $20,300,000 General Obligation Corporate Purpose Refunding Bonds, Series 2016A, of the Village of Oak Park, Cook County, Illinois, and Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the Principal of and Interest on Said Bonds. Overview: The 2016A will refinance the Village’s 2006 B debt series. AE. ORD 16-036 An Ordinance Providing for the Issuance of $4,075,000 Taxable General Obligation Corporate Purpose Bonds, Series 2016B and $2,845,000 Taxable General Obligation Corporate Purpose Bonds, Series 2016C, of the Village of Oak Park, Cook County, Illinois, and Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the Principal of and Interest on Said Bonds. Overview: Both the 2016 B and 2016 C issues will be used to finance the village’s portion of development project commonly referred to as Oak Park Station. Both issues are taxable given that the Village is going to the market before any capital assets are constructed. One issue will be used for the parking garage which will remain a taxable issue. The series used for the public street and parkway will be refinanced as a tax-exempt bond once construction is completed. AF. MOT 16-035 Motion to Concur with the Board of Health’s Recommendation to Raise the Minimum Age from 18 to 21 for the Purchase and Sale of Tobacco/Nicotine and Liquid Nicotine and Direct Staff to Prepare the Necessary Ordinance Overview: The Village Board referred this issue to the Board of Health on March 16, 2015 after receiving a request from the Oak Park Township Board. The Board of Health held various meetings to discuss and research the issue. The Board of Health is recommending the Village raise the age to 21 for the purchase and sale of tobacco/nicotine. ORD 16-032 Concur with the Zoning Board of Appeals’ Recommendation and Adopt an Ordinance Granting a Variance from the Transit-Related Retail Overlay District’s Use Restrictions to Operate a General Office Use (Clinic) at 1144 Lake Street Overview: Nicholas Karris-property owner, on behalf of Harken Health, is requesting a variance from Section 3.9.3 (F) (2) (e) of the Transit-Related Retail Overlay District, which Section prohibits general office uses, including clinics, on the ground floor of any building or structure unless located at least 50 feet from any street line, to operate a general office use (Harken Health) on the ground floor.
