Call to Order Village President Abu-Taleb called the meeting to order at 5:32 P.M. He authorized a statement be read providing that the meeting is being held remotely due to COVID-19 restrictions and guidelines and that it is not prudent to have people present at the Village Board's regular meeting location due to public health concerns related to that pandemic. II. Agenda Approval Village Trustee Boutet asked that Item R and Item S are moved from the Consent Agenda to the Regular Agenda. Village Manager Pavlicek announced that Item M is tabled to the next Regular Meeting due to a technical challenge in viewing the Resolutions attached to Item M. It was moved by Village Trustee Andrews, seconded by Village Trustee Taglia, that this be approved as amended. The motion was approved. Non-Agenda Public Comment Members of It's Our Future (IOF): It’s Our Future (IOF), is a local high school program of Seven Generations Ahead advocating for climate change solutions that benefit all members of the community. The members acknowledged the current opt in curbside composting programs are impactful and inspirational, they feel it is time to increase access for more residents to participate in these programs through composting for all or opt-out models. To make this transition successful, It's Our Future recommended increased education to the communities on how to properly compost and the benefits of doing so. They would like to offer the support of It’s Our Future students to aid in this process. Members of It's Our Future Manolo Avaolos Ava Brennan Anna Chulos Natasha Cosgrove Charlotte Meyer Ellie Raidt Charles Roeger Emma Sage Amy Bartucci, Sustainability Program Associate Seven Generations Ahead Jim Babcock, Interfaith Green Network (IGN): The Interfaith Green Network (IGN), is an interfaith collaboration of 17 congregations in Oak Park and River Forest who support the It’s Our Future organization in it's call for a composting program that’s easily accessible to all residents. The Interfaith Green Network has been working with the youth of It’s Our Future for several months. At the same time, The Interfaith Green Network has been engaging with the administration at the Village of Oak Park in discussions regarding composting options that might work for everyone. The Interfaith Green Network would like to pay special tribute to the initiatives of the young people of It’s Our Future. They stated this is an important and noteworthy development in the life of our Village, and they Village of Oak Park Page 2 Printed on 1/19/2021 President and Board of Trustees Meeting Minutes December 7, 2020 encourage the Village Board and the Village administration to heed these youthful voices. VI. Proclamation B. MOT 20-084 Motion to Approve Proclamation for A Day of Remembrance in Honor of Joanne E. Trapani Retired Village Clerk, Sandra Sokol read the Proclamation aloud. It was moved by Village Trustee Boutet, seconded by Village Trustee Moroney, that this Motion be approved. The motion was approved. Village Manager Reports Village Manager Cara Pavlicek planned to hold her comments until further discussion related to the budget throughout this evening's meeting. Village Walker-Peddakotla requested an update on the COVID-19 vaccination program. Village Manger Pavlicek stated that staff have been working through the vaccination planning since August. On Friday November 27, 2020 the Village received approval from the state, as the local certified public health department, to be a designated vaccination provider. Village Manager Pavlicek provided the most up to date details pertaining to the vaccination program. She also mentioned that once people are vaccinated, they must continue to wear masks and wash hands. VIII. Village Board Committees There were no comments. IX. Citizen Commission Vacancies C. ID 20-333 Motion to Consent to the Village President’s Appointment of: Metropolitan Mayors Caucus Environment Committee - Trustee Susan Buchanan Aging in Place Commission - Nancy Teclaw, Reappoint as Member Citizen Involvement Commission - Greg Kolar, Appoint as Member Citizen Involvement Commission - Rebecca O’Brien, Appoint as Member Citizen Police Oversight Committee - Donovan Pepper, Appoint as Chair Community Design Commission - Jonathan Kirk, Reappoint as Member Community Design Commission - Juan Bentancur, Appoint as Chair Farmers Market Commission - Dina Ross, Reappoint as Member Board of Fire and Police Commissioners - Robert Pickrell, Appoint as Chair Historic Preservation Commission - Rachel Will, Appoint as Member Historic Preservation Commission - Sarah Doherty, Appoint as Member Village Clerk Scaman read the names out loud. Village Trustee Walker-Peddakotla stated that while Village Trustees get to vote on Village commission and committee appointments made by the Village President, they do not have any other input on those appointments. She noted that Village Trustees do not have input on the actual appointments. She said the appointment process needs more insight and input. She provided the example that The Citizen Police Oversight Commission (CPOC) members did not have input on who was appointed as the Chair of The Citizen Police Oversight Commission (CPOC) during this meeting. She encouraged an appointment process that considers those already serving as commissioners and takes into account the Village Board goals. Village Trustee Boutet agreed there should be a conversation about the best way to do this moving forward. Village Trustee Andrews recommended his colleagues provide a formal proposal to improve the appointment process for which the Village Board can vote to approve, deny or amend. Village Trustee Boutet agreed that she and Village Trustee Walker-Peddakotla could work together to propose a new appointment process. It was moved by Village Trustee Andrews, seconded by Village Trustee Boutet, that this Motion be approved. The motion was approved. MOT 20-067 A Motion to Adopt the Five Year Capital Improvement Plan (2021-2025) as Reviewed and Discussed by the Village Board on October 12, 2020 Village Trustee Boutet requested that item R be removed from the consent agenda. She asked about the large increase of water user fees from year Village of Oak Park Page 8 Printed on 1/19/2021 President and Board of Trustees Meeting Minutes December 7, 2020 to year under the capital improvement plan revenue sources enterprise fund. Village Manager Pavlicek explained that the water user fee is set by ordinance by the Village Board. This revenue is from water revenue collections for both the water and sewer fee. She explained that the Village Board did not change the rates this year. Two years ago the Village Board approved a modest multi-year increase. The increase also reflects a pass along from the City of Chicago increases. Chief Financial Officer Steven Drazner confirmed that on the executive summary for the capital improvement plan, the user fees are not actually user fees, they are an offset to the water capital expenditures listed below it, which nets to zero. It was moved by Village Trustee Andrews, seconded by Village Trustee Boutet that this Motion be approved. The motion was approved. ORD 20-122 An Ordinance Amending the Fiscal Year 2020 Annual Budget Village Trustee Boutet asked if the Coronavirus Aid, Relief, and Economic Security (CARES) Act money will offset some of the costs related to COVID? Village Manager Pavlicek responded that the Community Development Block Grant (CDBG) CARES money has been distributed to other organizations, such as the not-for-profit and the business community. A modest amount has been retained to cover administrative costs which covers the work of processing those funds with the Housing and Urban Development (HUD). The Village's current application is to cover overtime in the Fire Department due to COVID. She mentioned that none of the Village's Federal Emergency Management Agency (FEMA) applications have been approved. There was further discussion which clarified the proposed ordinance to amend $975,000 which is needed to increase the budget to pay the City of Chicago water bills. This one requested amendment is needed as the result of higher water usage (as more people are home during the pandemic) as well as a fairly large water leak. The exact extent of the water loss will be tabulated a few months into the next calendar year once all the Village of Oak Park Page 9 Printed on 1/19/2021 President and Board of Trustees Meeting Minutes December 7, 2020 fiscal year 2020 bills are paid and all water billing cycles for the current year have been processed and mailed out to customers. ORD 20-112 An Ordinance Adopting the Budget for All Corporate Purposes of the Village of Oak Park, Cook County, Illinois in Lieu of the Appropriation Ordinance for the Fiscal Year Commencing on the First Day of January, 2021 and Ending on the Thirty-First Day of December, 2021 Village Trustee Walker-Peddakotla stated that budgets are moral documents which outline priorities for the village. She expressed her gratitude to staff for presenting the Board with a balanced budget. She mentioned groups like Oak Park Mutual Aid (OPMA) are stepping up to help people who are housing and food insecure. She believes those are disparities which the Village needs to address, that the Village has not addressed. She also said very little has been done with the police department budget, despite the civil rights movement of 2020. She stated calls to de-fund the police are calls to rewrite the priorities of the village budget so spending aligns with the need of the community. Village Trustee Boutet said she would like to start the budget process earlier to allow for more robust conversations pertaining to the budget. Village Trustee Buchanan reviewed the work plan on policing and she found it disappointing that there is no mention of the civil rights movement of 2020 in the accomplishments or the work plan. Village Trustee Moroney thanked staff for putting together this budget. He said staff proactively communicated the challenges and provided solutions and pathways to help the village deal with challenges since March. He mentioned this budget balances the needs of the community and the ability to pay for everything. Village President Abu-Taleb stated that if a budget fails, that means the government would shut down. He reiterated that the Village Board must recognize their role is to serve the community as a whole. ORD 20-099 An Ordinance for the Levy and Assessment of Taxes in the Amount of $450,000 for the 2020 Property Tax Year for Village of Oak Park Special Service Area Number One Village Trustee Boutet asked if every dollar we tax we give it to the Special Service Area. Village Manager confirmed it is now. When the Tax Increment Financing (TIF) was in existence as part of the settlement agreement, there were surplus funds distributed. Special Service Area One (SSA One) was one of the taxing bodies that received those funds. There is a year to year balancing process that occurs. Special Service Area One determines the amount they want to retain in the fund balance as the Village draws down on what accumulated during the Tax Increment Financing (TIF) and the final close out of the downtown Tax Increment Financing (TIF). This year they received the total amount levied plus additional funding based on the budget they submit, which is in accordance with the agreement adopted by the Village Board with Downtown Oak Park. Village Trustee Boutet thanked Downtown Oak Park as they do a great job marketing the businesses in their area and hosting special events. It was moved by Village Trustee Andrews, seconded by Village Trustee Moroney, that this Ordinance be adopted. The motion was approved. ORD 20-100 An Ordinance for the Levy and Assessment of Taxes in the Amount of $3,000 for the 2020 Property Tax Year for Village of Oak Park Special Service Area Number Eight Village Trustee Walker-Peddakotla asked if special service area eight will expire. Chief Financial Officer Steve Drazner explained there is maximum time frame of ten years. The total cost associated with the special service area eight ordinance is $20,000. This began two years ago and is scheduled to continue through fiscal year 2023, spreading it over a 5-year period. It was moved by Village Trustee Andrews, seconded by Village Trustee Boutet, that this Ordinance be adopted. The motion was approved. Call to Board and Clerk Village Clerk Scaman gave her condolences to the Trapani family. She wished everyone a happy holiday season. She also sent her condolences to those who are missing family either from loss or distance. Village Trustee Boutet stated it is great to say goodbye to 2020. She mentioned it has been a big year in many ways to learn and discuss racial equity. She encourages the Village Board to not tell women when not to talk. She said it is the feminist version of racial equity. She asked the Village Board to reflect on that. Village Trustee Walker-Peddakotla brought attention to a community member who was harmed by anti-Muslim rhetoric. She stated it is one of the most dangerous forms of hate-speech in America. She said this community member received threats and urged that our community should denounce this action. She reiterated that anti-Muslim rhetoric is dangerous. Village Trustee Andrews shared that several weeks ago he lost one of his former staff members to COVID. He encourages everyone to be diligent and stay safe. He wished everyone a happy new year and happy holidays. Village Trustee Buchanan begged people to continue to wear masks. She urged people not to have people inside of their homes who are from Village of Oak Park Page 12 Printed on 1/19/2021 President and Board of Trustees Meeting Minutes December 7, 2020 outside their homes. Village Trustee Taglia expressed how thankful he is that this year is almost over. The Village has a major undertaking to rollout the vaccine and properly administered. He is thankful for staff and their dedication. Village Trustee Moroney wished everyone happy holidays and hopes everyone can unwind and get away from the grind of board work and staff work. Village President Abu-Taleb walked, ran and drove on Lake Street and shared that it looks beautiful and Oak Park is open for business. He thanked everyone for the work they do for the Village. He acknowledged that they all share a common goal to serve the community. He wished everyone happy holidays. His thoughts and prayers are with those who have suffered from COVID. XIV. RES 20-253 A Resolution Approving a Purchase Price Agreement with SNI Solutions, Inc. for the Purchase of Winter De-icing Materials in Fiscal Year 2021 in an Amount Not to Exceed $35,000.00, Waiving the Village’s Bid Process and Authorizing its Execution Overview: The Public Works Department is responsible for anti-icing and de-icing treatment of various sidewalks, bridge decks, and streets. The Parking Services Division of the Development Customer Services Department is responsible for de-icing sidewalks adjacent to parking areas and parking structures which are susceptible to corrosion during snow plowing and salting events. Staff recommends purchase of products from SNI Solutions, Inc., which provides less corrosive and more environmentally friendly de-icing materials. The bid process waiver is requested as SNI Solutions is the only dealer for both products in the Chicago area. H. RES 20-241 A Resolution Approving an Amendment to the Independent Contractor Agreement with Revcon Technology Group, Inc. for the Service and Maintenance of the Parking Access and Revenue Control Systems at the Village’s Parking Garages to Change the Not to Exceed Amount from $45,000 to $51,000 in 2020 and Authorizing Its Execution Overview: Staff is submitting an Amendment to the Independent Contractor Agreement with Revcon Technology Group, Inc., increasing the agreement from $45,000 to $51,000. This increase is necessary to pay for the the December maintenance plan invoices and provide a contingency amount for other expenses that may arise outside of the coverage of the maintenance plan throughout the remainder of the year. RES 20-245 A Resolution Approving an Independent Contractor Agreement with Revcon Technology Group, Inc. for the Service and Maintenance of Parking Access and Revenue Control Systems at the Village’s Holley Court and Avenue Parking Garages for Fiscal Year 2021 in an Amount Not to Exceed $86,300, Authorizing its Execution and Waiving the Village’s Bid Process Overview: The initial term of this contract is one (1) year with the option to renew for one (1) additional one (1) year term. This is a sole source contract, since Revcon is the only Illinois dealer and servicer of the TIBA system. Timely service and maintenance to the equipment is necessary to ensure a convenient, reliable parking experience for residents of and visitors to Oak Park. J. RES 20-246 Resolutions Authorizing the Annual Renewal of Pawnbrokers Business Licenses Overview: Article 48 (“Pawnbrokers”) of Chapter 8 (“Business Licensing”) of the Oak Park Village Code requires that the annual renewal of the business license for pawnbrokers be given at the direction of and approval of the Village President and Board of Trustees, upon authorization of the Police Chief. RES 20-247 A Resolution Approving the Renewal of a Professional Services Agreement with Wight & Company for Architectural Design Review Services for Fiscal Year 2021 in an Amount Not to Exceed $35,000 and Authorizing its Execution Overview: The Village’s Development Customer Services Department issued a Request for Proposal for professional services for fiscal year 2019 including two renewable years. The Village Board approved the Professional Services Agreement for 2019 with a two-year renewal provision. This agreement is for the last year of the approved renewal period. These services are for architectural design consultation associated with Planned Development applications and applicable building permit applications. L. RES 20-254 A Resolution Approving a Supplemental Statement of Work for the Consultant Services Agreement with Municipal GIS Partners, Incorporated in an Amount Not to Exceed $101,561 and Authorizing its Execution Overview: At the August 4, 2014 Regular Meeting, the Village Board directed staff to join the Local GIS Consortium. This was an opportunity for the Village to greatly improve GIS capabilities by providing all Village employees with training and access to GIS as well as provide an opportunity for some public access to GIS information. As a result, this is the annual contract approval to provide GIS services to the Village using shared resources from over 30 communities. A list of specific projects accomplishments in 2020, as well as goals for 2021 are attached to this item. M. RES 20-255 Resolutions Retroactively Authorizing the Use of Motor Fuel Tax Funds in the Aggregate Amount of $3,091,828.68 for Eligible Local Street Improvements in the Village of Oak Park for Fiscal Years 2007, 2009, 2010, 2011, and 2013 Overview: Per an internal review by the Bureau of Local Roads and Streets division of the Illinois Department of Transporation (IDOT), certain public works forestry expenditures submitted by the Village for the use of MFT Funds dating back to calendar year 2007 have been determined as ineligible. Staff was unaware that only certain emergency forestry related projects are eligible and not routine forestry maintenance. As such, the IDOT has been working with Village to find adequate substitutes for previously incurred expenses which can be retroactively submitted to offset the ineligible expenditures. N. RES 20-256 A Resolution Approving a Collective Bargaining Agreement Between the Village of Oak Park and the Illinois FOP Labor Council for Community Service Officers for the Period of January 1, 2021 to December 31, 2023 and Authorizing Their Execution Overview: The current contract for Community Service Officers expires on December 31, 2020. This contract covers employees who work as Community Service Officers. RES 20-257 A Resolution Approving the Renewal of an Independent Contractor Agreement with Rozalado & Co. for Fiscal Year 2021 Custodial Services in an Amount Not to Exceed $106,453.00 and Authorizing its Execution Overview: On December 15, 2017 the Village Board approved entering into an Independent Contractor Agreement with Rozalado & Co., for Fiscal Year 2018 - 2020 Custodial Services for public buildings including Village Hall, the Police Department, the Public Works Center and Metra Station. The Agreement provides for additional one year renewals. It is proposed to exercise a contract renewal with Rozalado & Co., for Fiscal Year 2021 Custodial Services. P. RES 20-258 A Resolution Approving a Professional Services Agreement with Chastain & Associates LLC for Permit Plan Review and Inspection Services for the Public Works Department in an Amount Not To Exceed $150,000 and Authorizing its Execution Overview: The Engineering Division requested a proposal from Chastain & Associates to provide permit plan review and inspection services for the Public Works Department in 2021. Chastain & Associates provided these same services in 2019 and 2020 and will utilize the same key staff. Q. RES 20-259 A Resolution Approving an Independent Contractor Agreement with Total Parking Solutions, Inc. for the Service, Maintenance and Cellular Connectivity of Eighty-Seven (87) Cale Paystations During Fiscal Year 2021 in an Amount Not to Exceed $75,000 and Authorizing its Execution Overview: The Contractor, Total Parking Solutions, Inc., will service and maintain eighty-seven (87) Cale paystations located throughout the Village. Additionally, Total Parking Solutions, Inc. will provide cellular connectivity to ensure constant communication to the Cale WebOffice Monitoring server for the eighty-seven (87) cale paystations. Maintenance and cellular connectivity are necessary to ensure a convenient, reliable parking experience to residents and visitors of Oak Park. R. MOT 20-067 A Motion to Adopt the Five Year Capital Improvement Plan (2021-2025) as Reviewed and Discussed by the Village Board on October 12, 2020 Overview: The Village Board reviewed and discussed on October 12, 2020 the detailed Capital Improvement Plan for fiscal years 2021 through 2025. The first year of the CIP has been incorporated into the FY21 Recommended Budget, which, when adopted by the Board, will become the legal appropriations for the Village next fiscal year while the CIP serves as a strategic planning document. This proposed map identifies all existing on-street daytime parking restrictions, inclusive of changes to date, as recommended by the Transportation Commission and authorized by the Board of Trustees. AF. ORD 20-128 An Ordinance Amending Village of Oak Park Ordinance 1995-0-68 to Increase the Street Frontage of Overnight Parking Zones to 750 Feet from 500 Feet as Reviewed at the November 23, Village Board Meeting. Overview: On November 23, 2020, the Village Board approved a Motion to Concur with the Transportation Commission to Expand the Overnight Parking Zones to 750 feet from 500 feet. This is the Ordinance authorizes the changes. AG. MOT 20-082 A Motion to Approve Staff’s Recommendation to Overhire Police Officer, Community Service Officer and Firefighter/Paramedic Positions in Fiscal Year 2021 Overview: Staff is seeking approval to hire new police officers, community service officers and firefighters when there is a pending retirement/resignation of an employee combined with another long-term employee disability where said employee is not expected to return to work for an extended time period, resulting in overtime expenditures to fill the “vacancy” when minimum staffing levels in public safety positions require. This program was first approved in FY17 and annually thereafter by the Village Board and staff is seeking to continue in FY21. AH. MOT 20-083 A Motion to Approve the 2021 Village Board Regular Meeting Calendar Overview: This is an annual action in which the Village Board shall give public notice of the schedule of its regular meetings at the beginning of the year. ORD 20-112 An Ordinance Adopting the Budget for All Corporate Purposes of the Village of Oak Park, Cook County, Illinois in Lieu of the Appropriation Ordinance for the Fiscal Year Commencing on the First Day of January, 2021 and Ending on the Thirty-First Day of December, 2021 Overview: The Village Board held two Public Hearing on the Proposed FY21 Budget as well as discussed the document and five year Capital Improvement Plan (CIP) and four additional meetings. This item is the final action for adoption of the FY21 Budget. AL. ORD 20-098 The Village of Oak Park’s Tax Year 2020 Property Tax Levy Ordinance Overview: Concurrent with the recommended adoption of the FY21 Budget, staff has calculated the revenue needs for all funds of the Village based upon the final recommendations contained in the FY21 Budget, as well as all ordinances presented to abate the collection of property taxes for debt service due to the availability of other sources of revenues. In the case of funds fully or partially funded from property taxes, State law requires that property taxes are calculated after considerations of all other funding sources have been reviewed. AM. ORD 20-099 An Ordinance for the Levy and Assessment of Taxes in the Amount of $450,000 for the 2020 Property Tax Year for Village of Oak Park Special Service Area Number One Overview: The Village levies a tax upon the geographic area often referred to as Downtown Oak Park.
