Mustang Public School District, from a decision of the Code Official for noncompliance
with Chapter 4, Section 423.4(supplement) of the International Building Code 2015, as
adopted by Oklahoma City pertaining to required storm shelters for 9201 SW 59th Street
(Prairie View Elementary School).
II. CASE NO. BOAB-2022-00003. The appeal of Charles Bradley, Superintendent -
Mustang Public School District, from a decision of the Code Official for noncompliance
with Chapter 4, Section 423.4(supplement) of the International Building Code 2015, as
adopted by Oklahoma City pertaining to required storm shelters for 3001 S Morgan
Road (Mustang Valley Elementary School).
III. Building Code: The appeal involves a request for variance to the requirements listed
below:
IBC 2015 (Supplement) Section 423.4 - Group E Occupancies.
All new buildings and structures incorporating an Educational Group E occupancy shall
have a safe room(s) with an occupancy load equivalent to or greater than the number of
students and faculty the building or structure is designed for.
Exceptions:
1. Group E daycare facilities
2. Group E occupancies accessory to places of religious worship
3. Buildings meeting the requirements for shelter design in ICC-500
IBC 2015 Section 108.1 – General.
The building official is authorized to issue a permit for temporary structures and
temporary uses. Such permits shall be limited as to time of service, but shall not be
permitted for more than 180 days. The building official is authorized to grant extensions
for demonstrated cause.
IBC 2015 Section 108.4 – Termination of approval.
The building official is authorized to terminate such permit for a temporary structure or
use and to order the temporary structure or use to be discontinued.

Maximum Floor Area Allowances Per Occupant
ICC-500-2014 Section 501.1.1 – Occupant density.
The minimum required shelter floor area per occupant shall be determined in
accordance with Table 501.1.1, and this section. The number of standing, seated,
wheelchair or bedridden spaces shall be determined based upon the needs of the
shelter determined by the applicable authority having jurisdiction and the designer.
ICC-500-2014 Section 501.1.3 – Wheelchair spaces.
Each storm shelter shall be sized to accommodate a minimum of one wheelchair space
for every 200 shelter occupants or portion thereof.
IV. Applicant's Statement:
Background: Mustang Public Schools (MPS) has been fortunate to experience
unprecedented growth which is anticipated to continue exponentially based on turnpike
expansion and study of surrounding plat plans and housing permits. Our student
population has grown between 200 (2014) to 1500 (2021) students annually; that’s the
equivalent of adding, on average, the population of an elementary school to the district
every year. Zonda, a leading firm in data on housing throughout the United States
compiled a report for MPS (included in the appendices) that details the growth that has
occurred and is expected in the coming years. While this is exciting, it presents a
problem in that growth has outpaced bonding capacity for the District. In 2017, MPS
passed a $180.8 million bond package that added three new school buildings and new
high school facilities to increase the square footage for students. As will be detailed
later, herein, another bond package is in the imminent plans.
Grant Occupancy: The 2022-23 school year begins for Mustang Public Schools on
August 18, 2022; there is currently no possible solution (fiscally nor within this
timeframe) to construct new ICC500 or FEMA320 shelters. We humbly request that the
Board of Appeals grant temporary occupancy for the portable classroom buildings
described above until the requirements of IBC 2015 Section 423 (supplement) can be
met.
Plans to Address: The Mustang Public Schools’ Long Range Planning Committee is
planning to present the Board of Education with a proposal for a new Bond election
before November 1, 2022. This election, if approved by the Board, would be held in
early 2023 (February) and would allow substantial additional funds with which to address
the issues raised at PV & VE concerning IBC 2015 Section 423 (supplement).
It is important to note that all three new buildings constructed with funds from the 2017
Bond meet the requirements of this code which speaks to our intent, and any future
facilities or “new buildings or structures incorporating an Educational Group E
occupancy” shall meet or exceed the requirements of IBC 2015 Section 423
(supplement).
One solution which is not feasible due to timing and impact is redistricting or realigning
our attendance boundaries. As referenced in the Zonda appendices, this would, at best,
be a very temporary solution, but the act of redistricting is a process which requires
years of planning and impacts services for families. The timeframe to adjust
transportation (bus routes), staffing for schools, and allow adequate notification to
families is prohibitive of this solution.
Lastly, MPS has a shelter in place plan for all students in the current facility including the
students who would be using the prefabricated structure, which is only feet away from
the main school building. This plan will be in effect during the requested extended waiver
until a proper "safe room" is built for all students and faculty members.
Prairie View Elementary: Adequate Existing Safe Room - The current student enrollment
plus staff at Prairie View (PV) is 800, and with the proposed addition of portable units to
house 60 students, there would be a requirement of 4,300 square feet of safe room
space; PV currently has 5,100SF of available safe room space.
These additional students will be attending PV regardless of the installation of the
portable buildings, but the allowance for these will greatly enhance the overall
educational environment for all building occupants due to the increased space to
minimize overcrowding and allow for optimum class size.
Mustang Valley Elementary: Adequate Existing Safe Room - The current student
enrollment plus staff at Mustang Valley Elementary (VE) is 685, and with the proposed
addition of portable units to house 60 students, there would be a requirement of 3,725
square feet of safe room space; VE currently has 4,243SF of available safe room space.
These additional students will be attending VE regardless of the installation of the
portable buildings, but the allowance for these will greatly enhance the overall
educational environment for all building occupants due to the increased space to
minimize overcrowding and allow for optimum class size.
V. Staff Analysis: The applicant’s request pertains to the requirement for storm shelters to
be provided for all new buildings or structures incorporating an education E use group
under the IBC 2015 Section 423.4 supplement. This requirement also states that storm
shelter facilities must be provided with capacity to house the combined occupant load of
students and faculty only for which the permit encompasses. The applicant has
proposed the placement of modular classroom structure(s) to house students on campus
but had no initial plans for adding storm shelters.
The occupancy load for the new classroom use group E occupancy is calculated
according to IBC Table 1004.1.2 at 20sf net per occupant. The applicant has proposed
one structure for each location with 1266sf of classroom space, which gives us a total
occupant load of 64 apiece. The IBC 2015 Section 423.1 states that storm shelters are
to be constructed in accordance with the ICC-500 which would require 325sf of storm
shelter area.
In addition, while the 2015 IBC code does allow for the permitting of temporary uses
when approved by the Building Official, it has been the policy of Oklahoma City Plan
Review to deny these requests being that all building permits are seen as permanent
once issued, and as there is little to no means of enforcement triggered after a permit
receives certificate of occupancy.
The Plan Review staff finds no language as listed in either the ICC 500-2014 or the 2015
IBC which we interpret to allow for the applicants request to defer the construction of a
storm shelters. The Plan Review staff has allowed for the construction of the classrooms
to begin while yet holding the certificate of occupancy pending the storm shelter(s) or the
engineer’s certification.
The last ruling from the Board of Appeals on August 10th, 2022 had been to allowed for a
temporary 30-day certificate of occupancy pending either permitting and placement of
storm shelters, or the return of the applicant to the board for further extension of the
temporary certificate of occupancy provided they present a plan of action and timeline.
