Oklahoma City Water Utilities Trust Page 1 of 5 September 27, 2022 OKLAHOMA CITY WATER UTILITIES TRUST MEETING INFORMATION The Oklahoma City Water Utilities Trust usually meets twice per month on Tuesdays at 2:00 p.m. in Council Chambers at City Hall, unless different or prior notice of a change is posted. Call 297-2422 to confirm meeting dates. It is the policy of the Trust to ensure that communications with participants and members of the public with disabilities are as effective as communications with others. Anyone with a disability who requires an accommodation, a modification of policies or procedures, or an auxiliary aid or service in order to participate in this meeting should call (405) 297-2422 or TDD (405) 297-2020 at least 48 hours in advance (not including weekends or holidays). The staff will give primary consideration to the choice of auxiliary aid or service requested by the individual with disability. Safety Guidelines The following safety guidelines are in place during the COVID-19 pandemic for meetings in the Council Chamber at City Hall: face coverings are strongly recommended throughout the building (disposable face masks will be available); only the south entrance to City Hall will be open; air purifying machines will be in the Chamber; hand sanitizer machines will be available; and the Chamber will be cleaned and sanitized daily. Addressing the Trust Citizens may address the Trust on certain items by signing up to speak and providing the agenda item number, their reason for appearing and their address, but all comments must be relevant to the item. If you wish to address the Trust, you may call 297-2422 or you may sign up to speak at the meeting. The Chairman or presiding officer may in his or her discretion prohibit a person from addressing the Trust, or have any person removed from the Council Chamber, if that person commits any disorderly or disruptive behavior, which includes without limitation any of the following: speaking without being recognized by the Chairman or presiding officer; continuing to speak after notice that the speaker’s allotted time has expired; presenting comments or material not relevant to the item under discussion; failing to comply with the lawful instructions of the Chairman or presiding officer; engaging in other conduct, activity, or speech that delays, disturbs, interferes, or disrupts the effective or timely conduct of the meeting, or is otherwise violent, threatening, abusive, obscene, or jeopardizing the safety of self or others. A person may also be subject to arrest and removal from the Municipal Building for violation of Oklahoma City Municipal Code 2020, § 30-81 – Disorderly conduct and/or violation of Okla. Stat. tit. 21, §280- Willfully Disturbing, Interfering With or Disrupting State Business, Agency Operations or Employees. Citizens will be limited to three minutes to speak to the Trust. Trust Actions The Trust may take any of several actions including but not limited to adopt, approve, ratify, deny, defer, recommend, amend, strike, or continue any item. The Trust is not limited by staff recommendations as to the actions it may take. If more information is needed, the Trust may refer matters to the General Manager or to Legal Counsel, or submit them to committees, boards, commissions, or independent consultants for additional study. The Trust may authorize the General Manager or Legal Counsel to take certain actions. Items may be stricken from the agenda, or no action may be taken. Consent Docket Consent Docket items are usually approved as a group with the proper motion from a Trustee. Consent Docket items usually involve routine actions or standard contracts. Trustees, staff, or citizens may request discussion or separate consideration of any Consent Docket item. A separate vote may be taken upon the motion of a Trustee. B. Plans and Specifications to be advertised for bids, Project WC-0873, Atoka Pipeline Raw Water Transmission Line, Stonewall Pump Station to Ada Pump Station. C. Plans and Specifications to be advertised for bids, Project WC-1022, aerial waterline crossing replacement, NW 10th Street between County Line Road and the North Canadian River. D. Request for Proposals to be advertised, (RFP OCWUT 06-23) Enterprise Asset Management System Selection, Deployment, and Implementation. E. Contract for Engineering Services with CEC Corporation, Project SC-1096, sanitary sewer rehabilitation, NW 43rd Street to NW 50th Street from May Avenue to Pate Avenue, fee of $200,033. F. Contract for Engineering Services with Tetra Tech, Inc., Project SC-1097, sanitary sewer rehabilitation, NW 23rd Street to NW 30th Street from Shartel Avenue to Hudson Avenue, fee of $350,220. G. Ratifying and approving Addendum No. 1; awarding a contract to Crossland Heavy Contractors, Inc., Project WT-0246, Hefner surge system operational enhancements, Hefner Water Treatment Plant, $2,109,985; and approving the contract and bonds. H. Pricing Agreement award and approval, Core and Main LP (C239011), water sampling stations and replacement parts, September 27, 2022, through September 23, 2025, estimated annual cost $200,000. I. Amendment No. 3 to the Contract for Engineering Services with Carollo Engineers, Inc., Project WY-0012, distribution system nitrification evaluation, citywide, fee increase of $506,350. J. Amendment No. 1 and Change Order No. 1 revising the construction contract with Libra Electric Company, Project WT-0248, lighting upgrade, Draper Water Treatment Plant, increase of $40,129.76. Amendment No. 7 and Change Order No. 10 revising the construction contract with McKee Utility Contractors, Inc., Projects SC-0950, sanitary sewer relief interceptor, and SC-0950-1, mitigation of contaminated groundwater, Oklahoma River from I-35 to Shields Boulevard and SE 19th Street, increase of $427,003.56; and accepting the project and placing the maintenance bond into effects. L. Amendment No. 1 revising the construction contract with Urban Contractors, LLC, Project SE-0045, emergency 48-inch aerial crossing rehabilitation, East Reno Avenue and Tinker Diagonal Street, decrease of $15,983.90; and accepting the project and placing the maintenance bond into effect. M. Accept a permanent easement from The City of Oklahoma City, Project SC- 1070, sanitary sewer line replacement, NW Expressway and Linn Avenue. N. 1. Acceptance of Special Warranty Deed from The City of Oklahoma City, Projects M3-P016 and WC-1000, oversized water main extension to serve MAPS Lower Park under Policy A-1 procedures, Robinson Avenue to Harvey Avenue from Interstate 40 to SW 15th Street; and 2. Authorize payment of claim, $56,281. IV. Concurrence Docket A. Concurrence with the McGee Creek Authority in ratifying and approving Addendum No. 1; and rejecting bids, Project WMC-035 Revised, facility road improvements, McGee Creek Reservoir Dam Road and Pump Station Road. B. Concurrence with The City of Oklahoma City in adopting a Resolution approving Amendment No. 7 and Change Order No. 12, Projects M3-P016, MAPS 3 Scissortail (Lower) Park, WC-1000, waterline relocation, and SC-1073, sanitary sewer relocation, Robinson Avenue to Harvey Avenue from Interstate 40 to SW 15th Street, increase of $55,325.69; and authorizing the use of excess collections and/or interest in the amount of $55,325.69 to fund Change Order No. 12 and Amendment No. 7. (No OCWUT funds.) C. Concurrence with the McGee Creek Authority in adopting a Resolution ratifying the actions of the Chairman in approving Amendment No. 1 revising the construction contract with Downey Contracting, LLC, Project WMC-033, McGee Creek Equipment Building, McGee Creek Reservoir, Farris, Oklahoma, increase of $28,428; and ratifying the actions of the General Manager in approving Change Order No. 1 and accepting the project and placing the maintenance bond into effect. D. Concurrence with the McGee Creek Authority in adopting a Resolution ratifying the actions of the General Manager in approving plans and specifications to be advertised for bids and rejecting the bid, Project WMC-036, Bureau of Reclamation inspection improvements, McGee Creek Reservoir, Farris, Oklahoma. E. Concurrence with the McGee Creek Authority in adopting a Resolution ratifying the actions of the General Manager in approving plans and specifications to be advertised for bids, and ratifying and approving Addendum No. 1; ratifying the actions of the Chairman in awarding a contract to Luckinbill Construction Company, LLC, $296,000; ratifying the actions of the General Manager in approving Amendment No. 1, increase of $53,730; Project WMC-038, Bureau of Reclamation inspection gate and bonnet coating improvements, McGee Creek Reservoir, Farris, Oklahoma; and ratifying the actions of the General Manager in accepting the project and placing the maintenance bond into effect. Concurrence with the McGee Creek Authority in adopting a Resolution adopting participant and non-participant raw water service and raw water usage rates and charges for the McGee Creek raw water supply system (McGee Creek reservoir and pipeline) as set forth in the Schedule of Raw Water Service and Raw Water Usage Rates and Charges; and ratifying the actions of the General Manager in effectuating rates and charges for the McGee Creek Authority raw water bills issued on and after June 1, 2022. G. Concurrence with the McGee Creek Authority in adopting a Resolution ratifying the actions of the General Manager in approving the Joint Funding Agreement (22SJJFAOK017000) with the United States Geological Survey, AC-23-0001- US, July 1, 2022, through June 30, 2023, cost $4,300. V. Emergency Construction Contracts by Resolution (Four affirmative votes required for approval.) VI. Items for Individual Consideration A. 1. Receive the Preliminary Report, Project WM-0309, Overholser Dam structural stability improvements, Lake Overholser; and 2. Present recommendations for the Overholser Dam and authorize negotiations for the design; and 3. Resolution ratifying the actions of the General Manager, or designee(s), in executing and submitting a sub-applicant grant agreement between the Oklahoma City Water Utilities Trust and the Oklahoma Water Resources Board for a grant in the amount of up to $552,500 with an Oklahoma City Water Utilities Trust cost share of $297,500 for participation in the Federal Emergency Management Agency High Hazard Potential Dams grant for an Overholser Dam Structural Stability Project; authorizing the General Manager, or designee(s), to submit such application(s) to the Oklahoma Water Resources Board, as the state agency to administer the Federal Emergency Management Agency award program, for the High Hazard Potential Dam grant program, as available; and authorizing the General Manager, or designee(s), execute any documents associated with the grant application processes.
