Oklahoma City Water Utilities Trust Page 1 of 6 February 28, 2023 OKLAHOMA CITY WATER UTILITIES TRUST MEETING INFORMATION The Oklahoma City Water Utilities Trust usually meets twice per month on Tuesdays at 2:00 p.m. in Council Chambers at City Hall, unless different or prior notice of a change is posted. Call 297-2422 to confirm meeting dates. It is the policy of the Trust to ensure that communications with participants and members of the public with disabilities are as effective as communications with others. Anyone with a disability who requires an accommodation, a modification of policies or procedures, or an auxiliary aid or service in order to participate in this meeting should call (405) 297-2422 or TDD (405) 297-2020 at least 48 hours in advance (not including weekends or holidays). The staff will give primary consideration to the choice of auxiliary aid or service requested by the individual with disability. Safety Guidelines The following safety guidelines are in place during the COVID-19 pandemic for meetings in the Council Chamber at City Hall: face coverings are strongly recommended throughout the building (disposable face masks will be available); only the south entrance to City Hall will be open; air purifying machines will be in the Chamber; hand sanitizer machines will be available; and the Chamber will be cleaned and sanitized daily. Addressing the Trust Citizens may address the Trust on certain items by signing up to speak and providing the agenda item number, their reason for appearing and their address, but all comments must be relevant to the item. If you wish to address the Trust, you may call 297-2422 or you may sign up to speak at the meeting. The Chairman or presiding officer may in his or her discretion prohibit a person from addressing the Trust, or have any person removed from the Council Chamber, if that person commits any disorderly or disruptive behavior, which includes without limitation any of the following: speaking without being recognized by the Chairman or presiding officer; continuing to speak after notice that the speaker’s allotted time has expired; presenting comments or material not relevant to the item under discussion; failing to comply with the lawful instructions of the Chairman or presiding officer; engaging in other conduct, activity, or speech that delays, disturbs, interferes, or disrupts the effective or timely conduct of the meeting, or is otherwise violent, threatening, abusive, obscene, or jeopardizing the safety of self or others. A person may also be subject to arrest and removal from the Municipal Building for violation of Oklahoma City Municipal Code 2020, § 30-81 – Disorderly conduct and/or violation of Okla. Stat. tit. 21, §280- Willfully Disturbing, Interfering With or Disrupting State Business, Agency Operations or Employees. Citizens will be limited to three minutes to speak to the Trust. Trust Actions The Trust may take any of several actions including but not limited to adopt, approve, ratify, deny, defer, recommend, amend, strike, or continue any item. The Trust is not limited by staff recommendations as to the actions it may take. If more information is needed, the Trust may refer matters to the General Manager or to Legal Counsel, or submit them to committees, boards, commissions, or independent consultants for additional study. The Trust may authorize the General Manager or Legal Counsel to take certain actions. Items may be stricken from the agenda, or no action may be taken. Consent Docket Consent Docket items are usually approved as a group with the proper motion from a Trustee. Consent Docket items usually involve routine actions or standard contracts. Trustees, staff, or citizens may request discussion or separate consideration of any Consent Docket item. A separate vote may be taken upon the motion of a Trustee. Ratifying and approving Addenda Nos. 1 through 3; awarding a contract to Cimarron Construction Company, LLC, Project SC-1098, Twin Creek siphon replacement, Twin Creek at Wiley Post Park, $2,997,799; and approving the contract and bonds. B. Statement of Work with HCL America, Inc., (C99029), Volt MX, field services application, additional cost of $166,400. C. Statement of Work with HCL America, Inc., (C99029), Customer Service Representative new hire curriculum, additional cost of $263,000. D. Renewal of Professional Services Agreement with Carollo Engineers, Inc., (R23- C209022), power availability and electrical arc flash services, not to exceed $1,500,000, March 17, 2023, through March 16, 2026. E. Amendment No. 1 to the contract for engineering services with Ardurra Group, Inc., ST-0167, disinfection and dechlorination system improvements, North Canadian Wastewater Treatment Plant, fee increase of $3,165,880. F. Amendment No. 1 to the contract for engineering services with Freese and Nichols, Inc., Project WM-0309, Overholser Dam structural stability improvements, Lake Overholser, fee increase of $2,065,200. Amendment No. 2 to the contract for engineering services with Poe & Associates, Inc., Projects WM-0299, lake watershed protection program, and WM-0356, road rehabilitation, Lake Hefner and Lake Stanley Draper, fee increase of $15,450. Amendment No. 5 to the contract for engineering services with Carollo Engineers, Inc., Project WT-0159, various improvements to strengthen the redundancy and resiliency for water treatment and storage, Draper Water Treatment Plant, fee increase of $410,713. L. Resolution authorizing and directing the General Manager, or designee, to execute the service agreements establishing interest bearing trust accounts with Trustee Bank for the Atoka and Sardis Conservation Projects Fund; and authorizing the General Manager, Business Manager, or designee to oversee the administration, accounting and expenditure of all monies in the Atoka and Sardis Conservation Projects Fund. M. Resolution appropriating Oklahoma City Water Utilities Trust funds, as such become available, for the fiscal year 2023 replacement equipment; authorizing the General Manager, or designee, to purchase replacement equipment on Attachment “A” through Oklahoma City Water Utilities Trust procurement procedures and from state and other intergovernmental cooperative purchasing contracts that are bid and awarded in a manner consistent with the practices of the Oklahoma City Water Utilities Trust and applicable state law; directing the General Manager, or designee, to prepare and advertise bid specifications and requests for proposals for remaining replacement equipment, and to present contracts to the Oklahoma City Water Utilities Trust for award; and authorizing the General Manager, or designee, to declare replaced equipment items surplus to the needs of the Oklahoma City Water Utilities Trust and to trade-in or sell such replaced equipment in accordance with Oklahoma City Water Utilities Trust policies, estimated cost $4,777,491. N. Resolution authorizing and directing the General Manager to establish and administer procurement policies and practices in accordance with applicable law and the trust indenture and bond indenture and in accordance with this Resolution; directing the General Manager to review and approve contracts not more than $100,000 awarded by informal bidding procedures, awarded pursuant to emergencies, or awarded to sole sources; authorizing the General Manager to approve contracts and purchases from competitively bid contracts awarded by The City of Oklahoma City, by trusts of which The City of Oklahoma City is a beneficiary, or by the state of Oklahoma and its state agencies; authorizing the General Manager to declare emergencies, as is necessary for the protection of critical assets, the continuous operation of utility facilities, the provision of the utility services, and/or the public health, safety, and/or welfare, and to award emergency contracts subject to subsequent ratification and approval of the Oklahoma City Water Utilities Trust; and repealing any previously established procurement policies and practices in conflict herewith. O. 1. Renewal of Pricing Agreements with Core & Main LP (R23-C209034), and ICM of America, Inc. (R23-C209035), water and wastewater utility construction tools and equipment, estimated annual cost $125,000, April 1, 2023, through March 31, 2026; and 2. Resolution authorizing the open market purchase of water and wastewater utility construction tools and equipment for no bid items and related or associated items not available on a pricing agreement (OM23- C209036), estimated annual cost $50,000, April 1, 2023, through March 31, 2026. P. Revocable Permit with The City of Oklahoma City and Nate the Great Eight, Inc. to hold the Nate the Great Eight Race, March 25, 2023, Lake Overholser Reservoir and Reservation, revenue of $960. Concurrence with The City of Oklahoma City in approving Amendment No. 5 to the contract for engineering services with MacArthur Associated Consultants, LLC, Project BC-0219, Northwest Highway pedestrian crossing at West Wilshire Boulevard, fee increase of $37,370. (No OCWUT funds.) B. Concurrence with The City of Oklahoma City in approving Amendment No. 1 revising the construction contract with Allen Contracting, Inc., Projects PC-0559 and WC-0998, roadway widening improvements, Sara Road between SW 15th Street and SW 29th Street, increase of $3,345. (No OCWUT funds.) C. Concurrence with The City of Oklahoma City in approving Amendment No. 1 and Change Order No. 1 revising the construction contract with Downey Contracting, LLC, Projects DC-0310 and WC-1018, drainage improvements, west of North Western Avenue from NW 50th Street to NW 63rd Street, increase of $57,930.18. (No OCWUT funds.) D. Concurrence with The City of Oklahoma City in approving Amendment No. 2 and Change Order No. 3 revising the construction contract with Schwarz Paving Company, Inc., Projects PC-0472, roadway widening, WC-0944 and SC-1021, waterline and sanitary sewer line relocations, North Kelley Avenue from East Britton Road to East Hefner Road, increase of $182,276.05. (No OCWUT funds.) V. Emergency Construction Contracts by Resolution (Four affirmative votes required for approval.) A. 1. Resolution ratifying the actions of the General Manager in declaring an emergency; approving the bidding documents, approving Addendum No. 1, and awarding a contract to Krapff-Reynolds Construction Company, Project SE- 0047, emergency sanitary sewer replacement, North Western Avenue to Francis Avenue from south of Main Street to NW 4th Street, $4,892,587; ratifying issuance of an emergency work order; and approving the contract and bonds; and (Four affirmative votes required for approval.) 2. Amendment No. 1 and Change Order No. 1 revising the construction contract with Krapff-Reynolds Construction Company, Project SE-0047, emergency sanitary sewer improvements, North Western Avenue to Francis Avenue from south of Main Street to NW 4th Street, decrease of $2,397,622. B. 1. Resolution ratifying the actions of the General Manager in declaring an emergency; waiving competitive bidding, and awarding a contract to Crossland Heavy Contractors, Inc., Project WE-0101, Emergency Loop Repair, Hefner Water Treatment Plant, $24,545.39; ratifying issuance of an emergency work order; and approving the contract and bonds; and (Four affirmative votes required for approval.) 2. Final Acceptance, Project WE-0101, Emergency Loop Repair, Hefner Water Treatment Plant; and placing the maintenance bond into effect. VI. Items for Individual Consideration A. Receive an application from OKC L DEV, LLC, Project SB-2020-00002, oversized sanitary sewer main extension under Policy B-1 procedures to serve Creekside Village, vicinity of SW 29th Street and Czech Hall Road, estimated purchase price $246,480.
