Oklahoma City Water Utilities Trust Page 1 of 5 March 14, 2023 OKLAHOMA CITY WATER UTILITIES TRUST MEETING INFORMATION The Oklahoma City Water Utilities Trust usually meets twice per month on Tuesdays at 2:00 p.m. in Council Chambers at City Hall, unless different or prior notice of a change is posted. Call 297-2422 to confirm meeting dates. It is the policy of the Trust to ensure that communications with participants and members of the public with disabilities are as effective as communications with others. Anyone with a disability who requires an accommodation, a modification of policies or procedures, or an auxiliary aid or service in order to participate in this meeting should call (405) 297-2422 or TDD (405) 297-2020 at least 48 hours in advance (not including weekends or holidays). The staff will give primary consideration to the choice of auxiliary aid or service requested by the individual with disability. If you need an alternative format of the agenda, or any information provided at this meeting, please call (405) 297-2422 at least 48 hours before the meeting. Safety Guidelines The following safety guidelines are in place during the COVID-19 pandemic for meetings in the Council Chamber at City Hall: face coverings are strongly recommended throughout the building (disposable face masks will be available); only the south entrance to City Hall will be open; air purifying machines will be in the Chamber; hand sanitizer machines will be available; and the Chamber will be cleaned and sanitized daily. Addressing the Trust Citizens may address the Trust on certain items by signing up to speak and providing the agenda item number, their reason for appearing and their address, but all comments must be relevant to the item. If you wish to address the Trust, you may call 297-2422 or you may sign up to speak at the meeting. The Chairman or presiding officer may in his or her discretion prohibit a person from addressing the Trust, or have any person removed from the Council Chamber, if that person commits any disorderly or disruptive behavior, which includes without limitation any of the following: speaking without being recognized by the Chairman or presiding officer; continuing to speak after notice that the speaker’s allotted time has expired; presenting comments or material not relevant to the item under discussion; failing to comply with the lawful instructions of the Chairman or presiding officer; engaging in other conduct, activity, or speech that delays, disturbs, interferes, or disrupts the effective or timely conduct of the meeting, or is otherwise violent, threatening, abusive, obscene, or jeopardizing the safety of self or others. A person may also be subject to arrest and removal from the Municipal Building for violation of Oklahoma City Municipal Code 2020, § 30-81 – Disorderly conduct and/or violation of Okla. Stat. tit. 21, §280- Willfully Disturbing, Interfering With or Disrupting State Business, Agency Operations or Employees. Citizens will be limited to three minutes to speak to the Trust. Trust Actions The Trust may take any of several actions including but not limited to adopt, approve, ratify, deny, defer, recommend, amend, strike, or continue any item. The Trust is not limited by staff recommendations as to the actions it may take. If more information is needed, the Trust may refer matters to the General Manager or to Legal Counsel, or submit them to committees, boards, commissions, or independent consultants for additional study. The Trust may authorize the General Manager or Legal Counsel to take certain actions. Items may be stricken from the agenda, or no action may be taken. Consent Docket Consent Docket items are usually approved as a group with the proper motion from a Trustee. Consent Docket items usually involve routine actions or standard contracts. Trustees, staff, or citizens may request discussion or separate consideration of any Consent Docket item. A separate vote may be taken upon the motion of a Trustee. Specifications to be advertised for bids, Project WC-1051, lead service line identification, citywide. B. Joint Contract for engineering services with The City of Oklahoma City and Kimley-Horn and Associates, Inc., Project MC-0714-C, civil engineering services for water and wastewater systems, Tinker Air Force Base, estimated annual fee of $500,000 per fiscal year, March 14, 2023, through October 10, 2025. C. Scope of Work for process flow evaluation and system integration design and implementation services, with CH2M Hill Engineers, Inc., (C199010), additional cost of $241,000. D. Renewal of Professional Services Agreement with Carollo Engineers, Inc., (R23- C209022), power availability and electrical arc flash services, not to exceed $1,500,000, March 17, 2023, through March 16, 2026. Amendment No. 1 to the contract for engineering services with Ardurra Group, Inc., ST-0167, disinfection and dechlorination system improvements, North Canadian Wastewater Treatment Plant, fee increase of $3,165,880. Amendment No. 1 to the contract for engineering services with Carollo Engineers, Inc., Project WT-0253, Draper Water Treatment Plant, existing high service pump station electrical improvements, fee increase of $14,030. Resolution approving the plat and authorizing and ratifying the execution of the Owner’s Certificate and Dedication and the Owner’s Acknowledgement of Notary contained in the final plat of the Pratt and Whitney Sustainment Center, south of I-240 Highway and east of South Air Depot Boulevard. H. Oklahoma Department of Environmental Quality Permit to Construct, Project SC- 1101, sanitary sewer main improvements, Meridian Avenue from NW 28th Street to NW 33rd Street. Receive the Resolution adopting the McGee Creek Authority Fiscal Year 2024 budget, capital improvement projects, and pay plan; and directing the General Manager to implement and administer the budget and capital improvement projects, including but not limited to development of plans, specifications, bid solicitations, bid evaluations, contract negotiations, and award recommendations in accordance with the McGee Creek Authority Purchasing Policy and Procedures; and delegating to the Chairman the authority to award and execute contracts as needed, which comply with applicable law and do not exceed the funds available in the McGee Creek Authority Fiscal Year 2024 budget, pursuant hereto for ratification by the Trustees. J. Fiscal Year 2024 Loan Agreement with the Oklahoma City Water Utilities Trust, AC-23-0005-LA, estimated cost $2,692,000. K. Joint Resolution with The City of Oklahoma City electing and the Oklahoma City Water Utilities Trust agreeing to pay The City of Oklahoma City’s annual aliquot costs for Fiscal Year 2024 in accordance with the McGee Creek Authority Amended Trust Indenture. L. Confidential Settlement Agreement and Release with Meridian Contracting, Inc., the McGee Creek Authority, the Oklahoma City Water Utilities Trust, and The City of Oklahoma City, cost $8,786.64. M. Resolution to receive and approve the Lake Atoka Reservation Association Fiscal Year 2024 Budget. N. Ratification of payments from February 8, 2023, through March 7, 2023. IV. Concurrence Docket A. Concurrence with The City of Oklahoma City in approving Change Order No. 1 revising the construction contract with Schwarz Paving Co., Projects PC-0473, roadway widening improvements and WC-1027, waterline relocation, North Kelley Avenue from East Wilshire Boulevard to East Britton Road, increase of $104,358.00. (No OCWUT funds.) B. Concurrence with the McGee Creek Authority in approving Amendment No. 2 to the Contract for Professional Engineer Services with Smith Roberts Baldischwiler, LLC, Project WMC0TE, independent engineer to serve the McGee Creek Authority, annual fee not to exceed $650,000, March 19, 2023, through December 31, 2023. C. Concurrence with the McGee Creek Authority in adopting the Resolution ratifying the actions of the General Manager in approving plans and specifications to be advertised for bids, ratifying and approving Addendum No. 1; awarding contract to Ellsworth Construction OKC, LLC, Project WMC-035-1, facility road improvements, McGee Creek Reservoir, Farris, Oklahoma; $2,009,931.85; and approving contract and bonds. D. Concurrence with the McGee Creek Authority in adopting the Resolution ratifying the actions of the General Manager in approving plans and specifications to be advertised for bids, WMC-036 and WMC-039, Bureau of Reclamation inspection and regulating tank improvements, McGee Creek Reservoir, Farris, Oklahoma. Concurrence with the McGee Creek Authority in adopting the Resolution ratifying the actions of the General Manager in implementing a seven percent pay plan adjustment retroactive to July 1, 2022, a three percent one-time individual stipend for all current full-time McGee Creek Authority employees, and approving a new pay plan retroactive to July 1, 2022, through June 30, 2023, total estimated cost $26,200. F. Concurrence with the McGee Creek Authority in adopting the Resolution ratifying the actions of the General Manager in updating the McGee Creek Authority Uniform Policy, estimated annual cost $4,000, retroactive to January 1, 2023.
