Oklahoma City Water Utilities Trust Page 1 of 5 March 12, 2024 OKLAHOMA CITY WATER UTILITIES TRUST MEETING INFORMATION The Oklahoma City Water Utilities Trust usually meets twice per month on Tuesdays at 2:00 p.m. in Council Chambers at City Hall, unless different or prior notice of a change is posted. Call 297-2422 to confirm meeting dates. It is the policy of the Trust to ensure that communications with participants and members of the public with disabilities are as effective as communications with others. Anyone with a disability who requires an accommodation, a modification of policies or procedures, or an auxiliary aid or service in order to participate in this meeting should call (405) 297-2422 at least 48 hours in advance (not including weekends or holidays). The staff will give primary consideration to the choice of auxiliary aid or service requested by the individual with disability. If you need an alternative format of the agenda, or any information provided at this meeting, please call (405) 297-2422 at least 48 hours before the meeting. Addressing the Trust Citizens may address the Trust on certain items by signing up to speak and providing the agenda item number, their reason for appearing and their address, but all comments must be relevant to the item. If you wish to address the Trust, you may call 297-2422 or you may sign up to speak at the meeting. The Chairman or presiding officer may in his or her discretion prohibit a person from addressing the Trust, or have any person removed from the Council Chamber, if that person commits any disorderly or disruptive behavior, which includes without limitation any of the following: speaking without being recognized by the Chairman or presiding officer; continuing to speak after notice that the speaker’s allotted time has expired; presenting comments or material not relevant to the item under discussion; failing to comply with the lawful instructions of the Chairman or presiding officer; engaging in other conduct, activity, or speech that delays, disturbs, interferes, or disrupts the effective or timely conduct of the meeting, or is otherwise violent, threatening, abusive, obscene, or jeopardizing the safety of self or others. A person may also be subject to arrest and removal from the Municipal Building for violation of Oklahoma City Municipal Code 2020, § 30-81 – Disorderly conduct and/or violation of Okla. Stat. tit. 21, §280- Willfully Disturbing, Interfering With or Disrupting State Business, Agency Operations or Employees. Citizens may address the Trust on individual concerns at the end of the agenda under “Citizens to be Heard.” Comments must concern Trust services or policies. Please fill out a "Request to be Heard" form located outside the Chambers. Please return this form to the Trust Secretary before the meeting begins. PLEASE LIMIT YOUR COMMENTS TO 3 MINUTES. Continuing to speak beyond the time allowed by the Chairman or presiding officer shall constitute grounds for removal from the Council Chamber. Trust Actions The Trust may take any of several actions including but not limited to adopt, approve, ratify, deny, defer, recommend, amend, strike, or continue any item. The Trust is not limited by staff recommendations as to the actions it may take. If more information is needed, the Trust may refer matters to the General Manager or to Legal Counsel, or submit them to committees, boards, commissions, or independent consultants for additional study. The Trust may authorize the General Manager or Legal Counsel to take certain actions. Items may be stricken from the agenda, or no action may be taken. Consent Docket Consent Docket items are usually approved as a group with the proper motion from a Trustee. Consent Docket items usually involve routine actions or standard contracts. Trustees, staff, or citizens may request discussion or separate consideration of any Consent Docket item. A separate vote may be taken upon the motion of a Trustee. Ratifying and approving Addendum No. 1; awarding a contract to Jordan Contractors, LLC, Project SC-1110, Sanitary Sewer Rehabilitation, NE 24th Street to NE 30th Street from Santa Fe Avenue to Walnut Avenue, $1,461,031; and approving the contract and bonds. B. Renewal of the contract with Cimarron Construction Company, LLC, Project WC-1051, Lead Service Line Identification, Citywide, May 1, 2024 through April 30, 2025, not to exceed $2,500,000. C. Pricing Agreements award and approval, Primary Award – UCG2 LLC dba Anago of Oklahoma City (C249049), Secondary Award - SourceOne Facilities Management Services, Inc. (C249050), custodial services for the Utilities Department, March 12, 2024 through March 11, 2027, estimated annual cost $100,000; and approving performance bond for Anago of Oklahoma City. D. Amendment No. 1 and Change Order No. 1 with Krapff-Reynolds Construction Company, Project SC-1087, Sanitary Sewer Rehabilitation, eight locations, increase of $32,870. E. Amendment No. 2 and Change Order No. 2 with Cimarron Construction Company, Project SC-1098, Twin Creek Siphon Replacement, Twin Creek at Wiley Post Park, south of the North Canadian River and west of South Walker Avenue, increase of $179,533. F. Amendment No. 1 and Change Order No. 1 with Jordan Contractors, Inc., Project SE-0056, Emergency Sanitary Sewer Line Replacement, NE 4th Street between Kate Avenue and Fonshill Avenue, decrease of $8,391; and accepting the project and placing the maintenance bond into effect. G. Amendment No. 2 and Change Order No. 2 with Jordan Contractors, Inc., Project SC-1088, Sanitary Sewer Replacement, Villa Avenue from Reno Avenue to NW 1st Street, increase of $35,155; and accepting the project and placing the maintenance bond into effect. H. Final Acceptance, Project WT-0250-3, Filter Influent Flume Rehabilitation Treatment Train Number One, Draper Water Treatment Plant; and placing the maintenance bond into effect. J. Resolution authorizing the open market purchase of hydrants, valves, repair kits, valve positioners, repair parts, and services (OM24-C249065) estimated cost $250,000, until contract award. K. Oklahoma Department of Environmental Quality Permit to Construct, Project WC-0863-2, Balancing Tank Replacement for Atoka Pipeline Pump Stations, Coalgate and Macomb Pump Stations. L. Recommend The City of Oklahoma City grant a permanent easement to Oklahoma Gas and Electric Company, Project ST-0138, South Canadian Wastewater Treatment Plant Improvements M. 1. Accept a Quit Claim Deed; AND 2. Accept a Warranty Deed. N. 1. Recommend The City of Oklahoma City accept a Special Warranty Deed from Bixby Canyon Development, LLC, Project WR-0056, oversized water main extension under Policy A-1 procedures to serve The Canyons Phase 1, in the vicinity of SW 44th Street and Sara Road; accepting the project; AND 2. Authorize payment of the claim, $50,316. O. Ratification of payments from January 31, 2024 through February 27, 2024. IV. Concurrence Docket A. Concurrence with The City of Oklahoma City in ratifying and approving Addenda Nos. 1 and 2; awarding contract to First Water Contracting, LLC, Projects PC- 0698 and WC-1026, Roadway Widening, SW 149th Street between Western Avenue and Santa Fe Avenue, $4,827,483.75; assigning Standard Testing Company as the testing laboratory; and approving contract and bonds. (No OCWUT funds) B. Concurrence with The City of Oklahoma City in approving Change Order No. 5 with Allen Contracting, Inc., Projects PC-0559 and WC-0998, Roadway Widening Improvements, Sara Road between SW 15th Street and SW 29th Street. (No OCWUT funds) C. Concurrence with The City of Oklahoma City in approving Amendment No. 2 and Change Order No. 4 with Schwarz Paving Co., Projects PC-0473, Roadway Widening Improvements, and WC-1027, Waterline Relocation, North Kelley Avenue from East Wilshire Boulevard to East Britton Road, increase of $88,293.56. (No OCWUT funds) D. Concurrence with The City of Oklahoma City in approving Amendment No. 8 and Change Order No. 11 with Allen Contracting, Inc., Projects BC-0219R and WC- 0997, Pedestrian Bridge and Water Line Relocation, Northwest Expressway and West Wilshire Boulevard, increase of $6,738. Resolution ratifying the actions of the General Manager in declaring an emergency; approving the bidding documents, approving Addendum No. 1, and awarding a contract to Downey Contracting, LLC, Project WE-0103, Emergency Waterline Replacement, SE 89th Street and I-35 Service Road, $164,538; ratifying issuance of an emergency work order; and approving the contract and bonds. (Four affirmative votes required for approval.) VI. Items for Individual Consideration A. Engineering Report, Project SC-1099, Wastewater Lift Station No. 36 Improvements, 6012 SW 119th Street. B. 1. Joint Resolution with The City of Oklahoma City authorizing the participation in the settlement of Multi-District Litigation for drinking water supply claims related to per- and polyfluoroalkyl substances and/or aqueous film forming foams and related chemicals and pollution; AND/OR 2. Enter into executive session on advice of the Municipal Counselor to receive confidential communications from its attorneys regarding settlement of this case, as authorized by 25 O.S. (2023 Supp.) §307(B)(4), because disclosure would seriously impair the ability of the public body to process the claim or conduct a pending investigation or proceeding in the public interest. C. Enter into executive session on advice of the Municipal Counselor to receive confidential communications from its attorney concerning pending investigation and action related to the cases of Chickasaw Nation and Choctaw Nation of Oklahoma v. Mary Fallin, Rudolf John Herrmann, Tom Buchanan, Linda Lambert, Ford Drummond, Ed Fite, Marilyn Feaver, Kenneth K. Knowles, Richard Sevenoaks, Joe Taron, J.D. Strong, City of Oklahoma City, and Oklahoma City Water Utilities Trust, United States District Court for the Western District of Oklahoma, Case No. CIV-11-927-W, and Oklahoma Water Resources Board v. United States of America et al., United States District Court for the Western District of Oklahoma, Case Number CIV-12-275-W, as authorized by 25 O.S. (2023 Supp.) §307(B)(4) and related to the Settlement Agreement and Settlement Legislation, because disclosure would seriously impair the ability of the public body to conduct the pending investigation, litigation, or proceeding in the public interest, and as authorized by 25 O.S.
