Oklahoma City Water Utilities Trust Page 1 of 5 September 24, 2024 OKLAHOMA CITY WATER UTILITIES TRUST MEETING INFORMATION The Oklahoma City Water Utilities Trust usually meets twice per month on Tuesdays at 2:00 p.m. in Council Chambers at City Hall, unless different or prior notice of a change is posted. Call 297­2422 to confirm meeting dates. It is the policy of the Trust to ensure that communications with participants and members of the public with disabilities are as effective as communications with others. Anyone with a disability who requires an accommodation, a modification of policies or procedures, or an auxiliary aid or service in order to participate in this meeting should call (405) 297­2422 at least 48 hours in advance (not including weekends or holidays). The staff will give primary consideration to the choice of auxiliary aid or service requested by the individual with disability. Addressing the Trust Citizens may address the Trust on certain items by signing up to speak and providing the agenda item number, their reason for appearing and their address, but all comments must be relevant to the item. If you wish to address the Trust, you may call 297­2422 or you may sign up to speak at the meeting. The Chairman or presiding officer may in his or her discretion prohibit a person from addressing the Trust, or have any person removed from the Council Chamber, if that person commits any disorderly or disruptive behavior, which includes without limitation any of the following: speaking without being recognized by the Chairman or presiding officer; continuing to speak after notice that the speaker’s allotted time has expired; presenting comments or material not relevant to the item under discussion; failing to comply with the lawful instructions of the Chairman or presiding officer; engaging in other conduct, activity, or speech that delays, disturbs, interferes, or disrupts the effective or timely conduct of the meeting, or is otherwise violent, threatening, abusive, obscene, or jeopardizing the safety of self or others. A person may also be subject to arrest and removal from the Municipal Building for violation of Oklahoma City Municipal Code 2020, § 30­81 – Disorderly conduct and/or violation of Okla. Stat. tit. 21, §280­ Willfully Disturbing, Interfering With or Disrupting State Business, Agency Operations or Employees. Citizens may address the Trust on individual concerns at the end of the agenda under “Citizens to be Heard.” Comments must concern Trust services or policies. Please fill out a "Request to be Heard" form located outside the Chambers. Please return this form to the Trust Secretary before the meeting begins. PLEASE LIMIT YOUR COMMENTS TO 3 MINUTES. Continuing to speak beyond the time allowed by the Chairman or presiding officer shall constitute grounds for removal from the Council Chamber. Trust Actions The Trust may take any of several actions including but not limited to adopt, approve, ratify, deny, defer, recommend, amend, strike, or continue any item. The Trust is not limited by staff recommendations as to the actions it may take. If more information is needed, the Trust may refer matters to the General Manager or to Legal Counsel, or submit them to committees, boards, commissions, or independent consultants for additional study. The Trust may authorize the General Manager or Legal Counsel to take certain actions. Items may be stricken from the agenda, or no action may be taken. Consent Docket Consent Docket items are usually approved as a group with the proper motion from a Trustee. Consent Docket items usually involve routine actions or standard contracts. Ratifying and approving Addendum No. 1; awarding a contract to Urban Contractors, LLC, Project SC­1124, Sanitary Sewer Aerial Crossing Rehabilitation, 4800 South Broadway Place, $107,231; and approving the contract and bonds. C. Ratifying and approving Addendum No. 1; awarding a contract to Luckinbill Construction Company, LLC, Project WC­1083, Waterline Replacement, 700 West Memorial Road, $727,177; and approving the contract and bonds. D. Renewal No. 1 of the Professional Services Agreement with In­Pipe Technology, LLC (C229016), fats, oils, and grease reduction services, estimated annual cost $800,000, November 9, 2024 through November 8, 2027. E. Concurrence with The City of Oklahoma City in approving Plans and Specifications to be advertised for bids, Projects PC­0926 and WC­1023 Phase 2, Roadway Widening and Waterline Relocation, Post Road from SE 44th Street to SE 59th Street, SE 44th Street from Post Road to Douglas Boulevard. Concurrence with The City of Oklahoma City in approving Change Order No. 8 with Allen Contracting, Inc., Projects PC­0559 and WC­0998, Roadway Widening Improvements, Sara Road between SW 15th Street and SW 29th Street, increase of $28,290. Concurrence with The City of Oklahoma City in accepting Projects BC­0219R and WC­0997, Pedestrian Bridge and Waterline Relocation, Northwest Expressway and West Wilshire Boulevard; and placing maintenance bond into effect. (No OCWUT funds) D. Concurrence with the McGee Creek Authority in adopting a Resolution ratifying the actions of the Chairman in approving Amendment No. 2 and Change Order No. 2 with Nash Construction Company, Inc., Projects WMC­036 and WMC­ 039, Bureau of Reclamation Inspection and Regulating Tank Improvements, McGee Creek Reservoir, Farris, Oklahoma, decrease of $20,103.20; and accepting the project and placing the maintenance bond into effect. E. Concurrence with the McGee Creek Authority in adopting a Resolution ratifying the actions of the General Manager in approving Addenda Nos. 1 and 2; and rejecting bid, Project WMC­037­1, MCA Residence Replacement, McGee Creek Reservoir, Farris, Oklahoma. F. Concurrence with the McGee Creek Authority in adopting a Resolution ratifying the actions of the General Manager in approving Addendum No. 1; ratifying the actions of the Chairman in awarding contract to MacHill Construction Company, Inc., Project WMC­037­R, MCA Headquarters Building Replacement, McGee Creek Reservoir, Farris, Oklahoma, $2,907,542; and approving the contract and bonds. G. Concurrence with the McGee Creek Authority in adopting a Resolution ratifying the actions of the Chairman in approving Amendment No. 1 and Change Order No. 1 with Wynn Construction Company, Inc., Project WMC­040­Revised, McGee Creek Pipeline Cathodic Protection Improvements, McGee Creek Reservoir, Farris, Oklahoma, increase of $69,793.10; and accepting the project and placing the maintenance bond into effect. H. Concurrence with the McGee Creek Authority in adopting a Resolution ratifying the actions of the General Manager in approving the Joint Funding Agreement (24SJJFAOK017000) with the United States Geological Survey, AC­24­0003­ US, July 1, 2024 through June 30, 2025, cost $4,900. I. Concurrence with the McGee Creek Authority in adopting a Resolution authorizing a 3.62 percent pay plan adjustment over fiscal year 2023­2024 rates, retroactive to July 1, 2024, for full­time McGee Creek Authority employees; and approving a new McGee Creek Authority pay plan, retroactive to July 1, 2024 through June 30, 2025. V. Emergency Construction Contracts by Resolution (Four affirmative votes required for approval.) VI. Items for Individual Consideration A. Joint Resolution with The City of Oklahoma City approving the price adjustments to the regulated tariff rate contract with the United States of America for the provision of utility services, initial system deficiency corrections, and the recoverable portion of systems purchase price associated with Tinker Air Force Base effective November 1, 2023, as provided in accord with FAR 52.241­7, changes in rates or terms and conditions of the service for regulated services, and authorizing the General Manager to implement the approved Tinker Air Force annual water tariff rate of $15,247,200 and the approved Tinker Air Force Base annual wastewater tariff rate of $11,937,600 for Contract Year 3. Amendment No. 16 to the Award/Contract (SP0600­20­C­8331) associated with the United States of America for the municipalization of the water and wastewater systems at Tinker Air Force Base. C. 1. Settlement and Release Agreement with The City of Oklahoma City and Deer Creek Water Corporation involving water service to settle the case of Deer Creek Water Corporation v. The City of Oklahoma City and Oklahoma City Water Utilities Trust, in the U.S. District Court for the Western District of Oklahoma, Case No. CIV­19­1116­SLP; AND/OR 2. Enter into executive session on advice of the Municipal Counselor to receive confidential communications from its attorney concerning this case as authorized by 25 O.S. (2023 Supp.) §307(B)(4), because disclosure of the confidential communications would seriously impair the ability of the public body to conduct such potential litigation in the public interest. VII.
