Oklahoma City Water Utilities Trust Page 1 of 5 February 11, 2025 OKLAHOMA CITY WATER UTILITIES TRUST MEETING INFORMATION The Oklahoma City Water Utilities Trust usually meets twice per month on Tuesdays at 2:00 p.m. in Council Chambers at City Hall, unless different or prior notice of a change is posted. Call 297-2422 to confirm meeting dates. It is the policy of the Trust to ensure that communications with participants and members of the public with disabilities are as effective as communications with others. Anyone with a disability who requires an accommodation, a modification of policies or procedures, or an auxiliary aid or service in order to participate in this meeting should call (405) 297-2422 at least 48 hours in advance (not including weekends or holidays). The staff will give primary consideration to the choice of auxiliary aid or service requested by the individual with disability. If you need an alternative format of the agenda, or any information provided at this meeting, please call (405) 297-2422 at least 48 hours before the meeting. Addressing the Trust Citizens may address the Trust on certain items by signing up to speak and providing the agenda item number, their reason for appearing and their address, but all comments must be relevant to the item. If you wish to address the Trust, you may call 297-2422 or you may sign up to speak at the meeting. The Chairman or presiding officer may in his or her discretion prohibit a person from addressing the Trust, or have any person removed from the Council Chamber, if that person commits any disorderly or disruptive behavior, which includes without limitation any of the following: speaking without being recognized by the Chairman or presiding officer; continuing to speak after notice that the speaker’s allotted time has expired; presenting comments or material not relevant to the item under discussion; failing to comply with the lawful instructions of the Chairman or presiding officer; engaging in other conduct, activity, or speech that delays, disturbs, interferes, or disrupts the effective or timely conduct of the meeting, or is otherwise violent, threatening, abusive, obscene, or jeopardizing the safety of self or others. A person may also be subject to arrest and removal from the Municipal Building for violation of Oklahoma City Municipal Code 2020, § 30-81 – Disorderly conduct and/or violation of Okla. Stat. tit. 21, §280- Willfully Disturbing, Interfering With or Disrupting State Business, Agency Operations or Employees. Citizens may address the Trust on individual concerns at the end of the agenda under “Citizens to be Heard.” Comments must concern Trust services or policies. Please fill out a "Request to be Heard" form located outside the Chambers. Please return this form to the Trust Secretary before the meeting begins. PLEASE LIMIT YOUR COMMENTS TO 3 MINUTES. Continuing to speak beyond the time allowed by the Chairman or presiding officer shall constitute grounds for removal from the Council Chamber. Trust Actions The Trust may take any of several actions including but not limited to adopt, approve, ratify, deny, defer, recommend, amend, strike, or continue any item. The Trust is not limited by staff recommendations as to the actions it may take. If more information is needed, the Trust may refer matters to the General Manager or to Legal Counsel, or submit them to committees, boards, commissions, or independent consultants for additional study. The Trust may authorize the General Manager or Legal Counsel to take certain actions. Items may be stricken from the agenda, or no action may be taken. Consent Docket Consent Docket items are usually approved as a group with the proper motion from a Trustee. Consent Docket items usually involve routine actions or standard contracts. Pricing Agreements award and approval, VWR International, LLC (OCWUT00101), Hach Company (OCWUT00102), Brinkmann Instruments, Inc. dba Metrohm USA, Inc. (OCWUT00103), Pacific Star Corporation dba Labmax Equipment & Supplies (OCWUT00106), Thomas Scientific Holdings, LLC (OCWUT00107), and Fox Scientific, Inc. (OCWUT00109), Laboratory Chemicals, Supplies, and Accessories, estimated annual cost $450,000, February 11, 2025 through February 10, 2030. B. Amendment No. 1 and Change Order No. 1 with Wynn Construction Co., Inc., Projects ST-0154-1 and ST-0161, Wastewater Treatment Plant Biosolids; Odor Management and Electrical Improvements, Deer Creek Wastewater Treatment Plant, decrease of $5,941,219.60. C. Amendment No. 2 to the Software License and Services Agreement with SAP America, Inc. (C239036), annual increase of $16,015.97. D. Amendment No. 1 and Renewal No. 1 of the Pricing Agreement with Oklahoma City Landfill, LLC dba Southeast OKC Landfill (C209026), disposal of municipal solid waste, construction and demolition waste, water and wastewater sludge waste, appliances that may contain refrigerants, and tires, estimated annual cost $2,025,000, retroactive to February 1, 2025 through January 31, 2028; and approving the performance bond. E. Amendment No. 1 and Renewal No. 1 of the Pricing Agreement with Oklahoma City Landfill, LLC dba Southeast OKC Landfill (C209030), disposal of various waste at landfill during Federal Emergency Management Agency declared emergencies, retroactive to February 1, 2025 through January 31, 2028; and approving performance bond. F. Amendment No. 1 with Urban Contractors, LLC, Project SC-1115, Sanitary Sewer Rehabilitation, four locations, decrease of $6,160.50; and accepting the project; and placing the maintenance bond into effect. G. Resolution authorizing an increase in the cost estimate for Pricing Agreements with Cimarron Construction Company, LLC (OCWUT00091) and Southwest Water Works, LLC (OCWUT00092), to perform repair services on 4-inch to 12-inch water mains and to perform leak repair services on public water service lines and valves, and provide other related labor and services at various locations citywide, estimated annual cost increase of $1,500,000 to a total estimated annual cost of $2,500,000, for the period ending November 20, 2027. I. Ratification of payments from January 1, 2025 through January 28, 2025. IV. Concurrence Docket A. Concurrence with The City of Oklahoma City in approving Amendment No. 5 to the Contract for Engineering Services with Utley & Associates, LLC, Projects DC-0298, Drainage Improvements, and SC-1057, Sanitary Sewer Relocation, Twisted Oak Road and Oak Hollow Road to Quail Creek Golf Course, fee increase of $52,000. (No OCWUT funds) B. Concurrence with The City of Oklahoma City in approving Plans and Specifications to be advertised for bids, Projects DC-0298, Drainage Improvements, and SC-1057, Sanitary Sewer Relocation, Twisted Oak Road and Oak Hollow Road to Quail Creek Golf Course. (No OCWUT funds) V. Emergency Construction Contracts by Resolution (Four affirmative votes required for approval.) VI. Items for Individual Consideration A. Plans and Specifications to be advertised for bids, Project WC-0863-2, Balancing Tank Replacement, Atoka Pipeline Pump Stations, Coalgate and Macomb, Oklahoma. B. Resolution authorizing General Manager or designee, General Counsel, Bond Counsel, and the Financial Advisor to negotiate agreements with the Commercial Paper Letter of Credit Bank and other parties to increase the amount of covered Commercial Paper Notes supported by the letter of credit; authorizing the General Manager or designee and the Financial Advisor to solicit and/or negotiate with other financial institutions to replace any of said parties, if deemed necessary, by the General Manager or designee for such purposes; authorizing the General Manager or designee and the Financial Advisor to prepare necessary documents for and to initiate formal rating process pertaining thereto; approving scope of services letter and scope of services agreement; authorizing other agreements to the extent deemed necessary for such purpose; and containing other provisions related thereto. C. Resolution authorizing the General Manager or designee and the Financial Advisor to develop and issue a Request for Proposals to solicit quotes from financial institutions for a new tax-exempt bank note program for the purpose of providing interim funding; authorizing the General Manager or designee, General Counsel, Bond Counsel, and the Financial Advisor to negotiate an agreement with the successful proposer; approving scope of services letter and scope of services agreement; authorizing other agreements to the extent deemed necessary for such purposes; and containing other provisions related thereto.
