CALL TO ORDER The City Council of The City of Seattle met in the Council Chamber in City Hall in Seattle, Washington, on September 14, 2015, pursuant to the provisions of the City Charter. The meeting was called to order at 2:00 p.m., with Council President Burgess presiding. B. ROLL CALL Present: 8 - Bagshaw, Burgess, Godden, Harrell, Licata, O'Brien, Rasmussen, Sawant C. ADOPTION OF INTRODUCTION AND REFERRAL CALENDAR Page 1 Full Council Meeting Minutes September 14, 2015 IRC 30 September 14, 2015 ACTION 1: Motion was made and duly seconded to adopt the proposed Introduction and Referral Calendar. ACTION 2: Motion was made by Councilmember O'Brien, duly seconded and carried, to amend the proposed Introduction and Referral Calendar by introducing Resolution No. 31614, entitled, "A Resolution endorsing a vision for the City of Seattle to become a city with zero use of detention for youth, and establishing a path forward to develop policies that eliminate the need for youth detention," and by referring it to the Public Safety, Civil Rights, and Technology Committee. ACTION 3: Motion was made by Councilmember Sawant, duly seconded and carried, to amend the proposed Introduction and Referral Calendar by introducing Resolution No. 31615, entitled, "A Resolution designating the week of September 14, 2015 through September 18, 2015, 'Seattle Educators Week' in recognition and support of the Seattle Education Association whose members are on strike for a fair contract," and by referring it to the Full Council for Adoption. ACTION 4: Motion was made by Councilmember Burgess, duly seconded and carried, to amend the proposed Introduction and Referral Calendar by changing the referral of Appointment No. 219 from the Public Safety, Civil Rights, and Technology Committee to the Education and Governance Committee. ACTION 5: Motion was made and duly seconded to adopt the proposed Introduction and Referral Calendar as amended. Motion was made and duly seconded to pass Council Bill No. 118501. The Ordinance (Ord) was passed. In Favor: 9 - Bagshaw, Burgess, Godden, Harrell, Licata, O'Brien, Okamoto, Rasmussen, Sawant Opposed: None I. COMMITTEE REPORTS FINANCE AND CULTURE COMMITTEE 1. CB 118492 AN ORDINANCE relating to City employment, adopting a 2015 Citywide Position List. The Committee recommends that Full Council pass the Council Bill (CB). In Favor: 2 - Licata, Godden Opposed: None The Council Bill (CB) was passed by the following vote and the President signed the Bill: In Favor: 9 - Bagshaw, Burgess, Godden, Harrell, Licata, O'Brien, Okamoto, Rasmussen, Sawant Opposed: None Page 5 Full Council Meeting Minutes September 14, 2015 2. CB 118491 AN ORDINANCE authorizing the acceptance of the grant of an easement for public access over and across a portion of the property commonly known as (old) Fire Station Seven, located at 402 15th Avenue East, in exchange for the City’s extinguishment of certain deed restrictions encumbering title to Fire Station Seven; and ratifying and confirming certain prior acts. The Committee recommends that Full Council pass the Council Bill (CB). In Favor: 4 - Licata, Godden, Burgess, O'Brien Opposed: None The Council Bill (CB) was passed by the following vote and the President signed the Bill: In Favor: 9 - Bagshaw, Burgess, Godden, Harrell, Licata, O'Brien, Okamoto, Rasmussen, Sawant Opposed: None J. ADOPTION OF OTHER RESOLUTIONS Res 31615 A RESOLUTION designating the week of September 14, 2015 through September 18, 2015 “Seattle Educators Week” in recognition and support of the Seattle Education Association whose members are on strike for a fair contract. OTHER BUSINESS The Clerk read Washington Public Employment Relations Commission DECISION 12060-A - PECB: “NOTICE TO EMPLOYEES STATE LAW GIVES YOU THE RIGHT TO: • Form, join, or assist an employee organization (union). • Bargain collectively with your employer through a union chosen by a majority of employees. • Refrain from any or all of these activities except, you may be required to make payments to a union or charity under a lawful union security provision. THE WASHINGTON STATE PUBLIC EMPLOYMENT RELATIONS COMMISSION CONDUCTED A LEGAL PROCEEDING, AND RULED THAT THE CITY OF SEATTLE COMMITTED AN UNFAIR LABOR PRACTICE, AND ORDERED US TO POST THIS NOTICE TO EMPLOYEES: WE UNLAWFULLY changed represented employees’ working conditions by charging an employee with a violation of the Code of Ethics and initiating charges at the Seattle Ethics and Elections Commission (SEEC) after we had previously disciplined the employee for the same misconduct. TO REMEDY OUR UNFAIR LABOR PRACTICES: WE WILL close the SEEC investigation of Ron Allen’s October 2010 misconduct. WE WILL notify IBEW Local 77 and Allen in writing of the date that the SEEC case is closed. WE WILL follow the disciplinary process in the Collective Bargaining Agreement. WE WILL notify the union of proposed changes to working conditions and bargain upon request. WE WILL NOT unilaterally change represented employees’ working conditions or implement proposals that have not been bargained to agreement or impasse. WE WILL NOT, in any other manner, interfere with, restrain, or coerce our employees in the exercise of their collective bargaining rights under the laws of the State of Washington."
