CALL TO ORDER The City Council of The City of Seattle met in the Council Chamber in City Hall in Seattle, Washington, on January 17, 2017, pursuant to the provisions of the City Charter. The meeting was called to order at 2:01 p.m., with Council President Harrell presiding. B. ROLL CALL Present: 8 - Bagshaw, Burgess, Harrell, Herbold, Johnson, Juarez, O'Brien, Sawant Excused: 1 - González Motion was made, duly seconded and carried, to excuse Councilmember González from the January 17, 2017 Full Council meeting. C. ADOPTION OF INTRODUCTION AND REFERRAL CALENDAR Page 1 Full Council Meeting Minutes January 17, 2017 IRC 95 January 17, 2017 ACTION 1: Motion was made and duly seconded to adopt the proposed Introduction and Referral Calendar. ACTION 2: Motion was made by Councilmember O’Brien, duly seconded and carried, to amend the proposed Introduction and Referral Calendar by introducing Council Bills 118896 and 118897, and by referring both Council Bills to the Sustainability and Transportation Committee. Council Bill 118896, AN ORDINANCE amending Section 15.04.100 of the Seattle Municipal Code to allow the Director of Transportation the authority to credit certain use fees in exchange for voluntary transportation improvements of equal value in the public right-of-way. Council Bill 118897, AN ORDINANCE accepting various deeds for street or alley purposes and a limited purpose easement for public access, use, and maintenance; laying off, opening, widening, extending, and establishing portions of rights of way; placing the real property conveyed by said deeds and easement under the jurisdiction of the Seattle Department of Transportation; and ratifying and confirming certain prior acts. (This ordinance concerns the following rights of way: the alley in Block 21, North Seattle; University Way Northeast, Northeast 50th Street, and Brooklyn Avenue Northeast abutting Block 6, University Heights; the alley in Block 24, Addition to the Town of Seattle, as laid out by A. A. Denny (Commonly known as A. A. Denny’s 3rd Addition to the City of Seattle); the alley in Block 23 and Block 51, Second Addition to the Town of Seattle as laid off by the Heirs of Sara A. Bell, (deceased) (Commonly known as Heirs of Sarah A. Bell’s 2nd Addition to the City of Seattle); the alley in Block 4, University Heights; the alley in Block 12, North Seattle; the alley in Block 91, Woodlawn Addition to Green Lake; the alley in Block 18, University Park Addition to the City of Seattle; the alley in Section 5, Township 24 North, Range 4 East, W. ACTION 3: Motion was made by Councilmember Harrell, duly seconded and carried, to amend the proposed Introduction and Referral Calendar by introducing Resolution 31729, and by referring it to the Full Council for adoption at today’s meeting. Resolution 31729, A RESOLUTION ratifying and confirming emergency orders creating three additional encampments for persons experiencing homelessness. ACTION 4: Motion was made and duly seconded to adopt the proposed Introduction and Referral Calendar as amended. The Motion carried, and the Introduction & Referral Calendar (IRC) was adopted as amended by the following vote: In Favor: 8 - Bagshaw, Burgess, Harrell, Herbold, Johnson, Juarez, O'Brien, Sawant Opposed: None D. PAYMENT OF BILLS CB 118892 AN ORDINANCE appropriating money to pay certain audited claims and ordering the payment thereof. Motion was made and duly seconded to pass Council Bill 118892. CB 118870 AN ORDINANCE relating to the Seattle Public Utilities Department; declaring as surplus certain portions of a portion of the City’s Tolt Water Transmission Pipeline right-of-way, King County Assessor Parcel number 0326049122, to serve the property commonly known as 19229 47th Ave NE, The City of Lake Forest Park, Washington 98156, Elizabeth Simmons-O’Neill and John Joseph O’Neill, Grantee’s property, King County Assessor Parcel number 4400900040, and granting a non-exclusive easement for existing utility service lines, and the maintenance and use of a driveway access over and across the same. The Committee recommends that Full Council pass the Council Bill (CB). ADOPTION OF OTHER RESOLUTIONS Page 7 Full Council Meeting Minutes January 17, 2017 6. Res 31729 A RESOLUTION modifying emergency orders creating three additional encampments for persons experiencing homelessness. ACTION 1: Motion was made and duly seconded to adopt Resolution 31729. ACTION 2: Motion was made, duly seconded and carried, to suspend Council Rule III.A.6, relating to the presentation of Full Council amendments at least two hours before the Full Council meeting. ACTION 3: Motion was made by Councilmember Herbold and duly seconded, to amend Resolution 31729, by substituting version 2 for version 1a, which includes three Modified Orders as Exhibits to the Resolution. By Unanimous consent, the Council Rules were suspended to allow Ketil Freeman, Council Central Staff, to address the Council. ACTION 4: Motion was made by Councilmember Harrell, duly seconded and carried, to further amend the proposed amendment in Action 3, Exhibits B, D, and F, Section 1.3.c., as shown in the underlined language below: Section 1.3.c. c. The encampment operator shall provide toilets, potable or running water, and garbage collection according to the following standards: · Provide and maintain chemical toilets as recommended by the portable toilet service provider or provide access to toilets in an indoor location; · Provide potable or running water in an indoor location or alternatively, continuously maintain outdoor running water and discharge the water to a location approved by the City; and · Remove garbage frequently, and no less than once weekly, to prevent overflow. ACTION 6: Motion was made by Councilmember O’Brien, duly seconded and carried, to amend Resolution 31729, by adding a new 7th recital, as shown in the underlined language below: WHEREAS, the sanctioned encampments have provided safer living situations for some unsheltered residents, and the Executive should continue working with community groups and unsheltered residents to increase adequate and accessible indoor spaces to reduce the need for encampment removals; and ACTION 7: Motion was made and duly seconded to adopt Resolution 31729 as amended.
