(Project No. 3016200; Type IV) The Committee recommends that Full Council grant the Application as conditioned. In Favor: 4 - Johnson, O'Brien, Harris-Talley, Juarez Opposed: None Abstain: 1 - Herbold The Application was granted as conditioned by the following vote, and the President signed the Findings, Conclusions, and Decision of the City Council: In Favor: 8 - Bagshaw, Harrell, Herbold, Johnson, Juarez, Mosqueda, O'Brien, Sawant Opposed: None FULL COUNCIL: Page 6 Full Council Meeting Minutes December 4, 2017 3. CB 119147 AN ORDINANCE relating to land use and zoning; amending Chapter 23.32 of the Seattle Municipal Code at page 150 of the Official Land Use Map to rezone property located at 5911 42nd Avenue Southwest from Single Family 5000 to Lowrise 1, and accepting a Property Use and Development Agreement as a condition of rezone approval. (Petition by David Neiman, C.F. 314343, SDCI Project 3016200) ACTION 1: Motion was made and duly seconded to pass Council Bill 119147. ACTION 2: Motion was made by Councilmember Johnson, duly seconded and carried, to amend Council Bill 119147, Exhibit B, by substituting the executed Property Use and Development Agreement for the unexecuted Property Use and Development Agreement. ACTION 3: Motion was made by Councilmember O'Brien, duly seconded and carried, to amend Resolution 31787, Exhibit 1, by substituting version 3 for version 2. CB 119088 AN ORDINANCE related to KeyArena; authorizing the Mayor to execute a memorandum of understanding with Oak View Group, LLC, regarding the redevelopment of KeyArena into a world-class, multi-purpose sports and entertainment arena at Seattle Center, including its design, construction, lease, financing and future operation; exempting the redevelopment and future operation of the Arena from the requirements of Chapter 20.47 of the Seattle Municipal Code; and ratifying and confirming certain prior acts. The Committee recommends that Full Council pass the Council Bill (CB). In Favor: 5 - Harrell, Juarez, Bagshaw, González , Herbold Opposed: None ACTION 1: Motion was made by Councilmember Juarez, duly seconded and carried, to amend Council Bill 119088, Attachment 1, by sustituting version 2 for version 1. ACTION 2: Motion was made by Councilmember O'Brien and duly seconded, to amend Council Bill 119088, by amending Section 1.b, Term and Exclusivity, by deleting the last sentence's clause as shown in the strike through language below: "and (ii) the City shall not provide financial support, benefits, or incentives (other than those that are generally available to any potential developer) with respect to the construction of any live entertainment venue with a capacity of more than 15,000 seats within the jurisdictional boundaries of the City of Seattle." The Motion failed by the following vote: In favor: 2 - O'Brien, Sawant Opposed: 6 - Bagshaw, Harrell, Herbold, Johnson, Juarez, Mosqueda ACTION 3: Motion was made and duly seconded to pass Council Bill 119088 as amended.
