MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8
p.m. on Monday April 16, 2018
Pledge of Allegiance led by Cub Scout Pack #968 from Skokie School District 68.
The Mayor called the meeting to order.

AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ESTABLISH
AND OPERATE A CHILD DAY CARE AT 5121 DEMPSTER STREET,
SKOKIE, ILLINOIS IN A B3 BUSINESS DISTRICT
1 WHEREAS, the owner of the following described real property:
2 LOT 4 AND LOT 5 IN NICHOLAS DAHM’S SUBDIVISION OF PART OF THE
3 NORTHEAST ¼ OF SECTION 21, TOWNSHIP 41 NORTH, RANGE 13 EAST OF THE
4 THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS, (EXCEPT THAT PART
5 TAKEN FOR STREET).

7 more commonly described as 5121 Dempster Street, Skokie, Illinois (hereinafter “Subject
8 Property”), petitioned the Village of Skokie, on behalf of Barry Benveniste and Amber
9 Grafman (hereinafter “Creative Paths Learning Center”) for a special use permit to establish
10 and operate a child day care, in a B3 Business district, and for relief from Chapter 118,
11 Section 118-218, of the Skokie Village Code, in order to allow two rather than four legal off-
12 street parking spaces; and
13 WHEREAS, Creative Paths Learning Center intends to relocate and expand the infant
14 care portion of its facility into an adjacent storefront to the east and operate it as a new and
15 separate business, Creative Paths Infant Center (hereinafter “Infant Center”); and
16 WHEREAS, the Infant Center will have two classrooms, a kitchen, a laundry room, a
17 bathroom, and a reception area. Upon staff review, it was determined that relief from Section
18 118-218 was not required; and
19 WHEREAS, it is anticipated that the Infant Center will have up to 24 infants and will be
20 staffed by six people; and
21 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on March 19,
22 2018, for which proper legal notice had been achieved and no interested parties appeared, (a)
23 made the appropriate findings of fact as required under Section 118-6(f) of the Skokie Village
24 Code and (b) voted to recommend to the Mayor and Board of Trustees that the requested
25 special use permit be granted subject to the conditions contained in the Plan Commission
26 Report dated March 19, 2018; and
27 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on March
28 19, 2018, concurred in the aforesaid recommendations and findings of fact of the Skokie Plan
29 Commission;

1 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
2 Village of Skokie, Cook County, Illinois:
3 Section 1: That the special use permit requested by the petitioner to establish and
4 operate a child day care at the Subject Property, described above and commonly known as
5 5121 Dempster Street, Skokie, Illinois, in a B3 Business district, be and the same is hereby
6 granted and approved subject to each of the conditions set forth below:
7 1. The petitioner must operate and maintain the proposed use in substantial conformance
8 with the final Village approved Site Plan, dated December 20, 2017, and Proposed Floor
9 Plan, dated December 20, 2017;
10 2. Snow shall be removed and hauled off-site before accumulations pile up and block
11 parking spaces;
12 3. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,
13 landscaping, structures, and any other facilities or infrastructure on the Subject Property
14 must be maintained in a good state of repair, and when needed, be repaired or replaced
15 in a timely manner;
16 4. Parking lot and exterior lighting must meet IES standards, be full cut-off design and be
17 directed away from adjacent properties, subject to the approval of the Engineering
18 Division;
19 5. All off-street parking spaces must be legibly striped and maintained;
20 6. All modifications to building elevations, signage, and landscaping shall be subject to the
21 review and approval of the Skokie Appearance Commission;
22 7. All signage must conform to the Skokie Village Code. Any sign on the Subject Property
23 that is in violation of that Code must be removed or modified to conform with the Village
24 Code prior to the issuance of an occupancy permit;
25 8. Vehicles must always be parked between, and not overlap, the striped lines of
26 designated parking spaces and must not block driveways, sidewalks, aisles, or other
27 points of access;
28 9. All private and public sidewalks must be maintained free of snow, ice, sleet, or other
29 objects that may impede travel;
30 10. Prior to the issuance of building permits, the petitioners must submit to the Planning
31 Division of the Community Development Department the name, address, and telephone
32 number of the company and contact person responsible for site maintenance in
33 compliance with the special use permit;
34 11. If work is to be performed on public property or if public property is utilized or impacted
35 during construction and/or development, the owner shall provide, or shall cause the
36 developer and/or contractor to provide, the Village of Skokie with a certificate of
37 insurance naming the Village of Skokie as additionally insured for any and all claims
38 related to any and all work. The owner shall hold, and shall cause the developer and/or
39 contractor to hold, the Village of Skokie harmless and indemnify the Village for any and
40 all claims for property damage or personal injury related to work on or use of public
41 property;
42 12. The petitioners shall comply with all Federal and State statutes, laws, rules and

1 regulations and all Village codes, ordinances, rules, and regulations;
2 13. Failure to abide by any and all terms of this Ordinance shall be cause for the Village to
3 initiate hearings to determine whether the subject Ordinance, as well as any applicable
4 business licenses, should be revised or revoked; and
5 14. The petitioners shall pay all costs related to any hearings conducted as a result of non-
6 compliance with any of the provisions of the enabling ordinance. The costs shall include
7 but not be limited to court reporter fees, attorney fees, and staff time required
8 researching and conducting said hearing.
9 Section 2: That a notice of the approval of this Ordinance incorporating the
10 conditions contained herein shall be executed by the owner of the property in writing and
11 duly recorded with the Cook County Recorder of Deeds Office at the owner’s expense.
12 Section 3: That this Ordinance shall be in full force and effect from and after its
13 passage, approval and recordation as provided by law.

A RESOLUTION FOR THE RENEWAL OF A CLASS 6(b) REAL ESTATE
TAX INCENTIVE FOR THE REAL PROPERTY LOCATED AT 3501
HOWARD STREET, SKOKIE, ILLINOIS, PURSUANT TO COOK
COUNTY REAL PROPERTY CLASSIFICATION ORDINANCE
1 WHEREAS, the Village of Skokie (hereinafter “Village”), a home rule municipality
2 situated in Cook County (hereinafter “County”), State of Illinois, is a duly organized and
3 existing Village created under the provisions of the laws of the State of Illinois, and is now
4 operating under the provisions of the Illinois Municipal Code and the Constitution of the
5 State of Illinois; and
6
7 WHEREAS, the Mayor and Board of Trustees constitute the duly elected qualified
8 and acting officials of the Village; and
9
10 WHEREAS, the Cook County Board of Commissioners has amended the Cook
11 County Real Property Classification Ordinance (hereinafter “County Ordinance”), to provide
12 real estate tax incentives to property owners who build, rehabilitate, enhance and occupy
13 property which is located within Cook County and which is used for industrial purposes; and
14
15 WHEREAS, the Village, consistent with the County Ordinance, as amended, desires
16 and needs to induce industry to locate, expand and remain in the Village as viable
17 businesses by offering financial incentives in the form of property tax relief; and
18
19 WHEREAS, Class 6(b) of the County Ordinance requires that the municipality, in
20 which such real estate proposed for Class 6(b) designation is located, make a determination
21 through the adoption of a resolution that such real estate is appropriate for the incentive and
22 specifically provides for extension of Class 6(b) designation; and
23 WHEREAS, the Mayor and Board of Trustees passed Resolution 06-11-R-951, a
24 copy of which is attached hereto as Exhibit “1”, on November 20, 2006, which made such a
25 determination pertaining to the 8.3 acre site located at 3501 Howard Street in Skokie
26 (hereinafter “Subject Property”). The County subsequently granted 6(b) status to the
27 Subject Property; and
28 WHEREAS, in 2006, Wi-Fi Howard L.L.C., an Illinois limited liability corporation
29 (hereinafter “Applicant”), purchased an abandoned industrial facility on the Subject
30 Property, in the Southeast Industrial Area of Skokie, Illinois. Subsequently, the Applicant
31 has undertaken substantial and quality rehabilitation and renovation of the existing industrial
32 structure to enable the Subject Property to be used primarily for small industrial and
33 “incubator style” purposes; and

1 WHEREAS, a Class 6(b) status granted to a property has the duration of 12 years
2 but the County entertains extensions of the 6(b) where appropriate. The Applicant has
3 petitioned the Village of Skokie for a determination in support of the renewal of the Class
4 6(b) status. The Subject Property has two structures, with a total building area of
5 approximately 192,000 square feet, and it is anticipated that the entire property would be
6 eligible for Class 6(b) tax incentives pursuant to the County Ordinance, as amended; and
7
8 WHEREAS, requests for a renewal of a Class (b) status are viewed on a case by
9 case basis and the Applicant has provided sufficient documentation to the Corporation
10 Counsel and Economic Development staff of the Village detailing the operation of the
11 Subject Property and the continuing economic and commercial incubation of critical
12 businesses which require lower rents for new and developing businesses. Numerous
13 businesses have been launched at the Subject Property and grown to prominence at other
14 locations in the Village; and
15
16 WHEREAS, the Subject Property has and will continue to be utilized for industrial
17 and “incubator style” purposes in compliance with the Skokie Village Code; and
18 WHEREAS, Corporation Counsel has reported his findings in his memorandum
19 dated April 16, 2018, and he has recommended that the Village support the 6(b) renewal
20 application in this particular case; and
21
22 WHEREAS, the grant of the renewal of the Class 6(b) tax incentives for the Subject
23 Property is necessary for the continued successful operation of this unique business model
24 at the Subject Property; and
25
26 WHEREAS, the continued operation at the Subject Property has and will continue to
27 provide significant employment opportunities; and
28
29 WHEREAS, the Applicant has indicated to the Mayor and Board of Trustees that the
30 continued incentive provided for in said County Ordinance is necessary for the continued
31 operation and re-utilization of the Subject Property and the Applicant has submitted
32 extensive financial documentation; and
33
34 WHEREAS, the permanent Real Estate Tax Index Numbers for the Subject Property
35 are as follows:
36 10-26-400-016-0000, 10-26-400-021-0000,
37 10-26-400-029-0000, 10-26-400-031-0000;
38 NOW THEREFORE, BE IT RESOLVED by the Mayor and the Board of Trustees of
39 the Village of Skokie, County of Cook, State of Illinois:
40 Section 1: The above stated Recitals are hereby restated and incorporated
41 herein as if fully set forth.

43 Section 2: The Subject Property is appropriate for the renewal and extension of
44 Class 6(b) tax incentive benefits pursuant to the County Ordinance, as amended.

1 Section 3: The Mayor and Board of Trustees hereby find that the incentives
2 provided by the Class 6(b) real property assessment classification are applicable to the
3 entire value of the Subject Property and necessary for the continued development and
4 operation of the Subject Property to occur.

6 Section 4: Pursuant to the County Ordinance, as amended, the Village of Skokie
7 hereby approves, consents and supports the renewal of the Class 6(b) status for the
8 classification of the entire value of the Subject Property, and the Class 6(b) tax incentives
9 shall apply to the entire value of the Subject Property identified as Permanent Index
10 Numbers:
11 10-26-400-016-0000, 10-26-400-021-0000,
12 10-26-400-029-0000, 10-26-400-031-0000.
13 Section 5: The Clerk of the Village of Skokie is authorized to and shall send a
14 certified copy of this Resolution to the Office of the Cook County Assessor, Room 312,
15 County Building, Chicago, Illinois 60602.

17 Section 6: This resolution shall be effective immediately upon its passage and
18 approval, or as otherwise provided by law.
