MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8
p.m. on Monday October 7, 2019
Pledge of Allegiance led by Cub Scout Pack #85 from Middleton School.
The Mayor called the meeting to order.

AN ORDINANCE AMENDING CHAPTER 46, ARTICLE III, OF THE
SKOKIE VILLAGE CODE BY ADDING SECTION 46-82 PERTAINING
TO CANNABIS FEES
1 WHEREAS, Chapter 46, Article III, of the Skokie Village Code provides for fees for
2 businesses and occupations; and
3 WHEREAS, the State of Illinois adopted the Cannabis Regulation and Tax Act
4 (hereinafter “Act”) on June 4, 2019. The Act allows for adults over the age of 21 to legally
5 possess 30 grams of marijuana and five grams of marijuana concentrate for personal use
6 beginning January 1, 2020; and
7 WHEREAS, the Mayor and Board of Trustees adopted Village Ordinances 19-9-C-
8 4486, 19-9-C-4487 and 19-9-C-4488 on September 16, 2019, pertaining to cannabis retail
9 sales licensing, Municipal Cannabis Retailers’ Occupation Tax and cannabis zoning
10 classification and regulations; and
11 WHEREAS, in order to sell at retail cannabis products in the Village, an establishment
12 must obtain an annual cannabis retail sales license issued by the Cannabis Commissioner,
13 pursuant to Chapter 11, Article I, of the Skokie Village Code; and
14 WHEREAS, there shall be an initial fee of $20,000.00 for the initial license and
15 $5,000.00 for each subsequent yearly renewal; and
16 WHEREAS, the Village Manager and Corporation Counsel recommended to the
17 Mayor and Board of Trustees that Chapter 46, Article III, Section 46-82 be added to the
18 Village Code; and
19 WHEREAS, the Mayor and Board of Trustees at a public meeting duly held on
20 October 7, 2019, concurred in the aforesaid recommendation of the Village Manager and
21 Corporation Counsel; and
22 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the
23 Village of Skokie, Cook County, Illinois;
24 Section 1: That Chapter 46, Article III, of the Skokie Village Code be and the same
25 is hereby amended by adding Section 46-82 in the manner hereinafter indicated. The new
26 material is highlighted in bold.

22 WHEREAS, the owner desires to rezone the Subject Property in order to make the
23 zoning uniform with the surrounding areas and suitable for more office use; and
24 WHEREAS, as antenna structures are not a permitted use in the B3 Business
25 district, the antenna at 8820 LeClaire Avenue would become a legal nonconforming use;
26 and
27 WHEREAS, the Community Development Department staff is supportive of the
28 zoning changes, which would allow a greater variety of office uses that would be
29 appropriate for the site; and
30 WHEREAS, the Skokie Plan Commission, after public hearing duly held on August
31 15, 2019, at which no interested parties testified, (i) determined that proper notice had been

7 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the

1 WHEREAS, the “Areesha Properties LLC Resubdivision” plat includes the following
2 dedications of property:
3 (1) A triangular shaped parcel of property measuring 142.43 feet x 143.47 feet x
4 3.46 feet adjacent to Gross Point Road is being dedicated to the Illinois
5 Department of Transportation in order to place a portion of the exiting public
6 sidewalk within the right of way;
7 (2) A triangular shaped parcel of land measuring 43.91 feet x 26.75 feet x 19.92 feet
8 adjacent to the north side of the east-west alley being dedicated to the Village of
9 Skokie, which is currently being utilized as a public alley;
10 (3) A triangular shaped portion of property measuring 57.90 feet x 5.45 feet x 61.54
11 feet that is currently being utilized as a public sidewalk adjacent to the southwest
12 corner of Enfield Avenue and LeClaire Avenue; and
13 WHEREAS, the Skokie Plan Commission, after a public hearing duly held August
14 15, 2019, made the appropriate findings of fact, as required under Section 118-6 of the
15 Skokie Village Code, and recommended to the Mayor and Board of Trustees that the
16 requested subdivision be granted subject to certain conditions; and
17 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on
18 September 3, 2019, concurred in the aforesaid recommendation of the Skokie Plan

PLAN COMMISSION ANALYSIS
At its September 5, 2019, meeting, the Plan Commission heard the request of Shure
Incorporated to reconfigure 2 existing lots into 2 new lots through the resubdivision of
the property at 5500 Howard Street in an M1 Office Assembly Industry zoning district.
Lot 1 will contain the existing office building and parking lot. Lot 2 will contain an
undeveloped parcel that is being reserved for long-term future potential redevelopment.
The Plan Commission concurred with Staff’s recommendation to grant the subdivision
approval subject to conditions.

1. Upon the passage of the ordinance by the Board of Trustees, the Mylar of the
Shure Resubdivision must be submitted to the Village with all signatures other
than Village staff or elected officials.
2. The Shure Resubdivision shall be effective upon its recording by the Village in
the Office of the Recorder of Deeds of Cook County, Illinois.
3. All monuments must be set no later than 1 year after the date of the recording
of the plat.
4. If work is to be performed on public property or if public property is utilized or
impacted during construction and or development, the owners must provide, or
must cause the developer and/or contractor to provide, the Village of Skokie with
a certificate of insurance naming the Village of Skokie as additionally insured for
any and all claims related to any and all work. The owners shall hold, and shall
cause the developer and/or contractor to hold, the Village of Skokie harmless
and indemnify the Village for any and all claims for property damage or personal
injury related to work on or use of public property.

PETITIONER’S SUBMITTAL
The petitioner is requesting to reconfigure 2 existing lots into 2 new lots through the
resubdivision of the property at 5500 Howard Street in an M1 Office Assembly Industry
zoning district. Lot 1 will contain the existing office building and parking lot. Lot 2 will
contain an undeveloped parcel that is being reserved for long-term future potential
redevelopment.
STAFF ANALYSIS
Comments
All pertinent departments and divisions were offered an opportunity to comment on this
case. Other than the Planning Division comments below, all others did not respond or
approved the request without comment.
Planning Division
The Planning Division supports the proposed subdivision. The existing property lines
were drawn to accommodate a redevelopment that never occurred (cases 2001-19P
and 2001-20P). Although the 2 parcels comprising the existing property are all
located within one common subdivision, the resubdivision is necessary in order to
place the parking within the same lot as the office building. The subdivision is
required to be heard by the Plan Commission because the subject site is 4 acres or
greater in size. No dedications for right-of-way are required for this subdivision.
STAFF RECOMMENDATIONS
Staff recommends that the petitioner’s request to reconfigure 2 existing lots into 2 new
lots at 5500 Howard Street in an M1 Office Assembly Industry zoning district be

A motion was made by Commissioner Laxpati to approve the minutes of the August 15,
2019 Plan Commission meeting and seconded by Commissioner J. Burman. All voted
aye in unison.

Shure Incorporated requests a subdivision to reconfigure 2 existing lots into 2 new lots
in an M1 Office Assembly Industry zoning district, and any relief that may be discovered
during the review of this case.

Discussion and Interested Parties
Legal notice was advertised, posted, and delivered to property owners in the area as
prescribed by the Zoning Chapter. Corporation Counsel determined that notice was
proper and correct.
Mr. J. Kelly Bufton of Seyfarth Shaw LLP, on behalf of the petitioner, presented the
case. Mr. Paul Applebaum of Shure Incorporated was present but did not speak. As a
brief summary, Mr. Bufton stated that they purchased the property and would like to
slightly reconfigure the existing 2 lots which were previously subdivided by The Alter
Group in 2001. They would like to have the building and parking lot as Lot 1 and keep
Lot 2 for future plans of expansion.
Staff requested that the report be entered into the record as presented. The site spans
4 acres which triggered the need for the Plan Commission recommendation and will be
heard by the Village Board at a future meeting for final approval. Staff is supportive of
the request.
Recommendations and Voting
A motion to approve the request as presented was made for a resubdivision to
reconfigure 2 existing lots into 2 new lots at 5500 Howard Street in an M1 Office
Assembly Industry zoning district.
