13332 MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8 p.m. on Monday January 6, 2020 Pledge of Allegiance led by Village Clerk Pramod Shah. The Mayor called the meeting to order. The Clerk called the Roll. Those present were Roberts, Sutker, Ulrich, Bromberg, Klein, Gray- Keeler and Mayor Van Dusen. Motion to approve the Consent Agenda. Mayor Van Dusen noted that Gramins was named Illinois State Officer of the year and one of 10 law enforcement officers selected by NAPO to visit the White house for his Heroism in the 2008 Bank Robbery. Commander Gramins introduced his family and friends. He thanked the Village for wisdom and leadership. B. Plan Commission Case 2019-43P – Zoning Chapter Amendment: Art Dealers, Supplies, Sales, and Service in M1 Office Assembly Industry zoning districts. Motion to concur with the Plan Commission that the petitioner’s request to amend Appendix of Chapter 118 Zoning of the Skokie Village Code be amended to add art dealers, supplies, sales and service as permitted use in the M1 Office Assembly Industry be approved subject to all conditions. MOTION CARRIED 13333 Meeting of the Mayor and Board of Trustees Monday January 6, 2019 Page Two 2020-2021 Community Development Block Grant Public Hearing #2. A. FY21 Public Hearing: Proposal Presentations Carrie J. Haberstich, Planner/CDBG Administrator presented the Public Hearing. The Village's entitlement grant for FY21 is not yet known. At this time, we are estimating $600,000 in entitlement funds based on expectations that CDBG funding will be less than the current year’s entitlement amount. In addition to the new entitlement, we plan to reprogram roughly $50,000 in previously unallocated funds and $0 in program income from the current program year, while accommodating a reserve of unobligated funds that could be used for emergency expenses, resulting in an estimated FY21 budget of $650,000. Proposals from both Village staff and outside agencies total $952,789, so reductions will be necessary. The program’s 20% cap for administrative funding is applied against the new entitlement only, while the 15% cap for public service funding (non-capital/non-construction expenditures) is applied against the new entitlement plus any program income from the current program year. Budget recommendations by staff will be presented at the next public hearing on Monday, February 3. The Board will determine at that time the proposed funding award for each project or activity. Mayor Van Dusen stated that Trustee Sutker recused herself from participating in the discussion and voting on the grant as she is a Licensed Social Worker employed by a social service agency that is an applicant for a CDBG grant. Trustee Roberts also recused himself from participation because he is on the Board of one of the applicants for a CDBG grant. Adjournment. 562v1 PLAN COMMISSION REPORT 2019-43P: Zoning Chapter Amendment Plan Commission Council Chambers, 8:00 PM January 6, 2020 To: Mayor and Board of Trustees From: Paul Luke, Chairman Re: 2019-43P: Zoning Chapter Amendment Art Dealers, Supplies, Sales, and Service in M1 Office Assembly Industry zoning districts PLAN COMMISSION ANALYSIS At its December 5, 2019, meeting, the Plan Commission heard the request of Jeff Liebert of ART of North & Central Chicagoland at 7821 Gross Point Road to amend Appendix A of the Zoning chapter of the Village Code to make art dealers, supplies, sales, and service a permitted use in the M1 Office Assembly Industry zoning district, and any other necessary changes to the Zoning chapter related to this use. The use meets the intent of the zoning district. It is currently a permitted use in the NX, TX, CX, B1, B2, B3, and B4 districts, and nowhere is it a special use. Many of the businesses falling under this use tend to be geared toward retail sales of art and art supplies and require street presence within a business-zoned district. However, the service side of the use, which involves the repair and restoration of works of art, can be performed by businesses located within an M1-zoned building, where space is available for specialized equipment and customer traffic is lower. Limited retail uses, such as sales of art and art supplies within the industrial zoning districts are allowed with a special use permit, provided that the retail use not exceed the lesser of 5,000 s.f. or 10% of the total gross floor area. Other types of retail sales that are usually associated with large amounts of storage area (such as cars, furniture, and appliances) are also allowed in the M1 zoning district. The Plan Commission concurred with Staff’s recommendation to grant the subdivision approval subject to conditions. Discussion from the Commissioners about this case focused on how the petitioner was operating the business, parking requirements for the use, and whether the petitioner’s business was regulated by the EPA. A more detailed discussion of this case is in the attached Staff Report and minutes. INTERESTED PARTIES Legal notice was properly posted, advertised, and delivered to all property owners in the area of the subject site as prescribed by the Zoning Chapter. No interested parties spoke regarding the case. Discussion and Interested Parties According to Corporation Counsel, notice was proper in the newspaper. Staff requested that the staff report be accepted. Chairman Paul Luke granted the request. Jeff Libert is the petitioner. He applied for a zoning amendment after learning that his business was not permitted in the M1 zoning district. Libert described the business primarily as an art restoration service. The petitioner mentioned that part of the service involves retrieving artwork from homes and bringing it to the warehouse for restoration. Commissioner Scott Berman asked if the use described by the petitioner is currently performed at the site. Berman also asked how long the petitioner has been at the site. The petitioner affirmed that the described use is currently performed at the site. He added that he has been at the site since June. Commissioner Scott Berman asked a follow up question regarding where the business was operating prior to June. The petitioner stated that the business is new to the area and that he is a franchisee. Chairman Paul Luke asked the petitioner if he was providing a service. The petitioner affirmed that he would be providing a service. Chairman Luke asked a follow up question regarding whether the site would be used for retail, sales, or art auctioning. 562617 The petitioner replied that it would not be useful for any of these purposes, and that a customer might occasionally walk in to place an order, but no retail sales would be occurring. Commissioner Mathee asked a question regarding the business use. He asked whether the business is a restoration service for damaged art. He also asked whether art supplies would be sold as part of the business use. The petitioner affirmed that the business use is for art restoration and that art supplies would not be sold. Chairman Luke asked Staff if the warehouse was a storage facility. Staff replied that it is not. Chairman Luke asked a follow up question regarding whether other service based businesses are permitted within the M1 zoning district. Staff added that certain services such as Service Master exist within the zone, but that the petitioner’s business involves transport of art. Staff also mentioned that the location was determined to be appropriate for the proposed use because the operations require a space that is sufficient in size for art storage and machinery and equipment required for the restoration process. Chairman Luke asked Staff to clarify the permitted uses of the M1 zoning district. Staff added an example that car dealerships, furniture sales, and appliances sales are among the business uses permitted in the M1 zoning district; however, special use permits are required for sales in the district along with a limitation in square footage. Commissioner Quane asked Staff how the use in case 2019-43P was discovered. Staff replied that that the business applied for an occupancy permit and the Building Division noted that the business was not an approved use of the M1 zoning district. The business was already in the process of opening, and Village staff allowed the business to operate, provided that it applied for the zoning chapter amendment. Commissioner Berman asked about vehicle movement and truck parking with respect to the proposed use. Staff explained that a parking requirement already exists for the category. Staff affirmed that the location is already equipped with loading docks and added that the Edens Expressways is located on one side of the location and Niles West High School is located on the other side; therefore, there are no anticipated disruptions to residential areas as a result of the proposed use. Chairman Luke asked a question regarding EPA regulations with respect to the cleaning methods of the business. Staff responded that the question posed should be redirected to the petitioner. The petitioner affirmed that there are no EPA requirements with respect to his business activities. Libert added that hazardous chemicals will not be used for the 562617 cleaning methods. He mentioned that spray paint usage would be a part of business operations. Recommendation and Voting A motion was made to approve the Zoning Chapter Amendment as presented. The motion was seconded. Although a portion of the budgeted funds allocated for FY20 have been spent, administration funds may only be used during the specified program year; therefore, this line item is a placeholder to ensure the final payment for the AFH can be funded with CDBG administration funds. Housing VOS - Home The Building, Zoning & Property Standards Division is seeking funding to continue the Village's program of 50,000 70,000 Improvement Program repairing single-family homes, which began in 1983. The request will enable low/moderate-income households (less than 80% of area median family income) to be eligible to receive grants up to $12,000 to pay for building materials or contractors' services. The grant for the moderate-income households (50-80% of median family income) will continue its trial period. In addition, if a home owner received CDBG funding in the past, fulfilled its contractual obligations with the Village, and has remained in the home for an additional 15 years, he/she could be eligible for a new round of funding as long as the household remains eligible for the Home Improvement Program. HODC - Housing The HODC is seeking funding to purchase and install security cameras in an 11-unit building on Conrad Street. - 16,842 Opportunity The purpose of the security cameras, to be located in common areas, is to proactively ensure the safety and Development security of the tenants living in the building, enable HODC to monitor the building, and promote a culture of Corporation care for the building by the tenants. HODC to provide an estimated $5,614 in matching funds from other sources, and/or a reduction in the work scope. WINGS to provide a minimum $3,750 in matching funds from other sources, and/or a reduction in the work scope. VOS - Affordable The Manager's Office and Community Development Department are seeking funding to further affordable 105,328 150,000 Housing Initiative housing in Skokie. The expectation is that these funds will be used to facilitate the creation of housing units that are affordable low/moderate-income households. Disbursement activities may include, but not be limited to, property acquisition. Infrastructure VOS - Street and The Engineering Division is seeking funding to resurface Niles Avenue (between Oakton Street and Lincoln 200,000 220,000 Alley Resurfacing Avenue) and Hull Street (between Niles and Terminal Avenues). Both street segments are located in Census Tract 8077, Block Group #1 (8077-1), which is an eligible low/moderate-income residential area. According to 2011-2015 American Community Survey (ACS) data, 67.72% of the population in 8077-1 is comprised of low/moderate-income residents. Street and alley resurfacing is a high priority of the Village’s Capital Improvement Program (CIP) budget. VOS - Sidewalk The Engineering Division is seeking funding to provide grants to homeowners meeting low/moderate-income 3,000 3,000 Replacement eligibility who are required to participate in the Village’s 50/50 sidewalk replacement program. Low/moderate- Program income property owners are able to apply, on an individual basis, for CDBG funds to cover their 50% share. A simple application form is used and proof of income status is based on our Home Improvement Program guidelines (i.e. most recent federal tax return or proof of current earnings and signed affidavit). The focus area will be Golf Road to the north, Church Street to the south, and the east/west Village limits. Households in other areas of Skokie may participate upon request.
