13336 MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8 p.m. on Tuesday January 21, 2020 Pledge of Allegiance led by Village Clerk Pramod Shah. The Mayor called the meeting to order. The Clerk called the Roll. Those present were Roberts, Sutker, Ulrich, Bromberg, Klein, and Mayor Van Dusen. Trustee Gray-Keeler was not present. Voice of the People Award Presentation for “Transformation in Safety” from the National Research Center, Boulder, Colorado by Ann Tennes, Director of Marketing and Communications. The Village of Skokie recently received a Voice of the People Award (VOP) for Transformation in Safety from the International City/County Management Association and the National Research Center (NRC) in Boulder, Colorado, based on Skokie Residents’ responses to the Village’s 2018 National Citizen Survey. The VOP awards are given annually to communities conducting the citizen survey with the highest or most improved ratings as voiced by their own residents. Report of the Village Manager. A. Resolution to Endorse the Early Childhood Alliance (ECA). Beth Lindley, Director of Human Services presented an overview of the Alliance.. The formation of the Early Childhood Alliance (ECA) began in early 2016 motivated by the realization that children’s early learning and care were occurring in “silos” in the Skokie community, despite the efforts of multiple educational settings. Resolution 20-1-R-1455 Motion to approve a Resolution endorsing the Early Childhood Alliance. Ordinance 20-1-Z -4504 Motion to adopt an ordinance vacating various unopened and unimproved residential alleys within an area bounded by Golf Road, Hamlin Avenue, vacated Emerson Street and Avers Avenue, in an R1 Single-Family district (2019-42P). Adjournment. 563581v1 A MML: 12/21/2020 Manager’s Report THIS RESOLUTION MAY BE CITED AS VILLAGE RESOLUTION NUMBER 20-1-R- A RESOLUTION ENDORSING THE EARLY CHILDHOOD ALLIANCE AND AUTHORIZING THE VILLAGE OF SKOKIE TO BECOME A FOUNDING MEMBER 1 WHEREAS, the Village of Skokie, Skokie area school districts and its many 2 community and government organizations serving young children and families are 3 committed to the success and school readiness of all children, from birth to age five; and 4 WHEREAS, many young children in Skokie currently do not have access to the early 5 learning experience they need to prepare for success in school and later life; and 6 WHEREAS, representatives from local school districts, the Skokie Public Library, the 7 Skokie Park District, Skokie Health and Human Services Departments, community 8 agencies, local child care centers and family child care providers have identified the 9 development of a collaborative initiative as a key strategy for ensuring that young children 10 and families of the Village of Skokie have access to high quality early learning opportunities; 11 and 12 WHEREAS, in 2019, the Erikson Institute brought the Early Development Instrument 13 (EDI) to Skokie. Data acquired from this process will assist our community in identifying 14 community strengths and gaps, for the equitable distribution and alignment of resources 15 and improved coordination of services across systems; and 16 17 WHEREAS, a sub-committee of the EDI pilot team coached by the Partner Plan Act 18 Collaboration Institute has developed a governance structure and charter for the Early 19 Childhood Alliance; and 20 21 WHEREAS, thirty-one area organizations including local school districts, the Skokie 22 Public Library, Skokie Park District, community agencies, local child care centers and family 23 child care providers have endorsed the Early Childhood Alliance to support the enrollment 24 of young children in early learning programs; and 25 26 WHEREAS, children who are supported from early life grow to be contributing 27 members of society who go on to higher educational opportunities and better income 28 opportunities. Shining a spotlight on early childhood has the potential to impact the long- 29 term outcomes of our community across the lifespan for generations to come; and 30 31 WHEREAS, the Village of Skokie has been asked to sign the Charter and become 32 one of the founding members of the organization. and 33 WHEREAS, the proposed site plan significantly increases the amount of onsite parking 34 and accommodates bus pick-up and drop-off. Additionally, new bike parking facilities, 35 landscaping and stormwater detention is contemplated; and 36 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on November 37 21, 2019: (i) determined that proper legal notice had been achieved, (ii) made the appropriate 38 findings of fact in the affirmative, as required under Section 118-6(g) of the Skokie Village 39 Code, and (iii) voted to recommend to the Mayor and Board of Trustees that (a) the requested 40 site plan approval be granted subject to the conditions contained in the Plan Commission 41 Report dated December 16, 2019; and 42 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on 43 December 16, 2019, voted to concur in the aforesaid recommendations and findings of fact of 44 the Skokie Plan Commission; 45 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the 46 Village of Skokie, Cook County, Illinois: Page 2 of 12 VOSDOCS-#563536-v1-Ordinance__2019- 41P__Site_Plan_Approval__New_Lincoln_Jr__High_School_Building__7839_Lincoln_Ave_ 1 Section 1: That the site plan approval requested by the petitioner to construct a 2 new junior high building and other site improvements at the property legally described above 3 and commonly known as 7839 Lincoln Avenue, Skokie, Illinois, in TX Transit Mixed-Use district 4 is hereby granted and approved subject to each of the conditions set forth below: 5 1. The petitioner shall develop the Subject Property in substantial conformance 6 with the final Village approved site plans dated December 5, 2019, landscape 7 plans dated December 3, 2019, sign plans dated November 13, 2019, and 8 building elevations dated October 17, 2019; 9 2. A 15’ easement will be granted to the Village of Skokie to accommodate the 10 existing water main on the property; 11 3. Prior to the start of construction, the petitioner shall submit for approval a 12 lighting photometrics plan, fully developed civil engineering plans that comply 13 with the county WMO requirements and Village’s stormwater control 14 provisions, and redevelopment engineering plans to address all aspects of 15 private and public utility services. Any reconfigurations within state ROW will 16 require an IDOT highway/utility permit; 17 4. New parking lot and exterior lighting shall meet Illuminating Engineering 18 Society of North America (IES) standards, be full cut-off design, and be 19 directed away from adjacent properties, subject to the approval of the 20 Engineering Division; 21 5. Any outdoor sound systems shall at all times maintain audio levels that are 22 compliant with the Skokie Village Code; 23 6. All existing damaged public sidewalks or public sidewalks damaged due to the 24 implementation of this plan shall be replaced. (Standard) 25 7. No objects are allowed within a 15' sight distance triangle between 30" and 26 84" in height from grade except traffic control devices listed in the Manual on 27 Uniform Traffic Control Devices; 28 8. Prior to the start of construction, the petitioner shall submit a temporary 29 pedestrian, bicycle, and transit circulation plan, including routing, signage, and 30 barriers, to be in place prior to the commencement of construction, subject to 31 the approval of the Engineering Division; 32 9. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, 33 signage, landscaping, structures, and any other facilities or infrastructure on 34 the Subject Property shall be maintained in a good state of repair, and when 35 needed, be repaired or replaced in a timely manner; 36 10. All private and public sidewalks shall be maintained free of snow, ice, sleet, or 37 other objects that may impede travel; 38 11. Trash shall only be allowed within a designated trash enclosure and shall be 39 screened from public view in an enclosure approved by the Appearance 40 Commission. All trash shall be contained in such a way as to remain out of 41 sight at all times, except for waste receptacles for the general public; 42 12. Any plan to modify parking lot striping must be approved by the Director of 2 Engineering; 3 14. The handicapped parking spaces shall be installed and maintained in 4 compliance with State of Illinois Accessibility Standards and the Skokie Village 5 Code, including required signage; 6 15. Vehicles shall not be allowed to be parked in or otherwise block common 7 driveways, sidewalks, aisles, or other points of access at any time, shall only 8 be parked in designated parking spaces, and shall not overlap the striped lines 9 of designated parking spaces; 10 16. The owner of the Subject Property shall ensure that employees park on the 11 Subject Property; 12 17. All overhead utilities on the Subject Property shall be placed or relocated 13 underground. The petitioner shall bear the full cost of any utility relocation 14 and/or conflicts; 15 18. The petitioner shall sign an "Agreement for Installation and Maintenance of 16 Landscaping" to assure that the Subject Property and parkway landscaping is 17 completed and maintained, including trimming, watering, and replacing of 18 dead plant materials in a timely manner in accordance with the final approved 19 landscape plan. A copy of said Agreement is attached hereto, marked Exhibit 20 “A” and hereby made part of this Ordinance. This “Agreement for Installation 21 and Maintenance of Landscaping" shall be recorded at the petitioner’s 22 expense; 23 19. All new construction, alterations, and remodeling shall meet current 24 International Building and NFPA Life Safety Codes as amended; 25 20. The petitioner shall obtain all required permits and approvals for 26 improvements to County, State, or Federal rights-of-way from the governing 27 jurisdiction; 28 21. Prior to the start of construction, the petitioner shall submit to the Village of 29 Skokie Community Development Department a Cook County Assessor's 30 Office Petition for Consolidation of Property with associated fees to 31 consolidate property identification numbers 10-28-205-010-0000 and 10-28- 32 206-001-0000 into a single tax parcel or provide evidence that the petition was 33 submitted to Cook County; 34 22. The Subject Property must conform to the Village's storm water control 35 requirements as contained in the Skokie Village Code, including the 36 disconnection of any downspouts; 37 23. All signage shall conform to the Skokie Village Code. Any sign on the Subject 38 Property that is in violation of that Code must be removed or modified to 39 conform with the Village Code prior to the issuance of an occupancy permit; 40 24. All modifications to building elevations, signage, and landscaping shall be 41 subject to the review and approval of the Skokie Appearance Commission; 42 25. Such landscaping is 4 necessary in order for the PROPERTY OWNER to comply with the conditions of the 5 permit issued or granted by the VILLAGE for the PROPERTY OWNER’s requested 6 development or use of the property. 7 7. PROPERTY OWNER shall diligently maintain and care for the landscaping which is 8 installed and required by the permit and this Agreement, using generally accepted 9 methods of cultivation and watering. The PROPERTY OWNER shall maintain a 10 standard of care necessary to prevent the landscaping from deteriorating to the 11 extent that its value as landscaping is destroyed. If Exhibit “1”, attached hereto or 12 permit specifies maintenance standards or procedures, such procedures are hereby 13 adopted as part of this Agreement, and by such adoption, become enforcement 14 conditions of this Agreement. 15 8. Failure to maintain the landscaping as required by this Agreement shall be a 16 nuisance. In the event the PROPERTY OWNER fails to meet the standard of 17 maintenance necessary to keep the landscaping in a healthy condition as required 18 by this Agreement, the VILLAGE shall give written notice of the deficiency to the 19 PROPERTY OWNER who shall have 20 days to make the necessary correction or 20 replacement. If such correction or replacement is not made within the aforesaid 20- 21 day period, the VILLAGE may elect to abate the nuisance and take necessary action 22 to assure that the landscaping is replaced and/or maintained. In the event, the 23 VILLAGE so elects; the VILLAGE shall serve notice of its intent to enter the 24 premises for this purpose. The VILLAGE shall either personally serve the notice 25 upon the PROPERTY OWNER or mail a copy of it by certified mail to the 26 PROPERTY OWNER's last known address, or as shown on the tax rolls, at least 15 27 days in advance of the date when the VILLAGE or its agent intends to enter the 28 premises. 29 9. For this purpose, the VILLAGE or its agent may enter upon the property and perform 30 such work as it considers reasonably necessary and proper to restore, maintain, or 31 replace the landscaping required by this Agreement. The VILLAGE may act either 32 through its own employees or through an independent contractor. 33 10. The VILLAGE shall be entitled to reimbursement for abating the nuisance in 34 restoring, maintaining or replacing the landscaping, provided that the VILLAGE 35 follows the procedures set forth in this Agreement. Costs shall include but shall not 36 be limited to actual costs incurred by the VILLAGE and administrative costs. The 37 VILLAGE shall make demand upon the PROPERTY OWNER for payment. If the 38 PROPERTY OWNER fails to pay the costs within 30 days of the date on which 39 demand is made, the VILLAGE may cause a lien to be placed on the Subject 40 Property. The VILLAGE may record a notice with the Recorder of Deeds for Cook 41 County stating that it has incurred expenses under the terms this Landscape 42 Agreement. The VILLAGE shall be entitled to collect interest at the statutory rate on 43 the amount owed. 44 11. In addition to having a lien placed on the Subject Property, the VILLAGE may 45 institute a legal action to collect the amount owed. The PROPERTY OWNER agrees 46 to pay the VILLAGE a reasonable sum for attorney's fees and court costs. The 5 VILLAGE may require either a cash deposit or a surety bond guaranteeing 6 performance in a form signed by sureties satisfactory to the VILLAGE. The 7 condition of the security shall be that if the PROPERTY OWNER fails to perform any 8 obligation under this Agreement, the VILLAGE may, act on behalf of the 9 PROPERTY OWNER and use the proceeds of the cash bond, or in the case of a 10 surety bond, require the securities to perform the obligations of this Agreement. 11 13. The PROPERTY OWNER hereby agrees to indemnify and hold harmless the 12 VILLAGE, its trustees, officials, employees and agents for any costs, claims, actions 13 or causes of action for personal injury, property damage or otherwise, including 14 reasonable attorney’s fees, which may arise from the VILLAGE exercising any of its 15 rights or obligations and performance under this Agreement. 16 14. Corporation Counsel determined that notice was proper and correct. Mr. Ernie Loggarakis, owner and president of Fix Auto Skokie a/k/a Nick & Ernie’s, Inc. presented the case. He is proposing an expansion of the successful business that his father, Nick, started in 1986 at 8015 Lawndale. In 1990, he purchased the machine shop next door with the thought of expansion one day. They leased the space out to various tenants but an increase in the amount of work has made it necessary to add more space at this time and he now plans to use 8027 Lawndale to expand his own use. Collision, estimating, and body work will be done inside the building. Painting will continue to take place in the spray booths at 8015 Lawndale. Headquarters (consisting of administrative offices, parts and accounting) will be moving from 8015 to 8027 Lawndale. A commissioner wanted confirmation that there would be available space inside for cars in queue. The petitioner responded that there are 5-6 inside spaces and 15 spaces outside in the parking lot. Another commissioner asked if there were any plans to break through and connect the two buildings. Mr. Loggarakis stated that it is better and cleaner to keep the painting separate. Staff requested that the report be accepted into the record as presented. The chairman granted the request. He asked staff why there wasn’t an existing special use permit for the business. Staff replied that it was a grandfathered use. 563073 Staff noted that the northern building (8027) will meet the parking requirement of 21 spaces after the filling in of the loading dock on the west side. Staff has recommended that the guard rail on the east end to be removed for improved and increased circulation. Bicycle parking will be added near the front sidewalk and enhanced landscaping to the front as well as the parking lot. Prior to the case being presented to the Village Board, revised site and elevation plans are needed depicting that the guard rail on the north side will remain. Current drawings show its removal. Another commissioner asked if the number of employees will change. Mr. Loggarakis stated that three more technicians will be added. Recommendations and Voting A motion to approve the request as presented with Condition #1 modified by staff was made for a special use permit for an automotive repair facility at 8027 Lawndale Avenue in an M2 Light Industry zoning district.
