MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8
p.m. on Monday July 20, 2020
Until further notice, meetings of the Skokie Village Board will be held electronically, with a
majority of Village officials participating via remote access in order to comply with the
State of Illinois Stay-At-Home order. Members of the public who wish to comment as to an
item on the published agenda or to comment during public comments must submit their

Report of the Village Manager.
A. COVID-19 Update.
Village Manager announced that Dr. Counard will be leaving the Village August 14th and taking
a position as a Medical Director for the Illinois Department of Public Health.
Dr. Counard stated that it is reassuring that the Village is doing its part in controlling the virus.
There is no increase in cases in Skokie. As of to date, there are 1059 positive, 987 recovered , 35
in isolation, 5 in the hospital and 35 deaths.
The Skokie Community Foundation donated $55,000 to help the Skokie Community. She spoke
about contact tracing and antibody testing in the area. She answered questions from the Trustees.
The Trustees thanked her for her leadership, expertise and service to the community.

A. COVID-19 Update.
A report regarding the most up to date information will be provided by Dr.
Catherine Counard, Director of Health.
B. Intergovernmental Agreement between Oakton Community College and
Village of Skokie to Establish a Community Apiary.
The Village of Skokie and Oakton Community College (OCC) are partnering to
establish a community apiary on the OCC Skokie Campus, to celebrate
beekeeping and provide a communal beekeeping location for Skokie residents
who are not able to, or would prefer not to, use their own property for this
purpose. The proposed site is on the east edge of the OCC parking lot in a
secluded corner with abundant vegetation. Oakton Community College will
oversee construction and be responsible for any future maintenance. The Village
of Skokie will conduct yearly inspections and ensure compliance as well as
investigate any complaints. The OCC will construct the apiary over the next few
months, utilizing grant funds, with the hope that beekeepers will be able to begin
using the facility in the spring.
I concur with staff’s recommendation and respectfully request Mayor and Board
approval of a Resolution authorizing the Village of Skokie to enter into an
Intergovernmental Agreement with Oakton Community College for the purposes
of establishing a Community Apiary.
C. Water Rate Ordinance for FY2021.
For FY2021, a 3% increase is recommended to fund all water related activities for
the coming year. Even with the rate increase, Skokie’s water rate remains the
second lowest among area municipalities. The impact of the recommended rate
adjustment would result in an average residential monthly increase of $1.52.
I concur with staff’s recommendation and respectfully request Mayor and Board
approval. The final ordinance will be brought before the Board at the August 3
meeting for final consideration.

D. Commercial Corridor Storefront Enhancement Program: 3938 Dempster
Street.
Harry and Steve Eikesidekas, co-owners of the longtime Skokie-based and family-
owned restaurant Grecian Kitchen (along with their brother Chris), have applied
for funding under the Commercial Corridor Storefront Enhancement Program
(SEP). The Eikesidekas brothers have owned and operated this iconic eatery
since 1996 and have undertaken various investments within the structure and site
over the past 15 years. To further accommodate their customers during the
COVID State of Illinois Phase 4 guidelines and beyond, the owners are seeking to
invest in their restaurant by improving the outdoor dining experience and by
modifying their interior serving and dining areas.
The majority of the interior and exterior work to be completed includes the
construction of a new outdoor patio and structural roof, decorative stonework
along base of building, new exterior façade including new columns and windows,
exposed ceiling, remove dry vit and replace with new brickwork, new paneling and
floor tile, counter tops, new built-in beverage stations, lighting upgrades and
signage enhancements, among other eligible costs.
The applicant has received several bids for the major components in the interior
and exterior work. The lowest estimate for the work to be done totals
approximately $156,500. Of that amount, $40,000 is deemed eligible for
reimbursement with maximum architectural fees of $3,000. The total SEP grant
will not exceed $43,000, which would be transferred to the owner following the
completion of all the work, final inspections and submittal of all required
documentation.
Mayor and Board approval of a grant in an amount not to exceed $43,000 is
respectfully requested for Grecian Kitchen, located at 3938 Dempster Street.
* E. 2020 Thermoplastic Pavement Marking Maintenance Contract – Superior
Road Striping, Melrose Park, Illinois - $100,000.
The Village purchases thermoplastic pavement marking maintenance on an
annual basis. Pricing for thermoplastic pavement marking services was obtained
through the Northwest Municipal Conference’s joint bid procedure. The
conference bids this contract once every three years and reserves the right to
extend the contract for up to three additional one-year terms upon mutual
agreement on a negotiated basis. The lowest responsive and responsible bidder
was Superior Road Striping. I concur with staff’s recommendation and respectfully
request Mayor and Board approval of a contract in the amount not to exceed
$100,000 to be awarded to Superior Road Striping.
* F. CentralSquare Public Safety Software Maintenance Contract - CentralSquare,
Lake Mary, Florida - $139,044.94.
In FY2012, the Village contracted with SunGard Corporation for the licensing and
use of SunGard OSSI Public Safety System for Computer Aided Dispatch,
Records Management, Mobile Computer Terminal and Mobile Field Reporting
modules. In 2018, the name of the company was changed to CentralSquare. The
software maintenance contract for these public safety modules is up for renewal.
Since all the software is provided and maintained by CentralSquare, the contract

AN ORDINANCE AMENDING CHAPTER 10, ARTICLE I, SECTION 10-3
AND ARTICLE II, SECTION 10-64 OF THE SKOKIE VILLAGE CODE
PERTAINING TO ALCOHOLIC LIQUOR
1 WHEREAS, Chapter 10 of the Skokie Village Code (hereinafter “Code”) provides
2 for rules and regulations pertaining to the sale of alcoholic liquor in the Village of Skokie
3 (hereinafter “Skokie”); and
4 WHEREAS, on July 6, 2015, the Skokie Village Board adopted Ordinance 15-7-C-
5 4152, establishing the Class G liquor license for manufacturers of beer; and
6 WHEREAS, the language as adopted at the time reflected the State definition of a
7 Brew Pub, which was available only to a Microbrewery, and included a limitation on
8 manufacturing of 50,000 gallons per year; and
9 WHEREAS, State of Illinois has changed this requirement by also allowing on-
10 premises sales for Class 1 Brewers, limited to manufacturing 930,000 gallons per year;
11 and
12 WHEREAS, the Skokie Village Code, in order to be consistent with State statute,
13 requires an amendment reflecting the change; and
14 WHEREAS, the Local Liquor Commissioner recommended to the Board of
15 Trustees that Chapter 10, Article I, Section 10-3 and Article II, Section 10-64 of the Skokie
16 Village Code be amended accordingly; and
17 WHEREAS, the Mayor and Board of Trustees at a public meeting duly held on
18 July 20, 2020, concurred in the aforesaid recommendation of the Local Liquor

16 for off-premises consumption more than 50,000 gallons per year.

AN ORDINANCE AMENDING CHAPTER 106, ARTICLE II, SECTION
106-54 AND CHAPTER 46, ARTICLE VII, SECTION 46-222 OF THE
SKOKIE VILLAGE CODE PERTAINING TO OVERWEIGHT AND
OVERSIZE VEHICLES
1 WHEREAS, Chapter 106, Article II, Section 106-54 of the Skokie Village Code provides
2 for permits for oversize and overweight vehicles; and
3 WHEREAS, Chapter 46, Article VII, Section 46-222 of the Skokie Village Code provides
4 for fees for permits for oversize and overweight vehicles; and
5 WHEREAS, the Illinois Vehicle Code pursuant to 625 ILCS 5/15, establishes a maximum
6 size and weight for vehicles to be operated on roadways within the State of Illinois. These size
7 and weight limits are established to maintain the safety and integrity of the roads on which such
8 vehicles are operated in a uniform manner throughout the state. This section also establishes a
9 permitting system, whereby operators of oversize or overweight vehicles may apply for a permit
10 through the Illinois Department of Transportation to allow for the temporary operation of said
11 vehicles on state roadways; and
12 WHEREAS, additionally, state statute authorizes municipalities to establish a permitting
13 system to allow for the operation of oversize and overweight vehicles on local roadways; and
14 WHEREAS, permits are an effective way to offset the significant cost to the Village by
15 such vehicles in damage to Village roadways and general wear-and-tear thereupon; and
16 WHEREAS, the State permitting system requires the vehicles that obtain a permit to
17 secure permission from local municipalities before using local roadways. In practice, municipalities
18 that lack their own permitting system often receive notification of these vehicles when it is too late
19 to allow the municipality to exercise its option to deny them access to the specified route on local
20 roads; and
21 WHEREAS, this lack of communication to municipalities, in addition to the significant costs
22 it imposes through damage to roads, can also present traffic and safety hazards, with overweight
23 and oversize vehicles attempting to use roads that are closed or otherwise unsuitable; and
24 WHEREAS, the provisions for overweight and oversize vehicles as currently provided for
25 in Sections 106-54 and the required fees outlined in 46-222 of the Skokie Village Code were
26 intended for very infrequent permits issued on a one-time basis, and lack the scope necessary for
27 the number and nature of permits that would need to be issued based on current information; and
28 WHEREAS, the proposed language outlays more clarity as to the permit requirements, the
29 information necessary for processing, and updates the fees to reflect the administrative and
30 infrastructural burdens such traffic places on local roadways; and

16 (a) Authorized. When in the Village Manager's judgment an emergency exists, the Village
17 Manager, with respect to streets and highways under the jurisdiction of the Village, may, in the
18 Manager's discretion, upon application in writing and good cause being shown therefor,
19 pursuant to the provisions of 625 ILCS 5/15-301, issue a special permit in writing authorizing
20 the applicant to operate or move a vehicle or combination of vehicles of a size or weight of
21 vehicle or load exceeding the maximum specified in the laws of the State or otherwise not in
22 conformity with the provisions of this article upon any street or highway under the jurisdiction
23 of the Village.
24 (b) Application. The application for any such permit shall specifically describe the vehicle or
25 vehicles and load to be operated or moved and the particular streets or highways for which the
26 permit to operate is requested, and whether such permit is requested for a single trip or for
27 continuous operation.
28 (c) Issuance; conditions. The Village Manager is authorized to issue or withhold such permit at
29 the Manager's discretion. Any permit is issued in accordance with this section may limit the
30 number of trips, establish seasonal or other limitations within which the vehicles described
31 may be operated on the streets or highways indicated, or otherwise to limit or prescribe
32 conditions of operation of such vehicle or vehicles, when necessary to ensure against undue
33 damage to the road foundations, surfaces, or structures. Any permit issued may require
34 security as may be deemed necessary by the Village Manager or designee to compensate for
35 any damage to any roadway or load structure.
36 (d) Permit for single trip. Whenever the application for such a permit is for the transportation of a
37 single article which cannot be divided and which exceeds 24,000 pounds total on any axle or
38 exceeds 60 feet in total length or 102 inches in maximum width, the Village Manager or
39 designee may issue a permit for a single trip for the load to be transported. The person
40 making such application shall have paid to the Village a fee as set forth in Section 46-222 for

1 such permit and shall have furnished a bond to the Village in an amount determined by the
2 Village Manager or designee. Any permit issued in accordance with this subsection shall be
3 conditional so as to save the Village harmless from any claim, loss or damage that may result
4 from the granting of such permit or that may arise from or on account of any work done
5 thereunder, and further conditioned that the permittee shall restore, at the permittee's own
6 cost, to a condition satisfactory to the Village Manager or designee, any pavement, subway,
7 tunnel, sewer, pipe, conduit, or other public utility that may be injured by reason of the
8 transportation of such article under such permit.
9 (e) Permit to be carried in vehicle; compliance with terms of permit. Every permit issued under the
10 provisions of this section shall be carried in the vehicle or combination of vehicles to which it
11 refers and shall be open to inspection by any police officer, and no person shall violate any of
12 the terms or conditions of such special permit.
13 A. Authority.
14 The Village Manager shall have the authority to grant, deny, suspend, reinstate or revoke
15 overweight or oversize permits.
16 B. Permit required.
17 A permit shall be required for the movement of any vehicle or combination of vehicles,
18 which is non-divisible or is carrying a load which is non-divisible, while operating on
19 highways and bridges within the Village while exceeding the maximum size and weight
20 limits described in 625 ILCS 5/15-102 (width), 625 ILCS 5/15-103 (height), 625 ILCS 5/15-107
21 (length) and 625 ILCS 5/15-111 (weight) of the Illinois Vehicle Code.
22 I. Definitions
23 For purposes of this Section, the following definitions shall apply:
24 Single trip permit. One move from the point of origin to the point of destination. Any
25 additional stops between the point of origin and the point of destination are
26 expressly prohibited. Single trip permits are valid for five (5) consecutive days from
27 the date of issuance unless otherwise directed by the Village.
28 Round trip movement. Two trips over the same route in opposite directions. Round
29 trip permits are valid for ten (10) consecutive days from the date of issuance unless
30 otherwise directed by the Village.
31 Non-divisible. A vehicle and load will be considered non-divisible when meeting the
32 definitions found in 625 ILCS 5/1-148.8 of the Illinois Vehicle Code.
33 II. Permit application.
34 Applications for all overweight and oversize permits shall be submitted in the
35 method and form required by the Village Manager or designee, and shall include at
36 a minimum:
37 a. Type of vehicle and identifying vehicle information;

1 b. Weights and dimensions of the vehicle (and load if oversized);
2 c. Description of the load;
3 d. Requested route to be taken by the vehicle;
4 e. Destination of the vehicle within the Village, if applicable;
5 f. Name of the carrier, if different than the applicant;
6 g. Company information.
7 III. Issuance of overweight or oversize permits.
8 Upon receipt of a completed application and proof of payment of the fee, the Village
9 Manager or designee may issue an overweight or oversize permit, subject to the
10 following conditions:
11 a. Permits shall be nontransferable and shall be valid only for the applicant or
12 his agent or employee and the specific vehicle listed on the application.
13 b. Every permit shall be carried in paper or electronic form in the vehicle to
14 which it refers and shall be open to inspection by any Skokie Police Officer.
15 c. In consideration of seasonal or other time limitations, the Village Manager or
16 designee may restrict the timing or number of daily trips authorized by each
17 permit.
18 d. In establishing the routes to be traveled, the Village Manager or designee
19 may establish the route consistent with public safety, taking into
20 consideration existing traffic, the character of the road or roads and the
21 configuration of the terrain.
22 e. No refunds of the permit fee shall be made to the applicant following the
23 issuance of a permit. The Village Manager or designee is authorized to create
24 and amend reasonable provisions for permits on a case by case basis.
25 f. The applicant shall comply with all Federal, State, and local regulations,
26 rules, requirements, statutes, and ordinances.
27 g. The permit, when issued, constitutes an agreement between the permittee
28 and the Village that the move described in the application shall take place
29 only as described. The permittee has the responsibility to report to the
30 Village Manager or designee, any inaccuracies or errors on the part of either
31 the Village or the permittee before starting any move. Undertaking the move
32 is prima facie evidence of acceptance of the permit and its terms as issued.
33 h. The routing prescribed in the permit constitutes the sole extent of the
34 authority granted by the permit for the use of highways within the
35 jurisdiction of the Village, and any vehicles and/or load found to be off route
36 shall be considered operating without a permit.

1 i. Any vehicle(s) and/or load found to be divisible shall render the permit null
2 and void, and the entire gross weight and axle weights of the vehicle(s) with
3 the load shall be subject to legal size and weight limits. It is the duty of the
4 applicant to verify the non-divisibility of the vehicle(s) before applying for the
5 permit. The permit application shall serve as prima facie evidence that the
6 applicant confirmed the vehicle(s) and/or loads to be non-divisible.
7 j. The Village may require the permittee to have bridge and/or highway
8 analysis performed and completed, the proper utilities notified, and/or
9 property moved, in advance of any permit-authorized movement.
10 k. No permits shall be issued to an applicant or company who has outstanding
11 fees or payments due to the Village.
12 IV. Vehicle Escorts
13 Civilian or Police escorts may be required at the discretion of the Village Manager
14 or designee. The total number of Police Officers necessary to provide for a safe
15 move shall be determined by the Village Manager, or designee. Fees for Police
16 escorts shall be in addition to the permit fees set forth herein and included in the
17 billing, invoicing and collection of permit fees. Police escort fees shall provide for a
18 minimum of three (3) hours of service calculated by the most current overtime rate
19 established by the Police Department.
20 (A) Suspension and Reinstatement; Revocation
21 a. Failure to adhere to the requirements of this Section, the conditions for an
22 issued permit, or delinquency in any payments due to the Village may result
23 in the suspension of a permit.
24 b. Suspension of a current permit shall be for a time determined by the Village
25 Manager. If suspension is due to delinquency of payments owed to the
26 Village, reinstatement may be made upon payment of all outstanding
27 settlements or judgments and any other conditions determined by the
28 Village Manager.
29 (B) Revocation
30 c. Altering or falsifying a permit application shall revoke an applicant’s permit
31 privileges for twelve (12) months subsequent to the revocation and cause
32 the permit issued on the altered or falsified application to be considered null
33 and void.
34 V. Hearings.
35 Any applicant or permittee denied an overweight or oversize permit or who has had
36 an overweight or oversize permit suspended shall be, upon request, given a hearing
37 before the Village Manager.

15 west side of the building; and
16 WHEREAS, general maintenance will also be performed at the Subject Property,
17 however, major repairs will be performed elsewhere; and
18 WHEREAS, screening will be installed facing Oakton Street and no busses shall be
19 parked in front of the building; and
20 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on May 21,
21 2020, for which proper legal notice had been achieved and no interested parties appeared, (a)
22 made the appropriate findings of fact as required under Section 118-6(f) of the Skokie Village
23 Code and (b) voted to recommend to the Mayor and Board of Trustees that the requested
24 special use permit be granted subject to the conditions contained in the Plan Commission
25 Report dated June 15, 2020; and
26 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on June
27 15, 2020, concurred in the aforesaid recommendations and findings of fact of the Skokie Plan
28 Commission;

1 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
2 Village of Skokie, Cook County, Illinois:
3 Section 1: That the special use permit requested by the petitioner to allow school
4 and employee bus transportation at the Subject Property, described above and commonly
5 known as 6001 Oakton Street, Skokie, Illinois, in an M2 Light Industry district be and the same
6 is hereby granted and approved subject to each of the conditions set forth below:
7 1. Prior to the issuance of a building permit, the petitioner must submit a scalable
8 striping plan depicting all modifications to the parking lots;
9 2. The petitioner shall develop the Subject Property in substantial conformance
10 with the final Village approved site plan, dated May 4, 2020; striping plan; floor
11 plans, dated May 4, 2020; landscape plan, dated May 4, 2020; and elevations,
12 dated May 4, 2020;
13 3. Two additional parkway trees must be planted midway between the curb and
14 the north edge of the proposed Oakton Street multiuse path, once the path
15 has been constructed. The parkway trees are to be planted at a distance of
16 30 feet from all other parkway trees. The petitioner must contact the Village
17 Forester for a list of approved parkway trees. A $300 permit fee is required for
18 the installation of both trees;
19 4. Storage of buses outside the building, other than the screened area to the
20 west of the building, is prohibited;
21 5. Any new parking lot and exterior lighting shall meet Illuminating Engineering
22 Society of North America (IES) standards, be full cut-off design, and be
23 directed away from adjacent properties, subject to the approval of the
24 Engineering Division;
25 6. All existing damaged public sidewalks or public sidewalks damaged due to the
26 implementation of this plan shall be replaced;
27 7. No objects are allowed within a 10' sight distance triangle in R1, R2, R3, and
28 R4 districts, or within a 15' sight distance triangle in all other districts,
29 between 30" and 84" in height from grade except traffic control devices listed
30 in the Manual on Uniform Traffic Control Devices;
31 8. Prior to the issuance of building permits, the petitioner shall submit a
32 temporary pedestrian and bicycle circulation plan, including routing, signage,
33 and barriers, to be in place prior to the commencement of construction,
34 subject to the approval of the Engineering Division;
35 9. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas,
36 signage, landscaping, structures, and any other facilities or infrastructure on
37 the Subject Property shall be maintained in a good state of repair, and when
38 needed, be repaired or replaced in a timely manner;
39 10. All private and public sidewalks shall be maintained free of snow, ice, sleet, or
40 other objects that may impede travel;
41 11. A screened garbage corral with an impermeable surface shall be provided to
42 contain all dumpsters;
43 12. All off-street parking spaces shall be legibly striped and maintained;

1 13. Any plan to modify parking lot striping must be approved by the Director of
2 Engineering;
3 14. The handicapped parking spaces shall be installed and maintained in
4 compliance with State of Illinois Accessibility Standards and the Skokie Village
5 Code, including required signage;
6 15. Vehicles shall not be allowed to be parked in or otherwise block common
7 driveways, sidewalks, aisles, or other points of access at any time, shall only
8 be parked in designated parking spaces, and shall not overlap the striped lines
9 of designated parking spaces;
10 16. The owner of the Subject Property [and its tenants] shall ensure that
11 employees park on the Subject Property;
12 17. No required parking space on the site may be for the exclusive use of any
13 tenant;
14 18. All new utilities on the Subject Property or in adjacent right-of-way shall be
15 placed or relocated underground. The petitioner shall bear the full cost of any
16 utility relocation and/or conflicts;
17 19. The owner of the Subject Property shall cooperate with any public utility
18 project;
19 20. The petitioner shall sign an "Agreement for Installation and Maintenance of
20 Landscaping" to assure that the Subject Property and parkway landscaping is
21 completed and maintained, including trimming, watering, and replacing of
22 dead plant materials in a timely manner in accordance with the final approved
23 landscape plan. A copy of said Agreement is attached hereto, marked Exhibit
24 “A” and hereby made part of this Ordinance. This “Agreement for Installation
25 and Maintenance of Landscaping" shall be recorded at the petitioner’s
26 expense;
27 21. All new construction, alterations, and remodeling shall meet current
28 International Building and NFPA Life Safety Codes as amended;
29 22. The petitioner shall obtain all required permits and approvals for
30 improvements to County, State, or Federal rights-of-way from the governing
31 jurisdiction;
32 23. The Subject Property must conform to the Village's storm water control
33 requirements as contained in the Skokie Village Code, including the
34 disconnection of any downspouts;
35 24. All signage shall conform to the Skokie Village Code, except as provided in
36 this ordinance. Any legal nonconforming sign on the Subject Property that
37 shall conform with the Village Code when it is damaged >50%, modified, or
38 replaced in the future;
39 25. All modifications to building elevations, signage, and landscaping shall be
40 subject to the review and approval of the Skokie Appearance Commission;
41 26. The petitioner shall submit to the Planning Division electronic files of the plat
42 of survey, site plan, and landscape plan in their approved and finalized form.
43 The files shall be scaled 2-dimensional drawing files on non-compressed, non-

2 27. Prior to the issuance of building permits, the petitioner shall submit to the
3 Planning Division of the Community Development Department the name,
4 property address, email address, and telephone number of the company and
5 contact person responsible for site maintenance in compliance with this site
6 plan approval;
7 28. If work is to be performed on public property or if public property is utilized or
8 impacted during construction and/or development, the owner shall provide, or
9 shall cause the developer and/or contractor to provide, the Village of Skokie
10 with a certificate of insurance naming the Village of Skokie as additionally
11 insured for any and all claims related to any and all work. The owner shall hold
12 and shall cause the developer and/or contractor to hold, the Village of Skokie
13 harmless and indemnify the Village for all claims for property damage or
14 personal injury related to work on or use of public property;
15 29. The petitioner shall comply with all Federal and State statutes, laws, rules and
16 regulations and all Village codes, ordinances, rules, and regulations; and
17 30. Failure to abide by all terms of this Ordinance shall be cause for the Village to
18 initiate hearings to determine whether the subject Ordinance, as well as any
19 applicable business licenses, should be revised or revoked. The petitioner
20 shall pay all costs related to any hearings conducted as a result of non-
21 compliance with any of the provisions of the enabling ordinance. The costs
22 shall include but not be limited to court reporter fees, attorney fees, and staff
23 time required researching and conducting said hearing.
24 Section 2: That a notice of the approval of this Ordinance incorporating the
25 conditions contained herein shall be executed by the owner of the property in writing and
26 duly recorded with the Cook County Recorder of Deeds Office at the owner’s expense.

1 This Agreement is entered into this day of 2020 by and
2 between TRUSTEES OF SCHOOLS, TOWNSHIP 41 NORTH, RANGE 13, EAST OF THE
3 THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS FOR THE BENEFIT OF
4 COMMUNITY HIGH SCHOOL DISTRICT NO. 219 hereinafter referred to as "PROPERTY
5 OWNER", and the VILLAGE OF SKOKIE, an Illinois municipal corporation, hereinafter referred
6 to as "VILLAGE". The parties to this Agreement hereby agree as follows:

17 1. At or near the time of execution of this Agreement, the VILLAGE granted an
18 Occupancy Permit, Business License, Site Plan Approval or Special Use Permit
19 hereinafter collectively referred to as “permit” pursuant to state statutes and local
20 ordinances.
21 2. By the terms of the aforesaid permit, the PROPERTY OWNER is required to install
22 and maintain landscaping in accordance with the plan dated May 4, 2020, or as it
23 may be subsequently revised with the approval of the Village Manager, or designee,
24 and the Corporation Counsel.
25 3. The parties to this Agreement recognize that the installation and maintenance of
26 landscaping is an integral part of the PROPERTY OWNER's plan for development
27 and/or use of the property and is necessary to carry out the purpose and intent of the
28 VILLAGE's land use objectives, and that the permit would not have been approved
29 by the VILLAGE without the assurance that this Agreement would be executed by
30 the PROPERTY OWNER.
31 4. The purpose of this Agreement is to assure:
32 (a) installation of the landscaping in accordance with the landscaping plan
33 approved by the VILLAGE, and
34 (b) continued maintenance and care of the landscaping, including any
35 landscaping indicated in the parkway area.
36 5. The property, which is the subject matter of this Agreement, is legally described
37 above. The portions of the Subject Property which are to be landscaped and
38 maintained pursuant to the terms and conditions of this Agreement are indicated on

1 the Landscape Plan attached hereto, marked Exhibit “1” and are hereby made a part
2 of this Agreement.
3 6. PROPERTY OWNER agrees that the installation and maintenance of the
4 landscaping which is required in accordance with the permit issued by the VILLAGE
5 and this Agreement will materially benefit the Subject Property. Such landscaping is
6 necessary in order for the PROPERTY OWNER to comply with the conditions of the
7 permit issued or granted by the VILLAGE for the PROPERTY OWNER’s requested
8 development or use of the property.
9 7. PROPERTY OWNER shall diligently maintain and care for the landscaping which is
10 installed and required by the permit and this Agreement, using generally accepted
11 methods of cultivation and watering. The PROPERTY OWNER shall maintain a
12 standard of care necessary to prevent the landscaping from deteriorating to the
13 extent that its value as landscaping is destroyed. If Exhibit “1”, attached hereto or
14 permit specifies maintenance standards or procedures, such procedures are hereby
15 adopted as part of this Agreement, and by such adoption, become enforcement
16 conditions of this Agreement.
17 8. Failure to maintain the landscaping as required by this Agreement shall be a
18 nuisance. In the event the PROPERTY OWNER fails to meet the standard of
19 maintenance necessary to keep the landscaping in a healthy condition as required
20 by this Agreement, the VILLAGE shall give written notice of the deficiency to the
21 PROPERTY OWNER who shall have 20 days to make the necessary correction or
22 replacement. If such correction or replacement is not made within the aforesaid 20-
23 day period, the VILLAGE may elect to abate the nuisance and take necessary action
24 to assure that the landscaping is replaced and/or maintained. In the event, the
25 VILLAGE so elects; the VILLAGE shall serve notice of its intent to enter the
26 premises for this purpose. The VILLAGE shall either personally serve the notice
27 upon the PROPERTY OWNER or mail a copy of it by certified mail to the
28 PROPERTY OWNER's last known address, or as shown on the tax rolls, at least 15
29 days in advance of the date when the VILLAGE or its agent intends to enter the
30 premises.
31 9. For this purpose, the VILLAGE or its agent may enter upon the property and perform
32 such work as it considers reasonably necessary and proper to restore, maintain, or
33 replace the landscaping required by this Agreement. The VILLAGE may act either
34 through its own employees or through an independent contractor.
35 10. The VILLAGE shall be entitled to reimbursement for abating the nuisance in
36 restoring, maintaining or replacing the landscaping, provided that the VILLAGE
37 follows the procedures set forth in this Agreement. Costs shall include but shall not
38 be limited to actual costs incurred by the VILLAGE and administrative costs. The
39 VILLAGE shall make demand upon the PROPERTY OWNER for payment. If the
40 PROPERTY OWNER fails to pay the costs within 30 days of the date on which
41 demand is made, the VILLAGE may cause a lien to be placed on the Subject
42 Property. The VILLAGE may record a notice with the Recorder of Deeds for Cook
43 County stating that it has incurred expenses under the terms this Landscape
44 Agreement. The VILLAGE shall be entitled to collect interest at the statutory rate on
45 the amount owed.

1 11. In addition to having a lien placed on the Subject Property, the VILLAGE may
2 institute a legal action to collect the amount owed. The PROPERTY OWNER agrees
3 to pay the VILLAGE a reasonable sum for attorney's fees and court costs.
4 12. If either party upon the execution of this Agreement or during the course of
5 performance considers that it is necessary to have the PROPERTY OWNER post
6 additional security to guarantee the performance of his obligations hereunder, the
7 VILLAGE may require the PROPERTY OWNER to post additional security. The
8 VILLAGE may require either a cash deposit or a surety bond guaranteeing
9 performance in a form signed by sureties satisfactory to the VILLAGE. The
10 condition of the security shall be that if the PROPERTY OWNER fails to perform any
11 obligation under this Agreement, the VILLAGE may, act on behalf of the
12 PROPERTY OWNER and use the proceeds of the cash bond, or in the case of a
13 surety bond, require the securities to perform the obligations of this Agreement.
14 13. The PROPERTY OWNER hereby agrees to indemnify and hold harmless the
15 VILLAGE, its trustees, officials, employees and agents for any costs, claims, actions
16 or causes of action for personal injury, property damage or otherwise, including
17 reasonable attorney’s fees, which may arise from the VILLAGE exercising any of its
18 rights or obligations and performance under this Agreement.
19 14. All notices required or to be given pursuant hereto shall be in writing and either
20 delivered personally or by a nationally recognized "over-night" courier service or
21 mailed by United States certified or registered mail, postage prepaid, addressed to
22 the VILLAGE and the PROPERTY OWNER as follows:

A RESOLUTION APPROVING AND AUTHORIZING AN
INTERGOVERNMENTAL AGREEMENT WITH THE
NILES TOWNSHIP GOVERNMENT BOARD, FOR THE
ESTABLISHMENT OF A COMPOSTING PROGRAM
AT 5255 MAIN STREET, SKOKIE, ILLINOIS
1 WHEREAS, Niles Township Government Board (hereinafter "Township") and the
2 Village of Skokie (hereinafter “Skokie”) may enter into intergovernmental cooperation
3 agreements pursuant to Art. vii, Sec. 10, of the Constitution of the State of Illinois (1970), and
4 the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq. (2010); and
5 WHEREAS, Township, as part of its commitment to the community operates a food
6 pantry. This food pantry serves the residents of the Township, including Skokie, and provides
7 nourishment to those in need; and
8 WHEREAS, Township, through donations to and operation of its food pantry, is
9 continuously in receipt of a very large and inconsistent flow of perishable foods. Much of the
10 leftover food scrap waste can be composted to nourish the soil and conserve water; and
11 WHEREAS, Township therefore has a uniquely significant need for a sustainable way to
12 dispose of excess food supplies that cannot be safely stored or consumed and plans to
13 execute the sustainable elimination of its sizeable food waste through on-premises
14 composting; and
15 WHEREAS, Skokie is deeply committed to sustainability efforts and has encouraged
16 residential composting and other environmental programs and measures to impact our
17 community; and
18 WHEREAS, Skokie recognizes the particular need for this composting program and
19 will monitor its execution; and
20 WHEREAS, the Village Manager recommended to the Mayor and Board of Trustees
21 that the Intergovernmental Agreement with Township for the establishment of a composting
22 program be approved substantially in the form attached hereto and marked as Exhibit “1”,
23 subject to changes approved by the Village Manager or designee and the Corporation Counsel
24 of the Village of Skokie;
25 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the
26 Village of Skokie, Cook County, Illinois that the Agreement with Township for the establishment
27 of a composting program, a copy of which is attached hereto and marked Exhibit “1”, or subject
28 to changes approved by the Corporation Counsel and Village Manager or designee, be and the
29 same is hereby approved.

INTERGOVERNMENTAL AGREEMENT
BETWEEN NILES TOWNSHIP GOVERNMENT BOARD
AND THE VILLAGE OF SKOKIE REGARDING COMPOSTING
1 This Agreement is entered into by and between Niles Township Government Board
2 (hereinafter "Township"), an Illinois municipal corporation, and the Village of Skokie
3 (hereinafter "Skokie"), an Illinois municipal corporation (hereinafter collectively “Parties”)
4 for the purpose of providing for the composting of foods in a limited capacity at the
5 Township offices located at 5255 Main Street, Skokie, Illinois 60077. (hereinafter “Subject
6 Property”).

8 RECITALS
9
10 WHEREAS, Township and Skokie may enter into intergovernmental cooperation
11 agreements pursuant to Art. vii, Sec. 10, of the Constitution of the State of Illinois (1970),
12 and the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq. (2010); and
13
14 WHEREAS, placing organic waste in landfills generates dangerous methane gas
15 which can be significantly reduced by composting organic materials such as wasted
16 food; and
17 WHEREAS, much like landscape waste, food scrap waste can be composted to
18 nourish the soil and conserve water; and
19 WHEREAS, Skokie is deeply committed to sustainability efforts and has
20 encouraged residential composting and other environmental programs and measures to
21 impact our community; and
22 WHEREAS, Township, as part of its commitment to the community operates a food
23 pantry. This food pantry serves the residents of the Township, including Skokie, and
24 provides nourishment to those in need; and
25 WHEREAS, Township, through donations to and operation of its food pantry, is
26 continuously in receipt of a very large and inconsistent flow of perishable foods; and
27 WHEREAS, Township therefore has a uniquely significant need for a sustainable
28 way to dispose of excess food supplies that cannot be safely stored or consumed; and
29 WHEREAS, Township has expressed interest in and demonstrated itself to have the
30 resources and capacity to begin its own composting program and has the staff to protect
31 the composted material throughout each year;
32 NOW, THEREFORE, in consideration of the mutual promises contained herein and
33 for other good and valuable consideration, the parties agree as follows:

35 1. The above stated recitals are material and are restated and incorporated
36 herein as if stated in full.

1 2. Township shall submit a composting plan to Skokie for approval, which shall
2 include the following information. Subsequent to review, Skokie may require
3 more information:

5 a. Materials to be composted;
6 b. Composting bin(s) location(s) on the Subject Property;
7 c. Composting bin specifications including but not limited to: dimensions,
8 construction material and its ability to block animal infiltration and height
9 off the ground.

11 3. Township shall not permit any composting that is inconsistent with the Skokie-
12 approved composting plan in any way.
13
14 4. Township shall only compost materials donated to or purchased for the Niles
15 Township Food Pantry.

17 5. Composting Bin Maintenance:
18
19 a. Township shall maintain composting bins in such a way as to prevent
20 animal and pest infestation and/or noxious odors.
21 b. In the event a composting bin has been damaged or penetrated by
22 rodents or another animal or pest, then Niles shall immediately dismantle
23 or destroy the bin and dispose of any and all material, or cause this to
24 happen.

26 6. In the event of a Skokie Health Department investigation into a rodent or other
27 animal or pest infestation, Township shall grant the Skokie Health Department
28 immediate entry onto the Subject Property in order to examine any composting
29 bin(s) located in the blocks with a known infestation and determine if the
30 composting bin(s) are contributing to the infestation.

32 7. If it is determined that an inspected composting bin is a direct cause of an
33 infestation in the area, then, according to the direction of the Skokie Health
34 Department, Township shall immediately dismantle or destroy the composting
35 bin(s) and dispose of any and all material or make specific changes to the
36 composting bin within a proscribed time. In the event that Township fails to act
37 and make the proscribed changes and dismantle or destroy and remove all
38 composting material, Township shall permit the Skokie Health Department to
39 enter onto the property and dismantle or destroy the damaged bin, dispose of
40 all material and eradicate any infestation found at the site. Any and all
41 expenses incurred shall be paid by Township.

43 8. Township shall provide staff to oversee the execution of the composting plan
44 and its ongoing maintenance at its sole expense.

46 9. Skokie shall have access to monitor the Township’s composting operations
47 and shall ensure compliance with this Agreement and the approved
48 composting plan.

1 10. Each party (hereinafter “Indemnifying Party”) shall indemnify, defend and hold
2 harmless the other party and such other Party’s boards, board members,
3 officers, directors, employees, agents and contractors, successors, and
4 assigns (hereinafter “Indemnified Parties”) from and against any and all
5 liability, claims, losses, costs, judgments, penalties, fines, damages and
6 expenses, including reasonable attorneys’ fees, directly to the extent arising
7 from: (1) the negligent acts or omissions of the Indemnifying Party, its
8 officers, directors, agents, employees or contractors, and to the extent of any
9 alleged violation of or noncompliance with applicable State, Federal or local
10 laws by the Indemnifying Party or its employees, and (2) to the extent of any
11 breach of this Agreement by the Indemnifying Party.

13 11. A termination of this Agreement by Skokie shall constitute the end of Niles
14 Composting Plan, and Niles shall immediately dismantle or destroy the
15 Composting Bin(s) and dispose of any and all material.
16 12. This Agreement and a Skokie-approved Composting Plan submitted by
17 Township represent the entire agreement between the Parties and may only
18 be amended by subsequent written agreement by the Parties.

20 Therefore, the Parties have agreed to the terms and provisions of this
21 Agreement and have evidenced their agreement by causing their duly authorized
22 officers to affix their signatures below.

AN ORDINANCE AMENDING CHAPTER 10 AND CHAPTER 46, OF
THE SKOKIE VILLAGE CODE PERTAINING TO THE SALE OF
ALCOHOLIC LIQUOR AND RELATED FEES
1 WHEREAS, Chapter 10 of the Skokie Village Code (hereinafter “Code”) provides for
2 the retail sale and regulation of alcoholic liquor in the Village of Skokie; and
3 WHEREAS, Chapter 46, Section 46-80 of the Code provides for fees for Skokie Liquor
4 Licenses; and
5 WHEREAS, in accordance with the Illinois Liquor Control Act and the Code, the Mayor
6 is charged with the duties of Local Liquor Control Commissioner and is responsible for the
7 enforcement of the regulation of the retail sale of alcoholic liquor in the Village; and
8 WHEREAS, the Skokie Park District (hereinafter “District”) serves our community as a
9 hub for a wide-ranging array of events, from weddings and other private parties to organized
10 entertainment for every demographic in the Village; and
11 WHEREAS, while 235 ILCS 5/6-15 allows the sale of alcoholic liquor in buildings and
12 golf courses owned by a park district organized under the Illinois Park District Code, currently
13 the Skokie Village Code does not; and
14 WHEREAS, as such, the Liquor Commissioner desires to add another classification of
15 license for the District (Class H), in order to allow for the sale of alcohol on District property,
16 with the limitation that sales of alcohol outside shall be only to private events, not the general
17 public; and
18 WHEREAS, Section 46-80 should also be amended to provide for the nominal fee of
19 $200.00 for an annual license fee for a Class H license; and
20 WHEREAS, the Liquor Commissioner recommended to the Mayor and Board of
21 Trustees that Chapter 10, Article II, Sections 10-63, 10-64 and Chapter 46, Section 46-80 the
22 Skokie Village Code be amended accordingly; and
23 WHEREAS, the Mayor and Board of Trustees at a public meeting duly held on August
24 3, 2020 concurred in the aforesaid recommendation of the Liquor Commissioner;
25 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the
26 Village of Skokie, Cook County, Illinois;
