MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8
p.m. on Tuesday January 19, 2021
Until further notice, meetings of the Skokie Village Board will be held
electronically, with a majority of Village officials participating via remote access
in order to comply with the State of Illinois Gubernatorial Disaster Proclamation.
Members of the public who wish to comment as to an item on the published agenda or to

Mayor Van Dusen read a Proclamation congratulating The Harbour and its staff for their
dedication and commitment for the safety and well-being of our youth. On behalf of the Village
of Skokie and our elected officials, we wish The Harbour much continued success and look
forward to continuing to work with The Harbour.
Terri Szewczyk from the Harbour thanked the Village for the recognition and support.

A. COVID-19 Update.
Mike Charley , Director of Health and Human Service gave an overview of the COVID 19.
COVID-19 Memorial-103 members of the Skokie Community loss lives due to COVID 19.
4,890 total cases, deaths 104, 7 day average cases/day 25.5, 7 day moving average 5.9 which is a
decrease in cases.
He spoke about Restore Illinois, the 5 Phases, Contact Tracing and the Vaccine. Information is
on the Village’s COVID-19 webpage, and a COVID Hotline 847-779-7726
B. Overview of the Downtown Skokie Homewood Suites by Hilton Hotel and Conference
Center.
Len Becker, Economic Development Manager gave an overview and synopsis of the Downtown Skokie
Homewood Suites by Hilton Hotel and Conference Center.

Overview and Synopsis of the
Downtown Skokie Homewood Suites by Hilton Hotel and Conference Center

Community Support for Downtown Skokie Development
For decades, Skokie residents have shown strong support and a desire for redevelopment in Downtown
Skokie, as is evidenced by responses to the Village’s National Citizen Surveys that have been conducted
every three years since 2003, all of which has included questions about resident interest in Downtown
Skokie. Further, at the Village’s community forums in fall 2014 and 2019, to which all Skokie residents
were invited, the topic of revitalizing Downtown Skokie and continued development in Skokie emerged
as a major themes in discussions about residents’ hopes and aspirations for the community.
Recent History of Downtown Skokie Development Progress
For a number of years, Village leadership focused on securing a flagship project for the northwest corner
of Oakton Street and Lincoln Avenue in the heart of Downtown Skokie. As part of the request for
qualifications (RFQ) process that ultimately led to the development of the 8000 North project that is
currently under construction, another firm was identified to possibly develop a hotel in another area of
Downtown Skokie near the Illinois Science + Technology Park (ISTP), Downtown Skokie’s largest
employment base. The ISTP is home to over 20 companies from the United States and across the globe
that employ some 1,600 people on site.
The ISTP was formerly owned by GD Searle, then Pharmacia and then Pfizer, all single companies that
focused on pharmaceutical research and development. Pfizer closed the facility in 2003 and sold it to
Forest City in 2004. The Village partnered with Forest City to transform the complex into the ISTP, a
modern, state-of-the-art, multi-tenant science and technology park. In 2005, a master plan for the ISTP
was approved that contemplated the development of commercial activities, including a future hotel, along
Oakton Street adjacent to the ISTP.
In January 2017, Forest City sold the ISTP to Skokie-based American Landmark Properties (ALP). Since
purchasing the ISTP, ALP has fully leased the park and is planning expansions to accommodate new
employers. The graphic below highlights potential development opportunities at ITSP in orange.

Village Processes and Public Outreach for Hotel Development
The public process to develop a hotel in Downtown Skokie has been extensive. The developer, E&M
Strategic Development (E&M), expressed interest in developing a hotel in Downtown Skokie in 2016. To
validate the project, Village staff initiated and released an RFQ for a hotel market feasibility study for a
Downtown Skokie hotel. The feasibility study was completed in March 2017 and updated in 2018, both
times indicating that there was in fact demand for a Downtown Skokie hotel.
In November 2017, the Economic Development Commission presented an Economic
Development Strategy to the Village Board, and the Strategy included a possible hotel in
Downtown Skokie.

In June 2018, E&M demonstrated the project had a significant financial gap which made the
project difficult, if not impossible to finance. As one of the only economic development tools
available in Illinois for this purpose, Village staff recommended the creation of a Tax Increment
Finance (TIF) district to help bridge the financial “but for” gap for the proposed project,
launching a multi-month public process involving numerous public meetings for consideration of
a TIF to support the hotel.
On June 17, 2019, the Skokie Village Board of Trustees passed a resolution setting Tax
Increment Financing (TIF) Public Hearing and Joint Review Board (JRB) meeting dates and
establishing a TIF interested parties’ registry regarding the proposed new Oakton Niles TIF
District, primarily driven by the project and
developer.
On June 20, 2019, Village staff sent
notice of TIF Public Hearing/JRB
meetings dates by mail to all residential
addresses located within and within 750
feet of the exterior boundaries of the
proposed TIF District and to all current
parties on an interested parties’ registry.
On June 27, 2019, the Village
published a notice in the Skokie Review that
interested parties could register to receive
information on the proposed designation of
the Oakton-Niles TIF District.
Throughout summer 2019, the hotel
and proposed TIF District information was
posted and updated regularly on the Village
website.

As part of the approval process, the proposed Downtown Skokie Homewood
Suites by Hilton Hotel and Conference Center went to the Appearance
Commission on May 8, 2019 and August 14, 2019. The Appearance
Commission packets were made public, including renderings of the proposed
hotel.
On July 3, 2019 SkokieNews and the Village website announced the
proposed hotel and other projects in advance of an upcoming Downtown
Skokie Development Open House.
As part of the TIF approval process, on July 11, 2019, a JRB meeting was held
at Village Hall representing all overlapping taxing districts having property
within the proposed TIF District. The plans for the hotel and TIF were presented
and as a result, the JRB recommended approval of the new Oakton-Niles TIF
District. Given the recommendation from the JRB, on August 1 and 8, 2019 the
Village published TIF Public Hearing notice in the Skokie Review.
The Economic Development Commission discussed the proposed hotel as
part of its published agenda for the Commission’s July 23, 2019 meeting.
Postcards were mailed to approximately 3,500 Skokie residences and
businesses proximate to Downtown Skokie inviting them to a Downtown
Skokie Development Open House held on August 13, 2019.
At the August 13, 2019 Open House, held at Ignite Gaming on Skokie
Boulevard, numerous Downtown projects and developers were
represented, including E&M. Village officials presented and discussed the
proposed TIF District to over 300 residents and business representatives
that attended the event that took place during both daytime and evening
hours.
On August 19, 2019 the Village held a TIF Public Hearing where reports on
proposed Redevelopment Project and Plan, TIF eligibility and JRB
recommendation were presented to the Village Board.
On August 20, 2019, the Chicago Tribune published an article on Downtown
Skokie developments, including the hotel.

The September/October 2019 edition of NewSkokie that was mailed to
27,000 Skokie residences and businesses in late August 2019, also featured
information on the proposed hotel.
At the September 16, 2019 Village Board meeting, Skokie officials adopted
required ordinances amending the existing Downtown TIF District and
establishing the Oakton-Niles TIF District.

Village officials met with downtown Skokie retailers on November 14, 2019
and then again on December 18, 2019 where the hotel project was discussed and
met with enthusiasm.
Village staff and E&M continued to work towards final project approval as the
COVID-19 pandemic took hold in March 2020. To that end, financial markets
became cautious and many commercial projects were put on hold.
In fall 2020, E&M was able to garner financial commitments and interest for the
hotel.
On October 21, 2020, Mayor Van Dusen provided a State of the Village address
to the Skokie Chamber of Commerce that included a hotel update.
At the December 7, 2020 Village Board meeting, the proposed development
agreement between E&M and the Village was unanimously approved.
The second reading and final approval of ordinances pertaining to zoning,
site plan, special use permit and subdivision plat for the Downtown Skokie
Homewood Suites by Hilton Hotel and Conference Center is scheduled for
the Village Board meeting on Tuesday, January 19, 2021.

Economic Benefits for Skokie
The hotel development is replacing a functionally obsolete office building that has been vacant since 2014
and as such will eliminate blight and the continued decrease of commercial property tax values as
evidenced in the TIF report and justification. Without the hotel development, it is probable that the area
will continue to decline in value.
With an estimated 47,000 annual guests staying at the hotel, the development promises to bring
significant economic benefit to the community. These are welcomed and potential customers for
businesses and entertainment venues in Downtown Skokie. By applying conservative tourism industry
formulas, it is estimated that the spending generated by hotel guests will reach $12.5 million annually.
This figure factors in both leisure and business travelers staying at the hotel, as well as expenditures for
hotel room costs, dining in local restaurants, and shopping for non-tourism-related incidentals including
toiletries, clothing, gasoline and other items and services. The economic benefit to local restaurants alone
is expected to reach nearly $2.1 million annually.

One of the major factors in E&M’s decision to join the Hilton
family is their efforts to improving the environment. The new
hotel will be held accountable to the Hilton brand’s established
environmental standards and practices. As a Hilton franchisee,

E&M has agreed to these brand standards and strive to exceed where possible. These standards will be
applied to the entire project, which includes the 143-room hotel, rooftop bar, and event space. See

Design - The building is adopting multiple guidelines as set forth by the Department of Energy
Sustainability Division, Village of Skokie and Hilton brand standards. This includes construction
materials made from recycled content with a high R-value insulation where possible, technology-
based energy climate controls and improved storm water retention that meets the Clean Water Act
and all current environmental standards and Village of Skokie code requirements.
Process - The project will be constructed as a design build process. That means that the entire
construction team, including the architect, contractor, sub-contractors, ownership and operations
team will collaborate to find and implement environmental best practice in every step of the
construction process. Each party will state their sustainability goals and be held accountable as
the project progresses. This will include how to best recycle or repurpose excess building
materials and waste, limit excessive noise and light pollution and make efforts to reduce their
carbon footprint.

Responsible Sourcing - E&M will utilize food ingredients that local sourced whenever possible
and that are responsibly produced that also adhere to Hilton’s Animal Welfare Statement. All
products utilized by the hotel will meet Hilton brand standards and meet the Supplier Due
Diligence requirements for Hilton vendors.
As new environmental sustainability initiatives are developed, E&M has committed to refine and improve
its sustainability program with involvement from all the different team members.
In addition to E&M embracing environmentally sustainable practices, the new parking garage has been
part of the plan for the ISTP since its inception in 2005. The current garage is full as it accommodates the
existing ISTP, which is 100 percent leased. The new parking garage will support future growth at the
ISTP, while also providing parking for hotel guests and those attending functions at the hotel. In addition,
a measure of public parking in the new garage will serve visitors to other stores and restaurants in this
area of Downtown Skokie. Due to the garage’s central location in Downtown Skokie, it is well located to
serve existing and future businesses.
The development is replacing a functionally obsolete office building that has been vacant since 2014. In
addition, good planning encourages density in core area, as dense, multi-story developments are the
highest and best use of available space in Downtown Skokie. By contrast, a development that is spread
out and uses a lot of land is less efficient and is not sustainable. Less dense developments are less
walkable and more auto-oriented. The walkability and the movement of traffic are much less impacted by
new development in Downtown Skokie. As such, this allows cars to move freely without causing
congestion which impacts local air quality.
Affordable Housing
The Village of Skokie has a decades-long tradition of inclusive housing policies that support affordable
housing, with Skokie now achieving 19.9 percent of affordable housing stock which is double the amount
mandated by the State of Illinois. This is the percentage of affordable housing units in relation to the
overall housing supply. The Village of Skokie’s current 19.9 percent of affordable housing units
represents a 5.2 percent increase since 2011 and is one of the top rates of affordability in the suburban
North Shore area.

As it pertains to affordable housing, the new hotel project will not displace any housing units. The Village
supports social service agencies and regional programs that enhance affordable housing opportunities as
well as direct programs to assist income-eligible homeowners in needed repairs. One of Skokie’s primary
objectives, and a strong community value, is to have a diverse and healthy economy which involves
different housing options.
Skokie has distributed over $1.3 million in Home Improvement Skokie has distributed over $1.3

Neighborhood Enhancement Program Strategy
January 19, 2021
Overview
The Village of Skokie supports the improvement and maintenance of existing housing within the
community as a component of its overall affordable housing strategy.
The proposed pilot Neighborhood Enhancement Program is an extension of the Village’s Home
Improvement Program, improving homes occupied by low/moderate-income households. The
primary difference is the focus on improving a group of homes, such as attached townhouses,
multifamily buildings, or neighboring single family homes. The initial outreach will focus on
finding homeowners interested in participating in the program.
The Community Development Block Grant (CDBG) funding may assist with the construction/ rehab
or acquisition of one or more affordable housing units in Skokie, including $105,328 (FY20) and
$75,648 (FY21) in available funds.
Purpose
The purpose of this program is to impact a small group of homes within a neighborhood, making
needed improvements to properties and enabling one collective building rehabilitation project to
impact multiple households and broaden the return on investment of CDBG funds. This will enable
Skokie residents to stay and reinvest in their homes.
Approach
This program emphasizes maintaining the Village’s existing housing stock, which is an important
part of ensuring that Skokie’s affordable housing is maintained and/or expanded as we move forward
in the short-, mid-, and long-term. Staff has considered various options, and an owner-occupied
pilot program is preferred, facilitating improvements to a collection of attached townhouses, a four-
unit (2x2) building, one or more multi-unit building(s), or a group of single family homes in the
same neighborhood. The preliminary strategy:

Summary
In light of this being a pilot project with a focus on Skokie’s existing housing stock, several
alternatives could be considered if funds remain and/or if an urgent need arises:
Alternate #1
Due to the anticipated need for improvements to renter-occupied buildings, including
accessibility improvements to accommodate physically disabled occupants, electrical meter
upgrades, etc., consideration should be given to replicate the Neighborhood Enhancement
Program with a financial match by the landlord.
Alternate #2
Due to the onset of the COVID-19 pandemic, the need for homelessness prevention has
increased due to reduced working hours, layoffs, etc. and the reduced inability to make rent,
mortgage, and/or utility payments. Per the CDBG Cares Act (CDBG-CV and CDBG-CV3)
program, the Village may use PY19 and/or PY20 funds to assist with its COVID-19 response, in
addition to the CDBG-CV and CDBG-CV3 specific funds awarded to Skokie in April and
September 2020, respectively, including increasing funding for housing subsistence payments.
Some of the Affordable Housing Initiative funds could be used for subsistence payments.
Alternate #3
A townhouse neighborhood is in need of improved address visibility, unit identification, and
common area improvements. Multiple households have participated in HUD-based activities in
the past, so there is a possibility that at least 51% of the households in this neighborhood are
low/moderate-income. If the households meet income eligibility requirements, uniform address
and unit numbers, coordinated garbage and recycling infrastructure, sidewalk replacements,
and/or new tree planting activities may occur.

1 WHEREAS, Skokie ISTP, LLC, the owner of the Illinois Science + Technology Park
2 (hereinafter “Petitioner”), requested the vacation of the property commonly known as the
3 east-west alley north of and adjacent to 4930 Oakton Street, Skokie, Illinois, (hereinafter
4 “Subject Property”) by the Village of Skokie; and
5 WHEREAS, the Subject Property measures approximately 16 feet x 369.89 feet and

15 WHEREAS, the remaining 11.45 feet of the Subject Property will be sold to the
16 Illinois Science + Technology Park and redeveloped into a private street (Oakton Terrace)
17 which will serve the Illinois Science + Technology Park and the proposed mixed-use
18 development; and
19 WHEREAS, the Subject Property is depicted on the Plat of Right-of Way Vacation,
20 dated October 3, 2019, a copy of which is attached hereto as Exhibit “A”; and
21 WHEREAS, the Subject Property is located in both the B6 Downtown Science and
22 Technology district and the CX Core Mixed-Use district and is legally described in Exhibit
23 “B” attached hereto; and
24 WHEREAS, the nature and extent of the public use or public interest to be
25 subserved in the Subject Property shall warrant the vacation of the same; and

8 such utility or the drainage conditions in the Subject Property. In the course of repair,
9 replacement or removal, or maintenance of equipment or facilities of a Village-franchised
10 public utility, or drainage conditions in, on or over the Subject Property, the Village or the
11 Village-franchised public utility shall not be held liable by any owner of the Subject Property
12 for any damage to structures, landscaping, or fences in, on or over the Subject Property.
13 Any and all structures, including a fence, built or maintained on the Subject Property are
14 done so at the owner of the Subject Property’s own risk.
15 Section 4: That the aforesaid vacation, incorporating the conditions contained
16 herein, shall be effective upon the recording of a Plat of Right-of-Way Vacation by the
17 Village of Skokie in the Office of the Recorder of Deeds of Cook County.
18 Section 5: That compensation of $285,000 shall be paid by the Petitioner, which

6 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the
7 Village of Skokie, Cook County, Illinois:
8 Section1: That the requested subdivision of the Subject Property, legally
9 described above and commonly known as 4900-4906 and 4930 Oakton Street, Skokie,
10 Illinois, in CX Core Mixed-Use district, be and the same is hereby approved subject to the
11 following conditions:
12 1. Upon the passage of the resolution by the Board of Trustees, the Mylar of the
13 Skokie Hotel Subdivision must be submitted to the Village of Skokie with all
14 signatures other than Village staff or elected officials;
15 2. The Skokie Hotel Subdivision shall be effective upon its recording by the
16 Village of Skokie in the Office of the Recorder of Deeds of Cook County,
17 Illinois;
18 3. All monuments must be set no later than 1 year after the date of the recording
19 of the plat;
20 4. If work is to be performed on public property or if public property is utilized or
21 impacted during construction and or development, the owners must provide,

16 establish a planned development in a CX Core Mixed-Use district that includes a mixed-use
17 building that exceeds the district’s permitted base building height of 45’ and has an FAR
18 above 2.5; and
19 WHEREAS, Petitioner has also requested relief from the following sections of
20 Chapter 118 of the Skokie Village Code:
21 1. §118-184(c)(4) to allow less than 50% of the first floor façade to abut the public
22 sidewalk along a retail street,
23 2. §118-184(c)(5) to allow less than the required 60% of the first floor linear frontage of
24 total lot frontage along the public sidewalk to be devoted to permitted and special
25 uses on retail streets,
26 3. §118-184(c)(9) to allow recessed entrances to be wider than one third of the entire
27 frontage along a retail street, and any other relief that may be discovered during the
28 review of this case; and

1 WHEREAS, the proposed mixed-use building will contain ground-floor retail, a hotel,
2 conference center, and a roof-top skybar at the northeast corner of Oakton Street and Niles
3 Avenue. The building will be 8 stories and 96 feet tall to the top of the roof. There will be
4 11,924 ft2 of retail and hotel common areas on the ground. The second floor will have
5 additional hotel common areas as well as an 11,506 ft2 conference center, and an active
6 6,909 ft2 terrace. The 3rd through 7th floors will contain hotel rooms, and the 8th floor will be
7 additional hotel rooms, a 7,630 ft2 skybar, and a 2,391 ft2 terrace; and
8 WHEREAS, a private road, which will run on the north side of the site and the
9 parking garage that will be built immediately north of the site, are part of the Illinois Science
10 + Technology Park site plan approval that was previously adopted in Village Ordinance
11 Number 07-1-Z-3486; and
12 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on October 3,
13 2019: (i) determined that proper legal notice had been achieved, (ii) made the appropriate
14 findings of fact in the affirmative, as required under Section 118-6(g) of the Skokie Village
15 Code, and (iii) voted to recommend to the Mayor and Board of Trustees that (a) the requested
16 site plan approval be granted subject to the conditions contained in the Plan Commission
17 Report dated October 22, 2019 and (b) that the following relief be granted from the Skokie
18 Village Code:
19 1. §118-184(c)(4) to allow less than 50% of the first floor façade to abut the public
20 sidewalk along a retail street on Niles Avenue;
21 2. §118-184(c)(5) to allow less than the required 60% of the first floor linear frontage of
22 total lot frontage along the public sidewalk on Niles Avenue to be devoted to
23 permitted and special uses on retail streets;
24 3. §118-184(c)(9) to allow recessed entrances to be wider than one third of the entire
25 frontage along a retail street on Niles Avenue;
26 4. §118-52 to allow a sight distance triangle less than 15 feet on the Niles Avenue one-
27 way entrance drive; and
28 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on
29 October 22, 2019, voted to concur in the aforesaid recommendations and findings of fact of the
30 Skokie Plan Commission;
31 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
32 Village of Skokie, Cook County, Illinois:
33 Section 1: That the Site Plan approval requested by the petitioner to construct and
34 establish a planned development at the property legally described above and commonly
35 known as the northwest corner of Oakton Street and Niles Avenue (4918-4949 Oakton Street,
36 8009 Niles Avenue and 4933 Oakton Terrace) in a CX Core Mixed-Use district, is hereby
37 granted and approved subject to each of the conditions set forth below:
38 1. The petitioner shall develop the Subject Property in substantial conformance
39 with the final Village approved site plan dated October 10, 2019, floor plans
40 dated August 28, 2019, landscape plans dated October 11, 2019, and building
41 elevations dated August 28, 2019;

1 2. Required off-street vehicle and bicycle parking must be provided prior to
2 occupancy in the adjacent garage at 8031 Niles Avenue;
3 3. No restriction of use may be placed on the commercial space that is more
4 restrictive than is allowed in the Skokie Village Code;
5 4. No objects are allowed within a 15' sight distance triangle between 30" and
6 84" in height from grade except traffic control devices listed in the Manual on
7 Uniform Traffic Control Devices, except as shown on the final approved site
8 plan for which relief has been granted;
9 5. Prior to the issuance of building permits, the petitioner shall submit a
10 temporary pedestrian, bicycle, and transit circulation plan, including routing,
11 signage, and barriers, to be in place prior to the commencement of
12 construction, subject to the approval of the Engineering Division;
13 6. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas,
14 signage, landscaping, structures, and any other facilities or infrastructure on
15 the Subject Property shall be maintained in a good state of repair, and when
16 needed, be repaired or replaced in a timely manner;
17 7. All private and public sidewalks shall be maintained free of snow, ice, sleet, or
18 other objects that may impede travel;
19 8. Trash shall only be allowed within a designated trash enclosure and shall be
20 screened from public view in an enclosure approved by the Appearance
21 Commission. All trash shall be contained in such a way as to remain out of
22 sight at all times;
23 9. Vehicles shall not be allowed to be parked in or otherwise block common
24 driveways, sidewalks, aisles, or other points of access at any time, shall only
25 be parked in designated parking spaces, and shall not overlap the striped lines
26 of designated parking spaces;
27 10. Prior to issuance of building permits, the petitioner shall submit evidence of
28 issuance of permits for the construction and operation of the water main and
29 associated equipment by the Illinois Environmental Protection Agency (IEPA)
30 or provide a determination by IEPA that such permits are not required. Water
31 mains that feed multiple building structures and/or create a "looped" system
32 that require an IEPA permit will also require an easement and custodial
33 agreement with the Village;
34 11. The petitioner shall sign an "Agreement for Installation and Maintenance of
35 Landscaping" to assure that the Subject Property and parkway landscaping is
36 completed and maintained, including trimming, watering, and replacing of
37 dead plant materials in a timely manner in accordance with the final approved
38 landscape plan. A copy of said Agreement is attached hereto, marked Exhibit
39 “A” and hereby made part of this Ordinance. This “Agreement for Installation
40 and Maintenance of Landscaping" shall be recorded at the petitioner’s
41 expense;
42 12. All new construction, alterations, and remodeling shall meet current
43 International Building and NFPA Life Safety Codes as amended;

1 13. The petitioner shall obtain all required permits and approvals for
2 improvements to County, State, or Federal rights-of-way from the governing
3 jurisdiction;
4 14. The owner of every occupied commercial premises used for the sale of
5 packaged or prepared food shall supply at least one approved covered
6 container for litter at the main entrance to the premises for use by customers.
7 The owner of the premises shall be responsible for the removal of litter every
8 four hours;
9 15. All signage shall conform to the Skokie Village Code except as provided in
10 case 2019-37P. Any sign on the Subject Property that is in violation of that
11 Code must be removed or modified to conform with the Village Code prior to
12 the issuance of an occupancy permit;
13 16. All modifications to building elevations, signage, and landscaping shall be
14 subject to the review and approval of the Skokie Appearance Commission;
15 17. The petitioner shall submit to the Planning Division electronic files of the plat
16 of survey, site plan, and landscape plan in their approved and finalized form.
17 The files shall be scaled 2-dimensional drawing files on non-compressed, non-
18 read only CD-ROM *.dwg AutoCAD format;
19 18. Prior to the issuance of building permits, the petitioner shall submit to the
20 Planning Division of the Community Development Department the name,
21 property address, email address, and telephone number of the company and
22 contact person responsible for site maintenance in compliance with this site
23 plan approval;
24 19. If work is to be performed on public property or if public property is utilized or
25 impacted during construction and/or development, the owner shall provide, or
26 shall cause the developer and/or contractor to provide, the Village of Skokie
27 with a certificate of insurance naming the Village of Skokie as additionally
28 insured for any and all claims related to any and all work. The owner shall
29 hold, and shall cause the developer and/or contractor to hold, the Village of
30 Skokie harmless and indemnify the Village for any and all claims for property
31 damage or personal injury related to work on or use of public property;
32 20. The petitioner shall comply with all Federal and State statutes, laws, rules and
33 regulations and all Village codes, ordinances, rules, and regulations; and
34 21. Failure to abide by any and all terms of this Ordinance shall be cause for the
35 Village to initiate hearings to determine whether the subject Ordinance, as well
36 as any applicable business licenses, should be revised or revoked. The
37 petitioner shall pay all costs related to any hearings conducted as a result of
38 non-compliance with any of the provisions of the enabling ordinance. The
39 costs shall include but not be limited to court reporter fees, attorney fees, and
40 staff time required researching and conducting said hearing.

1 This Agreement is entered into this day of 2021 by and
2 between SKOKIE ISTP, LLC, A DELAWARE LLC, hereinafter referred to as "PROPERTY
3 OWNER", and the VILLAGE OF SKOKIE, an Illinois municipal corporation, hereinafter referred
4 to as "VILLAGE". The parties to this Agreement hereby agree as follows:

6 PROPERTY OWNER is the owner of real property located in the Village of Skokie,
7 PARCEL 1:

18 1. At or near the time of execution of this Agreement, the VILLAGE granted an
19 Occupancy Permit, Business License, Site Plan Approval or Special Use Permit
20 hereinafter collectively referred to as “permit” pursuant to state statutes and local
21 ordinances.
22 2. By the terms of the aforesaid permit, the PROPERTY OWNER is required to install
23 and maintain landscaping in accordance with the plan dated October 11, 2019, or as
24 it may be subsequently revised with the approval of the Village Manager, or
25 designee, and the Corporation Counsel.
26 3. The parties to this Agreement recognize that the installation and maintenance of
27 landscaping is an integral part of the PROPERTY OWNER's plan for development
28 and/or use of the property and is necessary to carry out the purpose and intent of the
29 VILLAGE's land use objectives, and that the permit would not have been approved
30 by the VILLAGE without the assurance that this Agreement would be executed by
31 the PROPERTY OWNER.
32 4. The purpose of this Agreement is to assure:
33 (a) installation of the landscaping in accordance with the landscaping plan
34 approved by the VILLAGE, and
35 (b) continued maintenance and care of the landscaping, including any
36 landscaping indicated in the parkway area.

1 5. The property, which is the subject matter of this Agreement, is legally described
2 above. The portions of the Subject Property which are to be landscaped and
3 maintained pursuant to the terms and conditions of this Agreement are indicated on
4 the Landscape Plan attached hereto, marked Exhibit “1” and are hereby made a part
5 of this Agreement.
6 6. PROPERTY OWNER agrees that the installation and maintenance of the
7 landscaping which is required in accordance with the permit issued by the VILLAGE
8 and this Agreement will materially benefit the Subject Property. Such landscaping is
9 necessary in order for the PROPERTY OWNER to comply with the conditions of the
10 permit issued or granted by the VILLAGE for the PROPERTY OWNER’s requested
11 development or use of the property.
12 7. PROPERTY OWNER shall diligently maintain and care for the landscaping which is
13 installed and required by the permit and this Agreement, using generally accepted
14 methods of cultivation and watering. The PROPERTY OWNER shall maintain a
15 standard of care necessary to prevent the landscaping from deteriorating to the
16 extent that its value as landscaping is destroyed. If Exhibit “1”, attached hereto or
17 permit specifies maintenance standards or procedures, such procedures are hereby
18 adopted as part of this Agreement, and by such adoption, become enforcement
19 conditions of this Agreement.
20 8. Failure to maintain the landscaping as required by this Agreement shall be a
21 nuisance. In the event the PROPERTY OWNER fails to meet the standard of
22 maintenance necessary to keep the landscaping in a healthy condition as required
23 by this Agreement, the VILLAGE shall give written notice of the deficiency to the
24 PROPERTY OWNER who shall have 20 days to make the necessary correction or
25 replacement. If such correction or replacement is not made within the aforesaid 20-
26 day period, the VILLAGE may elect to abate the nuisance and take necessary action
27 to assure that the landscaping is replaced and/or maintained. In the event, the
28 VILLAGE so elects; the VILLAGE shall serve notice of its intent to enter the
29 premises for this purpose. The VILLAGE shall either personally serve the notice
30 upon the PROPERTY OWNER or mail a copy of it by certified mail to the
31 PROPERTY OWNER's last known address, or as shown on the tax rolls, at least 15
32 days in advance of the date when the VILLAGE or its agent intends to enter the
33 premises.
34 9. For this purpose, the VILLAGE or its agent may enter upon the property and perform
35 such work as it considers reasonably necessary and proper to restore, maintain, or
36 replace the landscaping required by this Agreement. The VILLAGE may act either
37 through its own employees or through an independent contractor.
38 10. The VILLAGE shall be entitled to reimbursement for abating the nuisance in
39 restoring, maintaining or replacing the landscaping, provided that the VILLAGE
40 follows the procedures set forth in this Agreement. Costs shall include but shall not
41 be limited to actual costs incurred by the VILLAGE and administrative costs. The
42 VILLAGE shall make demand upon the PROPERTY OWNER for payment. If the
43 PROPERTY OWNER fails to pay the costs within 30 days of the date on which
44 demand is made, the VILLAGE may cause a lien to be placed on the Subject
45 Property. The VILLAGE may record a notice with the Recorder of Deeds for Cook
46 County stating that it has incurred expenses under the terms this Landscape

1 Agreement. The VILLAGE shall be entitled to collect interest at the statutory rate on
2 the amount owed.
3 11. In addition to having a lien placed on the Subject Property, the VILLAGE may
4 institute a legal action to collect the amount owed. The PROPERTY OWNER agrees
5 to pay the VILLAGE a reasonable sum for attorney's fees and court costs.
6 12. If either party upon the execution of this Agreement or during the course of
7 performance considers that it is necessary to have the PROPERTY OWNER post
8 additional security to guarantee the performance of his obligations hereunder, the
9 VILLAGE may require the PROPERTY OWNER to post additional security. The
10 VILLAGE may require either a cash deposit or a surety bond guaranteeing
11 performance in a form signed by sureties satisfactory to the VILLAGE. The
12 condition of the security shall be that if the PROPERTY OWNER fails to perform any
13 obligation under this Agreement, the VILLAGE may, act on behalf of the
14 PROPERTY OWNER and use the proceeds of the cash bond, or in the case of a
15 surety bond, require the securities to perform the obligations of this Agreement.
16 13. The PROPERTY OWNER hereby agrees to indemnify and hold harmless the
17 VILLAGE, its trustees, officials, employees and agents for any costs, claims, actions
18 or causes of action for personal injury, property damage or otherwise, including
19 reasonable attorney’s fees, which may arise from the VILLAGE exercising any of its
20 rights or obligations and performance under this Agreement.
21 14. All notices required or to be given pursuant hereto shall be in writing and either
22 delivered personally or by a nationally recognized "over-night" courier service or
23 mailed by United States certified or registered mail, postage prepaid, addressed to
24 the VILLAGE and the PROPERTY OWNER as follows:

1 WHEREAS, the owner (hereinafter “Petitioner”) of the following described real property:
2 LOT 1 (EXCEPT THE EAST 446 FEET THEREOF AS MEASURED ON THE SOUTH LINE AND EXCEPT
3 THE NORTH 16 FEET THEREOF) IN CLARA BLAMEUSER’S OAKTON STREET SUBDIVISION, BEING
4 A RESUBDIVISION OF THE SOUTH 146 FEET OF LOT 3 AND THAT PART OF LOT 4 WHICH LIES

11 more commonly described as 8009 Niles Avenue, Skokie, Illinois (the “Subject Property”),
12 petitioned the Village of Skokie for a special use permit to establish and operate a hotel on
13 the Subject Property located in a CX Core Mixed-Use district; and
14 WHEREAS, the proposed mixed-use building will contain ground-floor retail, a hotel,
15 conference center, banquet space and a roof-top skybar at the northeast corner of Oakton
16 Street and Niles Avenue. The building will be 8 stories and 96 feet tall to the top of the roof;
17 and
18 WHEREAS, there will be 11,924 square feet of retail and hotel common areas on the
19 ground floor. The second floor will have additional hotel common areas, as well as an
20 11,506 square foot conference center and an active 6,909 square foot terrace. The 3rd
21 through 7th floors will contain hotel rooms and the 8th floor will contain hotel rooms and a
22 7,630 square foot skybar, with a 2,391 square foot terrace; and
23 WHEREAS, the following relief is sought from the Sign Code, Chapter 82 of the Skokie
24 Village Code:
25 -§82-27(c)(5) to allow a wall sign above a second floor window sill,

5 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on October 3,
6 2019, for which proper legal notice had been achieved and no interested parties appeared, (a)
7 made the appropriate findings of fact as required under Section 118-6(f) of the Skokie Village
8 Code; and (b) voted to recommend to the Mayor and Board of Trustees that the requested
9 special use permit be granted subject to the conditions contained in the Plan Commission
10 Report dated October 22, 2019; and
11 WHEREAS, the Skokie Plan Commission further recommended that relief be granted
12 from the following sections of Chapter 82 of the Skokie Village Code:
13 -§82-27(c)(5) of the Village Code to allow a wall sign above a second floor window
14 sill;
15 -§82-27(d) of the Village Code to allow a 126.5 square foot ground sign located 0’
16 from an interior lot line;
17 -§82-27(e) of the Village Code to allow an 84 square foot internally illuminated blade
18 sign above the second floor window sills; and
19 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on
20 October 22, 2019, concurred in the aforesaid recommendations and findings of fact of the
21 Skokie Plan Commission;
22 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
23 Village of Skokie, Cook County, Illinois:
24 Section 1: That the special use permit requested by the petitioner to establish and
25 operate a hotel at the Subject Property, described above and commonly known as 8009 Niles
26 Avenue, Skokie, Illinois, in a CX Core Mixed-Use district be and the same is hereby granted
27 and approved subject to each of the conditions set forth below:
28 1. The petitioner shall develop the Subject Property in substantial conformance with the
29 final Village approved plans specified in Condition 1 of Site Plan Approval Ordinance
30 Number 21-1-Z-____ and sign plans dated August 6, 2019;
31 2. New parking lot and exterior lighting shall meet Illuminating Engineering Society of North
32 America (IES) standards, be full cut-off design, and be directed away from adjacent
33 properties, subject to the approval of the Engineering Division;
34 3. Any outdoor sound systems shall at all times maintain audio levels that are compliant
35 with the Skokie Village Code;
36 4. All new construction, alterations, and remodeling shall meet current International
37 Building and NFPA Life Safety Codes as amended;
38 5. All signage shall conform to the Skokie Village Code, except as provided in this
39 ordinance. Any sign on the Subject Property that is in violation of that Code must be

1 removed or modified to conform with the Village Code prior to the issuance of an
2 occupancy permit;
3 6. All modifications to building elevations, signage, and landscaping shall be subject to the
4 review and approval of the Skokie Appearance Commission;
5 7. The petitioner shall submit to the Planning Division electronic files of the site plan and
6 landscape plan in their approved and finalized form;
7 8. Prior to the issuance of building permits, the petitioner shall submit to the Planning
8 Division of the Community Development Department the name, property address, email
9 address, and telephone number of the company and contact person responsible for site
10 maintenance in compliance with this special use permit;
11 9. If work is to be performed on public property or if public property is utilized or impacted
12 during construction and/or development, the owner shall provide, or shall cause the
13 developer and/or contractor to provide, the Village of Skokie with a certificate of
14 insurance naming the Village of Skokie as additionally insured for any and all claims
15 related to any and all work. The owner shall hold and shall cause the developer and/or
16 contractor to hold, the Village of Skokie harmless and indemnify the Village for any and
17 all claims for property damage or personal injury related to work on or use of public
18 property;
19 10. The petitioner shall comply with all Federal and State statutes, laws, rules and
20 regulations and all Village codes, ordinances, rules, and regulations; and
21 11. Failure to abide by any and all terms of this Ordinance shall be cause for the Village to
22 initiate hearings to determine whether the subject Ordinance, as well as any applicable
23 business licenses, should be revised or revoked. The petitioner shall pay all costs
24 related to any hearings conducted as a result of non-compliance with any of the
25 provisions of the enabling ordinance. The costs shall include but not be limited to court
26 reporter fees, attorney fees, and staff time required researching and conducting said
27 hearing.
28 Section 2: The following relief requested from Chapter 82 of the Skokie Village Code,
29 is hereby granted:
30 1. §82-27(c)(5) to allow a wall sign above a 2nd floor window sill,

AN ORDINANCE AMENDING CHAPTER 118, SECTION 118-218,
AND THE APPENDIX A USE TABLE OF THE SKOKIE VILLAGE CODE
PERTAINING TO MISCELLANEOUS CROP FARMING
1 WHEREAS, Chapter 118, Section 118-218, of the Skokie Village Code provides for
2 the required number of off-street motor vehicle parking spaces for zoning uses; and
3 WHEREAS, Chapter 118, Appendix A Use Table, of the Skokie Village Code provides
4 for the listing of zoning uses in the Village of Skokie; and
5 WHEREAS, there was a request to amend Appendix A by adding “all other
6 miscellaneous crop farming” as a permitted use in the industrial zoning districts. The broader
7 application of allowing additional indoor crop farming would be well suited for many local
8 industrial buildings. Also, expanding the available zones for these uses is consistent with
9 one of the objectives of The Skokie Sustainability Plan, which is to support local regional
10 farming efforts to reduce the transportation distance for food; and
11 WHEREAS, this additional language will allow additional crops, not categorized by the
12 federal government as food crops or floriculture, like agave, hay, herbs, grass seed, industrial
13 hemp, hops and spices, and expands these uses to the M1, M2 and M3 industrial zoning
14 districts; and
15 WHEREAS, at the Skokie Plan Commission public meeting duly held on November
16 19, 2020, for which proper legal notice had been achieved, some commissioners had
17 questions regarding hemp licensure, micro-farming on rooftops, and the uses and different
18 categories in the industrial zones, and after hearing all discussion, the Skokie Plan
19 Commission voted to concur with the recommendation of staff to amend Chapter 118, Section
20 118-218 and Appendix A Use Table of the Skokie Village Code accordingly; and
21 WHEREAS, subsequent to the November 19, 2020 meeting, the petitioner notified the
22 Village that he was withdrawing his original request, however, the Skokie Plan Commission
23 determined it would still bring its recommendation to the Village Board as the broader
24 application of allowing additional non-food indoor crop farming would be suited for many local
25 industrial buildings; and

1 WHEREAS, at a public meeting duly held the Mayor and Board of Trustees concurred in
2 the aforesaid recommendations and findings of fact of the Corporation Counsel, Plan Commission
3 Chairman and Community Development Director;
4 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village
5 of Skokie, Cook County, Illinois:
6 Section 1: That Village Ordinance Number 04-6-Z-3272 pertaining to the special use
7 permit at the Subject Property, be and the same is hereby repealed. Any previous Village
8 Ordinances which were repealed by the foregoing ordinances shall remain repealed and are null
9 and void. Nothing in this Ordinance shall be construed to reinstate any previously repealed
10 ordinances.
11 Section 2: That the owner of the Subject Property is hereby granted the request to
12 modify the previously approved special use permit for the existing motor vehicle gas station with a
13 mini food mart, a carry out restaurant and motor vehicle laundry at 5015 Touhy Avenue, Skokie,
14 Illinois subject to the following conditions:
15 1. The petitioner shall develop the Subject Property in substantial conformance with
16 the final Village approved site plan dated December 10, 2020 and landscape plan
17 dated February 9, 2004;
18 2. An 8’ high brick wall must be maintained along the south property line of the site;
19 3. The hours of operation of the cash wash shall be limited to 8:00 AM to 9:00 PM;
20 4. No vending machines or display of merchandise shall be permitted outside the
21 building, except for a propane tank storage unit;
22 5. The attendant must always have a clear view of the fuel dispensing area;
23 6. At least 1 employee must always be at the fuel control console when self-serve
24 fuel is being dispensed. At least 2 employees shall be on the premises from 7:00
25 AM to 9:00 PM;
26 7. A system that allows communication between persons at each fuel dispensing
27 area and the employee at the fuel control console must be provided;
28 8. During the hours of operation, air and use of equipment for tire inflation, use of a
29 tire pressure gauge, fluid and equipment for washing vehicle windows, water and
30 use of a water container for filling radiators, and rest room facilities must be
31 provided free of charge. Charging a fee for these services is prohibited;
32 9. The pump islands and fuel tanks shall be removed upon closing of the automotive
33 fuel station in accordance with the requirements of the State Fire Marshal;
34 10. The operation of the car wash must minimize excessive water from collecting
35 outside the building openings to a wash bay;
36 11. The owner must supply at least one approved covered container for litter at the
37 store entrance and 1 for every 2 vacuum stations for use by customers. The
38 owner of the premises shall be responsible for the removal of litter every four
39 hours;
40 12. Any outdoor sound systems shall always maintain audio levels that are compliant
41 with the Skokie Village Code;
42 13. No objects are allowed within a 15' sight distance triangle between 30" and 84" in

1 height from grade except traffic control devices listed in the Manual on Uniform
2 Traffic Control Devices;
3 14. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas,
4 signage, landscaping, structures, and any other facilities or infrastructure on the
5 Subject Property shall be maintained in a good state of repair, and when needed,
6 be repaired or replaced in a timely manner;
7 15. All private and public sidewalks shall be maintained free of snow, ice, sleet, or
8 other objects that may impede travel;
9 16. Trash shall only be allowed within a designated trash enclosure and shall be
10 screened from public view in an enclosure approved by the Appearance
11 Commission. All trash shall be contained in such a way as to remain out of sight
12 at all times;
13 17. All off-street parking spaces shall be legibly striped and maintained;
14 18. Any plan to modify parking lot striping must be approved by the Director of
15 Engineering;
16 19. The handicapped parking spaces shall be installed and maintained in compliance
17 with State of Illinois Accessibility Standards and the Skokie Village Code, including
18 required signage;
19 20. Vehicles shall not be allowed to be parked in or otherwise block common
20 driveways, sidewalks, aisles, or other points of access at any time, shall only be
21 parked in designated parking spaces, and shall not overlap the striped lines of
22 designated parking spaces;
23 21. The owner of the Subject Property shall ensure that employees park on the
24 Subject Property;
25 22. The petitioner shall sign an "Agreement for Installation and Maintenance of
26 Landscaping" to assure that the Subject Property and parkway landscaping is
27 completed and maintained, including trimming, watering, and replacing of dead
28 plant materials in a timely manner in accordance with the final approved
29 landscape plan. A copy of said Agreement is attached hereto, marked Exhibit “A”
30 and hereby made part of this Ordinance. This “Agreement for Installation and
31 Maintenance of Landscaping" shall be recorded at the petitioner’s expense;
32 23. All new construction, alterations, and remodeling shall meet current International
33 Building and NFPA Life Safety Codes as amended;
34 24. The petitioner shall obtain all required permits and approvals for improvements to
35 County, State, or Federal rights-of-way from the governing jurisdiction;
36 25. The Subject Property must conform to the Village's storm water control
37 requirements as contained in the Skokie Village Code, including the disconnection
38 of any downspouts;
39 26. All signage shall conform to the Skokie Village Code. Any sign on the Subject
40 Property that is in violation of that Code must be removed or modified to conform
41 with the Village Code prior to the issuance of an occupancy permit;
42 27. All modifications to building elevations, signage, and landscaping shall be subject
43 to the review and approval of the Skokie Appearance Commission;

1 28. The petitioner shall submit to the Planning Division electronic files of the site plan
2 and landscape plan in their approved and finalized form;
3 29. Prior to the issuance of building permits, the petitioner shall submit to the
4 Planning Division of the Community Development Department the name, property
5 address, email address, and telephone number of the company and contact
6 person responsible for site maintenance in compliance with this special use
7 permit or site plan approval;
8 30. If work is to be performed on public property or if public property is utilized or
9 impacted during construction and/or development, the owner shall provide, or
10 shall cause the developer and/or contractor to provide, the Village of Skokie with
11 a certificate of insurance naming the Village of Skokie as additionally insured for
12 any and all claims related to any and all work. The owner shall hold, and shall
13 cause the developer and/or contractor to hold, the Village of Skokie harmless and
14 indemnify the Village for any and all claims for property damage or personal injury
15 related to work on or use of public property;
16 31. The petitioner shall comply with all Federal and State statutes, laws, rules and
17 regulations and all Village codes, ordinances, rules, and regulations; and
18 32. Failure to abide by any and all terms of this Ordinance shall be cause for the
19 Village to initiate hearings to determine whether the subject Ordinance, as well as
20 any applicable business licenses, should be revised or revoked. The petitioner
21 shall pay all costs related to any hearings conducted as a result of non-
22 compliance with any of the provisions of the enabling ordinance. The costs shall
23 include but not be limited to court reporter fees, attorney fees, and staff time
24 required researching and conducting said hearing.
25 Section 3: That a notice of the approval of this Ordinance incorporating the
26 conditions contained herein shall be executed by the owner of the property in writing and duly
27 recorded with the Cook County Recorder of Deeds Office at the owner’s expense.
28 Section 4: That this Ordinance shall be in full force and effect from and after its
29 passage, approval and recordation as provided by law.
