MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8
p.m. on Monday August 16, 2021
With Skokie and the entire State of Illinois now in Phase 5 of the Restore Illinois plan and the
lifting of restrictions on in-person gatherings, Skokie Village Board meetings are in-person in the
Council Chambers at Skokie Village Hall, 5127 Oakton Street. Village Board meetings begin at 8
p.m. and will continue to be broadcast live on the Village’s YouTube channel as well as on
SkokieVision cable television channels 17 (Comcast) and 25 (RCN). Meetings also are re-broadcast
on the cable channels in the weeks following each meeting, and the videos are archived on the
Village’s YouTube channel.
As of August 9, 2021, the transmission of COVID-19 has increased to a high level within Skokie. As
such, until further notice the Village of Skokie is requiring that all Village employees, officials and
visitors wear masks when inside of all Village buildings. This requirement is consistent with
guidance from the Centers for Disease Control and both the Illinois and Cook County Departments
of Public Health. The Skokie Health and Human Services Department recommended that the
Village follow this guidance to protect staff, visitors and the entire community.
Public comments may still be submitted to publiccomments@skokie.org; comments received prior
to the meeting or during the meeting will be provided to the Village Board and will not be read
aloud. Public comments also can be mailed or hand-delivered to Skokie Village Hall, 5127 Oakton
Street, Skokie, Illinois, 60077, Attention: Village Manager’s Office or placed in the exterior drop
box on the west side of Skokie Village Hall. Each Village Board meeting agenda includes time for
public comments, and individuals wishing to speak on an issue will be allocated three minutes to
address the Village Board.

Kyle DeGiulio, Manager of Economic Development Policy answered questions from the
Trustees concerning Pollution, Greenhouse gas emissions ,environmental issues,

Sharon Ammons, from GoGreen Skokie, Louis Mercer, Jim Barnard and Laurie Simmons spoke
about Sustainability and Climate Action.
Ted Smukler spoke about the Flex drivers.
Matt Brandmeyer, Community Development Director responded about substainability and
environmental issues.
Trustee Johnson proposed to amend the Plan Commission Case 2021-14P to require the
petitioner to set specific environmental goals. There was no second and the motion failed.

Fikret Palavra spoke about fence heights in the Village of Skokie. Mayor Van Dusen
responded with the explanation of the Ordinance. He also spoke about the Covid-19
vaccine.
George Saliba also apoke about concerns about the Covid-19 vaccine.
A resident of Skokie spoke about the vaccine and the effects on children and adults.

A RESOLUTION APPROVING AND AUTHORIZING A FIFTH AMENDMENT
TO THE FACILITY MANAGEMENT AGREEMENT WITH PROFESSIONAL
FACILITIES MANAGEMENT, INC. (PFM) FOR THE NORTH SHORE CENTER
FOR THE PERFORMING ARTS IN SKOKIE
1 WHEREAS, Professional Facilities Management, Inc., (hereinafter “PFM”) has
2 managed the North Shore Center for the Performing Arts in Skokie. In this capacity, PFM
3 oversees all building operations and provides staffing for management, box office sales,
4 marketing, budgeting, tenant management, technical operations and all aspects of operating
5 the world-class facility; and
6 WHEREAS, PFM has proven a valuable, supportive partner in both facility
7 management and programming at the North Shore Center for the Performing Arts; and
8 WHEREAS, the Facilities Management Agreement executed on June 18, 1996 has
9 been amended on four previous occasions, each time extending the term of the agreement,
10 with the most recent Amendment expiring on April 30, 2021. Cognizant of the uncertainties of
11 the entertainment venue market due to the COVID-19 pandemic, the Village of Skokie and
12 PFM have agreed upon an initial one-year term for a new Facilities Management Agreement,
13 with three one-year extension options; and
14 WHEREAS, the Village Manager recommended to the Mayor and Board of Trustees
15 that the Fifth Amendment to the Facility Management Agreement with Professional Facilities
16 Management, Inc., be approved substantially in the form attached hereto and marked as
17 Exhibit “1”, subject to changes approved by the Village Manager or designee and the
18 Corporation Counsel of the Village of Skokie;
19 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the
20 Village of Skokie, Cook County, Illinois that the Fifth Amendment to the Facility Management
21 Agreement with Professional Facilities Management, Inc., a copy of which is attached hereto
22 and marked Exhibit “1”, or subject to changes approved by the Corporation Counsel and Village

MANAGEMENT, INC. (PFM) REGARDING THE NORTH SHORE CENTER
FOR THE PERFORMING ARTS IN SKOKIE
1 WHEREAS, Professional Facilities Management, Inc., (hereinafter “PFM”) has managed
2 the North Shore Center for the Performing Arts (hereinafter “Center”) in Skokie. In this
3 capacity, PFM oversees all building operations and provides staffing for management, box
4 office sales, marketing, budgeting, tenant management, technical operations and all aspects
5 of operating the world-class facility; and
6 WHEREAS, PFM has provided programming services for the 867-seat main stage
7 theatre at the Center since 2010. While working closely with the Center’s Board of Directors
8 on programming choices, PFM’s programming recommendations draw on their decades of
9 experience in the entertainment industry and the efficiencies of managing multiple performing
10 arts while also being tailored for the Center’s unique market; and
11
12 WHEREAS, prior to the COVID-19 pandemic, patron surveys showed that PFM’s
13 programming recommendations increased both first-time and younger ticket buyers at the
14 Center. They also have focused on programs to promote equity and other voices in the
15 community, often with support from the North Shore Center for the Performing Arts
16 Foundation and the Rice Foundation; and
17
18 WHEREAS, PFM did an outstanding job in 2020, managing the uncertainties involved
19 with programming, and quickly organizing the Outback Summer Series concerts during the
20 summer; and
21 WHEREAS, the Village Manager recommended to the Mayor and Board of Trustees that the
22 Agreement for Programming Services with Professional Facilities Management, Inc., be approved
23 substantially in the form attached hereto and marked as Exhibit “1”, subject to changes approved by
24 the Village Manager or designee and the Corporation Counsel of the Village of Skokie;
25 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village
26 of Skokie, Cook County, Illinois that the Agreement for Programming Services with Professional

AN ORDINANCE AMENDING CHAPTER 46, ARTICLE II,
SECTION 46-36(b) OF THE SKOKIE VILLAGE CODE PERTAINING
TO THE RECOVERY OF FEES FOR EMERGENCY SERVICES
RENDERED BY THE SKOKIE FIRE DEPARTMENT
1 WHEREAS, Chapter 46, Article II, Section 46-36 of the Skokie Village Code provides
2 for Village of Skokie Fire Department service fees; and
3 WHEREAS, on July 15, 2019, the Mayor and Board of Trustees adopted Village
4 Ordinance Number 19-7-C-4472, amending Section 46-36 of the Skokie Village Code
5 (hereinafter “Code”) and listed Fire Department cost recovery fees for various Fire
6 Department services such as: vehicle extrication, fire suppression and hazardous materials
7 response; and
8
9 WHEREAS, Section 46-36(c) allows for the Village Manager “to modify or change the
10 fees that may be charged”. Pursuant to that authority the Village Manager has implemented
11 changes in the fees that are charged, and as such are not reflected in the amounts currently
12 outlined in Section 46-36(b); and
13
14 WHEREAS, in order to avoid confusion, the Fire Chief has recommended to the Village
15 Manager that Section 46-36(b) should be revised to remove any specific fees as they are
16 subject to change; and
17 WHEREAS, the Village Manager concurred with the recommendation of the Fire Chief
18 and recommended to the Mayor and Board of Trustees that the Section 46-36(b) be revised as
19 to remove any specific fees as they are subject to change, and thus recommended that Chapter
20 46, Article II, Section 46-36(b) of the Code be amended accordingly; and

3 (b) Emergency Incident Cost Recovery Fees. Each property owner or vehicle owner that
4 receives any of the following emergency services from the Village Skokie Fire Department
5 arising from the following situations set forth below, shall be charged the
6 corresponding recovery fee for such services, as set forth in the schedule of fees
7 authorized by Section 46-36(c):
8 1. Motor Vehicle Accident

13 1. Fire Department response to a motor vehicle accident shall be charged a fee of
14 $550.00;

18 excluding hazardous materials, shall be charged $700.00; and

21 structural and/or trench collapse incidents shall be charged a fee of $400.00.
22 (c) Billing. The Village Manager or designee shall cause a bill to be issued and sent to the
23 appropriate entity or person responsible for payment for said person having been
24 transported by ambulance, having received emergency medical services or Fire
25 Department Response specified in this section. The Village Manager shall, with the
26 consultation of the Fire Chief and the Director of Finance, establish a schedule of the
27 applicable fees for all services received by a person with regard to ambulance
28 transportation and emergency medical services, including fees for multiple responses
29 as specified in subsection (e) of this section. The Village Manager is authorized to
30 modify or change the fees that may be charged from time to time after consideration of
31 certain factors. Such factors that may be considered by the Village Manager include,
32 but are not limited to, applicable Medicare rates, reimbursement rates, cost standards
33 in the insurance or health care industry, and actual cost of services and supplies. The

AN ORDINANCE GRANTING RELIEF FROM CHAPTER 10, ARTICLE I,
SECTION 10-10 OF THE SKOKIE VILLAGE CODE PERTAINING TO THE
TEMPORARY SALE AND CONSUMPTION OF ALCOHOLIC LIQUOR ON
THE PUBLIC RIGHT OF WAY AND MUNICIPAL PROPERTY
1 WHEREAS, this routine ordinance for the Backlot Bash concerns Chapter 10, Article I,
2 Section 10-10 of the Skokie Village Code which prohibits the possession and consumption of
3 alcoholic liquor on Village of Skokie (hereinafter “Village”) owned property; and
4 WHEREAS, the Skokie Park District, in conjunction with various organizations, will be
5 presenting the 14th Annual Backlot Bash (hereinafter “Bash”), which will take place on August
6 27, 28 and 29, 2021; and
7 WHEREAS, the Bash is comprised of concerts, games, food and a carnival which will
8 utilize Village owned parking lots and a portion of the public ways at and around the
9 intersection of Floral Avenue and Oakton Street and a portion of Lincoln Avenue; and
10 WHEREAS, the Skokie Park District has or will acquire a temporary permit pursuant to
11 Section 10-40 of the Code, authorizing the sale of liquor for the 2 and ½ day event; and
12 WHEREAS, the Skokie Park District intends to restrict and limit the consumption of
13 alcoholic liquor to a defined and fenced-in area located on a portion of the public right of way
14 of Oakton Street, the Village Green and a portion of the Village Hall parking lot (hereinafter
15 “Beer Area”), as depicted on the 2021 Event Layout, attached hereto as Exhibit “1”; and
16 WHEREAS, the Mayor, as Liquor Commissioner, and the Corporation Counsel
17 recommend to the Board of Trustees that relief from Section 10-10 of the Code be granted to
18 the Skokie Park District; and
19 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the
20 Village of Skokie, Cook County, Illinois;
21 Section 1: That the Skokie Park District, or its specified agents, are authorized and
22 permitted to sell alcoholic liquor and to allow its consumption within the Beer Area. To the
23 extent necessary, relief from Section 10-10 of the Code is granted as part of this permission.
24 This permission to sell alcoholic liquor in the Beer Area is subject to the following conditions:
25 1) The Skokie Part District shall have a Temporary Permit to sell alcoholic liquor
26 from the Local Liquor Commissioner;

1 2) The Skokie Park District shall have obtained any license, permit or other
2 necessary approvals from the State of Illinois to sell alcoholic liquor;
3 3) The area in which the sale of alcoholic liquor takes place shall be enclosed with
4 a fence, access shall be restricted and consumption shall be limited to the self-
5 contained designated area. No consumption or sale of alcoholic liquor shall be
6 allowed on any other publicly owned property or any public right of way.
7 4) That any and all necessary authorization is granted from local, county or state
8 agencies, for the closure of certain public rights of way including but not limited
9 to Floral Avenue and Oakton Street.
10 5) The sale of alcoholic liquors shall only take place during the following times:
11 6:00 p.m. to 10:00 p.m. on August 27, 2021; 11:00 a.m. to 10:00 p.m. on
12 August 28, 2021; and 8:00 a.m. to 8:00 p.m. on August 29, 2021;
13 6) Only alcoholic liquor sold by the Skokie Park District or its approved vendor,
14 may be sold, consumed or possessed in the designated area of the Beer Area.
15 No alcoholic liquor may be brought in from outside of the designated area;
16 7) The Skokie Park District, the Youth Foundation of Skokie and the Village shall
17 enter into an Intergovernmental Agreement upon terms negotiated by the
18 Village Manager, or designee, and the Corporation Counsel, subject to final
19 approval by the Mayor and the Board of Trustees; and
20 8) The Skokie Park District, and its vendor(s), shall comply with the Village Code,
21 and all ordinances, rules and regulations of the Village.
22 Section 2: That this Ordinance shall be in full force and effect from and after its
23 passage, approval and publication in pamphlet form as provided by law.

AN ORDINANCE VACATING A RESIDENTIAL ALLEY BETWEEN
8057 NILES CENTER ROAD AND 8052 ELMWOOD STREET,
SKOKIE, ILLINOIS IN A CX CORE MIXED-USE DISTRICT
1 WHEREAS, the owner of 8057 Niles Center Road, Skokie, Illinois (hereinafter
2 “Petitioner”) has requested the vacation of the remaining portion of alley between 8057
3 Niles Center Road and 8052 Elmwood Avenue (hereinafter “Subject Property”); and
4 WHEREAS, the Subject Property is depicted on the Plat of Vacation, dated June 25,
5 2021, a copy of which is attached hereto as Exhibit “1”; and
6 WHEREAS, through its ongoing alley vacation program, initiated in 2002, the
7 Community Development Department has been systematically vacating unopened and
8 unimproved residential alleys that are unnecessary for Village transportation and access
9 needs; and
10 WHEREAS, although the Subject Property is improved, it was to be included in the
11 program due to its unique position as being wholly surrounded by private property and
12 being a residual piece of right of way remaining from previous alley vacations. It does abut
13 residential property to the east. Additionally, it is unnecessary for the Village’s transportation
14 and access needs. Petitioner’s recent request to vacate the Subject Property accelerated
15 the timeline; and
16 WHEREAS, the Subject Property is located in an CX Core Mixed-use district within
17 an area between 8057 Niles Center Road and 8052 Elmwood Avenue and is described and
18 attached hereto in Exhibit “2”. It is currently being utilized by the Haben Funeral Home &
19 Crematory (8057 Niles Center Road) as a driveway to its parking lot; and
20 WHEREAS, the nature and extent of the public use or public interest to be
21 subserved in the Subject Property shall warrant the vacation of the same; and
22 WHEREAS, the title and ownership of the portion of the Subject Property to be
23 vacated shall, pursuant to 65 ILCS 5/11-91-2, vest in equal proportions to the abutting
24 property owners as identified by the Permanent Index Numbers (hereinafter “PIN”) and are
25 listed by PIN block numbers in Exhibit “2” attached hereto; and
26 WHEREAS, the only structure that may be built on the vacated alley(s) is a fence,
27 and that any and all structures built or maintained by the property owners are done so at the
28 property owner’s risk. The Village will have the right to enter upon vacated alleys and may
29 damage or remove the structure, should the Village need to access the area covered by the
30 easement; and

1 WHEREAS, a permanent public easement for drainage purposes shall be
2 maintained by the Village, as well as easements for Village and Village-franchised public
3 utilities will remain over the entire area to be vacated; and
4 WHEREAS, no compensation shall be paid by the owners of the abutting properties
5 for the value of the real estate which may accrue to them by reason of the enactment of this
6 Ordinance, since it has been determined that the vacation of alleys and the vacated portion
7 will benefit both residents and the Village; and
8 WHEREAS, other abutting property owners, if any, to the Subject Property were duly
9 notified of the Skokie Plan Commission proceedings and presented no objection to the
10 proposed vacation; and
11 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on June 3,
12 2021 having heard relevant testimony; (a) determined proper legal notice was achieved and
13 (b) voted to recommend to the Mayor and Board of Trustees that the Subject Property be
14 vacated, subject to the conditions set forth in the Plan Commission Report dated July 6,
15 2021; and
16 WHEREAS, the Mayor and Board of Trustees of the Village of Skokie, at a public
17 meeting duly held July 6, 2021, concurred in the recommendation of the Skokie Plan
18 Commission;
19 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
20 Village of Skokie, Cook County, Illinois:
21 Section 1: That the following portion of the alley commonly described below, and
22 legally described in Exhibit “2” attached hereto, and depicted on the Plat of Vacation, dated
23 June 21, 2021, a copy of which is attached hereto as Exhibit “1”, located in the Village of
24 Skokie, be and the same is hereby vacated:
25 A portion of an alley right of way, approximately 72 feet by 16 feet, bordered entirely by
26 private property owned by Petitioner and the property owner of 8052 Elmwood Avenue;
27 and the title to the vacated alleys shall vest to the abutting property owners pursuant to 65
28 ILCS 5/11-91-2, as identified by their Permanent Index Numbers set out in Exhibit “2”
29 attached hereto.
30 Section 2: The aforesaid vacations are subject to the conditions set forth below:

32 1. The property shall be vacated pursuant to the Plat of Vacation dated June 21, 2021, and
33 as may be further revised with the approval of the Village Manager, or designee, and
34 Corporation Counsel.
35 2. Upon the passage of the ordinance by the Board of Trustees, the Mylar of the Plat of
36 Vacation shall be submitted to the Village with all signatures other than Village staff or
37 elected officials.
38 3. Property owners shall not alter the grade or change the drainage pattern in the
39 easement area without a permit from the Engineering Division.

1 4. The vacation shall be effective upon the recording of a Plat of Vacation by the Village in
2 the Office of the Recorder of Deeds of Cook County, Illinois.
3 Section 3: The Village, on its own behalf and on behalf of Village-franchised
4 public utilities, shall retain the right of entry upon the Subject Property in order to install,
5 repair, replace or remove, or engage in the maintenance of, any equipment or facility of any
6 such utility or the drainage conditions in the Subject Property. In the course of repair,
7 replacement or removal, or maintenance of equipment or facilities of a Village-franchised
8 public utility, or drainage conditions in, on or over the Subject Property, the Village or the
9 Village-franchised public utility shall not be held liable by any owner of the Subject Property
10 for any damage to structures, landscaping, or fences in, on or over the Subject Property.
11 Any and all structures, including a fence, built or maintained on the Subject Property are
12 done so at the owner of the Subject Property’s own risk.
13 Section 4: That the aforesaid vacation, incorporating the conditions contained
14 herein, shall be effective upon the recording of a Plat of Vacation by the Village of Skokie in
15 the Cook County Clerk’s Office.
16 Section 5: That no compensation shall be paid by the owners of the abutting
17 properties for the value of the real estate which may accrue to them by reason of the
18 enactment of this ordinance and that the public interest and benefit will be subserved by the
19 vacation of the properties referenced herein.
20 Section 6: It is the intention of the Village that ownership and title to the vacated
21 alleys shall pass to and vest in the adjacent property owners, as listed by the Permanent
22 Index Numbers in Exhibit “2”, in equal proportions of the vacated alley.
23 Section 7: That this Ordinance shall be in full force and effect from and after its
24 passage, approval, and recordation as provided by law.

PLAN COMMISSION ANALYSIS
During its June 3, 2021, meeting, the Plan Commission heard a request for a special
use permit for truck and freight transportation services in an M1 Office Assembly zoning
district and any other relief discovered during the review of this case. The proposed
facility will be using independent flex drivers, who are using their own vehicles and not
Amazon employees, to deliver packages and products within a 4-hour span inside a
certain radius and within a 12-hour delivery window to further distances.
Staff was supportive of the request subject to addressing potential traffic issues
identified in the applicant’s Traffic Impact Study. The Plan Commission Recommended
Conditions include next steps and a potential required remedy to install a traffic signal if
one is warranted.
Discussion from the Commission included:
1. The hours of operation of the facility, which is 24 hours with peak periods early
morning and at night.
2. Potential conflicts with neighboring businesses to utilize their own docks.
Amazon responded that Amazon is responsible for policing drivers, and drivers
need to be respectful to the neighbors. There will not be any semi-trailer staging
on Linder Avenue. If there is a problem, neighbors are encouraged to contact
the building security guard or call the facility.
3. Prior precedent for a developer or user being responsible for installation of traffic
signals. Staff responded with a list of developments that were heard by the Plan
Commission and Village Board where this was the case.

occurred after the Plan Commission meeting.

1. The petitioner shall develop the Subject Property in substantial conformance with
the final Village approved site plan dated June 29, 2021. (Standard)
2. The stopping or standing of any vehicle associated with the operation of the facility
in the public right-of-way must not prohibit two-way movement, block driveways, or
limit the ability of other vehicles to maneuver into neighboring properties.
3. The applicant should provide a Traffic Signal Warrant Study by no later than
September 30, 2021, and if such study finds that a traffic signal is warranted, and
Village agrees to such improvements, Amazon should be responsible for the costs of
new signal and any other associated improvements, which must be installed no later
than one-year from the date the Village Board approves this ordinance.
4. All existing damaged public sidewalks or public sidewalks damaged due to the
implementation of this plan shall be replaced. (Standard)
5. No objects are allowed within a 15' sight distance triangle, between 30" and 84" in
height from grade except traffic control devices listed in the Manual on Uniform
Traffic Control Devices. (Standard)
6. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,
landscaping, structures, and any other facilities or infrastructure on the Subject
Property shall be maintained in a good state of repair, and when needed, be
repaired or replaced in a timely manner. (Standard)
7. All private and public sidewalks shall be maintained free of snow, ice, sleet, or other
objects that may impede travel. (Standard)
8. Trash shall only be allowed within a designated trash enclosure and shall be
screened from public view in an enclosure approved by the Appearance Commission.

Plan Commission Meeting Minutes
Date: June 3, 2021
A motion was made by Commissioner Mitchell and seconded by Commissioner Franklin to
approve the minutes of the May 6, 2021 Plan Commission meeting.
The chairman read the following statement into the record.
Until further notice, meetings of the Skokie Plan Commission will be electronically, with a
majority of members participating via remote access in order to comply with the State of Illinois
Gubernatorial Disaster Proclamation. Members of the public who wish to comment as to an item
on the published legal notice must submit their statement or question in writing to Steve
Marciani at steve.marciani@skokie.org and all properly submitted statements or questions will
be presented and read during the relevant portion of the meeting. Written comments also may
be submitted by email to citizencomments@skokie.org ; by mail to Village of Skokie, Attn: Matt
Brandmeyer, Ex Officio Plan Commissioner, 5127 Oakton Street, Skokie, IL 60077; or via the
Village’s drop box (no later than noon the day of the meeting) located by the public entry to

The chairman called the roll to confirm a quorum. Currently there are two vacancies on the
commission. Six commissioners were present.

2021-14P – Special Use Permit: 7539 Linder Avenue
CP Logistics Linder Avenue, LLC, on behalf of Amazon.com Services, LLC, is requesting a
special use permit for truck and freight transportation services at 7539 Linder Avenue in an
M1 Office Assembly zoning district and any other relief discovered during the review of this
case.

Discussion and Interested Parties
Legal notice was advertised, posted, and delivered to all property owners within the area as
prescribed by the Zoning Chapter. Corporation Counsel determined that notice was proper
and correct.
Ms. Jill Crozier, construction manager for Amazon, presented the case. In her overview, she
stated that this facility is not the typical Amazon operation; it is different from the one on
Howard Street; it is much smaller in scale and called an SSD site (sub same day). They will
be using flex drivers who are not employees of Amazon. These drivers will be using their
own vehicles (mostly Sprinter vans) to deliver packages and products within a 4-hour span
inside a certain radius. Delivery to further distances will be within a 12-hour delivery
window.
The chairman asked what the hours will be. Ms. Crozier stated that they have 6 docks for a
24/7 operation. There will be vehicles coming & going around the clock. The peak delivery

time is early morning; afternoons slack off, and they hit another peak again at night. If
people order at midnight, they could expect to get their items in 4 hours if they are housed
at the facility.
A commissioner questioned with a 24/7 operation, would there will be enough space for
neighboring businesses to utilize their own docks. Ms. Crozier stated that this facility is a
confined area which doesn’t require a guard shack to regulate the vehicles coming in & out.
However, with 6 docks there are people to direct the trucks. She has witnessed, probably
for driver convenience, trucks not in assigned spaces and parked all over the place. She has
reached out to the site leader to get it regulated and under control; it needs to be policed
and the flex drivers need to be respectful to the neighbors. There will not be any semi-
staging on Linder Avenue. Since the site is already operational and a concern of a
neighboring business noted, the commissioner asked if it were to be a problem, who could
someone reach out to. Ms. Crozier suggested discussing issues with the building security
guard or call the facility. The chairman advised staff to obtain a directory of responsible
company contacts should problems arise.
Staff requested the report to be entered into the record as presented. Public comment
emails were attached to the staff report regarding traffic problems on Linder; the blocking
of building entrances, driveways and loading docks; and air quality & fuel consumption. The
petitioner can respond directly to them. Staff noted receiving revised site plans after the
report was written. Condition #1 lists the minor adjustments to the site that have been
since updated.
Staff is recommending a Traffic Signal Warrant Analysis be completed by Amazon to
determine if a traffic signal is needed at Long Avenue and Fargo to address the increase in
traffic congestion. If the study finds one is warranted, Amazon, and not the Village, should
be responsible for the costs. A commissioner asked if this request has ever been attached
as a condition of approval to other applicants or if this would be setting a precedent. Staff
responded that Village Crossing, the Illinois Science +Technology Park, south of the
hospital on Golf Road and Kenton, at St. Louis and Touhy, and Lawndale & Touhy were
some of the developments where traffic signals were installed as a condition of the
development.
Staff also inquired about the proposed concrete pad that is partially in the right-of-way. Ms.
Crozier recalled that was a smoking area for the facility, which is no longer part of the plan.
It will be removed from the plans.
There were no additional comments from the public.
Recommendations and Voting
A motion was made to concur with staff for approval, with the minor adjustments, as
amended by staff, for a special use permit for truck and freight transportation services at
7539 Linder Avenue in an M1 Office Assembly zoning district.

PETITIONER’S SUBMITTAL
The petitioner is requesting a special use permit for truck and freight transportation
services and any other relief discovered during the review of this case.
The petitioner submitted the following statement:
This distribution facility is the first tenant to an empty shell, built by the landlord.
This project consists of a package delivery service that will provide customers access to a four
(4) hour delivery window. This facility will utilize flex drivers for delivery. Flex drivers use their
own vehicles to deliver packages.
This site will have parking spaces for 67 flex drivers.
This site will have parking spaces for 140 associates that work in the building, which is also the
total number of employees.
This site will have 6 semi dock spaces.
This location will not have owned or leased delivery vehicles, these are all independent
contracts. The 6 semi dock spaces will be for deliveries and pickups, the intent for this site will
not be for fleet storage.
An extensive Traffic Impact Analysis was also submitted.
STAFF ANALYSIS
Staff Comment and Review requests were sent to all pertinent departments and were
received from Traffic Engineering and Planning. All other departments returned the
requests with no comments regarding the subject case. This case was continued from
the May 6, 2021 hearing to the June 3, 2021 hearing so that the applicant could
address staff concerns with the site plan, inadequate parking, the traffic impact study,
and comments and concerns received from the public prior to the meeting.
Engineering
The Transportation Engineer submitted a list of questions and concerns about the traffic
impact study (TIS). A list of those questions and the response from the applicant’s
consultant are attached to this report.
The recommended parking determination for this use in case 2021-13P is 207 off-street
parking spaces, and with the revisions to the site plan 209 parking spaces are now
provided. The parking requirement is met. However, the aisle width adjacent to the
loading spaces needs to be increased by half a foot to 14’ to meet the minimum
standards of the Village Code.
After reviewing the response and updated TIS, Staff has the following comments:

TIS. It is clear that the development will impact the surrounding traffic and
operation of the nearby streets – specifically Long and Fargo.
TIS recommends a traffic signal based on Level of Service capacities outlined in
study. Staff cannot review or agree with this recommendation without a Traffic
Signal Warrant Analysis report that supports the installation of a traffic signal at
Long Avenue and Fargo. Amazon needs to provide this warrant analysis as a
condition of approval. If such study finds that a traffic signal is warranted, and
Village agrees to such improvements, Amazon should be responsible for the costs of
new signal.
TIS states the southwest Site Driveway 2 is reserved for trucks only, meaning fleet
vehicles can only access the southeast driveway off of Long.
Lastly, the original study said that it was based on traffic counts from November
2020, after requesting specific dates and counts to be elaborated on, the updated
TIS is in fact based on averages from counts collected in March, April, September,
and October of 2019. These counts are getting close to being 2 years old and Staff
has concerns whether they still apply.
Planning
Planning is generally supportive to the request, but we have concerns that the applicant
did not respond to the neighbors’ input and the public as requested on April 29, 2021.
It is Staff’s expectation that these concerns will be addresses at this public hearing.
Those emails are attached to this report. Planning did respond to each of the emails
that the concerns were forwarded to the applicant and will be entered into the record.
With respect to Mr. Mercer’s environmental concerns and Skokie’s Sustainability Plan,
Staff also added the following response:
The purpose of the special use permit is to assess the positive and negative
externalities of the use and address as many of the negative ones that we
can. The findings of fact do address environmental impact as one criterion,
among many others. The practical application of the goal of reducing emissions
in this circumstance is that denying the use at this location solely for this reason
doesn’t achieve our policy objective. They would simply relocate the facility close
by, and the same delivery vehicles would be driving through the Village delivering
packages using gasoline or diesel fuel.
Although you or I might think (or know) that many individual deliveries decrease
air quality, people placing those orders may not place enough value on that
objective to alter their behavior and chose a different delivery method to receive
their goods.

Another of the neighbor objection requested that parking not be allowed on Linder
Avenue to allow room for truck access to the neighbor’s loading docks; parking is
already prohibited on Linder and there is no plan to change that. Also, a neighbor had
concerns about queuing vehicles not block driveways; a recommended condition has
been added prohibiting the standing of any vehicle entering or exiting the facility on a
public way that blocks traffic or facilities.
Planning shares Engineering’s concern about the applicant’s contention that it is the
Village’s responsibility to mitigate traffic concerns worsened by the applicant’s
operations, which from their own analysis will be over 3,000 trips a day. A condition of
approval includes a timeline for the study and the installation of a traffic signal at Fargo
and Long, if needed.
The address is improperly noted on many of the applicant’s documents as 7555 Linder
Avenue. The address of this use is 7539 Linder Avenue and must be used for mail and
all legal documents, without exception.
No other relief was discovered during the review of this case.
APPEARANCE COMMISSION
Appearance Commission review is not necessary for the site.
STAFF RECOMMENDATIONS
Staff recommends that the petitioner’s request for a special use permit for truck and
freight transportation services in a M1 Office Assembly district be APPROVED, based
upon the Proposed Positive Findings of Fact and subject to the recommended conditions
below.
RECOMMENDED SPECIAL USE PERMIT CONDITIONS
1. Prior to the hearing of this case before the Board of Trustees, the petitioner must
update the site plan to increase the one-way aisle width in the southern lot to a
minimum of 14’ wide, change the address on the site plan to 7539 Linder Avenue,
and update the revision year to 2021.
2. The petitioner shall develop the Subject Property in substantial conformance with
the final Village approved site plan dated <insert date of final approved plan>.

3. The stopping or standing of any vehicle associated with the operation of the facility
in the public right-of-way must not prohibit two-way movement, block driveways, or
limit the ability of other vehicles to maneuver into neighboring properties.

4. The applicant should provide a Traffic Signal Warrant Study by no later than
September 30, 2021, and if such study finds that a traffic signal is warranted, and
Village agrees to such improvements, Amazon should be responsible for the costs of
new signal and any other associated improvements, which must be installed no later
than one-year from the date the Village Board approves this ordinance.
5. All existing damaged public sidewalks or public sidewalks damaged due to the
implementation of this plan shall be replaced. (Standard)
6. No objects are allowed within a 15' sight distance triangle, between 30" and 84" in
height from grade except traffic control devices listed in the Manual on Uniform
Traffic Control Devices. (Standard)
7. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,
landscaping, structures, and any other facilities or infrastructure on the Subject
Property shall be maintained in a good state of repair, and when needed, be
repaired or replaced in a timely manner. (Standard)
8. All private and public sidewalks shall be maintained free of snow, ice, sleet, or other
objects that may impede travel. (Standard)
9. Trash shall only be allowed within a designated trash enclosure and shall be
screened from public view in an enclosure approved by the Appearance Commission.
All trash shall be contained in such a way as to remain out of sight at all times.

PLAN COMMISSION ANALYSIS
During its July 15, 2021, meeting, the Plan Commission heard a request for a special
use permit for cremation services in an M3 Industry zoning, relief from Section 118-218
of the Skokie Village Code to provide 7 rather than 16 off-street parking spaces, and
any other relief discovered during the review of this case. The applicant intends to
utilize the building as a crematory, which is an allowed use with a special use permit in
the M3 zoning district. The crematory intends to have two retorts on site that will not
be visible from Monticello. Funeral services and visitation would be at the applicant’s
funeral home in Chicago; occasionally some family members wish to witness the entry
into the retort chamber.
Staff was supportive of the request and the parking relief as long as no more than 5
non-employees will be permitted on-site at any given time. This area was part of a
Village-sponsored comprehensive parking program which allows use of the public right-
of way to increase parking availability. The westernmost parking spaces on the site
plan were part of that program, for the purposes of this petition, the parking spaces
between that sidewalk and the building are considered to be “on-site”.
Discussion from the Commission included:
1. What distinguished a funeral home from a crematory with respect to visitation
2. How the remains were being transported to the site and where vehicle would be
stored
3. Air quality, filtration, and exhaust from the burning
4. Regularity of the inspection of the equipment
5. General business operations
A condition was added to the Staff Recommendations that the operator provide
annually to the Village proof of inspection of the equipment.
No additional relief was discovered during the review of this case. Additional analysis
and the discussion can be found in the attached Staff Report and meeting minutes.
INTERESTED PARTIES
Legal notice was advertised, posted, and delivered to property owners in the area as
prescribed by the Zoning chapter of the Village Code. One interested party provided
testimony at the hearing, a Skokie funeral director, who asked about climate control,
testified that The State and County, not Skokie, regulates the operations of the use,
and that there are different state licenses for funeral homes and crematories.

1. The petitioner shall develop the Subject Property in substantial conformance with
the final Village approved site plan and floor plan dated July 29, 2021. (Standard)
2. Prior to the issuance of building permits, the petitioner must provide copies of any
and all necessary permit(s), licenses, and supporting documentation required by the
Illinois Environmental Protection Agency, the Illinois Pollution Control Board, and the
Illinois Office of the Comptroller authorizing the construction and operation of the
crematorium.
3. The petitioner shall provide to the Village annually proof of inspection of the
equipment, including the levels of emitted gases and particulate.
4. No more than 5 non-employees will be permitted to on-site at any given time.
5. The owner of the Subject Property shall ensure that all occupants of the building
containing the use must park on-site. Adjacent tandem or on-street parking in the
neighborhood is prohibited.
6. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,
landscaping, structures, and any other facilities or infrastructure on the Subject
Property shall be maintained in a good state of repair, and when needed, be
repaired or replaced in a timely manner. (Standard)
7. All private and public sidewalks shall be maintained free of snow, ice, sleet, or other
objects that may impede travel. (Standard)
8. All off-street parking spaces shall be legibly striped and maintained. (Standard)
9. Any plan to modify parking lot striping must be approved by the Director of

10. The handicapped parking spaces shall be installed and maintained in compliance with
State of Illinois Accessibility Standards and the Skokie Village Code, including required

11. Vehicles shall not be allowed to be parked in or otherwise block common driveways,

designated parking spaces, and shall not overlap the striped lines of designated

15. If work is to be performed on public property or if public property is utilized or
impacted during construction and/or development, the owner shall provide, or shall
cause the developer and/or contractor to provide, the Village of Skokie with a
certificate of insurance naming the Village of Skokie as additionally insured for any
and all claims related to any and all work. The owner shall hold, and shall cause the
developer and/or contractor to hold, the Village of Skokie harmless and indemnify
the Village for any and all claims for property damage or personal injury related to

16. The petitioner shall comply with all Federal and State statutes, laws, rules and

DRAFT Plan Commission Meeting Minutes
Date: July 15, 2021
A motion was made by Commissioner Burman and seconded by Commissioner Mathee to
approve the minutes of the June 3, 2021 Plan Commission meeting.
This meeting marks the return to in-person meetings.
The chairman introduced and welcomed 2 new members to the Plan Commission: Talia
Gevaryahu and Mike Shah.
Case Description:
2021-19P – Special Use Permit: 7309 Monticello Avenue
Chicago Title Land Trust Company, Trust Number 42086, on behalf of Big Tuna Cremation
Property, LLC/Caring Cremations, is requesting a special use permit for cremation services at
7309 Monticello Avenue in an M3 Industry zoning district, relief from Section 118-218 of the
Skokie Village Code to provide 7 rather than 16 off-street parking spaces, and any other relief
discovered during the review of this case.

Discussion and Interested Parties
Legal notice was advertised, posted, and delivered to all property owners within the area as
prescribed by the Zoning Chapter. Corporation Counsel determined that notice was proper
and correct.
Joey Carr, consultant for the applicant, gave an overview of the case. Milos Djordjevic,
Jakob Parduhn, and John Benoit also gave testimony. They are proposing to operate a
crematory in an existing vacant 5,400 sq. ft. building that was previously occupied by K-B-K
Tools in a M3 zoning district. It is an allowable use with a special use permit. They will be
making interior improvements mostly, adding 2 retorts, and updating the parking lot.
Milos Djordjevic, owner of Caring Cremations also is part owner of Theis-Gorski Funeral
Home in Chicago. The funeral home does offer cremations, but not at that site any longer;
they have been outsourcing them. They plan to utilize this facility for their clients who
choose cremation. It is a new business; therefore, he anticipates only doing 1-2 cremations
a month initially, increasing up to about 6 per day with 1-2 employees.
A commissioner wanted confirmation that the facility is just a crematory. Mr. Djordjevic
stated that visitations and services are handled at the funeral home.
Another commissioner asked about the process of bringing remains into the facility. Mr.
Djordjevic stated that a customized van fitted with a cot is used to retrieve the deceased,
who is then rolled into the building from the loading space.
The commissioner also inquired about the air quality, filtration, and exhaust from the
burning. Jakob Parduhn, of Cremation Systems/Armil CFS, Inc., spoke of the cremation

equipment at the site. There is no visible smoke; just CO2 and trace amounts of particulate.
There are no health or environmental concerns. Each machine is registered with and
approved by the State of Illinois. He stated that with the small number cremations per
month, the emissions are way under the state’s thresholds of 5 tons of particulate matter.
The federal government considers them a minor source and does not regulate them. They
have participated in and passed the numerous EPA visible smoke tests. There are no state
regulations for maintenance; however, the manufacturer does recommend annual
inspections.
To follow up, another commissioner asked if Skokie will schedule an annual inspection as
well. Staff stated that the Environment Health Department is following the State rules and
recommends that the business owner take part in annual inspections to check the emission
controls. Mr. Djordjevic has no problem with their recommendation.
Another commissioner wanted more information on the business operations. Mr. Djordjevic
stated that he receives clients through phone calls or online; usually families making final
arrangements for a loved one. Sometimes families do come to the funeral home to make
requests for cremation services. There will be no visitation or funeral service at the facility.
However, some families choose to view the body and witness the cremation; in that case,
they will accommodate 2-3 immediate family members.
Staff requested the report be submitted into the record as presented. There are minor
changes to the site plan needed prior to the presentation to the Trustees at a future Village
Board meeting. Traffic Engineering recommends a maximum of 5 non-employees be
permitted on-site based on the limited parking spaces leaving 2 spaces for employees.
Tandem parking is allowed in the area for businesses with regular employees who can
easily move their vehicle throughout the day if necessary but not for this use. The parking
lot will need to be re-configured, restriped, and wheel stops put in.
The chairman inquired where the transport vehicles will be stored when not in use. Another
commissioner asked how many transport vehicles they have. Mr. Djordjevic stated they
only have 1 vehicle and will be parked in the loading area or garage – not in any of the
provided spaces.
John Haben, 8051 Lincoln Avenue, voiced some concerns. He is a long time professional in
the same industry. He testified to the commission about the timeline from taking custody
of the remains and the steps taken until cremation. Decomposition takes place rapidly; not
every body is embalmed. Nothing can be done until the death certificate is signed, filed,
and registered, which brought up the storage issue. For public health reasons, he asked if
the facility is climate controlled for unembalmed human remains. The Village has no storage
requirements and goes by whatever the state regulates.
Mr. Haben continued, stating that the professional preparation of remain requires funeral
home licensing if there is to be a viewing. The proposed facility would be infringing on
services that a funeral home would provide; families making arrangements, preparing
remains for viewing, and providing last goodbyes. He also answered a previous question
regarding inspections; Skokie does not have any rules and regulations or maintenance

The chairman questioned if the licenses for funeral homes and crematories are different.
Mr. Haben answered that there are certain statutes for crematories and other statues for
funeral homes. The licenses are different.
There was discussion between the commissioners and staff regarding the definitions and
licenses required for funeral homes and crematories. The chairman commented that it
might be “in a gray area” and questioned whether the Village could be open to challenges
by the state and county if the special use is approved.
Staff clarified that the special use permit is based on the Village’s definition of funeral home
as an establishment that prepares the remains, conducts services, sells caskets, and
arranges cremations. There is no separate definition for crematory in the Village’s
ordinance.
Mr. Haben added that sometimes 50 people show up for a “last goodbye” and Monticello
Avenue will be lined with cars.
Mr. Djordjevic reiterated that he is a funeral director in Chicago. He does a high volume of
cremations and instead of outsourcing, he wants to control everything for his clients by
having his own crematory.
A commissioner noted that refrigeration is a necessity but is not shown on the plans. The
architect, John Benoit, stated that adequate refrigeration is located adjacent to the retort
room. They have allowed space but do not have specific volume yet to put it on the plan.
Staff answered that the floor plan submitted is not the final site plan and was used only for
calculating parking and relief for the special use permit. An amendment to Condition #1 can
be added addressing the refrigeration/storage needs.
Another commissioner asked what the approximate timeline was of the on-site storage of
decedents. Mr. Djordjevic answered that it depends on how quickly the doctor signs the
death certificate and he can get a cremation permit. It usually takes a few days until the
doctor signs the death certificate, but from 48 hours to 1 week is the norm. They do have a
fair amount of storage. If viewing is requested prior to cremation, storage will be at the
funeral home.
Another commissioner asked about industry standards for the retorts. Staff said that the
Environmental Health Dept. provided copies of the state’s regulations.
The chairman suggested that before presentation to the Village Board and on to the
Building Division for permits, final floor plans be submitted.
Recommendations and Voting
A motion was made to approve a special use permit request, with 2 amendments added,
for cremation services at 7309 Monticello Avenue in an M3 Industry zoning district.
Amendment #1 – the applicant must show adequate and specified areas on plans for
enough refrigeration based on their volume before presentation to the Village Board.
Amendment #2 – the Special Use Permit requires annual inspections as to gas and
particulate.

The petitioner’s agent, Joey Carr, submitted the following statement:
Currently the property is owned Chicago Title Land Trust Company, as successor Trustee under
the terms of a certain agreement dated January 3, 1983, and knows as Trust #42086 for the
benefit of Kenneth Hedeen. It is utilized as a warehouse for a K-B-K Tool Manufacturing. My
client intends to utilize the building as a crematory which is an allowed use with a special use

permit in the M-3 zoning district. The crematory intends to have two retorts on site that will not
be visible from Monticello.
Due to the use, there will be minimal employees on site and few cars as well. As it is a
crematory and not a funeral home, it will mostly be staffed by one to two people at all times.
We plan to restripe the parking lot to accommodate 7 cars including 1 ADA space. The dock will
remain to be used for deliveries. This is less than the required 16 off street parking spaces but
we are requesting relief due to the minimal staffing levels and resulting parking needs for this
specific use.
The character of the neighborhood will not be affected by this use as it is surrounded by other
warehouse buildings and there is another Crematory on Lawndale approximately 0.2 miles away.
Traffic resulting from this use will be negligible due to the small amount of staff on site. We do
not expect any impact to the public utilities or storm water detention. Signage will be minimal.
Improvements to the building include two retorts are designed to be placed inside a 1,200 sf
area within the building. Attached are specifications of the retorts. It is anticipated that two 2’
x 2’ openings will be created in the roof for the retort exhaust. Other cosmetic improvements
may take place and code impacts will be addressed as we study in further detail.
Initially, there will be two cremations done each day which should increase to six a day at some
point in the future. General operating hours are 9am – 5pm but subject to change as the
business requires.
We are working with our design and engineering team to apply for all of the required
environmental permits/licenses. We will apply and furnish copies to the Village when received.

STAFF ANALYSIS
Staff Comment and Review requests were sent to all pertinent departments and were
received from Engineering, Forestry, Fire Prevention, Environmental Health, and
Planning. All other departments returned the requests with no comments regarding the
subject case.
Engineering
The Engineering Division completed a parking analysis for the proposed use, and 16 off-
street parking spaces are required, while only 7 are provided. Also, the width of the
standard parking spaces is substandard and must be increased to a minimum of 9’
wide. The accessible parking space should be 8' wide with an 8' access aisle with R7-8
and R7-I101 signs in front of the accessible parking space.
In additional conversations with the applicant, it was stated that the site will not
function as a funeral home and at most times only be staffed by 1 or 2 people.
Witnessed cremation will occur at most twice a month by appointment only, and
attendance will be limited to 5 people. In order to support the needed parking relief, a
limit of 5 non-employees will be permitted to on-site at any given time.
Also, Monticello Avenue does not have enough width to support on-street parking. An
additional condition of the special use is that tandem parking or on-street parking for
any occupant of the building not be permitted; users of the building must park on-site.

Forestry
The Village Forester notes that tree protection fencing is required for site trees in a
construction project. There is one parkway tree that requires protection to the extent
of the tree pit. Please show its location on the site plan.
Fire Prevention Bureau
The Fire Prevention Bureau provided the following list for the applicant’s information,
which will be required for the building permit review. This list is not all-inclusive.
A full National Fire Protection Association (NFPA) 72 Fire Alarm system shall be
installed and meet the 2018 Illinois American with Disabilities Act (ADA).
The fire alarm shall be directly connected/ monitored to the Skokie Combined
Communication Center. An application and contract must be completed and
submitted.
An addressable annunciator must be located at the main entrance
Must have at least one Knox Box, with functioning keys at the main entrance
The building shall have a fire protection sprinkler system in accordance to NFPA 13
The Fire Department Connection (FDC) shall be within 100' of a Village of Skokie fire
hydrant. A fire protection engineer will have to calculate the demand to determine if
the building will require a fire pump.
Shall have panic hardware on all exit doors
Must have egress lighting per the International Fire Code (IFC) and Life Safety Code
(LSC) 101.
Shall have properly mounted fire extinguishers throughout per IFC, NFPA 10, LSC
101
The rear door must have the address of the building labeled on the door
If plans are submitted digitally, at least one set of plans and cut sheets must be
submitted directly to the Skokie Fire Prevention Bureau; including Sprinkler, Fire
Alarm, Scope of Work, etc.
Environmental Health
Provide copies of any and all necessary permit(s), licenses, and supporting
documentation required by the Illinois Environmental Protection Agency, the Illinois

Planning
Planning is supportive of the request and the parking relief as long as the conditions for
parking and occupancy are met. This area was part of a Village-sponsored
comprehensive parking program which allows use of the public right-of way to increase
parking availability. The westernmost parking spaces on the site plan were part of that
program, for the purposes of this petition, the parking spaces between that sidewalk
and the building are considered to be “on-site”.
